Attachments: 1. Draft Amendment No. 10

RECOMMENDATION
Staff recommends that City Council approve Amendment No. 10 to the Agreement with Los Angeles County Metropolitan Transportation Authority (Metro) and Environmental Intelligence, LLC (EI) to provide independent compliance monitoring services related to Sections 1 and 2 of the Purple Line Extension project; and approve a purchase order in the amount of $1,359,700 for Fiscal Year 2026/27 for a total contract amount not to exceed of $21,804,200. The cost of EI’s services associated with the Purple Line Extension Project will be reimbursed by Metro with the exception of an estimated $10,000.00 in Fiscal Year 2026-27 for in-person monitoring at Beverly Hills High School (or “BHHS”), which is paid for by the City.

INTRODUCTION
On September 5, 2017, City Council approved a one-year agreement between the City, Metro and EI for independent compliance monitoring services. Between 2018 and 2021, City Council approved Amendment Nos. 1 to 4 providing additional funding through each Fiscal Year up to June 30, 2022, for a total contract amount not to exceed $9,863,100. On Meeting Date: June 9, 2026

Page 2 of 3 ends

January 18, 2022, City Council approved Amendment No. 5, extending the Agreement’s termination to December 31, 2025, subject to annual extension for each year beyond June 30, 2022. Amendment Nos. 6, 7, 8, and 9 were approved in June 2022, May 2023, May 2024, and June 2025, providing additional funding for a total not-to-exceed amount of $20,444,500 and service term through June 30, 2026.

DISCUSSION
The current Memorandum of Agreements (MOAs) for Sections 1 and 2 of the Purple Line Subway Extension Project between the City and Metro requires an Independent Compliance Monitor (ICM) to provide oversight and enforcement to ensure Metro and its contractors comply with the conditions and mitigation measures outlined in the MOAs and the City Council authorized permits. In accordance with the terms of the MOAs, Metro will reimburse the City for the cost of ICM services associated with the Purple Line Extension Project.

Metro and the City jointly selected EI as a third-party monitor through a Request for Qualification process to provide the ICM services for Section 1 and Section 2 construction projects. EI began working with the City and Metro in September 2017.

Their primary scope of services includes:
 Verify Metro’s compliance with any and all conditions and mitigation measures included in the Section 1 and Section 2 MOAs, including all City-issued permit conditions.
 Enforce the conditions and mitigation measures as provided under the MOA Articles, “Enforcement of Permit Conditions and Mitigation Measures,” as necessary to achieve compliance.
 On February 19, 2019, the City and Metro executed the MOA for Design Build of Section 2 Station, which included the requirement for the ICM to be onsite at BHHS for certain work activities during specific hours when school is in session. The City agreed to absorb the cost of monitoring at BHHS. Metro’s construction impacts at BHHS are expected to be minimal in FY2026/27.
 Submit weekly summary reports, including documentation of any violations, which are made available to the public at www.beverlyhills.org/purpleline. From EI’s commencement date of September 11, 2017, through May 11, 2026, EI has issued 415 violations of MOA or permit conditions for Section 1 and 893 violations for Section 2. Based on these violations, Metro has released monetary contributions totaling $635,000 for Section 1 and $4,250,000 for Section 2 to date. An additional $615,000 for Section 1 and $1,300,000 for Section 2 remain pending for violationrelated payments. The City has utilized these monetary contributions toward construction mitigation measures, including the purchase of noise and dust mitigation devices, as well as the paving of Wilshire Boulevard and vicinity streets near the stations.

While the Wilshire/La Cienega Station is scheduled to open May 8, 2026, work will continue through fall 2026 for street restoration and punch-list items. Final paving along Wilshire Boulevard between Stanley Drive and San Vicente Boulevard is anticipated in fall 2026. In Section 2, street restoration near Beverly Dr Station is expected by November 2026 with additional repairs and paving work west of Beverly Drive continuing into spring 2027.

Meeting Date: June 9, 2026

Page 3 of 3 ends

Because FY 2026/27 is expected to be the final year of construction within the City’s rightof-way, staff recommend retaining EI’s services until the City formally accepts the restored infrastructure.

FISCAL IMPACT
The total estimate for ICM services from July 2026 through June 2027 is $1,359,700. Per the existing MOAs, Metro will reimburse the City for the majority of these costs. The City will be responsible for approximately $10,000 for monitoring at BHHS. This agreement requires a FY 2026/27 appropriation of $1,359,700 from the General Fund (Account No. 001-12401-731220), as reflected in the FY 2026/27 Proposed Budget scheduled for City Council adoption on June 23, 2026, and a corresponding purchase order for Fiscal Year 2026/27 for a total contract amount not to exceed $21,804,200. Any unused funds at the end of the fiscal year will be returned to the General Fund as done in prior years.
