RECOMMENDATION
Staff recommend City Council approve the recommendation of the Liaison Branding and Licensing Committee, Vice Mayor Wells and Councilmember Nazarian, to approve the use of the Beverly Hills Shield by Jet Set Candy and enter into an agreement for the use of the Beverly Hills Shield by Jet Set Candy for jewelry charms.
INTRODUCTION
The City periodically receives inquiries about the use of the trademarked Beverly Hills City Shield as well as notification when a business has been utilizing the shield without a license. In the latter case, the City typically requires the business that has been using the City Shield without authorization to pay a settlement, in addition to licensing fees for future use.
On January 22, 2026, the City Council Liaison/Branding and Licensing Committee, which is comprised of Vice Mayor Wells and Councilmember Nazarian (Liaisons), reviewed a

The City Council Liaisons recommended that the City Council approve both the proposed use of the City Shield, and the terms of the settlement agreement.
DISCUSSION
Background
Staff receives inquiries from individuals and businesses looking to use the trademarked Beverly Hills Shield on products and merchandise. As requests are received, they are referred to the City’s branding and licensing consultant CMG Worldwide (CMG). The City has contracted with CMG Worldwide since 2013.
Jet Set Candy is a jewelry brand offering a range of travel-inspired designs in sterling silver, gold vermeil, solid gold and enamel. Their assorted merchandise includes charms, bracelets, necklaces, pendants and rings, some of which feature the City Shield. The brand concept is built around the idea of a “wearable passport,” allowing customers to celebrate their travels and keep memories close. Their collections broadly feature iconic landmarks, travel symbols, and place-based motifs, including representations of cities and destinations, as well as travel related imagery. Many pieces are designed to be collected and layered.
Their primary focus is travel retail, with distribution primarily online and through duty-free and travel-related retailers globally. This includes a flagship location in Grand Central Terminal and airport locations at John F. Kennedy International Airport, a planned expansion at Los Angeles International Airport in 2026 (merchandise is currently offered at other retailers, located in in Terminals 3 and 4), and partnerships with cruise ships and other travel related retailers. They also offer the charms wholesale.
Jewelry Charm Collection
The City Shield has been a part of their travel charm collections for the past 11 years. It features a charm that can be worn on a chain or bracelet and is meant to be a collectible for those who travel to iconic destinations such as Beverly Hills. Until now, Jet Set Candy had not received authorization from the City to use the City Shield in its merchandise.
While revenues to date have been moderate, Jet Set has indicated that they see meaningful opportunity to expand the Beverly Hills brand and focus efforts on establishing and growing their retail presence in Los Angeles, including a potential collaboration with the Beverly Hills Hotel.
They offer both a full size and mini charm of the Beverly Hills Shield, in sterling silver, gold vermeil, and solid gold. Staff noted to the Liaisons that the current jewelry charm designs feature a slight modification to the City Shield – the trademark “swirls” have been removed from the bottom of the City Shield, and the bottom of the City Shield is flat, rather than pointed (full design in Attachment 1). Understanding that the retailer would have difficulty maintaining the swirls at such a small size, the Liaisons were in support of the current design, as it still preserves the appearance of the Beverly Hills shield design.
Approved Terms
Under the agreement terms recommended by Liaisons, the City will receive a one-time, non-refundable settlement, and license advance fee, of $5,000 total. $3,000 of the $5,000 total is a nonrefundable advance recoupable against royalties earned by the City during Meeting Date: May 19, 2026
the Term of the Agreement. This means that even if the City does not earn $3,000 in royalties during the Term, it will still be entitled to keep the $3,000 minimum amount. The City will additionally receive royalties of 12% of all sales (retail and wholesale) for 3 years following execution (Attachment 1) in excess of the $3,000, which CMG will track with Jet Set Candy. Per Liaison direction, there would be an option to extend this agreement administratively at the end of the initial 3-year period.
FISCAL IMPACT
Agreement terms including any advance and royalties are listed above, and appear in the attached, partially-executed agreement.

