HOLIDAY MORATORIUM BETWEEN THANKSGIVING DAY
THROUGH NEW YEAR’S DAY

RECOMMENDATION
Staff recommends that City Council (1) review the Los Angeles County Metropolitan Transportation Authority’s (Metro) request for a waiver of the holiday moratorium; (2) deny the waiver request to continue construction work; (3) allow Metro to maintain existing Krail barriers and fencing along Wilshire Boulevard during the moratorium; and (4) provide feedback on recommended permit conditions, if applicable.
INTRODUCTION
The Memorandum of Agreement (MOA) with Metro for Section 2 Station located under Wilshire Boulevard from Beverly Drive to Crescent Drive outlines allowable work hours and days in Article XIII. This agreement includes designated holiday moratorium dates during which no work is permitted. The MOA allows Metro to apply for a permit to waive the holiday moratorium with City Council holding sole discretion to review, approve, or deny the request.
On July 23, 2025, City Staff received Metro’s application to work during the 2025 holiday moratorium, which spans from Thanksgiving Day 2025 to New Year’s Day 2026 (Attachment 1).

DISCUSSION
Current Work and Site Conditions
Metro continues construction of the Purple (D) Line Extension – Beverly Dr Station, including multiple appendage structures, such as emergency exits and ventilation shafts, and street restoration. Surface construction is expected to conclude by summer 2026.
K-rail barriers and fencing are currently in place to protect drivers and pedestrians along both sides of Wilshire Boulevard between Beverly Drive and Crescent Drive, maintaining two travel lanes in each direction 24/7 since April 2025. Left turns are allowed at Beverly Drive and Crescent Drive but restricted at South Cañon Drive.
Work Allowed During Moratorium
Per the MOA, Metro is permitted to continue 24/7 work within staging yards and underground areas during the holiday moratorium. Metro will also maintain and monitor geotechnical instruments and dewatering wells within the right-of-way. Temporary traffic control requests for maintenance or emergency work will be reviewed by City staff on a case-by-case basis with advance notice. City staff will continue oversight to ensure safety and compliance with the MOA.
Holiday Moratorium Waiver Request
Metro and Tutor Perini Corporation / O&G (TPOG) have requested a waiver of the moratorium to continue the station, appendage, and street restoration work along Wilshire Boulevard between Beverly Drive and Crescent Drive and between Willaman Drive and Carson Road. Metro states that the preclusion of work would slow or delay the station construction.
Staff Review and Recommendations
After reviewing the proposed activities and projected construction timeline, staff finds that granting the waiver will not significantly reduce the overall schedule nor expedite the station opening. Continued work could lead to open trench conditions and unforeseen issues, extending lane reductions beyond hours allowed in the MOA.
Therefore, staff recommends denying the waiver request due to the potential construction impacts and to avoid unnecessary disruption to residents, businesses, and travelers during the holiday period. Given the denial, staff also recommends maintaining the current K-rail and fencing configuration along Wilshire Boulevard during the moratorium.
Preserving the existing two-lane configuration in each direction between Beverly Drive and Crescent Drive is considered the safest and least disruptive approach during the 5.5- week moratorium, even though the MOA calls for three lanes in each direction during peak hours (7:00 AM to 9:00 AM and 4:00 PM to 8:15 PM).
Removing and reinstalling the K-rails, fencing, and related temporary restoration work would require four to six weeks of added construction activity before and after the moratorium, resulting in significant dust, noise, and traffic disruptions. In contrast, keeping the current configuration minimizes these impacts and avoids exposing pedestrians and businesses to steel plates and other hazards, particularly during the rainy season and periods of high foot traffic.
City Council Ad Hoc
On July 30, 2025, the Metro Ad Hoc Committee, which includes Mayor Nazarian and Councilmember Friedman, was briefed on the holiday moratorium waiver request. Based Meeting Date: September 9, 2025
on the anticipated work impacts and minimal benefits to the community, the Ad Hoc Committee concurred with the staff recommendation to deny the request.
Following the meeting, on August 8, 2025, City staff sent an email to the Ad Hoc Committee informing them of the recommendation to maintain the existing K-rail and fencing configuration along Wilshire Boulevard throughout the moratorium due to the reasons outlined above.
Community Engagement
City Staff presented Metro’s waiver request and the recommendation to deny it during the Chamber of Commerce Stakeholder Meeting and the Government Affairs Committee (GAC) meeting on August 14, 2025. At the Stakeholder Meeting, the Two Rodeo Drive representative expressed a preference for maintaining a peaceful environment during the moratorium. Furthermore, he later submitted a written comment confirming that Two Rodeo Drive does not support the waiver request (Attachment 2). No other comments or questions were raised regarding the request or staff’s recommendation.
Notices regarding the waiver request were mailed on August 19, 2025, to residents and businesses near the construction area, including those:
Within the area bounded by South Santa Monica Boulevard, Wilshire Boulevard, Camden Drive, Olympic Boulevard, and Rexford Drive; and Within 500 feet of the concrete pour site at Wilshire Boulevard between Willaman Drive and Carson Drive.
The same notice was emailed to the City’s contact database on August 15, 2025. Links to the notice and upcoming City Council agenda items were also posted on the City website.
No comments or additional responses were received.
Next Steps
If the waiver is denied and the existing K-rail barriers and fencing along Wilshire Boulevard remain, staff will monitor and require Metro to safely maintain these enclosures throughout the moratorium. To create a more inviting holiday atmosphere, the City will continue maintaining graphic wraps on the K-rails and fences and will add seasonal holiday banners on the K-rails and staging yard walls to enhance the streetscape.
Should Council decide to reopen fully Wilshire Boulevard to three lanes in each direction during the moratorium, staff will coordinate with Metro to begin temporary sidewalk and curb lane restoration, including removal of K-rail barriers and fencing, ahead of Thanksgiving Day. Staff will also work with adjacent businesses to minimize disruptions during the temporary street restoration before Thanksgiving and the subsequent reinstallation of K-rails and fencing after New Year’s Day.
FISCAL IMPACT
There is no direct fiscal impact associated with approving or denying this request. The terms of the MOA include provisions for Metro to reimburse costs for all staff and consultants performing work associated with design-build construction activities of the Purple Line Extension – Section 2 in Beverly Hills.

Dear Honorable Mayor and City Council
On behalf of Two Rodeo Drive, I don't support changes to the Memorandum of Understanding, specifically to waiving the holiday moratorium for above ground Metro work. The holiday season is a very important time for retailers, restaurants, salons and related businesses in the city. The MOU was agreed upon by all parties to address this and other concerns. Thank you.
