STUDY SESSION
Prior to the discussion of item #2, four of the five Planning Commissioners provided statements regarding their respective financial interests in real property in proximity to proposed Builder’s Remedy projects.
Commissioner Milkowski advised that his primary residence is located less than 500 feet from the proposed Builder’s Remedy projects located at 346 North Maple Drive and 401 North Oakhurst Drive. Due to this, he will need to recuse from the Ministerial Permit Process Study Session.
Commissioner Demeter advised that her primary residence is located less than 500 feet from the proposed Builder’s Remedy project located at 333-353 South Beverly Drive. Due to this, she will need to recuse from the Ministerial Permit Process Study Session.
Vice Chair Wolfe advised that he has a financial interest in real property located in the 200 block of Tower Drive, which is less than 500 feet from the proposed Builder’s Remedy project located at 232 Tower Drive. Due to this, he will need to recuse from the Ministerial Permit Process Study Session.
Chair Kaplan advised that she has a financial interest in real property located in the 100 block of El Camino Drive, which is less than 500 feet from the proposed Builder’s Remedy project located at 145 South Rodeo Drive. Due to this, she will need to recuse from the Ministerial Permit Process Study Session.
Assistant City Attorney David Snow advised that, due to the aforementioned recusals, the Planning Commission no longer has the quorum required to conduct business. Because the lack of quorum is the result of Commissioner recusals rather than absences, and there is no alternative source for which a decision on this matter can be made in accordance with the provisions set forth in State planning and zoning laws, two of the four Commissioners must return to the dais to satisfy the conditions of Legally Required Participation. The determination of which two Commissioners will participate shall be made by random selection, which will be the drawing of straws. Once selected, the two selected Commissioners will participate for the duration of the Planning Commission Regular Meeting Synopsis

matter, which includes formal consideration at a future meeting if Commission directs the matter to return for such discussion.
Commission Specialist Karen Myron explained the process of drawing straws, advising that the four Commissioners who provided recusal statements will each select a straw of a different length.
The two Commissioners who select longer straws will remain to participate in the discussion, and the two who select shorter straws will recuse and leave the room. With the length of straws concealed, each of the four Commissioners selected a straw. Chair Kaplan and Commissioner Milkowski selected longer straws, and remained at the dais. Vice Chair Wolfe and Commissioner Demeter selected shorter straws, and left the meeting room at 1:42 PM.