WHEREAS, Licensor asserted that Licensee infringed upon the Property in connection with the sale and promotion of no more than two hundred and fifty-five (255) gold, vermeil, and silver charms over the past eleven (11) years from October 2014 through August 2025 through Licensee’s retail and wholesale channels throughout the United States (the “Past Use”).

WHEREAS, Licensor agrees to settle all currently existing claims directly related to the Past Use and to grant Licensee the license to utilize the Property upon the terms and conditions set forth below.
WHEREAS, CMG is the licensing agent of the Licensor in connection with licensing the Property.
NOW, THEREFORE, in consideration of the mutual promises and undertakings herein contained and for other good and valuable consideration, intending to be legally bound, the Parties agree as follows:
TERMS
1. Settlement and Release.
(a) Licensee warrants and represents to Licensor that prior to this Agreement, it sold no more than $16,380 in total revenues from the Past Use utilizing the Property. (b) Licensee represents and warrants that the above disclosed use is the full and complete extent of such Past Use, and Licensee has not sold any other products utilizing the Property. Licensee agrees that a breach of this paragraph shall be a material breach of this Agreement. Licensee agrees that it shall not utilize the Property in any manner whatsoever, other than as authorized under this Agreement, without first receiving written permission from Licensor.
(c) In exchange for Licensee’s warranties, indemnifications, and payment of the Settlement Fee (as defined below), Licensor hereby releases Licensee and its officers, shareholders, employees, agents, parents, subsidiaries, affiliates, distributors, wholesalers, retailers, successors, predecessors, and assigns from claims, demands, actions or causes of action directly related to the Past Use of the Property (“Existing Claims”). Notwithstanding the foregoing, Licensor and Licensee agree that the release granted herein does not release Licensee from claims, demands, actions, or causes of action that arise from or relate to the acts or omissions of Licensee occurring after the Effective Date of this Agreement or that are in breach of the terms of this Agreement. Further, the release set forth in this paragraph does not include a release of any agreements, rights, or obligations created in this Agreement.

giveaways, or to be disposed of under similar methods of merchandising. In the event Licensee desires to manufacture, sell or distribute Goods for such purposes, Licensee acknowledges and agrees that it must first seek and obtain a separate license from Licensor, and that the user thereof must also obtain a separate license from Licensor for such use of Goods. Furthermore, Licensee specifically agrees and acknowledges that making, using, distributing, and/or selling any unauthorized goods, articles, and/or promotional materials which use any aspect of the Property, including any variety of elements of Property's likeness, is an infringement of the Property that may result in serious damages, dilution, and tarnishment to the integrity, distinctiveness, and value of the Property, and will constitute material breach of this Agreement. Licensee shall neither contest nor object to immediate termination of this Agreement, and/or the injunctive relief against manufacture, use, and/or sales of any such goods, articles, and/or promotional materials. "Premium" shall mean any article used for the purpose of: increasing the sale of another item; promoting or publicizing any product or service; fundraising or as giveaways; to motivate a sales force, merchant, consumer, or any other person to perform a specific act.
3. Consideration.
(a) Settlement Fee. As full and final settlement of all Existing Claims Licensor may have against Licensee arising from the Past Use, Licensee agrees to furnish to Licensor ℅ CMG the nonrefundable sum of Two Thousand United States Dollars ($2,000 USD), net of taxes and fees, as a settlement fee (“Settlement Fee”) payable upon execution of this Agreement.
(b) License Fee. As consideration for the license granted under this Agreement, and concurrently with the payment of the Settlement Fee, Licensee shall pay Licensor Three Thousand United States Dollars ($3,000 USD), net of taxes and fees, as a nonrefundable advance recoupable against royalties earned through the Term and payable upon execution of this Agreement. For clarification, the Settlement Fee is separate and shall not be offset by future royalty payments.
