MEETING
DATE: December 12, 2022
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Director of Public Services
Jason Watterson, Public Works Operations Manager
SUBJECT: Resolution Authorizing the Purchase of a Replacement Fleet Vehicle

BACKGROUND
The City’s Public Works Division is responsible for the management and maintenance of the City’s motor fleet which includes a variety of vehicles and equipment for use in support of City operations. Annually, the City Council adopts an updated Five-Year Capital Improvement Program (CIP) which includes an annual allocation for the purchase of replacement fleet vehicles.

Staff maintains, and updates annually, a vehicle replacement schedule with the goal of maximizing the useful life of the City assets while also minimizing the ongoing maintenance and operating expenses and replacing the vehicles accordingly. Remaining in the adopted budget for this Fiscal Year is an additional pickup truck assigned to the Sanitation Division.

Recently, worldwide issues with the supply chain have made the acquisition of vehicles more challenging and there is limited availability within the marketplace. Staff has been able to locate the desired vehicle through Dave Smith Motors (Kellogg, ID), from whom most recent vehicle purchases have been made, and it is available for immediate delivery. Staff is seeking authorization for the purchase of a replacement vehicle from Dave Smith Motors.

DISCUSSION
Staff is seeking to purchase one (1) new vehicle for the City’s motor fleet, which is to replace an existing vehicle assigned to the Sanitation Division. The vehicle to be replaced is a 2000 Dodge pickup truck. The Public Works Division has standardized their preferred vehicle as the RAM 2500 Tradesman 4x4 Pickup. The Public Works Division has utilized these for several years and have found them to be appropriate for the job functions, they handle all weather conditions, and they are equipped to have a snow plow attached to them as needed.

Staff was able to locate the identified pickup truck through Dave Smith Motors in Kellogg, ID.

The City has previously purchased vehicles from Dave Smith Motors as they are believed to be one of the largest truck dealers in the Country and have proven able to obtain vehicles even in difficult market conditions. Staff has purchased a number of similar fleet vehicles from Dave Smith Motors in recent years. Dave Smith Motors has the vehicle on the lot is able to ship it immediately.

Based upon the extensive research conducted by staff and the lack of availability within the marketplace, staff believes the pricing received for these vehicles is fair in light of the current market conditions and is consistent with the price associated with the other recent vehicle purchases.

The vehicle that is to be replaced will be retired from service as the replacement vehicle is put into use and disposed of utilizing an auction service, consistent with historic practice.

FISCAL IMPACT
Funding for the purchase of fleet vehicles is included within the approved Fiscal Year 2022-23 Capital Improvement Budget. The purchase price of the vehicle is $60,074.

ENVIRONMENTAL CONSIDERATIONS
This action is not subject to environmental review pursuant to CEQA.

RECCOMENDATION
Staff recommends that the City Council adopt a Resolution Authorizing the Purchase of a Replacement Fleet Vehicle.

THROUGH: Erik Sund, City Manager

FROM: Erica Stephenson, City Clerk/Director of Human Resources

SUBJECT: Ordinance Amending Chapter 2.08 of the Big Bear Lake Municipal Code Pertaining to City Council Meetings, and Finding the Ordinance Exempt from the California Environmental Quality Act

BACKGROUND
The City of Big Bear Lake’s Municipal Code Chapter 2.08 sets forth rules and regulations related to the City Council, including establishing the days and timeframes of the City Council’s regular meetings. Currently, Municipal Code Section 2.08.010, indicates that all regular meetings of the City Council shall be held on the first and third Monday of each month, and that closed session can begin at 3:00 pm and open session can begin at 5:00 pm. This meeting start time reference is intended to provide Council with some scheduling flexibility, but typically Open Session begins at 6:00 pm.

DISCUSSION
The City Council has a long-standing history of modifying their traditional regular meeting schedule. Upon a recent review of several years of the City Council’s annual meeting calendars prior to 2021, staff determined that former City Councils’ held on average 12 to 15 regular meetings a year, in addition to periodic special meetings/workshops. This practice added flexibility to the City Council’s schedule so they could participate in other important City related duties and responsibilities, such as serving on the local Fire Authority, Fire Protection District, Mountain Transit Authority, and Big Bear Area Regional Wastewater boards. In addition to providing the City representation with other vital regional and statewide organizations such as the San Bernardino County Transportation Authority, Southern California Association of Governments, and the League of California Cities.

