DISCUSSION
On September 30, 2021, Governor Newsom signed Assembly Bill 481 (“AB 481”),adding sections 7070 et seq. to the Government Code, to address the funding, acquisition, and use of military equipment by law enforcement agencies in California.

Effective January 1, 2022, AB 481 requires California law enforcement agencies to obtain annual approval from their governing body by an ordinance adopting a militaryequipment use policy at a regular meeting of the governing body (Government Code §7071(a)(1)). On April 26, 2022, Council approved the Military Equipment Ordinanceadopting the Beverly Hills Police Department’s (‘Department’s”) Policy 706 and Military Equipment Inventory, which were subsequently renewed on May 2, 2023, and July 16, 2024.B0785-0001\3 156502v1.doc
On July 16, 2024, the City Council adopted Ordinance No. 24-0-2898, renewing approval for the Police Department’s existing Policy 706 and referenced Military Equipment Use Inventory. On August 6, 2024, the City Council adopted Ordinance No. 24-0-2899, authorizing the acquisition of new equipment to be added to the Military Equipment Use Inventory.

On August 5, 2025, the Police Department submitted the BHPD Annual Report, containing the 2025 Inventory, and Policy 706, as well as a military equipment use presentation to City Council during a Study Session.

On September 9, 2025, the City Council made the following required findings pursuant tosubdivision (d)(1) of Government Code section 7071:
• The military equipment is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety. • The proposed military equipment use policy will safeguard the public’s welfare, safety, civil rights, and civil liberties.
• If purchasing the equipment, the equipment is reasonably cost-effective compared to available alternatives that can achieve the same objective of officer and civilian safety.
• Prior military equipment use complied with the military equipment use police that was in effect at the time, or if prior uses did not comply with the accompanying military equipment use policy, corrective action has been taken to remedy nonconforming uses and ensure future compliance.