4. Payment and Reporting. Not later than the thirtieth (30th) day after the end of each calendar month during the Term and any extension thereof, and thereafter so long as any sales are made by the Licensee pursuant to this Agreement, the Licensee shall furnish to the Licensor a full and complete statement showing the number of Goods which have been sold by the Licensee and the selling price thereof during the preceding month, along with payment of such royalties. An item will be considered to be “sold” when it is ordered and then invoiced or shipped, whichever is sooner. The Licensee shall pay to the Licensor c/o CMG via wire transfer to a bank account specified by Licensor such royalties as the statement indicates are due the Licensor. All payments shall be payable to "CMG Worldwide, Inc." All late payments shall be subject to a two percent (2%) per month (24% annual rate) late processing charge on all such outstanding amounts. This Paragraph shall survive the expiration or earlier termination of this Agreement.
5. Quality. Licensee represents and warrants that it is fully capable of properly and competently designing, manufacturing, and distributing the Goods in accordance with and subject to the strict quality standards and levels demanded by Licensor in connection with the use of the Property. Licensor agrees that it will not at any time do or cause to be done any act or thing impairing or tending to impair any of Licensor’s rights in or to the Property, pursuant to the terms of this Agreement. Licensee acknowledges that if the Goods are of inferior quality in material and workmanship, the substantial goodwill which the Licensor has built up and now possesses in the Property will be impaired. Accordingly, Licensee warrants that the Goods will be of high standard and of such appearance and quality as shall be reasonably adequate and suited to their exploitation and best advantage.
Licensee shall, at no cost to Licensor, submit to Licensor finished samples of all Goods to be manufactured, together with its cartons and containers, including packaging and wrapping material, which shall be approved in writing by the Licensor, in its sole discretion, before the Goods are advertised, distributed or sold. After samples of the Goods have been approved pursuant to this paragraph, Licensee shall not depart therefrom without written consent from Licensor. In the event there is a departure from the approved sample of the Goods, or in the event there is an occurrence connected with the Goods which, in Licensor’s sole discretion, reflect unfavorably upon Licensor, the Licensor shall have the right, in its sole discretion, to withdraw its approval of such Goods, at which time this Agreement shall automatically terminate with respect to such Goods. Thereupon, Licensee shall cease the use of the Property in the sale, advertising, distribution, or use of such Goods immediately upon notice from Licensor; and within ten (10) days thereafter shall pay all amounts due to Licensor hereunder. If there are other Goods under this Agreement not covered or affected by the foregoing two sentences of this paragraph, this Agreement shall remain in full force and effect as to those other Goods. This Paragraph shall survive the expiration or earlier termination of this Agreement.
6. Advertising. All advertisements and promotional material which Licensee intends to use to promote the Goods shall be submitted to Licensor for its written approval prior to publication. Licensor shall have fourteen (14) days from the date of receipt of said material in which to grant or deny approval.
7. Samples. Licensee shall, without cost to Licensor, supply Licensor with ten (10) samples of each of the completed Goods, promptly after completion. Licensor shall have the right to purchase additional samples for its own personal use at the actual wholesale cost of the Goods.
8. Books and Records.
(a) The Licensee shall keep full, complete and accurate books of account and records covering all transactions relating to the subject matter of this Agreement. Licensor shall have the right to examine such books of account and records and other documents and material in Licensee's possession or under its control insofar as they relate to the manufacture and sale of Goods. Licensor shall have free and full access thereto at any reasonable hour of the day during which the Licensee's offices are open and in any reasonable manner. In the event an examination of Licensee's books and/or records reveals a deficiency in royalties paid to Licensor of more than Three Hundred Dollars ($300), Licensee shall pay all expenses related to the performance of the examination and shall immediately pay the deficient amount to Licensor. (b) Licensee shall ensure that all invoices for the purchase of the Goods will include the quantity and description of each of the Goods itemized by version, style, with the name of Property within the invoice item description.
(c) For audit purposes, Licensee must provide the auditor with the details of each period’s reported FOB purchases, to the invoice/credit memo level, in Excel format. Each report must detail the License number, invoice/credit memo number, date, ship to address, product number and description, FOB purchase price, units sold/returned, and royalty rate.
