RECOMMENDATION
It is recommended that City Council approve Amendment No. 2 to the Agreement between the City of Beverly Hills and Mark Tessier Landscape Architecture, Inc. for landscape architectural services for La Cienega Park Playground Renovations and approve a change purchase order for $31,900 for additional services to include construction administration. The total compensation for all services under this agreement will now include the original fee of $42,240, Amendment No. 1 for $42,602, and additional Amendment No. 2 for $31,900, bringing the total not-to-exceed amount to $116,742, inclusive of reimbursable expenses.
INTRODUCTION
The existing 12,400 SF playground was built in the 1980’s as part of the La Cienega Park re-development. It is the last playground in the City with sand surfaces, and play equipment was last replaced in 2007. The La Cienega Park Playground renovation was identified as a Council priority, and staff were tasked with conducting community outreach to collect stakeholder input. In the fall of 2024, the City received over 570 responses to an on-line survey, and a program for renovation of the playground was developed in a direct response to community feedback received.

Meeting Date: March 24, 2026
DISCUSSION
The landscape architectural firm of Mark Tessier (MTLA) prepared the conceptual design for the playground renovation. The improvements include two distinct play areas.
The little kids play zone is comprised of age 2-5 play structure components, nature themed springers, and parent and child swing seats. The older kids play zone is for ages 5-12 and consists of a variety of elements, including a slide, swings and rotating swivel play platforms. The two sections are separated by a symbolic “riverbed” concept of oversized concrete pebbles, which lead to a story time/performance stage, allowing for potential outdoor youth programming. The playground is surrounded by perimeter fencing and three points of entry secured by gates, a landscaping belt with seating areas, and shade trees shape the periphery of the playground. The play areas are shaded by large spans of sail shades, and selective areas are furnished with rigid, spherical shade components.
The design was presented to the Recreation and Parks Commission (RPC) on March 25, 2025, and to the Recreation & Parks Council Liaison on May 22, 2025. Staff were directed to continue with the design development phase. Updated documents were prepared and presented to the RPC on August 26, 2025, and to the full Council on September 16, 2025. With City Council’s unanimous approval, bid documents were prepared and issued for bidding, bids were received and the construction contract was awarded to the lowest responsible bidder on February 11, 2026.
The original agreement with MTLA, executed under Contract No. 539-23, outlined a comprehensive scope of work focused on preparing design, design development and construction documents as well as support during the bidding process for the renovation of the La Cienega Park Playground. The initial contract was valued at $42,240, which encompassed professional services and reimbursable expenses. An amendment to the contract was executed for additional services to include civil engineering, structural engineering, and additional architectural scope; Amendment No. 1 was valued at $42,602.
With the start of construction of the new playground, the services of MTLA are needed for construction administration services to address unforeseen complexities during the construction phase. The inclusion of construction administration services is critical to maintaining project continuity and ensuring that the design intent is accurately executed during construction. Amendment No. 2 expands MTLA’s role with services involving attending construction meetings, responding to requests for information (RFIs), reviewing submittals, conducting site visits, compiling punch lists, and preparing as-built documentation. These services will support the City in achieving a successful completion of the La Cienega Playground Renovation Project.
The fee proposal for the construction administration services totals $31,900. Should City Council approve a request to proceed with this Change Purchase Order, the total fee under the original Agreement, Amendment No. 1 and Amendment No. 2 is therefore a total not-to-exceed fee of $116,742.
Meeting Date: March 24, 2026
FISCAL IMPACT
The $116,742 for this contract is available in CIP #00343, Fund 160 – La Cienega Park Facilities Renovation. No additional funding is requested at this time.