In an effort to return to a meeting schedule that has traditionally been appropriate for the City of Big Bear Lake, staff is proposing that beginning in 2023 the City Council’s regular meetings shall be held once a month. Staff is also suggesting that the Council consider switching the previous Monday meeting day to the second Wednesday of each month. For years, the Monday meeting day has been an issue due to holiday conflicts, for instance, the first and third Mondays in January 2023 both fall on City observed holidays and would need to be cancelled if the City Council were to decide to keep the City’s current meeting schedule. City staff feels that Wednesdays are an optimal meeting day because they will rarely conflict with a holiday, which will contribute to more regularity in the City Council meeting schedule. Going to one meeting a month will be a benefit to the community, as it provides for a consistent and uninterrupted meeting schedule. Not only does this recommendation compliment the schedule of the various other agencies the City of Big Bear Lake participates in, it will be easier for the public to remember the City Councils’ meeting calendar as the second Wednesday of each month and they can begin to rely on an unchanging schedule going forward. Additionally, if City Council approves this change, staff plans to continue to release the Agenda packet on the Thursday prior to the following week’s meeting. This will afford the City Council and the public additional days to review the packet in preparation for the monthly regular meeting.

In addition to those twelve regular meetings, the City plans to hold several special meetings/workshops each year. These meetings will be held for City Council to provide input and direction during the City’s annual Budget preparation process, to conduct interviews and appoint Planning and DWP Commissioners, hold General Plan workshops, and to allow for joint meetings with the Planning Commission as the City focuses on the Community Visioning Process and other related strategic planning projects. It is important to note, the City Council is free to schedule special meetings as urgent needs arise, such as the recent special meeting held to ratify the Radford Fire Emergency Proclamation.

The attached ordinance stipulates that regular City Council meetings will begin at 5:00 pm or 3:00 pm or later for conducting a Closed Session. The staff is recommending that the City Council begin the Closed Session portion of their regular meetings at 4:00 pm and then Open Session would begin at 5:00 pm. We would also propose that the special meetings/workshops would be held as daytime meetings, likely beginning at 10:00am (but may be adjusted by the City Council as needed or desired).

As a result of the proposed ordinance, staff has prepared the attached 2023 meeting calendar for City Council consideration. The proposed 2023 calendar doesn’t currently include any special meetings, but it is important to reiterate that Council will still be able to schedule additional special public meetings as the need may arise to meet specific deadlines, address emergent issues and consider other items in a timely manner.

The proposed ordinance is required to formally update the City’s Municipal Code Section

2.08.010, thereby allowing the City Council’s regular monthly meeting to be held on the second Wednesday of each month. If Council approves a motion to read the title, waive further readings and introduce this ordinance at their adjourned regular meeting on December 12, 2022, the ordinance will be included for adoption at City Council’s January 11, 2023 adjourned regular meeting. Assuming that City Council formally adopts the proposed ordinance at that meeting, it would take effect 30 days later which would be February 11, 2023. Therefore, the City Council would need to adjourn the regularly scheduled meetings being held on December 12, 2022 (adjourned regular meeting) and February 6, 2023, and resume those meetings on January 11, 2023 and February 8, 2023.

FISCAL IMPACT
There is no fiscal impact associated with this Council discussion.

ENVIRONMENTAL CONSIDERATIONS
None requiring review under California Environmental Quality Act.

RECOMMENDATION
It is recommended that the City Council take the following actions:

1. Read the title, waive further reading and introduce an Ordinance entitled; Ordinance Amending Chapter 2.08 of the Big Bear Lake Municipal Code Pertaining to City Council Meetings, and Finding the Ordinance Exempt from the California Environmental Quality Act.