9. Goodwill. Licensee acknowledges Licensor’s exclusive rights in the Property and further acknowledges the value of the goodwill associated with the Property, that the Property and all ultimate rights therein belong exclusively to Licensor, and that the Property is famous and has developed secondary meaning and connotes an image of prestige, quality, and exclusivity in the minds of the public. Licensee agrees that the Property is, and shall remain, the property of Licensor and that Licensee obtains no right, title, or interest in or to the Property except for the limited rights to use the Property as set forth in this Agreement. Licensee acknowledges and agrees that any goodwill generated by Licensee’s use of the Property shall inure exclusively to the benefit of Licensor. Licensee shall not manufacture, market, or sell any confusingly similar unlicensed products that are intended to, or that consumers would reasonably believe to, trade off the goodwill of the Property licensed hereunder. Licensee shall not, during the Term of the Agreement or at any time thereafter, dispute or contest, directly or indirectly, the Licensor’s ownership of the Property; the Licensor’s exclusive right (subject to valid licenses granted by Licensor) to use the Property; the validity of any trademark registrations pertaining to the Property or the Licensor’s ownership thereof, nor shall the Licensee assist or aid others in doing so. At the Licensor’s request the Licensee shall cooperate with the Licensor in preventing or stopping any infringement or unfair use by any third party of the Goods or Property. The Licensor shall determine what action, if any, it elects to pursue in regard to preventing or stopping any infringement or unfair use by any third party of the Goods or Property and shall be under no obligation whatsoever to take action at Licensee’s request.
10. Intellectual Property & Credit Line.
(a) Licensor may apply to register trademarks and claims to copyright for any design incorporating the Property on the Goods and/or the Property as may be reasonably necessary, in Licensor's sole discretion, to protect Licensor's interests. All applications for registration of claims to copyright, where applicable, shall identify Licensor as the copyright owner; and all applications to register trademarks shall identify Licensor as the trademark owner.
(b) If Licensor requires any specimens of the Goods, or any photographic reproductions of the same, for use in filing copyright claims, where applicable, or trademark applications, Licensee shall provide Licensor with the same, at Licensee's expense.
(c) At Licensor's request, Licensee shall execute assignments in favor of Licensor of any and all copyrights, trademarks, or other intellectual property rights of whatever kind relating to the Property without further consideration, and Licensee will, upon the request of Licensor, assign any rights to Licensor, if any, which Licensee may have acquired through its use of the Property. (d) Licensee warrants that it will provide a legally sufficient legal line on the Goods (where possible), and packaging, advertising, and promotional material bearing any reproductions of the Goods or the Property, in the following format:
The Beverly Hills Shield TM is a trademark of the City of Beverly Hills, www.BeverlyHills.org
(e) Licensee warrants that it will provide a legally sufficient trademark notice by prominently displaying the letters ™, if so specified by Licensor, against every occurrence of Property on the Goods, and against every occurrence of the Property on packaging, wrapping, advertising, and promotional material for the Goods.
(f) Licensee warrants that it will take such precautions as are necessary to ensure that any promotional materials for the Goods which utilize the Property made by its customers bear Licensor's copyright and/or trademark notice as provided in Paragraph 10(d) and Paragraph 10(e).
11. Right of Termination. Without prejudice to any other rights, Licensor shall have the right to terminate this Agreement, or a portion thereof, upon written notice to Licensee, at any time that the following may occur:
(a) Licensee makes, sells, offers for sale, uses or distributes any Goods without the prior written approval of Licensor or continues to make, sell, offer for sale, use or distribute any Goods after receipt of notice from Licensor withdrawing approval of the same;
(b) If the quality of the Goods falls below the production-run quality, as approved by Licensor, and if such default continues for a period of five (5) business days after written notice of such default is sent to Licensor to Licensee;
(c) If Licensee fails to comply with the legal notice requirements specified in Paragraph 10(d) and if such default shall continue for a period of five (5) business days after written notice of such default is sent by Licensor to Licensee;
(d) If full and regular production and aggressive marketing has not commenced within five (5) months from the date of this Agreement. Any individual categories of Goods granted in paragraph 2(a) not in distribution throughout the Territory within nine (9) months are subject to revocation of production rights.
