INTRODUCTION
The City of Beverly Hills is creating the first monument of its kind, a permanent public memorial of the events surrounding October 7th, 2023; a monument honoring the memory of the victims and their families. The City has committed $500,000 toward the project. The Community Charitable Foundation will engage in soliciting and accepting donations to support the remaining project costs. The State of Israel, through its Consulate in Los Angeles (Consulate), has expressed an interest in supporting this project with participation funding in the amount of $10,000.

DISCUSSION
The participation agreement has been received from the Consulate in the amount of $10,000 to support the October 7th Memorial Project (Project.) Meeting Date: August 4, 2026

Page 2 of 2 ends

At the Formal City Council meeting of July 21, 2026 the City Council agreed upon specific language related to the refunding of project contributions and donations to be pari passu for this agreement and on a go-forward basis. Council directed that the revised language be circulated to the State of Israel to determine whether the State of Israel had any objections. Staff engaged with the State of Israel, through its Consulate in Los Angeles, to update the language to the proposed participation agreement. The State of Israel had no objections. All other terms and conditions remain the same as presented on July 21, 2026.

A summary of the key terms of the agreement are as follows:
• Payment of participation funding upon execution of the agreement in the amount of $10,000
• Consulate participation recognition at the Project site, proportional to the size of the donation and in proportion to other participants and donors • City to provide indemnity to the Consulate for the construction of the project • Consulate to provide indemnity to the City for the source of the funding • The cancellation and refund language for the proposed agreement has been updated to read:
o In the event the project is cancelled for any reason prior to the commencement of its construction, the BH Foundation shall refund the entire participation amount to the Consulate. In the event the project is cancelled for any reason after its construction has commenced, the BH Foundation shall refund a portion of the participation amount pari passu with refunds to other donors/contributors from the Foundation’s remaining unused funds designated for the project.

The City Council’s current direction provides for physical recognition of a ‘donation’ at the project site with a minimum threshold of $10,000. This participation agreement provides that the City will include a form of physical recognition at the project site for the Participant’s contribution. While the nature of this contribution is not technically a ‘donation,’ the language of the agreement provides that the recognition of the participation shall be in form to be determined by the City Council and shall be in a size, manner and location that shall be proportional to the size of the contribution relative to other donors and participants.

The remaining terms and conditions of the agreement are similar to baseline Charitable Donation Agreements that have been historically used for similar donations, such as artwork or specific construction projects.
1 FISCAL IMPACT
The City, through the Community Charitable Foundation, will receive $10,000 in funding from the State of Isreal, through its Consulate in Los Angeles, upon execution of this agreement.

Keith Sterling
Deputy City Manager

1 This is NOT a Charitable Donation Agreement. This is a Participation Agreement with similar terms and conditions.
