MEETING
DATE: January 11, 2023
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Erica Stephenson, City Clerk/Director of Human Resources Rebecca Cannon, Deputy City Clerk
SUBJECT: Ordinance Amending Chapter 2.08 of the Big Bear Lake Municipal Code Pertaining to City Council Meetings, and Finding the Ordinance Exempt from the California Environmental Quality Act
BACKGROUND
The City of Big Bear Lake’s Municipal Code Chapter 2.08 sets forth rules and regulations related to the City Council, including establishing the days and timeframes of the City Council’s regular meetings. Currently, Municipal Code Section 2.08.010 indicates that all regular meetings of the City Council shall be held on the first and third Monday of each month.
At the December 12, 2022 Council meeting, the City Council considered an ordinance that would amend the Municipal Code to reflect that regular City Council meetings will be held on the second Wednesday of each month. At that time, the City Council did not suggest any revisions to the proposed ordinance amendment and approved a motion to read the title, waive further readings and formally introduce the ordinance.
DISCUSSION
The proposed ordinance is required to formally update the City’s Municipal Code, thereby allowing the City Council’s regular meetings be held on a monthly basis, more specifically, on the second Wednesday of each month.
It is also important to note that the proposed ordinance stipulates that Regular City Council meetings will begin at 5:00 pm or 3:00 pm or later if there is a need to conduct a Closed Session meeting. We would also propose that the special meetings/workshops would be held as daytime meetings, likely beginning at 10:00am (but may be adjusted by the City Council as needed or desired). As a reminder, City Council will still have the ability to call for a special meeting/workshop, and/or cancel a future meeting as necessary.
Assuming that Council formally adopts the proposed ordinance, it would take effect 30 days later which is February 11, 2023. Therefore, the Council would need to adjourn the regularly scheduled meeting scheduled for February 6, 2023 and resume that meeting on February 8, 2023. The March 8 meeting would then be the first meeting officially held under the newly adopted ordinance.
FISCAL IMPACT
There is no fiscal impact associated with the adoption of this proposed ordinance.
ENVIRONMENTAL CONSIDERATIONS
None requiring review under California Environmental Quality Act.
RECOMMENDATION
It is recommended that the City Council adopt an ordinance entitled; Ordinance Amending Chapter
2.08 of the Big Bear Lake Municipal Code Pertaining to City Council Meetings, and Finding the Ordinance Exempt from the California Environmental Quality Act.

SUBJECT: Resolution Authorizing a Notice of Completion for the Stanfield Marsh Boardwalks Improvements Project
BACKGROUND
The Stanfield Marsh is located to the northeast of the intersection of Big Bear Boulevard and Stanfield Cutoff and presently includes a public parking lot, foot paths, and wooden boardwalks to allow for recreation in the area. In September 2021, the City Council authorized staff to accept the transfer of these assets from the Municipal Water District (MWD) to the City and escrow closed on the transaction in July 2022. As a condition of the transfer of these assets, the MWD made a one-time payment to the City in the amount of $500,000 to contribute to the deferred maintenance of the boardwalks.
As the transfer of these assets was underway, staff developed a project to rehabilitate these structures by replacing the existing decking and handrails along the boardwalks. On August 1, 2022, the City Council awarded a contract to Schock Contracting Corporation (Santa Barbara, CA) to complete this project. The work on this project has been completed to the satisfaction of staff and it is recommended that the City Council accept the work of this project and authorize the recording of a Notice of Completion.
DISCUSSION
The City’s Engineering team designed a project that removed and replaced all existing decking and handrails. The existing support structure would remain in place but would be inspected and reinforced as deemed necessary throughout the course of the project. Staff conducted a public bid process for this project and on August 1, 2022, the City Council awarded a contract for this project to Schock Contracting Corporation in the amount of $853,150.
Schock Contracting Corporation began work on this project around the end of August. During their demolition efforts, they determined that there was a need for some enhanced structural reinforcement. The structure was constructed in that the decking was attached to the support infrastructure with nails rather than hardware. The contractor proposed a change order to install “hurricane ties” which would properly attach the new decking to the support infrastructure and reinforce the stability of the boardwalks. This was the appropriate time to complete this effort as all decking was being removed as a part of the rehabilitation effort. On September 19, 2022, the City Council approved a change order for this additional structural work in an amount not to exceed $75,000. The actual final cost of the additional work was $65,258.
