RECOMMENDATION
Staff recommends that City Council approve Amendment No. 2 to the Agreement with Kennedy/Jenks Consultants, Inc. (KJ) to provide professional design services for a total not-to-exceed amount of $3,088,025 for the Cabrillo Reservoir Replacement project and approval of a change purchase in the amount of $1,467,025.

INTRODUCTION
This report is a request for City Council approval of Amendment No. 2 to an agreement between the City of Beverly Hills and KJ to continue engineering design and construction support services related to the Cabrillo Forebay and Pump Station project, Reservoir Management Systems (RMS) project and the Greystone junction structure improvements.

DISCUSSION
On June 1, 2021, City Council approved a purchase order in the not-to-exceed amount of $1,621,000 to KJ for an agreement to provide design services for the demolition of the existing Cabrillo Reservoir (Reservoir 3B), originally constructed in 1918, and its replacement with a new 4.3-million-gallon reservoir. KJ subsequently conducted preliminary engineering services, including topographic survey, geotechnical investigation, and hydraulic analysis, culminating in the completion of a Basis of Design Report (BODR) in October 2021.

Page 2 of 2 ends

The BODR presented two alternatives for the replacement reservoir with associated probable construction costs:
 Alternative 1: Two circular pre-stressed concrete reservoirs – estimated cost of $30 million
 Alternative 2: One trapezoidal reservoir – estimated cost of $32 million These cost estimates significantly exceeded a 2020 preliminary estimate of $12 million prepared by a previous consultant. The variance was attributed to substantial increases in materials, labor, dewatering, and shoring costs, in addition to the piling cost that was not accounted for in the previous estimate.

Given insufficient funding for the larger reservoir project, City Council directed staff to identify cost-reduction alternatives that would maximize emergency water storage and improve system reliability. Two options were identified and supported by City Council:

1. Installation of RMS at the City’s three largest water reservoirs (Coldwater, Sunset, and Greystone), which would help maintain higher operational levels (60% to full operational capacity instead of 35% to full operational capacity), thereby adding

8.45 million gallons (25%) to available emergency storage.

2. Construction of an approximately 200,000-gallon underground forebay and aboveground pump station at the Cabrillo Reservoir site to improve system reliability for Zones 8 and 9.

To expedite the RMS project design, staff authorized KJ an amount of $800,795 to proceed under the existing Cabrillo Reservoir agreement and purchase order. Design was completed in September 2023 with the construction contract awarded by City Council on November 21, 2023 to R2BUILD. Construction was completed in June 2025, and the system is currently undergoing startup and commissioning.

Concurrently, KJ completed preliminary engineering design for the Cabrillo Forebay and Pump Station project, conducted additional geotechnical investigations, completed a Class 32 Categorical Exemption Report, and finalized the BODR in May 2025.

The proposed agreement amendment in the additional amount of $1,467,025 will enable KJ to complete the design for the forebay and pump station and continue the construction support services for the RMS project throughout the closeout of the project. In addition, KJ’s amended scope will include improvements to the aged Greystone Reservoir junction structure constructed in 1967.

FISCAL IMPACT
The fee for the services described above in Amendment No. 2 is $1,467,025 (including a contingency in the amount $142,766) for a total contract not-to-exceed amount of $3,088,025. Funds for this amendment are available in CIP 00972.

Amendment No. 2
The following additional Scope of Work shall be considered additional services to the original Agreement. CONSULTANT shall provide engineering and construction support services for the Cabrillo Pump Station and Forebay Project and the Greystone Reservoir Junction Structure.

CITY will be replacing the abandoned Cabrillo Reservoir with a new pump station and forebay.

Water will enter the forebay from Pressure Zone (Zone) 6, which is fed from Greystone Reservoir, via a 12-inch pipeline. The pump station will then convey water from the forebay for distribution to Zone 8 and Zone 9.

The Cabrillo Pump Station and Forebay project will consist of the following work and major facilities:
• Demolition of the abandoned Cabrillo Reservoir
• Construction of a new 200,000-gallon buried concrete forebay • New 12-inch Zone 6 inlet pipeline and inlet valve vault • Construction of a new dual-zone (Zone 8 and Zone 9) booster pump station and concrete masonry building with parapet walls
• Three (3) Zone 8 (two duty and one standby) fixed-speed vertical turbine pumps, with the following design criteria, and 10-inch discharge header o 825 gallons per minute (gpm)
o 200 ft total dynamic head (TDH)
o 75 horsepower (HP)
• Two (2) Zone 9 vertical turbine pumps (one duty and one standby) with variable frequency drives (VFDs) as well as a fixed-speed vertical turbine high-service pump, with the following design criteria, and 12-inch discharge header Zone 9 pumps
- 150 gpm
- 450 ft TDH
- 30 HP
Zone 9 high service pump
- 1 ,250 gpm
- 425 ft TDH
- 200 HP
• Installation of an emergency standby power generator
• Installation of long-term site dewatering system and piping to existing drainage vault with existing connection to the storm drain in Coldwater Cañon Drive • Associated site work, including landscaping and fencing.

