RECOMMENDATION
Staff recommends that City Council approve Amendment No. 1 to the Agreement between the City of Beverly Hills and Broskin, LLC for additional architectural and engineering services for design of the October 7th memorial monument and approval of a change purchase order in the amount of $116,350. The total amount of the original agreement and the amendment is a not-to-exceed amount of $216,100. Staff also recommends that Council approve a one-time appropriation from the General Fund committed fund balance of $500,000 to fund a portion of this project.

INTRODUCTION
City Council has been steadfast in its support of Israel and the creation of a permanent memorial dedicated to the hundreds of victims from numerous countries from the brutal attack by Hamas on October 7, 2023. Through an RFP process, five firms were selected to present their design concept, after a series of interviews with designers/artists/architects with the goal of selecting a design for the October 7th Permanent Memorial.

After careful consideration, on August 19, 2025, the Committee recommended to City Council the selection of 40 Steps to the Sky: A Memorial of Light and Memory by Broskin, LLC (formerly Archillusion Design Studio/C.I. Form), and City Council unanimously approved of the design concept. On October 5, 2025, a site dedication ceremony was conducted, and the proposed design was presented to members of the community and received exceptional support.

DISCUSSION
The architectural and engineering design services of Broskin, LLC were engaged, and the architect and his engineering team started preparing schematic design documents based on the approved conceptual design. The original contract with Broskin, LLC in the amount of $99,750 included preparing schematic design and design development documents as well as fabrication of a mockup of one of the main design elements (a Step) made of glass and stainless steel.

The design development documents are near completion. The proposed development includes the main memorial plaza and the monument (1,500 SF) as well as site development of 9,200 SF surrounding the plaza. The memorial plaza includes the October 7th memorial monument in a water fountain basin with scriptures and a wall commemorating the victims with carved names. The surrounding site development area includes a series of curvilinear site walls creating significant areas for donor walls and integrated benches, landscape and hardscape area, and site lighting.

To get the project started right away, staff engaged the services of Broskin, LLC to work on phase one of the design and prepare schematic and design development packages.

The original agreement is in the amount of $96,400, which included a reduced designer fee of $29,800; the amendment to the Broskin, LLC contract for additional professional services in the amount of $104,080 will include architectural and engineering services for preparation of construction and bid documents, assistance during bidding and construction administration services during the construction phase.

The total not-to-exceed amount of $216,100 for the original agreement and Amendment No. 1 includes a reimbursable expenses amount of $8,500 for mockup fabrications and $7,120 in contingency for any design services beyond the scope of work.

The bid documents are scheduled to be completed in approximately mid-January. The Broskin, LLC team currently estimates the project cost of the memorial to be approximately $1.55 million, including this $0.2 million in design costs. Staff is currently working with professional cost estimators to provide estimates of probable costs based on the design development package. However, it should be noted that a final cost cannot be determined until formal bid drawings are prepared.

Staff is currently in the process of pre-qualifying contractors for the construction phase of the project.

The October 7th Permanent Memorial Ad Hoc has met and will meet again to discuss raising additional funds for the memorial. Once the fundraising program has been finalized, it will be brought to City Council for approval. The Beverly Hills Community Charitable Foundation will play a role in fundraising and accepting donated funds. It is anticipated that donations will supplement costs beyond the City’s available $500,000 fund for the construction of the memorial monument and surrounding site improvements.

Meeting Date: December 16, 2025

FISCAL IMPACT
City Council has committed $500,000 of City funds to be used toward the October 7th permanent memorial, and it is recommended that Council provides direction to appropriate this amount from the General Fund committed fund balance. The funds will be transferred to newly created CIP 00107 in Fund 405, where the memorial construction activity will be managed.

On June 17, 2025, City Council approved the Fiscal Year 2025-26 Capital and Operating Budgets, which indicated potential financial challenges on the horizon, including forecasted deficits within the next five years. The forecasted General Fund operating surplus of $1.9 million was projected before one-time public benefit contributions of $10.0 million. The chart below displays the adjusted forecasted General Fund results for Fiscal Year 2025-26 incorporating both approved and proposed mid-year appropriations. $ 1,944,997
