Re: Application PL2400152/Notice of CEQA Exemption under AB 130 and Public Resources Code § 21080.66
Project Site: 9229 Wilshire Boulevard, Beverly Hills, CA 90210 To Whom It May Concern:
This letter supplements our prior AB 1633 notice and provides formal notice to the City of Beverly Hills (the “City”) that the above-referenced project (the “Project”) qualifies for and claims an exemption from the California Environmental Quality Act (“CEQA”) pursuant to Public Resources Code (“PRC”) Section 21080.66, as enacted by Assembly Bill 130 (effective July 1, 2025).
1. CEQA Exemption Under PRC § 21080.66
Pursuant to PRC § 21080.66(b)(1)(A)(ii), this transmittal notifies the City that the Project is exempt from CEQA and that the City is required to commence formal tribal notification and consultation within 14 days of this letter.
The Project meets all conditions required under PRC Section 21080.66 for CEQA exemption, including but not limited to:
• Lot size: The site is less than five acres meeting the requirement of PRC § 21088.66(a)(1).
2 | Page
• Urban infill: The site qualifies as within the incorporated City of Beverly Hills and is infill under at least one criterion (e.g., 75% perimeter urbanized). In fact, the site is 100 percent surrounded by urban uses, therefore qualifying under PRC § 21080.66(a)(2) and (3).
• General Plan/Zoning consistency: The Project is consistent under the Builder’s Remedy framework. Government Code Section 65589.5(f)(6)(D)(iii) states that a builder’s remedy project “… shall be deemed consistent, compliant, and in conformity with an applicable plan, program, policy, ordinance, standard, requirement, redevelopment plan and implementing instruments, or other similar provision for all purposes, and shall not be considered or treated as a nonconforming lot, use, or structure for any purpose.” As such, by operation of law, the Project is consistent with the applicable general plan and zoning ordinance, therefore qualifying under PRC § 21080.66(a)(4). • Minimum density: The minimum density is 15 dwelling units per acre and the Project’s 116 dwelling units on a 20,665 square foot lot exceeds the applicable minimum density threshold pursuant to PRC § 21080.66(a)(5). • Environmental factors: The site is not located on or near wetlands, prime farmland, earthquake faults, flood zones, or hazardous waste sites, thereby meeting the PRC § 21080.66(a)(6) threshold.
o Pursuant to California Government Code Section 65913.4(6)(A), the Project is not located in a coastal zone.
o Pursuant to California Government Code Section 65913.4(6)(B), the Project Site is not located on Prime Farmland or Farmland of Statewide Importance. The Project Site and surrounding area are designated Urban and Built-Up Land.
o Pursuant to California Government Code Section 65913.4(6)(C), the Project Site is not located on a wetland. The Project Site does not include any protected wetlands or water features.
o Pursuant to California Government Code Section 65913.4(6)(E), the Project Site is not a hazardous waste site that is listed pursuant to Section 65962.5 or a hazardous waste site designated by the Department of Toxic Substances Control (DTSC) pursuant to Section 25356 of the Health and Safety Code. The Project Site is not located on any list of hazardous waste sites pursuant to Section 65962.5.
o Pursuant to California Government Code Section 65913.4(6)(F), the Project Site is not located within a delineated earthquake fault zone. The Project Site is not located within an Alquist-Priolo Earthquake Fault Zone, and no active faults are known to pass through the immediate Project vicinity.
o Pursuant to California Government Code Section 65913.4(6)(G), the Project Site is not located in a special flood hazard area subject to inundation by the 1 percent annual chance flood (100-year flood) as determined by the Federal Emergency Management Agency (“FEMA”).
The Project Site is located in Zone X, which is defined as an area of minimal flood hazard.
o Pursuant to California Government Code Section 65913.4(6)(H), the Project Site is not located within a regulatory floodway as determined by 3 | Page
FEMA. The Project Site is located in Zone X, which is defined as an area of minimal flood hazard.
o Pursuant to California Government Code Section 65913.4(6)(I), the Project Site is not on land identified for conservation in an adopted natural community conservation plan. The Project Site is also not located within an adopted Habitat Conservation Plan, Natural Conservation Community Plan, or other approved local, regional, or State conservation habitat plan. o Pursuant to California Government Code Section 65913.4(6)(J), the Project Site does not contain habitat for protected species identified as candidate, sensitive, or species of special status by State or federal agencies, fully protected species, or species protected by the federal Endangered Species Act of 1973, the California Endangered Species Act, or the Native Plant Protection Act. The Project Site is in an urbanized area within the City and is developed with a commercial building and a surface parking lot. The Project Site contains minimal ornamental landscaping along the alley to the north, Wilshire Boulevard to the south, and North Maple Drive to the west. No vegetation exists within the Project Site or surrounding areas that could provide habitat for candidate, sensitive, or special-status species.
o Pursuant to California Government Code Section 65913.4(6)(K), the Project Site is not land under conservation easement.
