RECOMMENDATION
Staff recommends that City Council accept the described contract work by PALP Inc.
DBA Excel Paving Company (Excel Paving) and authorize the City Clerk to record the attached Notice of Completion.
INTRODUCTION
This report provides information to City Council for acceptance of the contract work in the final amount of $3,110,906.30 and authorization for the recordation of the Notice of Completion with Los Angeles County Recorder by the City Clerk.
DISCUSSION
The City of Beverly Hills operates and maintains water utility infrastructure throughout the City and in portions of West Hollywood. Ongoing maintenance and repair of the utility infrastructure requires the periodic removal of small areas of street pavement and sidewalks in the public right-of-way to access the utilities. This project provided permanent pavement restoration related to water infrastructure in Beverly Hills and West Hollywood.
Over the three-year contract duration, Excel Paving has successfully repaired more than 60 locations in West Hollywood and 260 locations in Beverly Hills with an approximate

64,000 total square feet repaired. Excel Paving also provided emergency pavement repair services at multiple locations, including North Hillcrest Road and Laurel Way.
City Council originally awarded this contract to Excel Paving on April 12, 2022, in the amount of $1,377,600 base contract with $137,760 in contingency. Amendment No. 1 to the contract was approved by City Council on November 7, 2023, in the amount of $429,000. Amendment No. 2 to the contract was approved by City Council on November 7, 2024, in the amount of $484,000. City Council also approved a change purchase order to Excel Paving on March 21, 2023, in the amount of $700,000 to reconstruct North Hillcrest Road after a water main break. The total contract amount to date with all amendments and contingency is $3,128,360.
Excel Paving Company was issued a notice to proceed on August 01, 2022, and construction substantially completed on December 20, 2025. Engineering Division personnel inspected all the work and are satisfied that the work was completed in accordance with the contract documents approved for this project.
FISCAL IMPACT
The amended construction contract purchase order, including a 10% contingency, was $3,128,360.00. The final amount for the completed work is $3,110,906.30; $2,955,360.99 has been paid to date with retention balance of $155,545.31 due to be paid 35 days after the recordation of the Notice of Completion. The purchase order balance of $17,453.70 will be returned to CIP No. 00195 – Water Enterprise.
