Meeting Date: May 6, 2025
To: Honorable Mayor & City Council
From: Mandy Jiang, Senior Management Analyst
Magdalena Davis, Community Outreach Manager
Subject: State and Federal Legislative Update
Attachments: 1. State Legislative Bill Matrix

INTRODUCTION
On April 22, 2025, the City Council adopted the 2025 Legislative Platform, which houses City Council approved positions on numerous topics affecting our local jurisdiction. The Platform provides direction to City staff and the City’s contracted state and federal lobbyists, as staff and lobbyists work to advocate and represent the City’s position throughout the year at a regional level, in Sacramento, and in Washington, D.C.

The City receives reports throughout the year from both our state lobbyist (Shaw, Yoder, Antwih, Schmelzer, and Lange Inc.) and federal lobbyist (David Turch and Associates), based upon the legislative priorities listed in the Platform as well as topics of interest identified during City Council meetings.

This report is for informational purposes and transmits updates on actions taken by the City and updates on legislative activities occurring in Sacramento, California, and Washington, D.C., from the City’s contracted lobbyists.

DISCUSSION
All letters sent by the City are published on the following City webpage:
www.beverlyhills.org/legislation. Additionally, a current bill matrix of state legislation, which the City is actively advocating in support for, opposing, or monitoring, is attached for reference as Attachment 1. From January through April, the City has officially taken positions on seven state legislative bills:
 OPPOSE AB 647 (Gonzalez) – Override locally adopted housing plans forcing cities to ministerially approve housing developments up to eight housing units — only one of which is required to be affordable — on lots with an existing singlefamily home or in an area zoned for eight units or less, without any environmental review or public input.

Meeting Date: May 6, 2025

Page 2 of 4 ends

Status: As of April 24, 2025, amended and re-referred to Committee on Local Government; read second time and amended.
 SUPPORT AB 262 (Caloza) – California Individual Assistance Act. AB 262 includes grants for housing, essential supplies, income replacement, medical costs, and evacuation center operations—relief that can be administered quickly to residents in crisis. The bill also authorizes advanced funding for local governments and organizations, allowing communities to act swiftly in supporting affected residents.

Status: The bill will be introduced to Assembly Appropriations Committee on April 30, 2025. It was passed by the Committee of Emergency Management to (Ayes 5.

Noes 2.) to Assembly Appropriations Committee on April 7, 2025.  SUPPORT SB 6 (Ashby) – Controlled substances: xylazine. SB 6 would add xylazine to the list of controlled substances which when found with possession of such a substance is a misdemeanor offense with a fine up to $1,000 and a year of incarceration in County jail.

Status: As of April 7th hearing, placed on Appropriations suspense file.  SUPPORT AB 523 (Irwin) – Metropolitan Water Districts: Alternate Representative. This bill would allow each member agency of Metropolitan Water District entitled to only one representative, such as Beverly Hills, to designate a proxy representative for meeting participation, and possibly vote by proxy.

Status: As of April 23, re-referred to Committee on Local Government after amendments.
 SUPPORT AB 650 (Papan) – Planning and zoning: housing element: regional housing needs allocation. AB 650 would allow local governments to begin the housing element update process six months early, provide greater certainty and reduce ambiguity in the housing element review process, and ensure that local governments have adequate time to respond to the California Department of Housing and Community Development’s (HCD) review letters.

Status: As of April 24, passed by Committee on Local Government (Ayes 11. Noes

0.)
 SUPPORT SB 346 (Durazo) – Local agencies: transient occupancy taxes: shortterm rental facilitator. SB 346 would require short-term rental facilitators, at the request of a city, to provide the Assessor Parcel Number of a short-term rental listing to a city and would provide cities audit authority for transient occupancy taxes collected and remitted by short-term rental facilitators.

Status: As of March 20, read second time and amended, re-referred to Committee on Judiciary, hearing set for May 6.
 OPPOSE SB 364 (Perez) – Homelessness: civil and criminal penalties. SB 364 severely limits cities’ ability to respond to the homelessness crisis by prohibiting local governments from adopting any regulation, policy, or guidance that imposes civil or criminal penalties on a person experiencing homelessness.

Status: April 22nd hearing postponed by committee, new hearing set for April 28.

Meeting Date: May 6, 2025

City staff and our state lobbyist are monitoring numerous bills in Sacramento. Staff is currently working to identify a date and time for a meeting with the City Council Legislative / Lobby Liaisons. Bills that will be heard at the next meeting cover the following topics:
 Automated traffic enforcement programs
 Streamlined rebuild after wildfires
 Foreign national influence on American students
 Adaptive reuse streamlining incentives
State Update
Staff receives regular updates from the City’s state lobbyist. Some relevant updates over the last quarter include:
 Governor Newsom Files Lawsuit to End President Trump’s TariffsGovernor Newsom and California Attorney General Rob Bonta filed a lawsuit in federal court challenging President Trump’s use of emergency powers to enact broad-sweeping tariffs that hurt states, consumers, and businesses. The lawsuit argues that President Trump lacks the authority to unilaterally impose tariffs through the International Economic Emergency Powers Act, creating immediate and irreparable harm to California, the largest economy, manufacturing, and agriculture state in the nation.
 Governor Newsom, Legislature Double down on State’s Critical Cap-and-Trade Program in Face of Federal Threats - Governor Gavin Newsom, Senate President pro Tempore Mike McGuire and Assembly Speaker Robert Rivas announced they will seek an extension of California’s nation-leading climate pollution reduction program – known as cap-and-trade – during this legislative year. The program is currently set to expire in 2030, and requires extension by the Legislature. As the Governor noted in his proposed budget, extending the program this year can provide the market with greater certainty, attract stable investment, further California’s climate leadership and set the state on a clear path to achieve its 2045 carbon-neutrality goal.
 Retail Theft Crackdown in 2024 Recovers $13.5 Million in Stolen Goods - Governor Newsom announced that in 2024, the state’s Organized Retail Crime Task Force conducted a record-breaking 879 investigations which led to 1,707 arrests and the recovery of 676,227 stolen goods valued at $13.5 million.  Governor Newsom Announces Record-Breaking $76 Million to Safeguard Local Faith Communities and Nonprofits - Governor Newsom announced $76 million in grants, made in partnership with the state Legislature, to 347 community groups across the state to protect nonprofits and houses of worship from violence, the most that’s ever been awarded.