• No demolition of historic resources: The Project does not demolish any resource listed prior to the preliminary application (see PRC § 21080.66(a)(7)). • No hotel for a project deemed complete pursuant to Government Code § 65589.5(h)(5): The Project’s preliminary application was filed in December 2023; it was therefore deemed complete well before January 1, 2025, consistent with Government Code § 65589.5(h)(5). Accordingly, PRC Section 21080.66(a)(8) which prohibits this CEQA exemption for certain projects containing hotels or transient lodging only if the project was deemed complete on or after January 1, 2025, does not apply. As such, the Project’s hotel component does not preclude the use of the CEQA exemption under PRC Section 21080.66. • No freeway within 500 feet: The Project Site is not located within 500 feet of any freeway, so PRC § 21080.66(c)(2) is inapplicable.
• Tribal Consultation Notice – Required action by the City.
Under Public Resources Code § 21080.66(b)(1)(A)(ii), the City is now required to:
o Notify California Native American tribes traditionally affiliated with the area within 14 days.
o Include required project information (site maps, description, studies, contact info, etc.)
o Conclude consultation in accordance with the timelines and procedures specified in the statute.
The Project team stands ready to participate in the consultation process, consistent with statutory requirements.

• Phase 1 and Preliminary Endangerment Assessment: In conjunction with the Sustainable Communities Project Exemption (“SCPE”) submitted to the City for the Project this past spring, a Phase 1 and a PEA were submitted to the City.
There are no recognized environmental conditions. Therefore PRC § 21080.66(c)(1) has been satisfied.
• As the Project would be greater than 85 feet in height, the labor standards of paragraph (8) of subdivision (a) of Section 65913.4 of the Government Code shall apply in conformance with PRC § 21080.66(d).

Re: Required Use of Skilled and Trained Labor and Prevailing Wages under AB 130 for the 9229 Wilshire Boulevard Project (PL2400152) Dear Chair Wolfe, Vice Chair Milkowski, Honorable Commissioners, Ms. Gutierrez, and Ms.
Ahmed:
I am writing on behalf of Supporters Alliance for Environmental Responsibility (“SAFER”) and its members living or working in the City of Beverly Hills (“City”) regarding the 9229 Wilshire Boulevard Project (PL2400152) (“Project”), proposed by Hamburg Properties LLP, Frosenfelt LLP, Barry & Beth Rosenbloom Properties, LLC, Mimilee Properties LLC, KDR Golden LLC, Double Decker Partners, LLC; JD Tower LLC; and Reggio Mayo LLC (“Applicant”). The Project involves the construction of a 14-story, 116-unit, 163’-0” tall, mixed-use development with a combination of residential, commercial and hotel uses, a subterranean parking structure, and approximately 5,340 square feet of outdoor living space. The Project is scheduled to be heard at the Planning Commission meeting on October 29, 2025 at 1:30 p.m.
Through the recently-enacted Assembly Bill 130 (“AB 130”), the Applicant has sought to exempt the Project from environmental review under the California Environmental Quality Act (“CEQA”). AB 130 establishes a new statutory exemption from CEQA for qualifying infill housing projects. (See AB 130 § 59; Pub. Res. Code § 21080.66 [“PRC”].) As discussed below, October 22, 2025
Letter Re: Required Use of Skilled and Trained Labor and Prevailing Wages under AB 130 for the 9229 Wilshire Boulevard Project (PL2400152)
AB 130 specifies construction labor standards for certain types of projects, including buildings taller than 85 feet, such as the proposed Project here. Therefore, under AB 130, SAFER respectfully requests that the Planning Commission require the Applicant to: (1) employ a skilled and trained construction workforce; and (2) pay its construction workforce prevailing wages.
DISCUSSION
I. The Project is not exempt under AB 130 due to the Project’s hotel uses.
The City claims that the Project is exempt from environmental review pursuant to CEQA under the newly enacted AB 130. However, projects including hotel uses are not exempt from environmental review pursuant to CEQA under AB 130. Public Resources Code section 21080.66(a)(8) states, that AB 130 applies only if, “no portion of the project is designated for use as a hotel, motel, bed and breakfast inn, or other transient lodging.” Since the Project includes hotel uses, the Project is not exempt from environmental review pursuant to CEQA under AB 130.
