INTRODUCTION
Built in 1912 and dedicated to the City of Beverly Hills in 1915, Will Rogers Memorial Park is the City's first municipal park following the City's incorporation in 1914. It was designated as landmark no. 27 on the City of Beverly Hills local register of historic properties in 1985 because the park reflected the initial design intent conceived by the City's first planner and landscape architect Wilbur D. Cook, Jr. The park's focal point is a terraced fountain, with the pond sitting at the head of a 120-foot-long allée of flowers (roses), defined by rows of mature palm trees. The fountain was named in honor of hotelier and City pioneer Margaret J. Anderson in September 2014 in recognition of her contributions to the Beverly Hills community and direct donation of the land that would become Will Rogers Memorial Park.
The historic terraced lily pond includes koi and turtles. The fountain is currently supported by an aged pump and filtration equipment located in an underground vault in a landscaped area south of the fountain. The entire filtration system has reached its useful life and replacement is recommended. The Water Fountain Equipment Replacement Project is the next phase of improvements at Will Rogers Memorial Park.
DISCUSSION
The Will Rogers Park Public Restroom Replacement Project was recently completed in December of 2025 and included an expanded enclosed service yard area to allow for future pump equipment to be in a secure area with easy access for maintenance. The project also included some electrical and plumbing infrastructure to support the new pump and filtration system. The current water fountain pump and filtration equipment has reached the end of its useful life and requires replacement. Furthermore, the existing underground vault has experienced recurring flooding during heavy rain events, rendering the below-grade location unsuitable for continued use. The flooding issues in the underground vault necessitated a transition to an above-ground equipment location, which can now be placed in the expanded service yard constructed as part of the Will Rogers Park Public Restroom Replacement Project.
City staff engaged Patrell Engineering Group, Inc. (water fountain specialist engineer) and California Engineering Corp (electrical engineers) to provide engineering services for the new replacement project. Together, these consultants have prepared bid documents, including plans and specifications that form the basis of the bid documents presented for City Council approval. The scope of work for this project consists of furnishing and installation of new pump and filtration equipment plus required electrical and controls components.
On February 27, 2026, the City sought to obtain bids from experienced building contractors through a prequalification/qualified bidder’s process following State guidelines. A Request for Qualifications was advertised in the local Beverly Hills newspapers and construction trade publications, as well as the PlanetBids portal. The Prequalification Package was posted to the PlanetBids portal on March 2, 2026. Three companies submitted their qualifications on March 23, 2026 as follows: ACCO Engineered Meeting Date: August 4, 2026
Systems, Inc.; California Commercial Pools, Inc.; and California Waters Development, Inc., DBA California Waters. All three received passing scores.
On March 30, 2026, bid documents (RFB 26-350-40) were issued to pre-qualified contractors. Two companies, ACCO Engineered Systems, Inc., and California Waters Development, Inc., attended the mandatory pre-bid meeting held on April 1, 2026 and became eligible to submit bids.
Inclusive to the lump sum base bid, an allowance of $5,000.00 for fencing to be installed at the perimeter of existing water fountain for the duration of entire project was specified in the bid documents.
Basis of Selection
On July 2, 2026, two (2) bids were received as shown below.
ACCO California Waters
Base bid (incl. Allowance #1) $ 390,890.00 $ 211,850.00 20-Day Delay $ 0 $ 7,000.00
Basis of Selection Total
(Base bid and 20-Day Delay) $ 390,890.00 $ 218,850.00
The bid documents specify that the low bid is determined by the sum of the base bid and the compensable delay cost for 20 days. After review of the bids, staff has determined California Waters Development, Inc. is the lowest responsible bidder, has submitted a responsive bid and, as reported by the State Contractors Licensing Board, maintains a license that is current and in good standing. Therefore, staff recommend City Council approve an agreement with California Waters Development, Inc. for this work.
A contingency of $21,185.00, 10% of the contract amount, is recommended for changes due to unforeseen conditions to successfully complete the work. Expenditures from the contingency will be made utilizing the Change Order process in the Beverly Hills Municipal Code upon adequate written justification and substantiation.
The bid documents specify that all work under the contract shall be completed within 30 calendar days from the date specified in the notice to proceed, resulting in an estimated completion in fall of 2026.
Selected Bid
Base Bid (incl. Allowance #1) $ 211,850.00
Subtotal $ 211,850.00
10% Contingency $ 21,185.00
TOTAL $ 233,035.00
ENVIRONMENTAL REVIEW
Approval of the Will Rogers Park Water Fountain Equipment Replacement Project was assessed in accordance with the authority and criteria contained in California Environmental Quality Act (CEQA), the State CEQA Guidelines and the environmental regulations of the City. The project consists of replacement of existing mechanical, Meeting Date: August 4, 2026
electrical, and plumbing equipment serving an existing historic fountain. Work will occur within an existing service yard on existing equipment pads with no expansion of capacity or alteration of the historic fountain's character-defining features. Therefore, staff believe the approval of the project is categorically exempt from CEQA pursuant to the ‘Existing Facilities’ Section 15301 of Title 14 of the California Code of Regulations. Based on the foregoing, staff recommends City Council find that the project is exempt from further review under the provisions of CEQA pursuant to CEQA Guidelines Section 15301 Existing Facilities.
FISCAL IMPACT
The not-to-exceed amount of $233,035.00 is available in CIP #00315 (Park Facilities Maintenance & Improvements) in the Parks and Recreation Facilities Fund (Fund 160).
No additional funding is requested at this time.

Director of Public Works