If the Goods are out of production for more than three consecutive months, Licensor may terminate the production rights for the particular category of Goods, that particular Good in a particular territory, or terminate the entire Agreement at Licensor's sole discretion; (e) If Licensee shall fail to make any payment due hereunder or to deliver any of the statements herein referred to, and if such default shall continue for a period of five (5) days after written notice of such default is sent by Licensor to Licensee;
(f) If Licensee is involved in any act of bankruptcy or insolvency, then Licensor shall have the right to terminate this Agreement. Notwithstanding the foregoing, Licensor shall, at any time during the Term of this Agreement, have the option of demanding an assurance from Licensee of Licensee's ongoing ability to perform the provisions of this Agreement. Unless reasonable and adequate assurance is received by Licensor from Licensee concerning Licensee's ability to perform, Licensor shall have the right to terminate this Agreement;
(g) If Licensee breaches any of the terms and conditions, agreements or covenants contained in this Agreement, or there is a breach of any representation or warranty made by Licensee in connection with this Agreement and such breach is not curable or, if curable, is not cured within five (5) business days after written notice thereof from Licensor
12. Sales after Expiration. Upon expiration or termination (for whatever reason) of this Agreement, Licensee shall not be permitted to sell, distribute or ship its remaining inventory of Goods following the termination date of this Agreement without the express written consent from the Licensor. The Licensee shall not, without prior written consent of the Licensor, sell or ship any such remaining Goods as distress merchandise, or to unaffiliated third parties for eventual resale, or otherwise than in the ordinary course of business. Licensee shall not stockpile inventory prior to expiration or termination of this Agreement for purposes of sale or shipment thereafter. For purposes of this Agreement, a distress sale shall be defined as one in which the merchandise is sold for less than fifty percent (50%) of the normal wholesale selling price. This Paragraph shall survive the expiration or earlier termination of this Agreement.
13. Rights Reserved by Licensor. Any and all rights in and to the Property which are not expressly granted to Licensee are hereby reserved by Licensor. Any one or more of such reserved rights may be exercised or enjoyed by Licensor, directly or indirectly, at any and all times.
14. Licensor's Claim. Whatever claim Licensor may have against Licensee hereunder for royalties and/or for damages shall become a first lien upon all of said Goods manufactured or produced pursuant to the terms of this Agreement in the possession or under the control of Licensee or its agents upon the expiration or termination of this Agreement.
15. Remedies. All specific remedies provided for in this Agreement shall be cumulative and shall not be exclusive of one another or of any other remedies available in law or equity. Failure of Licensor to insist upon strict performance of any of the covenants or terms hereof to be performed by the Licensee shall not be construed to be a waiver of any such other covenants or terms. Should Licensor be forced to initiate legal action due to Licensee's breach hereof, then all legal costs incurred therein by Licensor shall be recoupable by Licensor.
16. Licensee's Indemnification & Product Liability Insurance. Licensee hereby agrees to be solely responsible for, to defend and indemnify Licensor and its respective officers, elected or appointed officials, agents and employees, and to hold each of them harmless from any claims, demands, causes of action or damages, including reasonable attorney's fees, arising out of the sale, distribution or use of the Goods. Licensee will obtain and maintain product liability insurance at least in the amount of $1,000,000 with a deductible of not more than $10,000 (certificate of which shall be furnished to Licensor) providing adequate protection for Licensor and its respective officers, elected or appointed officials, agents, and employees against any claims, demands, causes of action or damages arising out of any alleged defects in Goods or any use thereof. Such insurance policy shall provide that it may not be cancelled without at least ten (10) days written notice to Licensor.
