RECOMMENDATION
It is recommended that the City Council move to waive the full reading and adopt the ordinance entitled: “AN ORDINANCE OF THE CITY OF BEVERLY HILLS DESIGNATING FIRE HAZARD SEVERITY ZONES, AMENDING THE 2022 CALIFORNIA FIRE CODE, AND AMENDING TITLE 9 OF THE BEVERLY HILLS MUNICIPAL CODE”.
INTRODUCTION
At its meeting of July 15, 2025, the City Council conducted a first reading of this ordinance and introduced it.
DISCUSSION
California Government Code Section 51179(a) mandates that a local agency within 120 days of receiving recommendations from the State Fire Marshal, must designate, by ordinance,moderate, high, and very high fire hazard severity zones within its jurisdiction. This ordinance amends the Beverly Hills Municipal Code to designate the City’s fire hazard severity zones as recommended by the director of the California Department of Forestry and Fire Protection.

AN ORDINANCE OF THE CITY OF BEVERLY HILLS
DESIGNATING FIRE HAZARD SEVERITY ZONES,
AMENDING THE 2022 CALIFORNIA FIRE CODE, ANDAMENDING TITLE 9 OF THE BEVERLY HILLS
MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF BEVERLY HILLS HEREBY ORDAINS AS FOLLOWS:
Section 1. Section 9-2-2 of Chapter 2 of Title 9 is hereby amended by adding the following:
“Section 4904.2 Fire Hazard Severity Zone Map. The City of Beverly Hills City Councilhereby designates the Fire Hazard Severity Zones as recommended by the director of the California Department of Forestry and Fire Protection and as designated on the latest Local Responsibility Area Fire Hazard Severity Zones Map, retained on file at the Office of the Fire Marshal, 445 North Rexford Drive.”
Section 2. The map titled Local Responsibility Area Fire Hazard Severity Zones, March 24, 2025 is hereby attached to this Ordinance as Exhibit A.
Section 3. CEQA Findings. The City Council hereby finds that it can be seen with certainty that there is no possibility that the adoption and implementation of this Ordinance may have a significant effect on the environment. The Ordinance does not authorize construction and, in fact, imposes greater restrictions on certain development in order to protect the public health, safety and general welfare. In addition, the adoption of this ordinance is a ministerial act. The Ordinance is therefore exempt from the environmental review requirements of the California Environmental Quality Act pursuant to Section 1506 1(b)(3) of Title 14 of the California Code of Regulations (CEQA Guidelines).

Section 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance or the application thereof to any person or place, is for anyreason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remainder of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each and every section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.
Section 5. Publication. The City Clerk shall cause this Ordinance to be published at least once in a newspaper of general circulation published and circulated in the City within fifteen (15) days after its passage, in accordance with Section 39633 of the Government Code; shall certify to the adoption of this Ordinance; and shall cause this Ordinance and its certification, together withproof of publication, to be entered in the Book of Ordinances of the Council of this City.
Section 6. Effective Date. This Ordinance shall go into effect and be in full force and effect at 12:01 a.m. on the thirty-first (3 1st) day after its passage.
Section 7. Certification. The City Clerk shall certify to the adoption of this Ordinance.
