This 1.00% is shared by all taxing agencies for which the subject property resides within. In addition to the 1.00% fixed amount, property owners are charged taxes as a percentage of assessed property values for the payment of any voter approved bonds. 2 Overlapping rates are those of local and county governments that apply to property owners within the City. Not all overlapping rates apply to all city property owners.3 City's Share of the 1% Levy is based on the City's share of the general fund tax rate area with the largest net taxable value within the City. ERAF general fund tax shifts may not be included in tax ratio figures.4 Redevelopment Rate is based on the largest RDA tax rate area and only includes rate(s) from indebtedness adopted prior to 1989 per California State statute. RDA direct and overlapping rates are applied only to the incremental property values.

The approval of ABX126 eliminated Redevelopment from the State of California for the fiscal year 2012/13 and years thereafter. 5 Total Direct Rate is the weighted average of all individual direct rates applied by the City/Agency preparing the statistical section information and excludes revenues derived from aircraft. Beginning in 2013/14 the Total Direct Rate no longer includes revenue generated from the former redevelopment tax rate areas. Challenges to recognized enforceable obligations are assumed to have been resolved during 2012/13. For the purposes of this report, residual revenue is assumed to be distributed to the City/Agency in the same proportions as general fund revenue.Data Source: San Bernardino County Assessor 2010/11 thru 2019/20 Tax Rate Table Fiscal Year Ended July 30,

MEETING
DATE: January 3, 2022
TO: Honorable Mayor and Members of the City Council
FROM: Frank A. Rush, Jr., City Manager
SUBJECT: City Manager Comments
COVID Cases, Deaths
As of December 22, there have now been 1,959 cumulative COVID cases in the Big Bear Valley since March 2020. This represents an increase of 61 cases since December 1, a rate of nearly 3 new cases per day. This daily case rate is significantly lower than November, when the Big Bear Valley experienced a rate of nearly 7 new cases per day. Thus far, at least through December 22, it does not appear that the Big Bear Valley has been significantly impacted by the Omicron variant.

It is likely too soon to know the impact of Omicron on the Big Bear Valley, and we obviously hope that the new case rate will continue to be low in the coming weeks.

One additional COVID death has been reported since December 1, bringing the cumulative total since March 2020 to 39 deaths. Since March 2020, COVID has claimed the life of approximately 1 in every 485 residents of the Big Bear Valley, approximately 1 in every 364 residents of San Bernardino County, and approximately 1 in every 524 residents of California.

COVID Vaccinations
As of December 26, COVID vaccinations are as follows (% of residents over age 5):

City of Big Bear Lake 76.6% at least one dose 66.5% fully vaccinated Big Bear City 44.2% at least one dose 38.7% fully vaccinated Fawnskin 59.2% at least one dose 52.7% fully vaccinated Sugarloaf 36.1% at least one dose 32.0% fully vaccinated San Bernardino County 62.9% at least one dose 55.7% fully vaccinated State of California 78.9% at least one dose 70.7% fully vaccinated.

The City continues to partner with San Bernardino County to offer vaccinations at City Hall. The schedule for vaccination events is as follows, from 10 am – 2 pm:

Thursday, January 13
Thursday, January 20
Thursday, January 27.

It should be noted that these events are subject to weather conditions. Inclement weather may lead to postponements or cancellations.

We will be working with San Bernardino County to schedule additional dates in February and beyond as necessary or helpful. Flu shots are also expected to be available.

Pfizer and Johnson & Johnson doses are expected to be available at each event, and booster shots of both are expected to be offered to qualifying individuals. Appointments are recommended (www.myturn.ca.gov) but not required.

COVID Test Kits
City staff are working with San Bernardino County to secure home test kits that will be distributed free of charge to our residents in the coming weeks. Specific timelines and quantities will be announced as soon as possible, and the test kits will be provided at no charge.

