AGENDA REPORT
Meeting Date: March 4, 2026
Item Number:

To: Honorable Mayor & City Council
From: Daren Grilley, Assistant Public Works Director/City Engineer Christine Chung, Project Manager
Subject: DENY REQUEST FROM METRO FOR A WAIVER OF THE PURPLE LINE - SECTION 2 MEMORANDUM OF AGREEMENT HOLIDAY

MORATORIUM FOR SEVEN DESIGNATED HOLIDAYS BETWEEN
MAY 2026 TO MID-NOVEMBER 2026
Attachments: 1. Metro Holiday Moratorium Application

RECOMMENDATION
Staff recommends that City Council (1) review the Los Angeles County Metropolitan Transportation Authority’s (Metro) request for a waiver of the holiday moratorium; and (2) deny the waiver request.

INTRODUCTION
The Memorandum of Agreement (MOA) with Metro for Section 2 – Beverly Dr Station located under Wilshire Boulevard from Beverly Drive to Crescent Drive outlines allowable work hours and days in Article XIII. This agreement includes designated holiday moratorium dates during which no work is permitted. The MOA allows Metro to apply for a permit to waive the holiday moratorium with City Council holding sole discretion to review, approve, or deny the request.

On January 22, 2026, the City received an application from Metro (Attachment 1) to work during the following seven (7) holiday moratorium dates in 2026:
 Mother's Day – Sunday, May 10, 2026
 Memorial Day – Monday, May 25, 2026
 Father's Day – Sunday, June 21, 2026
 Independence Day (observed) – Friday, July 3, 2026
 Next Night Block Party (if scheduled)
 Labor Day – Monday, September 7, 2026
 Veteran's Day – Wednesday, November 11, 2026

DISCUSSION
Metro’s Holiday Moratorium Waiver Request
Metro and its contractor, Tutor Perini Corporation / O&G (TPOG), request a waiver of the holiday moratorium to continue station construction and street restoration work along Wilshire Boulevard between Beverly Drive and Crescent Drive. Metro indicates that restricting work during these dates could slow or delay station construction.

Current and Future Work and Site Conditions
Metro continues construction of the Purple (D) Line Extension – Beverly Dr Station, including underground station construction and surface street restoration.

To accommodate construction of multiple appendages (station side structures) and sidewalks, K-rail barriers and fencing are currently in place along both sides of Wilshire Boulevard between Beverly Drive and Crescent Drive. These measures protect motorists and pedestrians while maintaining two travel lanes in each direction since April 2025.

North Cañon Drive at Wilshire Boulevard is scheduled to reopen by mid-March 2026. Left turns are permitted at Beverly Drive and Crescent Drive but remain restricted at South Cañon Drive. Utility and sidewalk restoration along Wilshire Boulevard is anticipated to conclude by fall 2026. K-rail barriers will be removed in phases to ultimately restore three travel lanes in each direction, including all left-turn lanes.

Beginning in fall 2026, multiple curb ramps along Wilshire Boulevard between Camden Drive and Beverly Drive will be replaced to comply with current ADA standards. Following completion of ramp improvements and punch list items, Wilshire Boulevard is tentatively scheduled to be paved between Camden Drive and Rexford Drive in early 2027.

Work Allowed During Moratorium
Under the MOA, Metro is permitted to continue 24/7 work within staging yards and underground areas during the holiday moratorium. Temporary traffic control requests for maintenance or emergency work will be reviewed by City staff on a case-by-case basis with advance notice. City staff will continue to provide oversight to ensure safety and compliance with the MOA.

Staff Review and Recommendations
The waiver request does not adequately demonstrate how permitting work during the identified holidays would benefit the public or reduce the overall construction schedule.

The contractor typically does not work on Sundays (Mother’s Day and Father’s Day) or on labor union holidays, which comprise the majority of the requested dates. Therefore, staff recommends denying the holiday moratorium waiver request to avoid imposing an unnecessary burden on residents, businesses, and travelers.

City Council Ad Hoc
On February 19, 2026, City staff emailed the Metro Ad Hoc Committee, which includes Mayor Nazarian and Councilmember Friedman, regarding Metro’s request. Based on minimal benefits to the community, the staff recommended to deny the request at the City Council Meeting scheduled for March 4, 2026.

Meeting Date: March 4, 2026

Community Engagement
On February 13, 2026, the City emailed its contact database, including stakeholders near the construction area, regarding the City’s recommendation to deny the request at the City Council meeting scheduled for March 4, 2026. This agenda item was also posted on the City’s website. No public comments or inquiries were received.

FISCAL IMPACT
There is no direct fiscal impact associated with approving or denying this request. The terms of the MOA include provisions for Metro to reimburse costs for all staff and consultants performing work associated with design-build construction activities of the Purple Line Extension – Section 2 in Beverly Hills.
