Subject: AWARD OF A CONTRACT TO WESTERN STATE BUILDERS, Meeting Date: February 11, 2026
INTRODUCTION
The existing 12,400 SF playground was built in the 1980’s as part of La Cienega Park re-development. It is the last playground in the City with sand surfaces, and play equipment was last replaced in 2007. La Cienega Park Playground renovation was identified as a Council priority, and staff were tasked with conducting community outreach to collect stakeholder’s input. In the fall of 2024, the City received over 570 responses to an on-line survey, and a program for renovation of the playground was developed in a direct response to community feedback received.
DISCUSSION
The landscape architectural firm of Mark Tessier (MTLA) prepared the conceptual design for the playground renovation. The improvements include two distinct play areas:
the little kids play zone is comprised of age 2-5 play structure components, nature themed springers, and parent and child swing seats. The older kids’ play zone is for ages 5-12 and consists of a variety of elements, including a slide, swings and rotating swivel play platforms. The two sections are separated by a symbolic “riverbed” concept of oversized concrete pebbles, which lead to a story time/performance stage, allowing for potential outdoor youth programming. The playground is surrounded by perimeter fencing and three points of entry secured by gates; a landscaping belt with seating areas and shade trees shape the periphery of the playground; the play areas are shaded by large spans of sail shades; and selective areas are furnished with rigid, spherical shade components. The design was presented to the Recreation & Parks Commission (RPC) on March 25, 2025, and to the Recreation & Parks Council Liaison on May 22, 2025.
Staff were directed to continue with the design development phase. Updated documents were prepared and presented to the RPC on August 26, 2025, and to the full Council on September 16, 2025. With City Council’s unanimous approval, bid documents were prepared.
While the bid documents were being prepared, including the plans and specifications by MTLA, a California licensed architecture firm, the City used a prequalification/qualified bidders process following State guidelines to obtain bids from experienced general contractors. A Request for Qualifications was advertised in the local Beverly Hills newspapers and construction trade publications, as well as the PlanetBids portal. The Prequalification Package was posted to the PlanetBids portal. Six companies submitted their qualifications on November 14, 2025, as follows: R E Schultz, JPB Designs, Inc., Micon Construction, Western State Builders, Inc., Environmental Construction, Inc., and Klassic Engineering & Construction.
Klassic Engineering & Construction and JPB Designs, Inc., did not meet the minimum qualification requirements. As a result, four companies were qualified to bid on the La Cienega Park Playground Renovation project.
Bid documents were distributed to the pre-qualified contractors on December 15, 2025.
Three companies attended the mandatory pre-bid meeting.
Three bids were received on January 16, 2026.
To control costs of the project, the bid documents include three alternate costs, four unit costs, and one allowance line item as follows:
Meeting Date: February 11, 2026
Alternate No. 1: Provide a Decuctive Alternate if mounds on the north-east (grid lines E1 & N3) and north-west (grid lines N1 &W1) are eliminated and replaced with flat pour in place rubber.
Alternate No. 2: The Base Bid includes installation of owner furnished Gametime swings equipment; provide an additive alternate cost for for the contractor to also furnish Gametime Equipment.
Alternate No. 3: Provide an additive alternate cost for eight (8) 6’-0” module picket fence.
Unit Price #1 – PILLOW BENCHES, For deductive or additional bench units Unit Price #2 – SITE DRAINAGE,The Base Bid shall include Site Drainage as depicted in Civil drawings, provide a line item cost for this item.
Unit Price #3 – SOMA STONE M, For deductive or addional stones Unit Price #4 – DISC UMBRELLA, For deductive or addional stones Basis of Selection
The bid documents specify that the low bid is determined by the sum of the base bid, plus all the alternates, plus unit costs, plus the amount of per diem for compensable delay cost for twenty (20) days.

Note: Unit Price #2 is included in the base bid.
Bid results were shared with all pre-qualified contractors; the second low bidder submitted a protest letter citing the low bidder’s failure to list a fencing subcontractor due to the cost being over one-half percent (0.5%) of the total bid amount as required by Public Contract Code Section 4100. After reviewing the bids and contacting the lowbidder, Western State Builders, Inc., they confirmed that they did not list a sub-contractor since they will be self-performing that portion of the work with their own licensed forces.
Staff has determined that Western State Builders, Inc. is the lowest responsible bidder, has submitted a responsive bid, and maintains a Class A General Engineering Contractor and a Class D-34 Specialty licenses that are current and in good standing with the Contractors State Licensing Board. References have confirmed that Western State Builders, Inc. has successfully performed similar type projects in the past.
Meeting Date: February 11, 2026
Therefore, staff recommends that City Council approve an agreement with Western State Builders, Inc. for this work.
The bid documents specify that all work under the contract shall be completed within 105 calendar days from the date of the notice to proceed, resulting in an estimated completion in early Summer 2026.
A contingency of $179,831.00, 12% of the contract amount, is recommended for changes due to unforeseen conditions in order to successfully complete the work.
Expenditures from the contingency will be made utilizing the Change Order process in the Beverly Hills Municipal Code upon adequate written justification and substantiation.

ENVIRONMENTAL REVIEW
Approval of the La Cienega Park Playground Renovation project was assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines and the environmental regulations of the City. Staff believe the approval of the proposed improvements is exempt from CEQA pursuant to the ‘Existing Facilities’ Section 15301 of Title 14 of the California Code of Regulations because the work involves no expansion of use within the existing park facility. Based on the foregoing, staff recommend that City Council find that the project is exempt from CEQA pursuant to CEQA Guidelines Section 15301 Existing Facilities.
FISCAL IMPACT
The $1,678,430 for this project is available in CIP #00343, Fund 160 – La Cienega Park Facilities Renovation. No additional funding is requested at this time.

Director of Public Works