II. The Applicant must employ a skilled and trained construction workforce to build the Project.
If the City nevertheless applies AB 130, it must require the payment of prevailing wages and the use of a skilled and trained workforce. AB 130 states that the labor standards of Government Code § 65913.4(a)(8) [“Gov. Code”] apply to buildings over 85 feet in height for any housing development project that otherwise qualifies for a CEQA exemption under AB 130. (PRC § 21080.66(d)(2); AB 130 § 59(d)(2).) Here, the Project will be 163 feet tall, thereby triggering the labor standards of Gov. Code § 65913.4(a)(8).
Gov. Code § 65913.4(a)(8)(F)(i) states, inter alia, that the developer for any project over 85 feet tall shall enter construction contracts with prime contractors only if the contract contains an enforceable commitment that the prime contractor and subcontractors at every tier will use a skilled and trained workforce, as defined in Public Contract Code § 2601(d), to perform work on the project that falls within an apprenticeable occupation, as defined in PCC § 2601(a), in the building and construction trades. (Gov. Code § 65913.4(a)(8)(F)(i)(I).) Public Contract Code § 2601(d) [“PCC”] defines a “skilled and trained workforce” as a workforce that meets the following conditions, among others:
(1) All workers performing work in an apprenticeable occupation in the building and construction trades are either skilled journeypersons or apprentices registered in an apprenticeship program approved by the chief.
(2)(A) For work performed on or after January 1, 2017, at least 30 percent of the skilled journeypersons employed to perform work on the contract or project by every contractor October 22, 2025
Letter Re: Required Use of Skilled and Trained Labor and Prevailing Wages under AB 130 for the 9229 Wilshire Boulevard Project (PL2400152)
and each of its subcontractors at every tier are graduates of an apprenticeship program for the applicable occupation. This requirement shall not apply to work performed in the occupation of teamster. . . .
(2)(D) For work performed on or after January 1, 2020, at least 60 percent of the skilled journeypersons employed to perform work on the contract or project by every contractor and each of its subcontractors at every tier are graduates of an apprenticeship program for the applicable occupation, except that the requirements of subparagraph (A) shall continue to apply to work performed in the following occupations: acoustical installer, bricklayer, carpenter, cement mason, drywall installer or lather, marble mason, finisher, or setter, modular furniture or systems installer, operating engineer, pile driver, plasterer, roofer or waterproofer, stone mason, surveyor, teamster, terrazzo worker or finisher, and tile layer, setter, or finisher.
(PCC § § 2601(d).) PCC § 2601(a) defines an “apprenticeable occupation” as an occupation for which the Chief of the Division of Apprenticeship Standards of the Department of Industrial Relations had approved an apprenticeship program pursuant to California Labor Code § 3075 [“CLC”] before 2014.
Here, because the Project building will be over 85 feet tall, the Applicant must use a skilled and trained workforce at every tier to perform work on the Project that falls within an apprenticeable occupation in the building and construction trades.
III. The Applicant must pay its construction workforce prevailing wages for the Project.
For any development that is not entirely a public work, Gov. Code § 65913.4(a)(8)(A) requires, inter alia, that all construction workers employed in the execution of the subject project be paid at least the general prevailing rate of per diem wages for the type of work and geographic area, as determined by the Director of Industrial Relations under CLC §§ 1733 and 1733.9.
However, apprentices registered in programs approved by the Chief of the Division of Apprenticeship Standards may be paid at least the applicable apprentice prevailing rate. (Gov.
Code § 65913.4(a)(8)(A)(i).) Additionally, the development proponent shall ensure that the prevailing wage requirement is included in all contracts for the performance of the work and shall also provide notice of all contracts for the performance of the work to the Department of Industrial Relations for the portions of the development that are not a public work. (Gov. Code § 65913.4(a)(8)(A)(ii).)
Here, because the Project is not a wholly public work and will be over 85 feet tall, the Applicant must pay all its construction workers prevailing wages.
CONCLUSION
For the reasons set forth above, the Planning Commission must require the Applicant to use a skilled and trained construction workforce and pay its construction workforce prevailing October 22, 2025
Letter Re: Required Use of Skilled and Trained Labor and Prevailing Wages under AB 130 for the 9229 Wilshire Boulevard Project (PL2400152)
wages, in compliance with the labor standards set forth in AB 130. However, despite these provisions, the Project does not qualify for a CEQA exemption under AB 130 due to the Project’s hotel uses. Thank you for your consideration.
Sincerely,
Richard T. Drury

Dear Planning Commission,
I support the Builders Remedy projects at 8844 Burton Way and 9229 Wilshire Blvd. These applications will help the city meet state housing requirements and deliver development consistent with the high standards of Beverly Hills.