17. Licensor's Warranty. Licensor represents and warrants to Licensee that it has the power to enter into this Agreement. Should any third party assert a claim, demand, or cause of action against Licensee in relation to Licensee's use of the Property under this Agreement, Licensor hereby agrees to be solely responsible for, to defend and indemnify Licensee and its officers, agents and employees, and to hold each of them harmless from any claims, reasonable demands, causes of action or damages, including reasonable attorney's fees arising out of any such claim, reasonable demands, or cause of action (except to the extent arising from the gross negligence or willful misconduct of the Licensee, its officers, agents and employees). Licensee may, but shall not be obligated to, join in such defense and be represented by its own counsel. If Licensee elects to be represented by its own counsel, Licensee will pay its own attorney's fees. Licensee agrees that, while it may counsel Licensor concerning the disposition of any such action, Licensor shall have the sole and final decision concerning the disposition of any action which involves the Property and has the right to order Licensee to dispose of inventory and all works in progress as it sees fit (at Licensor’s sole cost, including reimbursement for the costs of such inventory and works in progress). Licensor shall also have the right, in its discretion, to institute and prosecute lawsuits against third persons for infringement of the rights licensed in this Agreement. Any lawsuit shall be prosecuted solely at the cost and expense of the Licensor and all sums recovered in any such lawsuits, whether by judgment, settlement or otherwise, shall be retained solely and exclusively by the Licensor. Upon request of the Licensor, the Licensee shall execute all papers, testify on all matters, and otherwise cooperate in every way necessary and desirable for the prosecution of any such lawsuit. Licensor shall reimburse Licensee for all expenses incurred as a result of such cooperation.
18. No Partnership or Joint Venture. This Agreement does not constitute, and shall not be construed to constitute, a partnership, agency, or joint venture between Licensor and Licensee. Licensee shall have no right to obligate or bind Licensor in any manner whatsoever and nothing herein contained shall give or is intended to give any right of any kind to any third party.
19. No Assignment. The license hereby granted is and shall be personal to the Licensee, and shall not be assignable by any action of Licensee or by operation of the law, and any attempt at such assignment shall be null and void. Licensee shall have no right to grant any sublicenses (solely excepting manufacturers from which Licensee buys the Goods, and only to allow manufacturing of Goods for Licensee). This Agreement shall inure to the benefit of and shall be binding upon Licensee's successors and assigns.
20. Notice. Whenever notice is required to be given under this Agreement, it shall be deemed to be good and sufficient notice if in writing, signed by an officer or an authorized agent of the Party serving such notice and sent by telefax, email or mailed with confirmation, to the other Party at the address stated above unless notification of a change of address is given in writing.
21. Entire Agreement. This Agreement contains the entire understanding of the Parties. There are no representations, warranties, promises, covenants, or understandings, whether oral or written, other than those herein contained.
22. Confidentiality. This Agreement and the contents hereof constitute a confidential business relationship between the Parties. Each Party acknowledges that significant damage could be done to the other one should the terms of this Agreement become public knowledge. Both Parties agree that they will not reveal the terms of this Agreement to any third party (excluding agents, attorneys, representatives, and others with whom they have a legal obligation to disclose) and that they will exercise reasonable precautions to ensure that neither they nor their employees or agents shall allow the terms of the Agreement to become public knowledge.
23. Disclaimer. This Agreement in no manner absolves Licensee of its responsibility, if any, to procure legally sufficient permission from the copyright owner(s) of, including without limitation, any photographs, illustrations, and/or artwork, or any other third party intellectual property utilized in conjunction with the manufacture, distribution, and promotion of the Goods. Licensee agrees to indemnify and hold harmless Licensor and its officers, elected and appointed officials, directors, employees, agents, and affiliates from any and all claims made by third parties with respect to materials utilized in conjunction with this Agreement.
