Attachment: 1. Joint Resolution
RECOMMENDATION
Staff recommends City Council and the Parking Authority Board of Directors adopt a Joint Resolution (i) declaring real property at 327-335 South Robertson Boulevard (the “Property”) to be exempt surplus land, (ii) authorizing the Parking Authority Executive Director to execute a quitclaim deed to the City of Beverly Hills, and (ii) authorizing the City Manager to accept the quitclaim deed for the Property.
INTRODUCTION
The Parking Authority acquired the Property in November of 2019 for $10.1 million. At the time, the intention was to utilize the property for future parking and/or economic development purposes, initially as a surface parking lot with the potential for a future parking structure if the Parking Authority/City were to assemble more land by acquiring adjacent properties since the footprint of the Property alone is not large enough to Meeting Date: November 12, 2025
accommodate a parking structure. Plans were placed on hold during the pandemic and the City has since focused efforts on developing affordable housing.
Because the project now contemplated at the property does not include a public parking component, Staff recommends the Parking Authority transfer the property to the City prior to the City entering into an exclusive negotiation agreement (“ENA”) to develop the site for affordable housing.
Additional details regarding this item are included in the November 12, 2025, City Council Study Session agenda packet.
DISCUSSION
The subject property consists of a 6,000 square foot commercial building on approximately 13,740 square feet of land located on South Robertson between Gregory Way and Chalmers Drive. The transfer of property from the Parking Authority to the City will allow the City to enter into an ENA with developer West Hollywood Community Housing Corporation (“WHCHC”) to negotiate the terms of a ground lease to develop the Property for affordable housing. At the time of 2019 acquisition, the Parking Authority assumed responsibility for the existing retail tenants already operating on site, three of which have leases. While redevelopment options are still being explored, the tenants will continue to remain in place under their existing leases.
The transfer of the property by quitclaim deed is authorized under applicable state law, including the California Streets and Highways Code Section 32667, where at any time after the activation of a parking authority, the legislative body by a two-thirds vote may adopt a resolution transferring the property of the Authority to the City, and the City may, through such department, board, officer, or agency, as it determines, exercise its powers in regard to such property by virtue of the Constitution, its charter, or any general law.
The California Surplus Land Act (SLA) requires a local agency to declare property to be as surplus land or exempt surplus land prior to taking action to dispose of the Property.
Per Section 54221(f)(1)(B) of the SLA, the property is exempt surplus land because the Property is less than one-half acre in area, not contiguous to land owned by a state or local agency that is used for open-space or low and moderate income housing, and is not:
(i) within a coastal zone; (ii) adjacent to a historical unit of the State Parks System; (iii) listed on, or determined by the State Office of Historic Preservation to be eligible for, the National Register of Historic Places; or (iv) within the Lake Tahoe region as defined by Government Code Section 66905.5. The exempt surplus land declaration requires notification to the California Department of Housing and Community Development(“HCD”) 30 days prior to the disposition for HCD’s review.
FISCAL IMPACT
The transfer of the $10.1 million Property from the Parking Authority to the City will be executed without a new cash appropriation from the General Fund.
The Parking Enterprise Fund transferred $8 million to the Parking Authority to effectuate the original purchase. During and immediately following the pandemic, parking and lease revenues were significantly impacted and the General Fund provided $12 million in subsidies to the Parking Enterprise Fund. Hence, the General Fund has effectively provided the $8 million that was transferred to the Parking Authority.
Meeting Date: November 12, 2025
Staff recommends the remaining $2.1 million be transferred to the Parking Authority from funds available in the City’s Land Acquisition Capital Improvement Program (approximately $6.9 million in the Capital Assets Fund). Should the City choose to purchase other property in the future, the Fiscal Impact would be determined at that time, with potential funds from other sources such as the Committed Fund Balance earmark for one-time Capital Improvement Program contributions or the unassigned reserve balance.
