AGENDA REPORT
Meeting Date: September 1, 2026
Item Number:

To: Honorable Mayor & City Council
From: Daren Grilley, City Engineer/Assistant Director of Public Works Samer Elayyan, Engineering Services Manager
Andre Sahakian, Project Manager
Subject: TO SET A HEARING DATE FOR AN APPEAL OF EXCAVATION PERMIT (PW2600515) TO ALLOW INSTALLATION OF

SOUTHERN CALIFORNIA EDISON ELECTRICAL UTILITY

INFRASTRUCTURE ALONG SOUTH SANTA MONICA

BOULEVARD FROM WILSHIRE BOULEVARD TO CHARLEVILLE

BOULEVARD
Attachments: 1. Excavation Permit PW2600515

2. Appeal Petition

RECOMMENDATION
Staff recommends that the City Council schedule a public hearing for September 22, 2026 for the Council to consider an appeal of Excavation Permit (PW2600515) to allow the installation of Southern California Edison (SCE) electrical utility infrastructure along South Santa Monica Boulevard from Wilshire Boulevard to Charleville Boulevard.

DISCUSSION
On August 7, 2026, the Public Works Department in conjunction with Community Development Major Projects issued an Excavation Permit (Attachment 1) to allow excavation and installation of SCE electrical conduit and vaults within the public right of way along South Santa Monica Boulevard from the intersection of Wilshire Boulevard to the intersection of Charleville Boulevard. The utilities proposed under the permit in question are associated with the Edison infrastructure upgrades required to provide service to the One Beverly Hills project.

On August 14, 2026, Victor De la Cruz of Mannatt, Phelps & Phillips, LLP, on behalf of The Belvedere Hotel Partnership dba The Peninsula Beverly Hills, filed an appeal of the issuance of the Excavation Permit (Attachment 2). The appeal alleges that the extent and duration of the construction would create unacceptable operational, scheduling, noise, Meeting Date: September 1, 2026

vibration, traffic, and reputational impacts to the Peninsula hotel. The appeal also alleges that the location of the SCE utility alignment violates conditions of approval associated with the One Beverly Hills project entitlements and that further environmental analysis is required.

PROCESS
Pursuant to Beverly Hills Municipal Code (BHMC) Section 1-4-105, the procedure for appeals of this type of administrative decision to the City Council is a two-step process.

The matter is first placed on the Council agenda for review of the evidence presented in the appeal petition. If the evidence and information presented in the appeal is the same as was presented to the official issuing the permit, the Council can then set a public hearing to consider the appeal. However, if the appeal petition contains new information, the Council may order that the official reconsider the matter.

Based on the appeal received by the City, it appears that the appeal is based on information that was previously considered and shared with the relevant City officials.

Pursuant to BHMC Section 1-4-105, staff recommends that the Council move forward on consideration of the appeal.

Staff recommends that the Council schedule a public hearing for September 22, 2026 to consider the appeal. Staff has reached out to both the appellant and the permit applicant to confirm their availability on September 22, 2026. The permit applicant has confirmed their availability; however, the appellant has indicated they could not agree to proceeding with an appeal hearing until a pending Public Records Act request related to the One Beverly Hills project and the permit under appeal has been fulfilled.

Scheduling for September 22, 2026 will allow for adequate time to meet all BHMC public noticing requirements for the appeal hearing.

FISCAL IMPACT
There is no anticipated fiscal impact to the City, as this agenda item only schedules a hearing date for an appeal of the Public Works decision.

Re: Appeal of Permit PW2600515 for Off-Site Electrical Infrastructure — One Beverly Hills Project
Dear Honorable Mayor Corman and City Council:

This firm represents The Belvedere Hotel Partnership dba The Peninsula Beverly Hills (the “Peninsula”). Pursuant to Beverly Hills Municipal Code (“BHMC”) Sections 8-2-19 and 1- 4-101, on behalf ofthe Peninsula, we are appealing Permit PW2600515 (Exhibit A), which was issued to the developer ofthe One Beverly Hills project, Cain International (“Cain”), on Friday, August 7, 2026. The Permit authorizes trenching and installation of off-site electrical infrastructure within the South Santa Monica Boulevard public right-of-way for the One Beverly Hills project (the “Proposed Work”) directly in front of the Peninsula. In compliance with BHMC Section 1-4-101(C), on August 11, 2026, this firm notified the City Engineer and City Manager in the presence of the City Attorney that it would be filing the subject appeal. The City Attorney confirmed that such oral notification satisfied the condition precedent in BHMC Section 1-4-10 1(C) for filing this appeal.