Federal Update
Staff receives regular updates from the City’s federal lobbyist. Some relevant updates over the last quarter include:
 President Trump is expected to submit his full budget request to Congress in May, although no date has been set. However, a smaller “skinny” budget may be released in late April. Those documents will help guide the FY 2026 appropriations process. The House passed its budget resolution on February 25 by a vote of 217 to 215, which would provide for a filibuster-proof reconciliation bill. This still needs to be assembled and would aim for $2 trillion in spending cuts, in exchange for $4.5 trillion in tax cuts over the span of a decade. On April 3, the Senate adopted Meeting Date: May 6, 2025

Page 4 of 4 ends

a motion to proceed by a vote of 52-48 and has moved onto the “vota-a-rama.” This is a series of votes on all amendments to the budget resolution, one at time.

Consideration of the budget resolution was slowed when several Republican Senators sought assurance from President Trump that Medicaid would not be cut.

FISCAL IMPACT
None.

Current law makes the theft of money, labor, or property petty theft punishable as a misdemeanor, whenever the value of the property taken does not exceed $950. Under current law, if the value of the property taken exceeds $950, the theft is grand theft, punishable as a misdemeanor or a felony. Current law defines any 2nd-degree burglary or grand theft, during and within an affectedcounty in a state of emergency or local emergency, as specified, as looting, punishable by either imprisonment in a county jail for one year or as a felony. Current law prescribes summary procedures for actions to obtain possession of real property. Current law authorizes a landlord to serve a notice of termination of tenancy on a tenant who is in default inthe payment of rent. The notice must permit the tenant at least 3 days, excluding weekends and judicial holidays, to pay the amount that is in default and due. The Planning and Zoning Law requires each county and each city to adopt a comprehensive, long-term general plan for the physical development of the county or city, and specified land outside its boundaries, that includes, among other specified mandatory elements, a housing element. Current law, commonly referred to as the housing element law, prescribes requirements for a city’s or county’s preparation of, and compliance with, its housing element, and requires the Department of Housing and Community Development to review and determine whether the housing element substantially complies with the housing element law, as specified. Current law within the Planning andZoning Law, the Housing Accountability Act, among other things, prohibits a local agency from disapproving, or conditioning approval in a manner that renders infeasible, a housing development project for very low, low-, or moderate-income households or an emergency shelter unless the local agency makes written findings, based on a preponderance of the evidence, that one of 6 specified conditions exist. Among these conditions, the act allows a local agency to disapprove a housing development project that is inconsistent with the jurisdiction’s zoning ordinances and general plan land use designation as it existed on the date the application was deemed complete, if the jurisdiction has adopted a revised housing element that is in substantial compliance with the housing element law, as specified. 4/24/2025-A. DESK4/24/2025-Read third time. Passed. (Ayes 37. Noes 0.) Ordered to the Assembly. In Assembly. Read first time. Held at Desk.

Under current law, a pedestrian control signal showing a “WALK” or approved “Walking Person” symbol means a pedestrian may proceed across the roadway in the direction of the signal. Under current law, a pedestrian facing a flashing “DON’T WALK” or “WAIT” or approved “Upraised Hand” symbol with a “countdown” signal, as specified, means a pedestrian may start crossing the roadway in the direction of the signal but requires the pedestrian to finish crossing prior to the display of thesteady “DON’T WALK” or “WAIT” or approved “Upraised Hand” symbol, as specified. Upon the first placement or replacement of a traffic-actuated signal, as specified, existing law requires that trafficactuated signal to be installed and maintained to detect bicycle or motorcycle traffic on the roadway. For these purposes, current law defines a traffic-actuated signal as an official traffic signal, as specified, that displays one or more of its indications in response to traffic detected by mechanical, visual, electrical, or other means. Upon the first placement or replacement of a state-owned or -operated traffic-actuated signal, existing law requires that the traffic-actuated signal to be installed and maintained to have a leading pedestrian interval (LPI) and include the installation, activation, and maintenance of an accessible pedestrian signal (APS) and detector that complies with certain sections of the California Manual on Uniform Traffic Control Devices (CA MUTCD). At crosswalks with stateowned or -operated traffic-actuated signals and pedestrian hybrid beacons with pedestrian signal heads, this bill would require the walk indication and other visual signals to comply with CA MUTCD.• The bill would require these pedestrian signal heads to have an APS pushbutton or touch-free APS that activates “WALK” or “DON’T WALK” intervals and other visual signals at signalized intersections in nonvisual formats.• The bill would require touch-free APS to be installed at new signalized pedestrian crossings on capital projects on the state highway system, encroachment projects, and highway maintenancefunded projects, as specified.• The bill would require, as soon as practicable, all existing state-owned or -operated traffic signals located in certain areas to be identified and recorded in the Department of Transportation management system (TMS) inventory database to assist future annual operational review requirements and coordination with local agencies for delegated signals.