I will try my best to be at the meeting today. But just In case I am sending this email. This project will dramatically and permanently change the quality of life for families who already live here on Palm drive and maple drive. Our streets are small and already crowded. We struggle just to back out of our driveways due to constant traffic on Palm drive. Since maple is almost dead ended. More vas means more noise and more pollution. We moved to this neighborhood 1997 because it was a peaceful quiet residential area. A high rise commercial building would take that away. It will overshadow our homes and our privacy.
And the sense of community we value . We ask you to please reconsider this project and to protect the safety and health and wellbeing of the families.
Commission Members:
I fully intended to be at this meeting today but maintenance/repair issues prevented me from coming. However, I do want to add my voice to those who are very concerned about this project.
While I do not live directly on the blocks that will be most affected by this project, I am only two blocks away and am already suffering from traffic nightmares where I cannot get out of my driveway easily, where street parking is difficult, and noise and dirt and rats from all the nearby construction are impacting my quality of life. Also, I walk the neighborhood daily and already fear for my life with no one stopping at boulevard stops or pedestrians. This project will only add to that issue.
Please consider the needs of the neighborhood residents when allowing this type of project Thank you.

Honorable Planning Commissioners,
I want to thank the Planning Commissioners who had the good character and courage to deny the huge builder’s remedy project on Burton Way for numerous good reasons.
The developer will appeal and then the matter will be heard by the City Council as it should be. That is, city staff and the city council members who were serving at the time are responsible for the incomprehensible failure of the city to get housing element accepted by the state for over 2 1/2 years, and that does not count the couple of years the city had in advance of the deadline to file it. So why should the Planning Commission have to do the dirty work and inflict pain on the residents.
We appreciate the Planning Commission considering the adverse health and safety consequences of these immense projects and doing their best to protect our quality of life, all of the investments we have made in our homes, and our ability to use and enjoy our homes.
I hope that the Planning Commission will note how unfair the developer of 9229 Wilshire has been toward residents in causing them to spend thousands of dollars to defend against two projects when if the developer had been acting in good faith and intended to provide any affordable housing, only one application would have been filed. The developer has abused of the process and residents have been deprived of the due process they were entitled to—consideration of one project the developer actually planned to build.
But this is not new for this developer who purchased charming four flexes and a small apartment building in the 100 South block of Maple, required over 2 dozen tenants to move out of their rent controlled units, and then instead of building the 6 story project which was approved, he has been attempting to sell the property with entitlements for a large profit.
Thank you again.

Good evening
My name is Asher Ahdoot and I live at 106 n maple, just north of 9229 Wilshire Boulevard. I’m here to strongly oppose the proposed 14-story development.
This project completely ignores the intent of our city’s zoning and planning framework.
Under Beverly Hills Municipal Code, buildings in nearby multi-family zones are limited to three stories or 33 feet in height). Even along Whilshire, the Mixed-Use Overlay Zone Guidelines envision buildings generally between three and five stories, depending on context and transitions. That’s the scale our city designed to maintain compatibility between commercial corridors and residential neighborhoods.
Now we are being asked to accept a 14-story tower, nearly triple the height of what was already considered excessive when the 8-story version was approved last year.
Commissioners at that time called the smaller project a “shock to the system.” Doubling it to fourteen stories is not compatible growth; it’s overreach.
Beyond the numbers, this building would sit directly behind single-family homes, with no meaningful rear setback. That means constant shadows, loss of privacy, and intrusive balcony views into backyards and living spaces. It would fundamentally change what it feels like to live north of Wilshire. The alley that separates homes from the site would become a busy corridor for deliveries, parking access, and rideshare traffic, conditions it was never designed to handle safely.
The Beverly Hills General Plan emphasizes protecting residential character and ensuring that new development provides a smooth transition between commercial and residential areas. This proposal fails that standard on every level. It overwhelms the scale of the surrounding neighborhood, creates unsafe traffic conditions, and disregards the principles that define Beverly Hills planning.
Let me be clear: we are not against development. We understand the need for thoughtful, balanced growth and housing. But not this project, not one that breaks from the city’s own design standards, overburdens our streets, and erases the careful balance between progress and livability that makes Beverly Hills special.
Please protect our neighborhoods and uphold the integrity of our planning process.
I urge you to deny the 14-story proposal at 9229 Wilshire Boulevard or require it to be substantially reduced in scale
Good afternoon:
I’m writing on behalf of my parents who live at 107 N Maple Dr.
This proposed building at 14 stories high will cause multiple negative issues for my parents as well as the community of homes in that area.
This project will flood the neighborhood with extra cars and traffic.
Grandchildren and young children are currently on Maple Drive riding bikes and playing.
The extra traffic will make this unsafe.
Further, the extra traffic will make it unsafe for residents who currently park in their own driveways to back out from their spots.
There will be an increase in unsafe and unhealthy emissions given off by the extra traffic.