The Greystone Reservoir Junction Structure is located near 905 Loma Vista Drive. It is located amongst foliage within a residential neighborhood, across the street from the Greystone Mansion Docusign Envelope ID: EB2FB0DF-1ED8-4A5D-8532-6DE372378141 B0785-0001\3179437v3.doc
and Gardens. The Greystone Reservoir Junction Structure is located on a hillside with soil overtopping it.

The Greystone Reservoir Junction Structure is a cast-in-place concrete vault with aluminum grated access cover and is equipped with an egress pole ladder located along the northeast wall.

It has dimensions of 9 feet wide, 11 feet long, and approximately 8.5 feet deep. The Greystone Reservoir Junction Structure houses various appurtenances on the 24-inch inlet/outlet pipeline, including a 24-inch motor-actuated butterfly valve, a 2-inch combination air valve, a 6-inch gate valve, an 8-inch bypass line, two 8-inch bypass gate valves, and a 20-inch access manhole. In addition to the inlet/outlet pipeline, a 20-inch drain pipeline and three 6-inch underdrain collector pipelines terminate in the Greystone Reservoir Junction Structure.

The Greystone Reservoir Junction Structure was originally constructed in 1967, and there have been several modifications made since then, including installations of the motorized actuation on the existing 24-inch butterfly valve and the 8-inch bypass line on the existing 24-inch inlet/outlet pipe. Piping, valves, appurtenances, and electrical conduits are corroded due to drain water flowing through the Greystone Reservoir Junction Structure.

The inlet/outlet pipeline is steel and delivers water from the 19.4 million gallon (MG) Greystone Reservoir to the Greystone Pump Station located downhill of the Greystone Reservoir Junction Structure. From there water is pumped to Zone 6 and Zone 8. The pipeline also serves to fill the Greystone Reservoir from Reservoir A, and it is imperative that the pipeline remains active during construction.

The Greystone Reservoir Junction Structure rehabilitation will include the following work:
• Remove and replace mechanical equipment
o Includes the motor-actuated butterfly valve, combination air valve, gate valves, check valve, access manhole, and flap gate on the 20-inch incoming drainpipe • Vault piping improvements
o Remove and replace the inlet/outlet pipeline, air valve vent line, and inlet/outlet bypass line
o Sand blast the pipe face of the Reservoir Footing Underdrain Collection Line o Pressure wash the pipe face, inspect the buried portion of pipe, and confirm the condition of the drainpipe during construction for the East Basin Underdrain Collector Line, West Basin Underdrain Collector Line, Incoming drainpipe, and outgoing drainpipes
• Structural improvements
o Raise the top of the Greystone Reservoir Junction Structure by 18-24 inches using a precast extension
o Perform concrete repairs where necessary on the walls o Remove and replace the existing grated access cover
o Remove and replace the existing ladder
• Electrical improvements
Docusign Envelope ID: EB2FB0DF-1ED8-4A5D-8532-6DE372378141 B0785-0001\3179437v3.doc
o Limited to in-vault electrical wiring pertaining to the new motor-actuated butterfly valve • Stormwater control
o Install a concrete swale, approximately 2-4 foot wide, to divert stormwater to the east and west of the Greystone Reservoir Junction Structure Task 1. Engineering Services to Support Final Design

EXHIBIT D
Terms for Compliance with California Labor Law Requirements Section 1. CONSULTANT acknowledges that the project as defined in this Agreement between CONSULTANT and CITY, to which this Agreement to Comply with California Labor Law Requirements is attached and incorporated by reference, is a “public work” as defined in Division 2, Part 7, Chapter 1 (commencing with Section 1720) of the California Labor Code (“Chapter 1”), and that this Agreement is subject to (a) Chapter 1, including without limitation Labor Code Section 1771 and (b) the rules and regulations established by the Department of Industrial Relations (“DIR”) implementing such statutes. CONSULTANT shall perform all work on the project as a public work. CONSULTANT shall comply with and be bound by all the terms, rules and regulations described in 1(a) and 1(b) as though set forth in full herein.

Section 2. California law requires the inclusion of specific Labor Code provisions in certain contracts. The inclusion of such specific provisions below, whether or not required by California law, does not alter the meaning or scope of Section 1 above.

Section 3. CONSULTANT shall be registered with the Department of Industrial Relations in accordance with California Labor Code Section 1725.5, and has provided proof of registration to CITY prior to the effective date of this Agreement. CONSULTANT shall not perform work with any subconsultant that is not registered with DIR pursuant to Section 1725.5.

