PERFORMANCES IN THE AMOUNT NOT TO EXCEED $50,000;
AND

REQUEST TO WAIVE USE AND FACILITY RENTAL AND STAFFING
FEES UP TO A NOT TO EXCEED AMOUNT OF $24,523

RECOMMENDATION
Staff recommends that City Council review and approve an agreement with Theatre 40 for cultural programming and theatrical performances for the 2026-2027 Theatre 40 season in a not-to-exceed amount of $50,000, and a request to waive use and facility rental and staffing fees for one production to be staged at Greystone Mansion & Gardens, in a notto-exceed amount of $24,523.

INTRODUCTION
Since approximately 2006, the City of Beverly Hills has provided funding to the local nonprofit theatre group, Theatre 40, to produce theatrical productions for the community to attend and enjoy. The funding provided for many years has been for an amount of $50,000 and was part of the larger Community Assistance Grant Funding program. Since fiscal year 2025-26, Theatre 40 and four other cultural service providers were transitioned from a grant award program to a contracted for services program. The Community Services Department has requested the services of Theatre 40 to continue to produce up to six productions per season, for a not-to-exceed amount of $50,000.

DISCUSSION
Theatre 40’s six-production season is primarily hosted at the Mary Levin Cutler Theatre on the campus of Beverly Hills High School. One of those six productions is typically staged in the living room of Greystone Mansion and is provided to Theatre 40 as an inkind contribution above and beyond the $50,000 agreement, with Theatre 40 retaining the Meeting Date: September 22, 2026

Page 2 of 2 ends

revenue generated from ticket sales for that production. The in-kind contribution consists of the performance space on the first floor of the Greystone Mansion, use of the South Guest Room as dressing room space, and storage space in one room designated by the City for the storage of props and costumes for the production.

The City has typically provided facility access to Greystone Mansion for set-up, two weekday evenings for rehearsals, up to ten (10) performances conducted within a twoweek period, with up to six hours of facility access per performance, and up to four hours for breakdown. The equivalent facility rental fee for Greystone Mansion is $21,280, and the related staff support cost is $3,243 for Park Rangers, resulting in a total waiver request of $24,523.

Staff recommend continuing to partner with Theatre 40 to provide live theatre performances for the benefit of the community in a not-to-exceed amount of $50,000, and the waiving of facility and use and staffing fees for one production at Greystone Mansion in the amount of $24,523, to continue providing live theatre in the historic mansion.

FISCAL IMPACT
The not-to-exceed contract amount of $50,000 for the six-production season are budgeted within the Community Services Department’s fiscal year 2026-27 adopted budget.

The requested fee waiver for expenses necessary to support the production at Greystone Mansion are estimated at $24,523. This total includes all rental fees for the duration of the event, including set-up and breakdown time, plus staff costs for Park Rangers to assist with the influx of patrons attending the performances on the park grounds, and to oversee set up and breakdown by Theatre 40.

Category Cost
Greystone Mansion rental fees $21,280
Park Ranger Fees $3,243
Total Fee Waiver Request $24,523
