AND PROJECT MANAGEMENT SERVICES FOR THE ONE
BEVERLY HILLS PROJECT; AND

RECOMMENDATION
Staff recommends that the City Council:
1. Approve an agreement between the City of Beverly Hills and Psomas for developer reimbursed construction management services for the One Beverly Hills project; and
2. Approve a purchase order for Psomas in the not-to-exceed amount of $783,634.84.
INTRODUCTION
The One Beverly Hills project is a landmark private development situated at a prominent gateway to the City. It includes a mix of luxury residential, hotel, retail, and open space components spanning multiple years of phased construction. Due to its size, high-profile location, and proximity to major public infrastructure, the project is anticipated to generate significant construction activity and traffic impacts over an extended period.
Meeting Date: September 9, 2025
This major multi-phase project requires active coordination between the City, the developer, and various construction contractors. Due to the scale and complexity of the project, dedicated and experienced construction management support is essential.
Given the potential for disruptions to public right-of-way, utilities, and surrounding businesses and neighborhoods, it is critical that the City proactively manage and monitor all construction-related activities to ensure public safety, regulatory compliance, and protection of City interests.
To support this effort, the City requires a dedicated, full-time Construction Manager (also referred to as a Construction Monitor) to act as the City’s on-site representative. This role serves as a liaison between the developer, contractors, City departments, and the public, ensuring that all construction activities are performed in accordance with approved plans, permits, and conditions of approval. In addition to the following field responsibilities, it is important to note that the assigned Construction Manager will report directly to City staff in Major Projects within the Community Development Department.
This requirement ensures City staff is abreast of all ongoing construction activity and important information pertaining to the onsite happenings in real time.
Specifically, the Construction Manager will:
• Maintain real-time oversight of construction activity to identify and mitigate potential conflicts early
• Monitor compliance with traffic control and detour plans to minimize impacts to City mobility
• Ensure pedestrian safety and protection of public infrastructure • Provide timely communication and reporting to City staff and stakeholders • Serve as an extension of City staff to coordinate multi-agency issues (e.g., utility coordination, access to adjacent properties, permit conditions) • Track schedule adherence and flag issues that may delay delivery of public improvements tied to the development
This approach mirrors the City’s current oversight strategy on other large infrastructure efforts, such as the Purple Line Extension, and reflects a best practice for managing high-impact construction within dense urban environments. Although the consultants would be hired by and work for the City, the developer would be required to pay all associated costs for the services provided.
DISCUSSION
Staff conducted an informal bid request process through soliciting proposals from professional firms including Psomas, Berg & Associates, TRC Companies, and ZF Alexander. Professional services, including consultants, are exempted from the City’s bidding requirements per Beverly Hills Municipal Code § 3-3-112 (G). Staff has elected to move forward with Psomas to provide the professional construction management services under a one-year contract, with the option for two one-year extensions. The proposed contract will be structured around a full-time equivalent (FTE) Construction Manager, billed at the hourly rate proposed in Psomas' submitted scope of services.
The total not-to-exceed cost for the first year is $681,421.60, which reflects the fully loaded rate for one FTE for a 12-month period. In alignment with typical City contracting practices, an additional 15% contingency ($102,213.24) is recommended to address unforeseen needs or changes in project scope. The contingency may only be utilized with prior written authorization from the City. The One Beverly Hills developer team has agreed to pay this deposit in installments, however services will not commence until the initial deposit is collected.
Meeting Date: September 9, 2025
Although the initial budget is based on one FTE, the City may, at its discretion, reallocate funding within the approved contract amount to utilize other Psomas staff or services as needed, so long as overall contract limits are not exceeded.
FISCAL IMPACT
The cost of providing these services will be reimbursed entirely by the developer with no fiscal impact to the City. A notice to proceed will be issued to the Psomas as soon as the initial deposit is collected from the One Beverly Hills developer team. Subsequent payments will be collected on a semi-annual basis or if the deposit nears exhaustion.
Future payments that the City will collect are based on the rates outlined in Exhibit B of the attached Agreement.
