RECOMMENDATION
Staff recommends that City Council reject all bids received for the Beverly Hills Sidewalk Restoration Project Phase III and authorize staff to revise the bidding documents, as necessary, and rebid the project in accordance with applicable procurement requirements.
INTRODUCTION
This report requests that City Council reject all bids received for the Beverly Hills Sidewalk Restoration Project Phase 3 and authorize staff to rebid the project.
The project includes the removal and replacement of deteriorated sidewalks, curbs, gutters, and ADA curb ramps at 31 locations throughout the City. The locations were identified through the City’s sidewalk inspection and maintenance program and prioritized based on the condition of the improvements, pedestrian exposure, and the need for full removal and replacement.
The City initially solicited bids for the project using the informal bidding procedures authorized under the California Uniform Public Construction Cost Accounting Act (CUPCCAA). All bids received exceeded the maximum amount that may be awarded through the informal bidding process. Accordingly, staff recommends rejecting the bids and rebidding the project using the appropriate competitive bidding procedure.
Meeting Date: September 22, 2026
DISCUSSION
The Beverly Hills Sidewalk Restoration Project Phase III is part of the Public Works Department’s ongoing effort to address deteriorated sidewalk conditions and maintain safe and accessible pedestrian facilities throughout the City. The work generally consists of removing and reconstructing sidewalk panels and associated concrete improvements at locations where full replacement is warranted.
On May 21, 2026, the City issued a Notice Inviting Bids through PlanetBids to qualified contractors on the City’s CUPCCAA contractor list. The solicitation provided the project scope, construction documents, and bid-submittal requirements.
On June 5, 2026, the City received three bids as follows:
Bidder Bid Amount
Gentry General Engineering, Inc. $279,866.00
Paveco Construction, Inc. $307,550.00
PALP, Inc. dba Excel Paving Company $323,872.00
Under CUPCCAA, public projects with a cost of $220,000 or less may be awarded using informal bidding procedures. If all bids received exceed $220,000, City Council may, by a four-fifths vote and under specified circumstances, award the contract to the lowest responsible bidder if the award does not exceed $235,000.
All three bids received for Phase 3 exceeded both the $220,000 informal bidding threshold and the $235,000 maximum permitted under this limited exception. The apparent low bid submitted by Gentry General Engineering, Inc., in the amount of $279,866, exceeds the $235,000 maximum by $44,866. Accordingly, none of the bids may be awarded through the CUPCCAA informal bidding process.
Public Contract Code Section 22038 permits the City to reject the bids and, after reevaluating the project cost estimate, readvertise the project. Staff, therefore, recommends rejection of all three bids.
Following rejection, staff will review the bid results, project quantities, construction documents, and cost estimate to determine whether any appropriate revisions should be made before readvertising. Staff will then rebid the project in accordance with the applicable CUPCCAA requirements. If the estimated project cost remains above the $220,000 informal bidding threshold, the project will be advertised using the formal competitive bidding process.
Following completion of the rebid process, staff will return to City Council with the bid results and a recommendation for contract award.
FISCAL IMPACT
There is no fiscal impact associated with rejecting the bids.