The sheer size and height of this project will eliminate all sense of privacy for the community living on the N. 100-300 blocks of Maple and Palm Drives.
Please reconsider this project in its entirety and or consider reducing the height of this project. Please prioritize the lives of the neighborhood who are current citizens of Beverly Hills and would like to keep their neighborhoods safe.
With much appreciation,
Natalie Ashouri.
Hello Commissioners
We have been Beverly Hills residents for the past 35 years and on north maple for the past ten years .
We are very concerned about this project and the future of our beloved city as well .
This building would attract much unwanted traffic , construction , parking restrictions and pollution to our everyday lives . Just to name a few .
In addition to crime and lowering our living quality and conditions .
We already have been dealing with the metro projects construction and it affects us everyday .
Please consider these circumstances.
Thank you

Re: Proposed Housing Development Project at 9229 Wilshire Blvd To: [email protected]
CC: [email protected]; [email protected]; [email protected]; [email protected]; [email protected]
Dear Beverly Hills Planning Commission,
The California Housing Defense Fund (“CalHDF”) writes regarding public hearing item number 2 on the agenda for the October 29, 2025 Planning Commission meeting: permit approvals for a proposed 116-unit housing development project at 9229 Wilshire Boulevard, which includes 24 low-income units. We urge the Planning Commission to approve the project, as is required by law.
The City’s Discretion to Deny the Project is Limited by the HAA The City correctly identifies the standards governing the approval or disapproval of the project as those contained in Government Code section 65589.5, subdivisions (d) and (j). As the staff report notes, there is no evidence in the record to support a denial of the project under those provisions of those sections of law.
The staff report also includes a discussion of the findings purportedly required by local code for the approval of a Development Plan Review. These findings are inapplicable to the project. As a builder’s remedy project, the development is exempt from local zoning and general plan standards. Required findings for local zoning permits are standards, therefore these findings are inapplicable to the development at 9229 Wilshire Boulevard.
Even if we set aside the fact that the development is a builder’s remedy project, the HAA still constrains the City’s discretion to fail to make the local findings. The required findings for the Development Plan Review are largely subjective, involving consistency with subjective general plan standards, the general welfare of the City, or involving subjective judgement of 2201 Broadway, PH1, Oakland, CA 94612
www.calhdf.org
City officials. The HAA prohibits the City from denying any housing development project on the basis of such subjective findings. A failure to make any of the findings or grant any of the permits for this development would violate the HAA if not accompanied by findings under subdivision (d)(1)-(5).
Objections to Proposed Conditions of Approval
CalHDF also objects to some of the proposed conditions of approval for the project. The City’s authority to condition the approval of the 9229 Wilshire Boulevard development is limited in several ways. First, the City cannot impose conditions that would render the project infeasible. (HAA, subd. (d).) Second, as a builder’s remedy project, 9229 Wilshire Boulevard Drive is not subject to the City’s zoning and general plan standards. The City is not only prohibited from denying the development based on these standards, but it also cannot condition approval on compliance with any zoning or general plan standards. Finally, any exactions imposed on the development through conditions of approval must have a nexus to impacts created by the development, and must be roughly proportional to these impacts, conditions cannot impose costs on the development that are unrelated to the impacted created. (Gov. Code §§ 66000 – 66025; Sheetz v. County of El Dorado, (2025) 113 Cal. App. 5th 113.)
First, many of the proposed conditions would have the effect of imposing general plan or local code standards via conditions of approval:
● Limitation on common outdoor living space hours (Condition No. 13) ● Amplified sound prohibition in common outdoor living space areas, including balconies and the rooftop of the building (Condition No. 14) ● Construction of a 6’-0” tall sound barrier on the north side of the rooftop area (Condition No. 16)
● At least one state-licensed guard shall be on duty at all times (Condition No. 27) The staff report (and proposed Planning Commission resolution) provides evidence that these conditions are an attempt to impose non-objective city code and general plan standards. Beginning on page 15 of the staff report, each required finding for a Development Plan Review is listed, followed by a discussion of whether or not (in the City’s eyes) the finding can be made for the project, and a discussion of how the HAA constrains the city. It is clear from the discussion of the project’s compliance that the relevant condition of approval is being imposed to attempt to force the project to comply with that city code or general plan standard.
