MEETING
DATE: September 9, 2022
TO: Honorable Mayor and Members of the City Council
FROM: Kelly Ent, Acting City Manager
SUBJECT: Resolution Ratifying a Proclamation Declaring a Local State of Emergency

BACKGROUND
On September 5, 2022, a fire started north of Highway 38 in the San Bernardino National Forest:
known as the ‘Radford Fire’. At approximately 11:00 a.m. on Tuesday, September 6, the first evacuation order impacting the Big Bear Valley community was issued. In response to the imminent threat to the Big Bear Valley, I declared a local state of emergency in my capacity as Acting City Manager / Acting Director of Emergency Services.

DISCUSSION
The emergency proclamation executed on September 6 is effective for seven days. To remain in effect, pursuant to Government Code Section 8630 (b), a proclamation of local emergency must be ratified by the City Council within seven (7) days. Therefore, City Council is being requested to consider adopting a formal Resolution entitled, “Resolution Ratifying a Proclamation Declaring a Local State of Emergency”, which would allow the emergency proclamation to continue in effect until such time as the City Council adopts a future resolution rescinding the emergency order.

FISCAL IMPACT
There is no fiscal impact associated with adopting a resolution to ratify a Proclamation Declaring a Local State of Emergency. Although, by taking this action, the City Council would meet one of the requirements related to the City’s eligibility for State/Federal funding, if emergency expenditure reimbursement opportunities were to be made available.

ENVIRONMENTAL CONSIDERATIONS
None requiring review under California Environmental Quality Act.

RECOMMENDATION
It is recommended that the City Council adopt a Resolution Ratifying a Proclamation Declaring a Local State of Emergency.