City Employee Vaccinations
As of December 27, a total of 34 of the City’s 58 current employees have been vaccinated. A total of 8 of these individuals either were vaccinated after having contracted COVID or contracted COVID after being vaccinated. An additional 9 City employees have previously contracted COVID but have not been vaccinated. Thus, 43 of the 58 current employees are believed to have some level of COVID antibodies.

California Indoor Mask Mandate
Masks are mandated for all indoor activities in the State of California, regardless of vaccination status. City employees are required to wear a mask indoors, unless they are working alone away from others. Visitors to City Hall are required to wear a mask indoors.

The indoor mask mandate also applies to all private businesses, institutions, and other governmental agencies. Many businesses in Big Bear Lake are requiring masks for patrons and employees, and the implementation of this mandate is essentially on an honor system basis.

Neither the City, nor any State agency, is actively enforcing this mandate, and is instead relying on everyone to simply do the right thing and wear a mask indoors.

The indoor mask mandate is in effect in California through January 15, unless extended.

Position Vacancies
We currently have a total of 4 vacant positions across the City organization: a Senior Administrative Analyst in Administrative Services, a Senior Administrative Analyst in City Clerk / Human Resources, a Counter Technician in Community Development, and a Principal Planner in Community Development.

All other vacant positions have recently been filled, and the new employees have either already begun work or a conditional offer has been extended and background checks are being completed.

Assuming recent hires successfully complete the background process, I am pleased to have all positions in the Public Services Department now filled, and we will implement the new park attendant assignments and the new litter collection team in the coming weeks.

Department directors and I continue to evaluate potential organizational structure changes associated with a few of the current vacancies, and will present any desired changes to City Council at the appropriate time.

November Budget Report
A copy of the November monthly budget report is attached. There are no significant budget concerns for FY 2021-22 at this point.

November Vacation Rental Compliance Report
A copy of the November vacation rental compliance report is attached. We continue to experience decreased visitation from 2020 levels, and decreased complaints and citations.

December Public Records Act Report
A copy of the December public records act request report is attached. Due to the timing of the holidays and the January 3 meeting, the report is current through December 22.

Notice of Intent to Circulate Petition - Initiative to Limit Vacation Rentals The City received the attached Notice of Intent and proposed ordinance amendments on December

27. There are several proposed amendments to the City’s vacation rental ordinance, including a limit of 1,500 vacation rental licenses and a limit of 30 contracts per year in the future. As of December 17, there were 2,584 active vacation rental licenses in the City, and the City’s ordinance does not currently limit the number of contracts.

The City Attorney now has 15 days (by January 11) to prepare an impartial ballot title and summary, and return it to the City Clerk. A summary of the additional steps in this process is outlined below:
• The proponents may challenge the City Attorney’s ballot title and summary through the Court if the proponents are not satisfied.
• The proponents must then publish the notice of intent and provide an affidavit to the City Clerk within 10 days of publication.
• After submitting to City Clerk, the proponents may begin to gather signatures of registered voters. There are certain technical requirements for the format of the petition and the individuals gathering the signatures.
• The proponents have 180 days to gather signatures from the date the City Attorney returns the ballot title and summary.
• Once the petition is submitted to the City Clerk, the Clerk has 30 working days to verify that the signatures are valid (registered voters of the City). The threshold is 10% of the total registered voters in the City.
• If the petition meets the requirements, the City Clerk will present the petition to the City Council at the next regular meeting of the City Council. At that meeting, Council may do any of the following at its discretion:
a) adopt the measure, either at the meeting or within 10 days, OR b) submit the measure to the voters at the next regular City Council election at least 88 days away, OR
c) schedule a special election before the next Council election, but not less than 88 days nor more than 103 days away, OR
d) direct City staff to prepare an impact report on the proposed measure, with 30 days to complete -- after which the previous 3 options (a, b, and c) are available to Council. • If an election is called by the City Council, the City Attorney will prepare an Impartial Analysis to be distributed to voters.
• A simple majority is required to approve the initiative. If approved by the voters, the City Council would certify the election results approximately one month after the election. If approved, the substance of the initiative would become effective 10 days after Council certifies the election results.
• This initiative, if adopted by Council without a vote or approved by the voters, may only be amended in the future by another vote of the people.

