RECOMMENDATION
Staff recommends that City Council approve Amendment No. 3 to the agreement with HF&H Consultants, LLC for solid waste consulting in the amount of $203,700.13 for a total not-to-exceed amount of $1,002,700.13 and approve a Fiscal Year 2026/27 purchase order in the amount of $203,700.13.
INTRODUCTION
The City utilizes HF&H Consultants, LLC (“HF&H”) to provide specialized solid waste consulting services, including financial and rate analyses, waste hauler audits, regulatory compliance assistance, and other technical support related to the City’s solid waste program. HF&H is currently assisting the City with its Solid Waste Cost-of-Service Study, which is anticipated to be completed in Fiscal Year 2026/27.
The existing agreement is in its final year and additional funding is needed to complete the Cost-of-Service Study and other anticipated services under the agreement. Due to a greater level of consulting services provided in prior years than originally anticipated, a larger portion of the agreement funding was utilized in earlier years, leaving insufficient funding for the remaining work in Fiscal Year 2026/27. Staff recommends increasing the agreement by $203,700.13 and approving a corresponding purchase order.

DISCUSSION
In 2022, the City Council approved an agreement with HF&H for solid waste consulting services in an amount not to exceed $675,000. The agreement provided for an initial threeyear term with two one-year extension options, for a total potential term of five years through Fiscal Year 2026/27.
The agreement provides the City with specialized solid waste consulting services in six primary areas: financial and rate analyses; review of contractor rate adjustment requests; assistance with contract amendments; meetings, briefings and implementation issues; waste hauler audits; and Senate Bill 1383 compliance assistance.
In September 2024, the City Manager approved Amendment No. 1 to the agreement, which increased contract authority by $99,000 to address additional services needed across the six task areas. On May 20, 2025, the City Council approved Amendment No. 2, which provided an additional $25,000 for HF&H to conduct a refuse vehicle street impact analysis.
The City is currently in the final year of the agreement and is completing a comprehensive Solid Waste Cost-of-Service Study. The study evaluates the costs associated with providing residential and commercial solid waste services and establishes rates necessary to support the long-term financial sustainability of the Solid Waste Enterprise. As part of this effort, HF&H has developed and refined the financial model, evaluated revenues and expenditures, analyzed reserve levels and projected costs, developed proposed rates, and prepared customer bill-impact analyses. HF&H has also assisted staff with presentations and discussions before the Public Works Commission regarding the City's existing and potential alternative residential rate structures.
Additional contract authority is needed in Fiscal Year 2026/27 for two primary reasons.
First, additional work is required to complete the Solid Waste Cost-of-Service Study and associated rate-setting process. Remaining work includes incorporating final Fiscal Year 2025/26 financial results into the rate model, finalizing proposed rates and customer bill impacts, finalizing the cost-of-service study report, and providing technical support through final consideration of the rates by the City Council.
Second, the City utilized a greater portion of the agreement's available funding during earlier years than originally anticipated due to the level of consulting services required mainly due to support additional analysis and research required during prolonged negotiations with the City’s solid waste franchise hauler. These efforts required a greater level of consultant support than originally anticipated. Consequently, the remaining funding available for Fiscal Year 2026/27 is insufficient to complete the Cost-of-Service Study and provide the other anticipated consulting services during the final year of the agreement.
Amendment No. 3 would provide an additional $203,700.13 in Fiscal Year 2026/27 to ensure sufficient funding is available to complete the Cost-of-Service Study and the remaining work anticipated under the agreement.

AMENDMENT NO. 3 TO THE AGREEMENT BETWEEN THE
CITY OF BEVERLY HILLS AND HF&H CONSULTANTS, LLC,
FOR SOLID WASTE CONSULTATION
This Amendment No. 3 is to that certain Agreement between the City of Beverly Hills (hereinafter called "CITY") and HF&H Consultants, LLC (hereinafter called "CONSULTANT"), dated June 14, 2022, and identified as Contract No. 352-22, as amended by Amendment No. 1, dated September 10, 2024, and identified as Contract No. 489-24, as amended by Amendment No. 2, dated May 20, 2025, and identified as Contract No. 216-25 (“Agreement”).
RECITALS
A. CITY and CONSULTANT entered into the Agreement for solid waste consultation, which was previously amended.
B. CITY and CONSULTANT desire to further amend the Agreement to extend the Termination Date and increase the Consideration to compensate CONSULTANT for the ongoing financial and rate analysis.
NOW, THEREFORE, the parties agree as follows:
Section 1. The Termination Date shall be amended as set forth on the cover page.
Section 2. The Consideration shall be amended as set forth on the cover page.
Section 3. Exhibit B, “Schedule of Payment and Rates”, is hereby amended as attached hereto and incorporated herein.

EXHIBIT B
SCHEDULE OF PAYMENT AND RATES
CITY shall compensate CONSULTANT for the satisfactory performance of services performed under this Agreement as described in Exhibit A, “Scope of Work,” in the not-to-exceed amount of One Million Two Thousand Seven Hundred Dollars and Thirteen Cents ($1,002,700.13) based on the rates set forth in this Exhibit B.
COST ESTIMATE
CONSULTANT will perform the Scope of Work based on time and materials, subject to the notto-exceed amount stated above. The audit costs in Task 5 of Exhibit A are reimbursed to CITY by the hauler per terms of CITY’s commercial solid waste agreement (Agreement No. 657-19).

Postage, overnight mail, and other out-of-pocket costs Actual cost CONSULTANT shall submit to CITY a detailed invoice, on a monthly basis or less frequently, for the services performed pursuant to this Agreement. Each invoice shall itemize the services rendered during the billing period and the amount due. Within thirty (30) days of receipt of each invoice, CITY shall pay all undisputed amounts included on the invoice. CITY shall pay CONSULTANT said Consideration in accordance with the schedule of payment set forth in this Exhibit B.