Relevant excerpts from the staff report and resolution:
Pages 20-21 of the staff report, with similar language on pages 19-22 of the resolution: “The proposed plan is consistent with the general plan and any specific plans adopted for the area.” [BHMC § 10-3-3104(A)]

● “..the project appears to be in conflict with several goals and policies of the City’s General Plan, including LU 1.1 (Scale of the City), LU 2.1 (City Places: Neighborhoods, Districts, and Corridors), LU 2.10 (Development Transitions and Compatibility), LU 3.2 (Fair Share of Regional Housing Needs), LU 5.1 (Neighborhood Conservation), LU 5.7 (Neighborhood Transitions), LU 12.1 (Functional and Operational Compatibility), LU
12.2 (Building, Parking, Structure, Site Design), and LU 12.3 (Alleys Between Commercial and Residential Uses … Additionally, the orientation of the rooftop deck and pool amenities toward neighboring residential properties would result in direct views into private yards, creating privacy concerns … Based on the foregoing, this proposed project is not consistent with the City’s General Plan and thus, the finding cannot be made that the project is consistent with the General Plan. …” [emphasis added]
proposed plan will not adversely affect existing and anticipated development in the vicinity and will promote harmonious development of the area.” [BHMC § 10-3-3104(B)] ● “... The hotel component is also inconsistent with the development pattern, as hotel uses are not permitted on sites where an alley is the only separation from adjoining residentially zoned properties. This proximity would introduce potential privacy, light, and noise impacts to the nearby residential neighborhood. Additionally, the orientation of rooftop amenities, including the pool and deck areas, toward adjacent residential properties would result in direct views into private yards, exacerbating privacy concerns. Based on the foregoing, the proposed project would appear to adversely affect existing and anticipated development in the vicinity of the project site and would not promote harmonious development of the area. Thus, this finding cannot be made; however, in light of the issues presented in this finding, the project has been conditioned to address the above noted impacts.” [emphasis added] Pages 22-23 of the staff report, with similar language on pages 19-23 of the resolution: “The nature, configuration, location, density, height and manner of operation of any commercial development proposed by the plan will not significantly and adversely interfere with the use and enjoyment of residential properties in the vicinity of the subject property. [BHMC § 10-3-3104(C)]
● “The proposed height, stories, lack of a rear setback, and lack of landscaping or screening along the alley create visual and privacy concerns with the one- and twostory single-family residences located across the alley to the north. The orientation of rooftop hotel amenities, including the pool and deck, toward the north would result in direct views into private yards, further diminishing privacy. Additionally, the nature of hotel activity, including late-night guest circulation, valet operations, and loading along the shared alley would generate noise, light, and operational 3 of 6
disturbances inconsistent with the residential neighborhood immediately to the north of the project site. Based on the foregoing, the proposed project would appear to adversely interfere with the use and enjoyment of residential properties in the vicinity of the project site. Thus, this finding cannot be made; however, in light of the issues presented in this finding, the project has been conditioned to address the above noted impacts.” [emphasis added]
Pages 23-24 of the staff report, with similar language on pages 19-25 of the resolution: “The proposed plan will not be detrimental to the public health, safety or general welfare.” [BHMC § 10-3-3104(E)]
● “… The proposed hotel component, which would operate on a 24-hour basis introduces lighting, activity, and noise incompatible with the residential uses immediately to the north. The orientation of rooftop hotel amenities, including the pool and deck, toward nearby residences further increases privacy and noise concerns, affecting the general welfare of neighboring properties. Based on the foregoing, the proposed project appears to be detrimental to the general welfare and thus, this finding cannot be made.” [emphasis added]
proposed location of any such use will not be detrimental to the adjacent property or to the public welfare..” [BHMC § 10-3-3800(B)].
● The proposed 14-story, 162’-5” tall mixed use building, which includes residential, retail, and hotel uses, is located immediately south of single-family residential properties separated only by an alley. The project’s height, number of stories, lack of a rear setback, and lack of landscaping and screening along the alley create visual and privacy concerns for the single-family residences located across the alley to the north. The orientation of rooftop amenities, including the pool and deck, toward the north would result in direct views into private yards, reducing privacy. Further, the nature of hotel activity, including late-night guest circulation, valet operations, and loading along the shared alley, would generate noise, light, and operational disturbances that are inconsistent with the residential neighborhood immediately to the north of the project site. Based on the foregoing, the proposed location appears to be detrimental to the adjacent property and public welfare, however, this is not a basis for denial of the project. In light of the issues presented in this finding, the project has been conditioned to address the above noted impacts.
The City is imposing conditions of approval that force the project to at least partially comply with City Code sections 10-3-3104, 10-3-2862, and 10-3-3800 as well as various general plan standards. As discussed supra, the HAA forbids the City from applying its code or general plan standards to the project. Applying these standards via conditions of approval is unlawful.
4 of 6
Proposed Condition 11 also seeks to impose local zoning requirements found in the City’s inclusionary housing ordinance on the project, in violation of the builder’s remedy. (Gov.
Code, § 65589.5, subd. (d)(5).) “An inclusionary housing agreement which includes provisions and terms for meeting the requirements of the City’s inclusionary housing requirements shall be approved by the city manager and city attorney and recorded as a deed restriction against the property prior to issuance of either a grading or building permit, whichever comes first.”