The completed work was reviewed by the City’s Engineering Division as well as Building and Safety Division and the project was completed to the satisfaction of the City. Staff is recommending that the City Council authorize the recording of a Notice of Completion for this project.
FISCAL IMPACT
The contract awarded to Schock Contracting Corporation was in the amount of $853,150. With the approved change order expenditure of $65,258, the total project expenditure was $918,408.
The total budget for this project was $1,000,000, which included $500,000 from the MWD as a condition of the asset transfer and $500,000 in Measure Y proceeds.
ENVIRONMENTAL CONSIDERATIONS
At the time of approving the bid solicitation, the City Council found that these repairs are categorically exempt from the California Environmental Quality Act (CEQA) under section 15301.C as repair and maintenance of existing bicycle and pedestrian facilities.
RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing a Notice of Completion for the Stanfield Marsh Boardwalks Improvements Project.

SUBJECT: Resolution Authorizing a Notice of Completion for the Demolition of the Building at 40986 Big Bear Boulevard Project
BACKGROUND
On August 1, 2022, a 99-year ground lease became effective between the City of Big Bear Lake and Bear Valley Mutual Water Company for 19-acres of property located between Big Bear Boulevard and Big Bear Lake. The property presently includes two (2) commercial restaurant properties, two (2) residential units, and a fifty-nine (59) space mobile home park. On the property was a building at 40986 Big Bear Boulevard that was dilapidated and unsafe with no present or future use opportunities.
On November 7, 2022, the City Council awarded a contract to T-Rex Demolition, Inc. (Baldwin Park, CA) for the demolition of this structure and clearing of the site in the amount of $31,932.
Work has been completed on this project and staff is recommending that the City Council accept the work of T-Rex Demolition and authorize the recording of a Notice of Completion for this project.
DISCUSSION
The building that was located at 40986 Big Bear Boulevard was a commercial structure that previously housed a sign shop. The property has been vacant for several years and there was an incomplete tenant improvement project that was undertaken on the property. The building exterior was dilapidated and has lacked maintenance for several years, rendering it unsafe. Staff‘s assessment of the structure was that there was no present or future use for it and that any identified use would require considerable expense associated with improving the building to make it habitable.
T-Rex Demolition, Inc. began work on this effort on Monday, December 5, 2022 and the work was completed on Friday, December 9, 2022. This effort included the disconnection and securing of all utilities, the complete demolition of the structure, and the removal of all hardscape and other site improvements. The site has been cleared to bare land. The work has been completed to the satisfaction of staff and it is recommended that the City Council should accept the work on this project and issue a Notice of Completion.
FISCAL IMPACT
The Demolition of the Building at 40986 Big Bear Boulevard was completed at a total cost of $31,932.11, which is the total cost of the awarded contract for this effort. This effort was funded through Measure Y proceeds which were allocated by the City Council for the initial efforts associated with the Bear Valley Mutual Property.
ENVIRONMENTAL CONSIDERATIONS
At the time of authorizing the bid solicitation, the City Council found this project to be categorically exempt from the California Environmental Quality Act (CEQA).
RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing a Notice of Completion for the Demolition of the Building at 40986 Big Bear Boulevard Project.

SUBJECT: Resolution Authorizing a Notice of Completion for the Moonridge Road Corridor Improvements Project
BACKGROUND
The Moonridge Corridor Improvements Project was identified within the Rathbun Corridor Sustainability Plan (2017) as a high priority project for the City aimed at transforming the portion of Moonridge Road located between Elm Street and Clubview Drive. Design work, which included considerable public outreach, commenced in 2017 and a final design was presented to the City Council in November 2019. By the Spring of 2021, City staff had refined the design and developed a funding plan to enable this project to become a reality.