Potential Ordinance Prohibiting Campaign Activities on City Property The Municipal Code does not currently prohibit campaign activities at City Hall, City parks, or other City-owned properties, however, the City may adopt such an ordinance if desired. Recently, the proponents of the initiative to limit vacation rentals set up at both Veterans Park and at City Hall. With the initiative apparently now moving forward, Council may wish to consider an ordinance prohibiting these kinds of activities in the future – on any issue, and by any side to any issue – to avoid the appearance of City support for a particular issue or side. If Council is interested in pursuing this, an appropriate ordinance will be presented for Council consideration at the February 7 meeting.

Bear Valley Mutual Lease
The agreement was executed by the City on December 8, thus beginning the 6-month due diligence process, which will expire on June 8, 2022. The City has initiated the Phase I environmental review, and will proceed with a Phase II review as necessary.

City staff are scheduled to meet with the restaurant lessees on January 12. I am in the process of scheduling a group meeting with all residential tenants for sometime later in January.

Electric Vehicle Charging Stations
The City is still working to add 3 electric vehicle charging stations (2 slow chargers and 1 fast charger) in the Bartlett parking lot and 2 electric vehicle charging stations in the Pennsylvania parking lot. The City is currently waiting for Bear Valley Electric to complete necessary electric infrastructure to serve the charging stations, and installation was proceed as soon as possible after Bear Valley Electric completes its work.

City Grant Applications Not Funded
Earlier this year, the City submitted two different Statewide Parks Program grant applications – one in the amount of $2.98 million for the construction of a new Village Plaza on the “Christmas tree lot”, and another for $2.99 million for the acquisition of a lakefront parcel adjacent to the Marina Resort and the development of initial park amenities. Unfortunately, neither of the City’s two applications were awarded funding. The grant process was very competitive, with approximately $548 million awarded out of approximately $2.42 billion requested.

In the absence of grant funding, I do not envision the City proceeding with the Marina Resort parcel acquisition, particularly now that the City is planning a large park at the Bear Valley Mutual property. I do expect that the City will continue to pursue the future development of the “Christmas tree lot” in The Village in the future, and City staff will consider both future grant opportunities and City funding for any desired improvements.

City Staff Exploring Paid Parking for The Village
City staff are currently exploring the potential implementation of paid parking in public parking lots and/or on public parking spaces on Village Drive and Pine Knot Avenue. Staff will be participating in demonstrations with parking software companies in the coming weeks, and will devise a plan that will be shared with the Village Business Association in February. I expect to present a plan for City Council review in March, and if the Council decides to proceed we would expect to finalize this plan as part of the FY 22-23 budget process and implement paid parking on or around July 1, 2022.

Depending on how a paid parking program is structured, it is possible that such a plan could expedite the elimination of the deficit in the Village Maintenance Fund and/or reduce or eliminate the current Village maintenance assessments in the future.

Next EDAC Meeting Scheduled for Tuesday, January 11
The new committee held its first meeting on November 15, and engaged in thoughtful discussion.

The next meeting was scheduled for Tuesday, December 14, however, it was postponed due to a snow storm that day. Because of scheduling difficulties around the holidays, the next meeting was rescheduled for January 11 at 1 pm in City Hall.

City Council Redistricting
The online mapping tool is now live, and can be accessed at this link:
https://mapbigbearlake.org/?page id=789 . We have tentatively scheduled the next redistricting public hearing for February 7, and plan to present various map options for Council consideration at that time.

KMart Shopping Center
The broker for the sale of the shopping center recently received proposals from potential buyers, and is currently evaluating proposals. I expect that the City will learn the identity of the prospective buyer in the coming weeks.