CONSULTANT and subconsultants shall maintain their registration with the DIR in effect throughout the duration of this Agreement. If CONSULTANT or any subconsultant cease to be registered with DIR at any time during the duration of the project, CONSULTANT shall immediately notify CITY.

Section 4. Pursuant to Labor Code Section 1771.4, CONSULTANT’s services are subject to compliance monitoring and enforcement by DIR. CONSULTANT shall post job site notices, as prescribed by DIR regulations.

Section 5. Pursuant to Labor Code Section 1773.2, copies of the prevailing rate of per diem wages for each craft, classification, or type of worker needed to perform the Agreement are on file at City Hall and will be made available to any interested party on request.

CONSULTANT acknowledges receipt of a copy of the DIR determination of such prevailing rate of per diem wages, and CONSULTANT shall post such rates at each job site covered by this Agreement.

Section 6. CONSULTANT shall comply with and be bound by the provisions of Labor Code Sections 1774 and 1775 concerning the payment of prevailing rates of wages to workers and the penalties for failure to pay prevailing wages. CONSULTANT shall, as a penalty to the CITY, forfeit two hundred dollars ($200) for each calendar day, or portion thereof, for each worker paid less than the prevailing rates as determined by the DIR for the work or craft in which the worker is employed for any public work done pursuant to this Agreement by CONSULTANT or by any subconsultant.

Section 7. CONSULTANT shall comply with and be bound by the provisions of Labor Code Section 1776, which requires CONSULTANT and each subconsultant to (1) keep accurate payroll records and verify such records in writing under penalty of perjury, as specified Docusign Envelope ID: EB2FB0DF-1ED8-4A5D-8532-6DE372378141 B0785-0001\3179437v3.doc
in Section 1776, (2) certify and make such payroll records available for inspection as provided by Section 1776, and (3) inform the CITY of the location of the records.

Section 8. CONSULTANT shall comply with and be bound by the provisions of Labor Code Sections 1777.5, 1777.6 and 1777.7 and California Administrative Code title 8, section 200 et seq. concerning the employment of apprentices on public works projects.

CONSULTANT shall be responsible for compliance with these aforementioned Sections for all apprenticeable occupations. Prior to commencing work under this Agreement, CONSULTANT shall provide CITY with a copy of the information submitted to any applicable apprenticeship program. Within 60 days after concluding work pursuant to this Agreement, CONSULTANT and each of its subconsultants shall submit to the CITY a verified statement of the journeyman and apprentice hours performed under this Agreement.

Section 9. CONSULTANT acknowledges that eight hours labor constitutes a legal day’s work. CONSULTANT shall comply with and be bound by Labor Code Section 1810.

CONSULTANT shall comply with and be bound by the provisions of Labor Code Section 1813 concerning penalties for workers who work excess hours. CONSULTANT shall, as a penalty to the CITY, forfeit twenty-five dollars ($25) for each worker employed in the performance of this Agreement by CONSULTANT or by any subconsultant for each calendar day during which such worker is required or permitted to work more than eight hours in any one calendar day and 40 hours in any one calendar week in violation of the provisions of Division 2, Part 7, Chapter 1, Article 3 of the Labor Code. Pursuant to Labor Code section 1815, work performed by employees of CONSULTANT in excess of eight hours per day, and 40 hours during any one week shall be permitted upon public work upon compensation for all hours worked in excess of eight hours per day at not less than one and one-half times the basic rate of pay.

Section 10. California Labor Code Sections 1860 and 3700 provide that every employer will be required to secure the payment of compensation to its employees. In accordance with the provisions of California Labor Code Section 1861, CONSULTANT hereby certifies as follows:
“I am aware of the provisions of Section 3700 of the Labor Code which require every employer to be insured against liability for workers’ compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions before commencing the performance of the work of this contract.”
Section 11. For every subconsultant who will perform work on the project, CONSULTANT shall be responsible for such subconsultant’s compliance with Chapter 1 and Labor Code Sections 1860 and 3700, and CONSULTANT shall include in the written contract between it and each subconsultant a copy of those statutory provisions and a requirement that each subconsultant shall comply with those statutory provisions. CONSULTANT shall be required to take all actions necessary to enforce such contractual provisions and ensure subconsultant’s compliance, including without limitation, conducting a periodic review of the certified payroll records of the subconsultant and upon becoming aware of the failure of the subconsultant to pay his or her workers the specified prevailing rate of wages. CONSULTANT shall diligently take corrective action to halt or rectify any failure.

Section 12. To the maximum extent permitted by law, CONSULTANT shall indemnify, hold harmless and defend (at CONSULTANT’s expense with counsel reasonably Docusign Envelope ID: EB2FB0DF-1ED8-4A5D-8532-6DE372378141 B0785-0001\3179437v3.doc