24. Construction & Jurisdiction.
(a) This Agreement shall be construed in accordance with the laws of the State of California. (b) Nothing in this Agreement is intended to be contrary to the laws of any country or political subdivision thereof. In the event that any of the paragraphs or particular terms or conditions set forth within any paragraphs are held to be unenforceable by a court of record with competent jurisdiction, such paragraph, or particular term of condition therein, shall be deemed to be stricken from this Agreement within the jurisdiction of such court, and the Agreement shall otherwise remain in full force and effect in such jurisdiction and in its entirety in other jurisdictions. (c) Notwithstanding any present or future legal decisions in any jurisdiction, regarding the necessity of Licensee to be licensed hereunder, Licensee agrees to pay royalties as provided herein for as long as it exploits the Property.
(d) Each Party has cooperated in the drafting and preparation of this Agreement. Hence, this Agreement will be construed neutrally, and will not be applied more strictly against one Party than the other Party.
25. Forum Selection Clause. Both parties acknowledge and consent that any controversy or claim arising out of or relating to this Agreement or the breach thereof, shall be settled within any court located in the State of California, agreeing that any such court would have exclusive jurisdiction over any dispute, case or controversy arising under or in connection with this Agreement, and that such any California court shall be a proper forum in which to adjudicate such dispute, case or controversy. In the event of any dispute or action hereunder, Licensor shall be entitled to recover its reasonable attorney's fees.
26. Multiple Counterparts and Facsimile Signatures. This Agreement may be executed in any number of counterparts, including facsimile counterparts, each of which shall be deemed to be an original, but all of which together shall constitute one and the same Agreement. Signatures conveyed by facsimile transmission shall serve to bind the Parties to this Agreement.
IN WITNESS WHEREOF, the Parties hereto have signed by their duly authorized officers as of the Effective Date. "Licensor" “Licensee”

CITY OF BEVERLY HILLS
POLICY AND MANAGEMENT
MEMORANDUM
TO: City Council Liaison/Branding and Licensing Committee FROM: Magdalena Davis, Community Outreach Manager
DATE: January 22, 2026
SUBJECT: Request for Use of City Shield for Jet Set Candy ATTACHMENT: 1. Jet Set Candy Proposal Deck
INTRODUCTION
This report provides the City Council Liaison/Branding and Licensing Committee of Mayor Nazarian and Councilmember Wells (Liaisons) with an overview of the proposal for settlement and use of the City Shield by Jet Set Candy for a jewelry charm collection. The City periodically receives both inquiries about the use of the trademarked Beverly Hills City Shield, and also receives notice that a business has been utilizing the shield without a license. In the latter case, the City typically requests a settlement in addition to future use.
The City Council Liaisons are requested to review Jet Set Candy’s proposed use of the City Shield, for the attached product designs, as well as the draft negotiated terms of the agreement.
DISCUSSION
Jet Set Candy is a jewelry brand offering a range of travel inspired designs in sterling silver, gold vermeil, solid gold and enamel. Their assortment includes charms, bracelets, necklaces, pendants and rings, including the BH shield, which is at the center of the settlement portion for review.
Their primary focus is travel retail, with distribution online and through duty-free and travel related retailers globally. This includes a flagship location in Grand Central Terminal and airport locations at JFK, a planned LAX opening in 2026, and partnerships with cruise ships and other travel related retailers
The shield has been a part of their travel charm collections for the past 11 years. It features a charm that can be worn on a chain or bracelet and is offered in sterling silver, gold vermeil, or solid gold. While revenues to date have been moderate, Jet Set has indicated that they see meaningful opportunity to expand the Beverly Hills / City brand and focus efforts on establishing and growing their retail presence in Los Angeles, including a potential alignment with the Beverly Hills Hotel.
Staff does need to note that the current jewelry charms do feature a modification to the shield – without the trademark “swirls” on the bottom, and instead a flat treatment, rather than coming to a point (full design in Attachment 1).
Liaison request at this time is for both product review and agreement approval. Below are the draft terms.
Decision Points for Consideration
Are the 3 charms from Jet Set Candy with the modifications for the shield recommended to move forward?