2. Adopt the proposed 2023 City Council Meeting Calendar.

CEQA NOTICE OF EXEMPTION
TO: Clerk of the Board of Supervisors FROM: City Clerk’s Department County of San Bernardino City of Big Bear Lake
385 N. Arrowhead Avenue, 2nd Floor P. O. Box 10000
San Bernardino, CA 92415-0130 Big Bear Lake, CA 92315
Project Title:

Adoption of an Ordinance Amending Chapter 2.08 of the Big Bear Lake Municipal Code Pertaining to City Council Meetings
Project Location - Specific:

City-wide
Description of Project:

This action is the adoption of an Ordinance Amending Chapter 2.08 of the Big Bear Lake Municipal Code Pertaining to City Council Meetings
Name of Public Agency Approving Project:

City Council, City of Big Bear Lake
Exempt Status: (check one) (State type and section number) XX Statutory Exemption. Section: 15061(b)(3)
Reasons why project is exempt:

Adoption of this ordinance does not constitute a “project” for purposes of the California Environmental Quality Act (Pub. Resources Code, § 21000 et. seq.) (“CEQA”) and the State CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 et seq.), and therefore does not require environmental review. Specifically, under State CEQA Guidelines section 15378, “project” does not include administrative activities or government fiscal activities that do not involve any commitment to any specific project which may result in a physical change in the environment. For purposes of this code adoption, it is further proposed that even if the adoption constituted a “project” for purposes of CEQA, the project would be exempt from environmental review under State CEQA Guidelines section 15320 (Organization of Local Agencies), and 15061(b)(3), which exempts projects for which it can be seen with certainty will not result in significant environmental impacts.

MEETING
DATE: December 12, 2022
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sue O’Strander, AICP, Director of Community Development Janice Etter, AICP, Sr. Principal Planner
SUBJECT: Re-adoption of a Resolution Approving a Vacation of Right-of-Way for Francis Way

BACKGROUND
On September 19, 2022, the City Council adopted a resolution approving Vacation of Right-ofWay application 2021-140 to vacate a small, approximately 217 square foot triangular portion of right-of-way at the terminus of Francis Way. Unfortunately, after this action, during the final plan check of the documents, errors were found in the diagrams and legal descriptions which prevented the final resolution from being recorded. Upon recommendation of the City Attorney, a resolution is being returned to the Council for adoption with the corrected diagrams and legal descriptions.

DISCUSSION
The end result of the vacation of right-of-way remains the same as described in the August 15 and September 19, 2022, Agenda Reports, with the exception that the corrected measurements in the legal descriptions now show that the area to be abandoned is slightly smaller at 173 square feet.

The review of the road abandonment request occurred in compliance with the appropriate sections of the Streets and Highways Code, including the preparation of public notices, findings, and holding of a public hearing on September 19, 2022, concluding with the adoption of Resolution No. 2022-116. Subsequent adoption of today’s resolution will replace the earlier resolution. Once this corrected resolution is recorded, the vacation of right-of-way will be complete and in effect.

FISCAL IMPACT
The appraised value of the property, estimated at $3,500 will be deposited in the City’s General Fund.

ENVIRONMENTAL CONSIDERATIONS
The action to abandon a portion of right-of-way is determined to not be a “project” under Public Resources Code Section 21065, and is exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15061(b)(3), the “common sense exemption.” This Section states that where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, then the activity is not subject to CEQA. A Notice of Exemption is attached as Attachment 2.

RECOMMENDATION
Staff recommends that the Council move to adopt Resolution No. 2022-XX approving Vacation of Right-of-Way Application 2021-140 pertaining to a portion of Francis Way and finding the request not a project and categorically exempt from the California Environmental Quality Act, pursuant to the findings and recommended conditions of approval contained in the resolution and revised exhibits.

