Assembly Bill 481 (‘AB 481”) (Government Code sections 7070 et seq.) requires California law enforcement agencies to obtain approval from their governing body in order to obtain new or additional military equipment.
The Beverly Hills Police Department (“Department”) submitted its Military Equipment Use Policy (“Policy 706”), Annual Report, and presentation to the City Council during the August 5, 2025, Study Session.
B0785-0001\3 156696v1 .doc
On August 21, 2025, the Department held a “Community Engagement Meeting” pursuant to subdivision (b) of Government Code section 7072, to allow the public to discuss and inquire into its funding, acquisition, or use of military equipment, as well as any new proposals to purchase military equipment.
On September 9, 2025, the City Council made the following findings pursuant to subdivision (d)(l) of Government Code section 7071:
• The military equipment is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety. • The proposed military equipment use policy will safeguard the public’s welfare, safety, civil rights, and civil liberties.
• If purchasing the equipment, the equipment is reasonably cost-effective compared to available alternatives that can achieve the same objective of officer and civilian safety.
• Prior military equipment use complied with the military equipment use policy that was in effect at the time, or if prior uses did not comply with the accompanying military equipment use policy, corrective action has been taken to remedy nonconforming uses and ensure future compliance.
FISCAL IMPACT
The costs associated with the information contained in the submission of the Use Policy and Annual Report are accounted for and funded through the current fiscal year budgetappropriations. No additional funding is requested for the operation, maintenance, or acquisition of this equipment. Upon approval by the Council to proceed with the purchase, a purchase order will be issued by the City Manager (purchases under$100,000).