Second, several of the proposed conditions would have the effect of deferring the project’s approval to a later stage and/or giving the City discretion to impose requirements that would be inconsistent with the HAA.
Proposed Condition 3 gives the Planning Commission unilateral authority to “impose additional conditions as necessary to mitigate any other unanticipated impacts caused by the Project as they arise.”
● This proposed condition is inconsistent with the HAA, as it allows the City to impose local standards on the project. (Gov. Code, § 65589.5, subd. (d)(5).) Proposed Condition 5. “The Applicant shall provide an updated rooftop operations plan to comply with Project conditions. The updated rooftop operations plan shall be subject to the approval of the Director of Community Development or their designee.” ● As discussed supra, the imposition of local standards via conditions of approval is unlawful under the HAA. (Gov. Code, § 65589.5, subd. (d)(5).) Proposed Condition 6 “Prior to the issuance of building permits, the design, materials, and finish of the building and landscaping shall be subject to the City’s architectural review process.”
● The City’s Architectural and Design Review Commission has no authority to impose local standards on the project, as such standards are forbidden by the HAA. (Gov.
Code, § 65589.5, subd. (d)(5).) Furthermore, the City may not disapprove the project for non-objective reasons. (Gov. Code, §§ 66300, subd. (b)(1)(C); 65589.5, subd. (j)(1)(a).) Proposed Condition 7. “The property shall not be eligible for participation in the City’s Residential Parking Permit Program, or any other City-established parking program..” ● As discussed supra, the imposition of local standards via conditions of approval is unlawful under the HAA. Furthermore, section 7-3-201 of the City code, which governs the residential parking program, allows residential or multifamily buildings to participate in the program. This condition of approval punishes the future residents of this building for no valid public purpose. Further, if the City only applies this condition to residents of Builder’s Remedy projects, it is a violation of the HAA (Gov. Code, § 65589.5, subd. (f)(6)(E)) and likely a violation of state fair housing law, as 5 of 6
low-income residents are a protected class in California (see Gov. Code, §§ 8899.50 and 65008, subs. (a)(3), (b)(1)(C), and (b)(2)(B)).
The Project is Entitled to a Statutory CEQA Exemption
The project is eligible for an exemption from the provisions of the California Environmental Quality Act (“CEQA”) pursuant to AB 130 (Pub. Res. Code, § 21080.66), which was signed into law on June 30, 2025 and was effective immediately (Assembly Bill No. 130, 2025-2026 Regular Session, Sec. 74, available here). Caselaw from the California Court of Appeal affirms that local governments err, and may be sued, when they improperly refuse to grant a project a CEQA exemption or streamlined CEQA review to which it is entitled. (Hilltop Group, Inc. v.
County of San Diego (2024) 99 Cal.App.5th 890, 911.)

From: Ellen Sherwood, resident of 100 block Maple Drive I’ve lived in Beverly Hills since 1946 and appeared several times before other City Councils. Council members I remember were residents who donated a few years of public service while conducting successful careers, to which they returned when their term of service was over. Council decisions always showed balanced representation of both sides, and a focus on keeping the character of the city, and insuring the welfare of residents and business here. Last week I was gratefully reminded of the high quality Commissioners I remember when Planning Commissioner Gary Ross did his homework and revealed how one Builder’s Remedy monstrosity fell far short of meeting State requirements and that’s a low bar. We sincerely thank him! The Builder’s Remedy law that threatens the character and livability of our city has befallen us because our council failed to submit an adequate housing expansion plan to the state. Who knows why the Council submitted one failed plan after the other, its as if they didn’t want to commit. But the sad consequences are that residents and businesses here were left powerless when greedy, exploitive developers rushed in to devour parts of the city, like cancers devouring healthy tissue. They presented with impunity grossly out of scale buildings, most of which looked purposely designed to ruin the character, safety and architectural integrity of the neighborhood they were forced into.
These parasites love to feign altruism, and spew statements like “you’re against housing for the poor” to anyone who disagrees with their mission of greed and community destruction, They love to virtue signal, and accuse others, while shamelessly showing floor plans that relegate poorer residents to the worst units in the building, segregating them on a single floor or side of the building well away from richer tenants. They create a ghetto, housed in a grotesque and dangerous building. Why dangerous? Because Planning Commission revelation showed that one overbuilt structure with its massive footprint would interfere with adequate access for fire trucks and emergency
vehicles. What soulless, amoral phonies these developers are.