RESOLUTION APPROVING VACATION OF RIGHT-OF-WAY
APPLICATION 2021-140 FOR AN APPROXIMATELY 173

SQUARE FOOT PORTION OF FRANCIS WAY ADJACENT TO
199 AND 205 LAGUNITA LANE, APN’S 0307-071-36, 43 & 44

AND FINDING THE ACTION CATEGORICALLY EXEMPT

FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, the applicants, Stone Family Trust 4/27/2002, Mary and Richard Stone, applicants, represented by Andrew Goodwin Brown, have submitted Vacation of Right-of-Way application 2021-140 requesting that the City vacate an approximately 173 square foot portion of right-of-way of Francis Way adjacent to their properties at 199 and 205 Lagunita Lane, APN 0307-071-36, 43 & 44. The portion of right-of-way to be abandoned is legally described and graphically depicted in Exhibits A and B attached to this Resolution; and
WHEREAS, the dedication of Francis Way was made by the recording of St. Francis Woods Tract on October 5, 1922, as recorded in Book 23, Page 22 of the records of the County of San Bernardino; and
WHEREAS, these street vacation proceedings have been conducted in accordance with Division 9, Part 3 of the Streets and Highways Code, beginning with Section 8320; and WHEREAS, on August 3, 2022, the Planning Commission adopted Resolution No. PC2022-16 determining that the requested vacation of right-of-way is consistent with the General Plan; and WHEREAS, on August 15, 2022, in a regular meeting, the City Council adopted Resolution No. 2022-102 declaring a notice of intent to vacate a portion of Francis Way and establishing a date and time of a public hearing on the abandonment set for September 19, 2022, at 6:00 pm; and WHEREAS, on August 15, 2022, in a regular meeting, the City Council also adopted Resolution No. 2022-103 declaring that the property to be vacated is exempt surplus land under the Surplus Land Act, as supported by written findings; and
WHEREAS, the action to abandon a portion of right-of-way is determined to not be a project under Public Resources Code Section 21065 and is exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15061(b)(3) the common sense exemption.

This Section states that where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, then the activity is not subject to CEQA. It is determined that the vacation of right-of-way of a portion of Francis Way will have no significant environmental impact. A Notice of Exemption is retained in the permanent case file; and
WHEREAS, the City conspicuously posted a Notice of Street Vacation in excess of 15-days prior to the hearing, together with a copy of this Resolution, in three locations along Lagunita Lane and Francis Way; published a Notice of Street Vacation for two successive weeks prior to the hearing in the legal advertisement section of an newspaper of general circulation; mailed the notice to twenty-four surrounding property owners; posted the notice in three public places, and placed the notice on the City’s website. Said notices stated the date, time, and location of the public hearing; and
WHEREAS, on September 19, 2022, the City Council conducted a duly noticed public hearing on Vacation of Right-of-Way application 2021-140 in Hofert Hall of City Hall, 39707 Big Bear Boulevard, Big Bear Lake, CA 92315, and adopted Resolution 2022-116, concluded the meeting on this date; and
WHEREAS, technical errors were found in the exhibits of Resolution 2022-116. On December 12, 2022, the City Council considered a revised Resolution 2022-XX containing corrected exhibits.

WHEREAS, all prerequisites to the adoption of this Resolution 2022-XX have been met.

NOW, THEREFORE, BE IT RESOLVED by the City Council that:

1. All of the facts set forth in the above recitals of this Resolution are true and correct.

2. The City Council finds that the vacation of right-of-way application is not a project under Public Resources Code Section 21065 and is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3). This section states that where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, then the activity is not subject to CEQA. A Notice of Exemption is retained in the case file.

3. Based on evidence presented to the City Council during the September 19, 2022, public hearing and December 12, 2022, public meeting, including public testimony and written and oral agenda reports, the Council specifically finds as follows with respect to Vacation of Right-of-Way application 2021-140 to vacate an approximately 173 square foot portion at the terminus of Francis Way:
a. The requested vacation of right-of-way is consistent with the General Plan because Francis Way is not designated as an arterial or collector street on the General Plan Circulation Element plan. Pursuant to Circulation Element Policy C1.1(b.) Francis Way is considered an undesignated local street. The road abandonment request is consistent with Policy C1.1(d.) to protect existing neighborhoods because Francis Way will continue to provide access to Lagonita Lodge and three remaining private properties. The existing circulation pattern of the neighborhood will be maintained in compliance with Policy C1.6.
b. The public convenience and necessity requires the reservation of a public utility easement for all public utilities, including sewer, water, and electricity lines that currently exist within the triangular area that is proposed to be vacated. The reservation of such easements is allowed by Streets and Highways Code Section 8341.

4. Based on the findings and conclusions set forth in statements 1, 2, and 3, above, the City Council hereby adopts a Resolution approving Vacation of Right-of-Way application 2021-140, as described herein, and for the property shown in Exhibits A and B.

5. Pursuant to Streets and Highways Code Section 8325, the City Clerk shall cause a certified copy of the resolution of vacation, attested by the clerk under seal, to be recorded without acknowledgement, certificate of acknowledgement, or further proof, in the office of the recorder of the county in which the property is located. Upon such recordation, the vacation of right-of-way is complete.

PASSED, APPROVED AND ADOPTED this 12th day of December, 2022.