City staff participated in several encouraging conversations with the broker and potential buyers in recent weeks, and I am optimistic that the shopping center will eventually be occupied by retailers who will provide necessary goods for the community in the future. Several discussions referenced Target, Marshalls, Ross, Home Goods, Big Lots, and other national retailers that offer goods that our community currently must travel down the mountain to purchase.

Meeting with Caltrans Regarding Bicycle Path Connection Under Big Bear Boulevard City staff had a productive meeting with Caltrans staff on December 9 about the potential routing of the Rathbun Creek bicycle path through an existing storm water culvert under Big Bear Boulevard near the Sizzler Restaurant. Other ideas discussed included a potential at-grade crossing, a new under-highway crossing, and an overhead crossing.

City staff is scheduled to meet with the San Bernardino County Flood Control District about this potential project on January 6. Both the Flood Control District and Caltrans would need to sign off on any plan to utilize the existing culvert or construct a new culvert.

I am hopeful that a feasible solution will emerge that will enable a safe connection for pedestrians and bicyclists in this area, and tie into other sections of bicycle path in the next few years.

Potential TOT Ballot Measure
City staff continue to consider a potential TOT ballot measure, and plan to discuss this issue more with the City Council at the March 21 budget workshop meeting in conjunction with the new draft of the 5-Year Capital Replacement / Improvement Plan. Based on Council’s feedback on November 15, we are focused on a potential 2% increase, with the proceeds from 1% targeted for new capital investment (including Replenish Big Bear, City parks, and City bicycle paths) and 1% targeted for public safety (law enforcement and fire services). Council will be asked to make a final decision on any ballot measure at the May 2 meeting. If authorized by Council, a TOT ballot measure would appear on the ballot on November 8, 2022.

Stanfield Cutoff Land Acquisition
City staff continue to work with the City Attorney, the Municipal Water District, and the San Bernardino Mountains Wildlife Society to finalize the City’s acquisition of all land near the southeast corner of Stanfield Cutoff and Big Bear Boulevard, including the existing boardwalks and MWD’s $500,000 contribution toward future boardwalk improvements. I hope to complete the full acquisition later in January or February.

Hampton Inn / Home 2
The developers of the new hotel are working to obtain necessary building permits, and hope to begin construction on or around May 1, 2022. The project has already received all required Planning Commission approvals.

TOT Collections By Hosting Platforms Begin January 1
Under the City’s new vacation rental ordinance, online hosting platforms are now required to collect and remit TOT and TBID assessments from vacation rental guests on a monthly basis.

VRBO has indicated they will collect both TOT (8%) and TBID (3%), however, AirBnB has indicated they will collect the TOT only (8%). AirBnB is resistant to collecting and remitting the TBID (3%), citing legal concerns, and we continue to work with AirBnB on this issue and will hopefully resolve this issue soon. In the absence of AirBnB collecting and remitting the TBID, the owner / manager will continue to be responsible for collecting and remitting the TBID to the City.

Noise Monitoring Devices Will Now Be Required After First Noise Violation Beginning in January, any vacation rental owner / manager who receives a noise violation will be required to install a noise monitoring device as a condition of maintaining the license. Through a special arrangement between the City and Noise Aware, vacation rental owners / managers may purchase the equipment and the first year subscription for $150, and the City will reduce the next annual registration fee by $150 (from $550 to $400), thereby making the first year completely free.

To date, only 21 vacation rental licensees have taken advantage of this offer since it was extended in September.

Labor Negotiations
The City’s existing labor agreement expires on June 30, 2022, and we will soon begin negotiations.

I have tentatively scheduled a closed session for the February 7 meeting to conduct initial discussion with the Council.

In God We Trust / E Pluribus Unum
City staff have ordered a new City seal for Hofert Hall that includes these phrases, and we are expecting delivery sometime in February.

Burial Flag Display
City staff are also working with a vendor on a display case for a recently abandoned burial flag, along with an inscription, and we will place it on permanent display in Hofert Hall. I am hopeful that the new case will be received sometime in January, and that it will be on display in time for the February 7 meeting.