The Peninsula has made it eminently clear to the City and Cain on various occasions that the significant period oftime that South Santa Monica Boulevard would be subject to lane closures and construction for the Proposed Work would create unacceptable operational and scheduling problems, including violations of existing commitments to guests and hotel partners.

The significant and untenable noise, vibration, and traffic impacts on the Peninsula’s guestswould further create immense reputational damage and financial harm to the Peninsula. With the Peninsula’s Verandah Room being directly on South Santa Monica Boulevard, for example, scheduled weddings, conferences, and events would likely be cancelled, and in turn, this wouldresult in significant room blocks (often forty-plus rooms) being cancelled too. Further, partnerssuch as American Express and Chase Visa require significant advance notice of any renovationsor disruptions that could affect the quality of guest stays, and certain rooms and villas directly on South Santa Monica Boulevard could not possibly be rented out during the Proposed Work.

Nevertheless, in an effort to be as neighborly as possible, the Peninsula has been engaging in good faith discussions with Cain over a period of several months, hired dry utility Manatt, Phelps & Phillips, LLP 2049 Century Park East, Suite 1700, Los Angeles, California 90067 Tel: 310.312.4000 Fax: 310.312.4224 manatt

experts to evaluate the feasibility of relocating the Proposed Work to North Santa Monica Boulevard, and offered to pay Cain the difference in costs resulting from any relocation. For those reasons, the Peninsula was shocked by the issuance of the Permit given that as recently as June 9. 2026, Cain informed the Peninsula that relocating the Proposed Work from South Santa Monica Boulevard to North Santa Monica Boulevard should be viable. So incredibly important to the Peninsula is the relocation ofthe Proposed Work to North Santa Monica Boulevard thatthe Peninsula even committed in writing to paying the incremental costs for that relocation work to the tune of approximately $750,000 even though the Proposed Work in no way benefits the Peninsula. (Exhibit B.) In other words, despite the Peninsula’s willingness to pay for theProposed Work to be relocated and such relocation being feasible, a decision was made to reject the PeninsuL&s pleas for help, ignore its significant offer of financial assistance, and keep the Peninsula in the dark until after the new Permit was issued.

We have been informed by the City Manager that South Santa Monica Boulevard was selected over the Peninsula’s objections because it is more convenient to existing Southern California Edison infrastructure, would better serve future needs in the area, and would betteralign with future planned street paving schedules. However, the Peninsula and its dry utility expert team has not seen anything that would support those assertions or that would demonstrate the degree to which moving the Proposed Work just a few feet north would compromise such future needs. And importantly, no effort was made to engage with the Peninsula in a discussion about these issues to explore solutions or better assess whether they overrode the Proposed Work’s potentially catastrophic impacts on the Peninsula. The Peninsula understands that the City must consider overall infrastructure needs in making decisions about utilities; however, it is a mistake to completely ignore major City stakeholders and their long-term tax revenuegeneration for any perceived short-term gain.

As we have previously informed the City, Condition No. 8, adopted as part ofthe City Council’s approval ofthe Amended and Restated 9900 Wilshire Specific Plan (Resolution No. l6-R-13 118, Exhibit C), requires the Applicant to underground utilities in “adjacent streets and alleys.” By its terms, the condition is limited to streets directly adjoining the project site and does not authorize utility work beyond that geographic scope.’ The Permit cannot be issuedwithout first amending the OBH project’s entitlements. Furthermore, having reviewed the recently issued Addendum #4 to the Final Supplemental Environmental Impact Report for the ‘South Santa Monica Boulevard is not adjacent to the One Beverly Hills project site. The site is bounded by Wilshire Boulevard and Santa Monica Boulevard and is bisected by Merv Griffin Way, which together constitute the streets directly adjoining the site and forming the basis ofthe project’s circulation and infrastructure analysis in the SEIR. South Santa Monica Boulevard is physically separated from theproject site and is not identified as a project frontage or adjacent Street in the project approvals or environmental review.

For those reasons, the Peninsula was shocked by the issuance of the Permit given that as recently as June 9, 2026, Cain informed the Peninsula that relocating the Proposed Work from South Santa Monica Boulevard to North Santa Monica Boulevard should be viable. So incredibly important to the Peninsula is the relocation of the Proposed Work to North Santa Monica Boulevard that the Peninsula even committed in writing to paying the incremental costs for that relocation work to the tune of approximately $750,000 even though the Proposed Work in no way benefits the Peninsula. (Exhibit B.) In other words, despite the Peninsula's willingness to pay for the Proposed Work to be relocated and such relocation being feasible, a decision was made to reject the Peninsula's pleas for help, ignore its significant offer of financial assistance, and keep the Peninsula in the dark until after the new Permit was issued.