That is what’s so heartbreaking is seeing our city’s descent into impending degradation caused by a lost City Council, beset by inertia when action on housing was essential, thereby leaving us victims of morally lost, soulless developers who, like the old cliche, are driven by greed. And, when we see their obvious plans to destroy beauty, safety, and community... perhaps spurred by some long buried envy and resentment.

Matter: 9229 Wilshire Blvd.
We are here today because a few years ago CA state government passed an unjust housing law that is making our lives miserable. We are also here because our city’s Planning Commission and City Council did nothing to fight this unjust law until earlier this month.
The law is unjust because it allows buildings several hundred feet high to be built on lots surrounding and next to our residental homes. These monster buildings will destroy our privacy, clog our streets, fill our sidewalks with strangers, increase crime and trample our right to the pursuit of happiness.
The builders of these monster buildings walk in here wearing righteous crowns claiming that the purpose of their buildings is to provide housing for the poor; that they are the champions of the poor. Oh really! Let’s examine how the builders of the proposed 9229 building are championing the rights of the poor. This is what I learned from their proposed 8 story building because I could not find their plans for their 14 story Builders Remedy building. But, their plans for the 8 story structure reveal the sincerity of their righteous claim of championing the poor. For starters, the state law requires them to have a minimum of 10% of the units reserved for very low rent units. Well, the builders just reached the minimum of reserving 6 out of 56 units for the poor. Hitting the bare minimum for the poor is well below justification of their righteous crowns. What’s more, the builders placed 5 of the 6 very low rent units on the second floor, which is the lowest floor with housing units in the building. That floor has to absorb all the traƯic noise from Wilshire Blvd. and the alley that all vehicles coming and going from the building must use. Again, this is no sign of caring for the poor. Instead, it is a sign of stigmatizing and ghettoizing the poor by squeezing nearly all of them together on a single undesireable floor. The only remaining very low rent unit is on the east end of the 3rd floor, just a little above the driveway where all traƯic entering or leaving the building must pass. Who would want to live there? The truth is, these builders could care less about the poor. They only care about how they can use the poor to enrich themselves. Surely, there must be state laws that protect the poor against this abuse and are strong enough to at least challenge or neutralize the state law that created the Builders Remedy nightmare.
My congratulations to Gary Ross and his team who earlier this month in the Burton Way case heard our cries and found state laws that could challenge or neutralize the Builders Remedy law. My congratulations also to the 4 Planning Commissioners who voted in favor of what Ross proposed. It took courage to challenge the hapless BH city attorneys who claimed over and over again that the city had no choice but to give in to the dark voices of the builders and state government. It has been disheartening to those of us living on North Maple Drive how Planning Council members not only refused to fight for us in the last couple of years but one member last year actually praised the 9229 builder’s plans while we were in this room and after we had spoken of our unanimous opposition to the building.
He was clueless and heartless to the fact he was supposed to represent the residents of this city and not someone else.
In closing, I ask you to represent the people of this city and find a way to disapprove the builder’s plan for the 14 story building at 9229 Wilshire Blvd.
Thank You

REMOTE DRIVER WIRED IN SERIES
Often referred to as series wiring the current in a series circuit follows one path from start-to-finish with the positive of the second LED connected to the negative of the first. Series wiring allows a single driver to be mounted remotely, powering a number of series fittings. Often the most simplest of wiring schemes as each fitting is connected to the next in a daisy chain. It removes the need for a smaller 12 volt driver in each fitting.
INTEGRAL DRIVER + TRANSFORMER
In a parallel circuit all the positive connections are tied together and back to the positive output of the LED driver and all the negative connections are tied together and back to the negative output of the driver. The integral driver option allows LuxR fittings to be wired in parallel to existing or new installations where a wire wound or magnetic transformer is being used.
M1 HALO
The M1 luminaire range is powered by a 1 watt LuxR light engine that offers a wide choice of LED colours. The luminaire was developed to meet the challenge of delivering high
quality practical accent lighting with maximum energy
efficiency and a long, maintenance-free life.
All LuxR luminaires offer a replaceable LED system using Cree LED chips for maximum performance and long life.
Precise LED binning by Cree ensure the same colour
temperature across all our luminaires which allows LuxR products to be situated close to one another without the fear of colour variance in the colours.
This luminaire is extremely tough, durable and waterproof, making it ideal for installation in public spaces, large-scale projects and residential areas.
RECOMMENDATIONS
If you are unable to spike this luminaire into gardens or along side paths you can specify this product with a surface mount flange. This allows the user to mount the luminaire where it is not possible to spike it in, such as concrete.

Joan Gaspar
The striking, industrial shapes in the Soho collection are reminiscent of the lamps that were traditionally used in markets and taverns, but they contrast through the use of thoroughly contemporary materials and textures.
It is made from rotation-molded polyethylene, a technique that allows us to offer it in different sizes.