We have been informed by the City Manager that South Santa Monica Boulevard was selected over the Peninsula's objections because it is more convenient to existing Southern California Edison infrastructure, would better serve future needs in the area, and would better align with future planned street paving schedules. However, the Peninsula and its dry utility expert team has not seen anything that would support those assertions or that would demonstrate the degree to which moving the Proposed Workjust a few feet north would compromise such future needs. And importantly, no effort was made to engage with the Peninsula in a discussion about these issues to explore solutions or better assess whether they overrode the Proposed Work's potentially catastrophic impacts on the Peninsula. The Peninsula understands that the City must consider overall infrastructure needs in making decisions about utilities; however, it is a mistake to completely ignore major City stakeholders and their long-term tax revenue generation for any perceived short-term gain.

As we have previously informed the City, Condition No. 8, adopted as part of the City Council's approval of the Amended and Restated 9900 Wilshire Specific Plan (Resolution No. l 6-R-13118, Exhibit C), requires the Applicant to underground utilities in "adjacent streets and alleys." By its terms, the condition is limited to streets directly adjoining the project site and does not authorize utility work beyond that geographic scope.1 The Permit cannot be issued without first amending the OBH project's entitlements. Furthermore, having reviewed the recently issued Addendum #4 to the Final Supplemental Environmental Impact Report for the 1 South Santa Monica Boulevard is not adjacent to the One Beverly Hills project site. The site is bounded by Wilshire Boulevard and Santa Monica Boulevard and is bisected by Merv Griffin Way, which together constitute the streets directly adjoining the site and forming the basis of the project's circulation and infrastructure analysis in the SEIR. South Santa Monica Boulevard is physically separated from the project site and is not identified as a project frontage or adjacent street in the project approvals or environmental review.

One Beverly Hills Overlay Specific Plan Project (the “SEIR”), it is abundantly clear that thedocument is riddled with flaws that render it meaningless as an informational document under the California Environmental Quality Act (“CEQA”), not the least of which is that the noise and vibration analysis, among others, conceal the Proposed Work’s true impacts. Simply stated, a new Supplemental EIR and public circulation is required to comply with CEQA.

Despite the aforementioned legal violations, the Peninsula remains willing to continue engaging with Cain to explore a potential amicable resolution outside ofthe City Council appeal process. Accordingly, while such discussions continue, at this time we are limiting the contentsofthis appeal as an indication of our good faith in these discussions. However, the Peninsula reserves the right to supplement its appeal before any City Council hearing on the appeal and reserves all rights and remedies, waiving none.

Dear Jonathan,
Thank you for your update of June 9th and your indication that relocating the SCE electric line is doable.

Subject to verification, Peninsula is willing to pay all direct, valid costs which you would incur to relocate the SCE line to North Santa Monica Boulevard, above and beyond the costs you would have incurred had the project gone forward, as you originally proposed on South Santa Monica Boulevard.

We presume you arrive at the $750,000 cost estimate after conducting an in-depth review of the costs. In your email you stated that you can provide “evidence” supporting such
estimate. We would appreciate receiving at your earliest convenience details of all such evidence for our review, including the details of your cost estimate, as well as detailed evidence of the electric line project costs, as originally proposed on South Santa Monica Boulevard.

We look forward to receiving the above information at your earliest convenience.

My best wishes,Robert

Dear Robert
I committed to you in our meeting [ate April that, at your request, we would look at relocating the SCE conduit from South Santa Monica Boulevard to North SantaMonica Boulevard and keep you apprised of what we found. In our meeting, and your subsequent email of May 19, you agreed to cover any extra costs to reroute the line.

There are positive signs that the relocation is viable and our current estimate ofthe incremental costs for moving the SCE conduit will be in the range of $750,000. We can of course evidence this to you.

Please reconfirm that ifwe are able to accomplish this relocation, Peninsula agrees to pay the increased costs. We would bill you during the course of the work. Once we have received this confirmation we will proceed to finalise with SCE.

I look forward to hearing from you on this issue and would be happy to discuss.Regards JonathanJonathan GoldsteinChief Executive Officer