On June 21, 2021, the City Council awarded a construction contract to Granite Construction Co. (Granite) in the amount of $8,379,649 for the Moonridge Corridor Improvements Project (Moonridge Project). This project includes comprehensive streetscape improvements along the portion of Moonridge Road from Elm Street to Clubview Drive, including traffic calming roundabouts, widened sidewalks, a bicycle trail, medians and parkways, and improved landscape and amenities throughout the corridor. Work commenced in the summer of 2021, broke for the winter season (November 2021 to April 2022), and work resumed in April 2022 and continued until it was completed in November 2022.
Work has been completed for this project according to the conditions of the construction contract and staff is recommending that the City Council accept the work of Granite Construction Co. for the Moonridge Corridor Improvements Project, authorize the recordation of a Notice of Completion, and authorize all remaining payments, including retention, associated with this project.
DISCUSSION
The Moonridge Corridor, which is the portion of Moonridge Road between Elm Street and Clubview Drive, is a major roadway providing access to residential areas, the existing commercial corridor, and Bear Mountain Resort. Prior to this project, the roadway consists of four driving lanes, with two in either direction, a center lane, angled parking, and narrow sidewalks. The design efforts for this project focused on transforming this corridor with a reconstructed roadway, featuring traffic calming elements, enhanced pedestrian and bicycle facilities, landscaping, streetlighting, and other amenities. The design process included considerable public outreach and engagement with the public feedback shaping the selection of the amenities for this project.
The initial design was presented to the City Council in November 2019. In early 2021, this project was again presented to the City Council to review and adjust the final design and review a project funding plan that had been developed. On April 5, 2021, the City Council adopted a resolution authorizing staff to solicit construction bids for this project.
On June 21, 2021, the City Council awarded a construction contract to Granite Construction Co. (Granite) in the amount of $8,379,649 for the Moonridge Corridor Improvements Project and allocated a total project budget of $9,000,000. Construction activities commenced in August 2021 and were completed in November 2022, with a break for the winter season between November and April.
Change Orders
The City Council reviewed and considered two change orders during the course of the project. At the meeting of July 18, 2022, the City Council approved expending $120,000 on the addition of electrical receptacles throughout the corridor area. The receptacles were added to the planned street light poles as well as within the landscape areas to support events and public uses as well as seasonal decorations. The $120,000 for this effort was made available from unencumbered funds that were available as part established project budget.
At the City Council Meeting of August 1, 2022, the City Council awarded a change order to Granite for additional street improvements on local streets that are adjacent to and intersect Moonridge Road as well as some drainage improvements along Fir Street that tie into the project area. These improvements were identified as separate projects within the City’s adopted Capital Improvement Program (CIP) budget. Granite’s proposed change order price was $390,000 for the improvements, which is within the available budget. The approval of the change order, and specified budget, brought the total available project budget to $9,390,000.
Coordination with Outside Utility Agencies
As this project conducted extensive work to an existing streetscape, the project required extensive coordination with local utility providers, namely Bear Valley Electric Service, Inc. and the Department of Water. The project, as designed, included necessary relocations of water infrastructure and electrical infrastructure to accommodate the desired improvements.
In order to accommodate the placement of the widened sidewalk, the project plans called for the relocation of approximately three (3) electricity poles owned by Bear Valley Electric Service, Inc.
As the team was working in the field to coordinate the work, the opportunity presented itself to underground the electrical lines rather than relocate them. This section was the only remaining above ground services, but for the transmission lines, within the corridor and the project team felt it would benefit the overall quality and appearance of the finished project to underground these lines and remove the poles. The cost of this enhancement was approximately $30,000 and was partially offset by existing costs that were within the project associated with this effort.
Additionally, the City’s project team worked very closely with the Department of Water as the project included extensive relocations of existing water infrastructure to accommodate the road design and the placement of drainage infrastructure. In January 2022, the City Council authorized a payment to the Department of Water for the replacement of a water main along the Moonridge Corridor in lieu of relocating it, which was initially included in the project. The collaborative effort exhibited by the Project Team and the representatives from the Department of Water resulted in cost savings and a better quality delivery.
As the project progressed, another opportunity for coordination with the Department of Water availed itself that the City took advantage of for the project. As the roundabout at Moonridge and Elm was being constructed, portions of the waterline and several fire hydrants needed to be relocated. In reviewing the condition of the pipeline, it was determined that it would be in the best interest of the finished project to replace the pipeline before the new roundabouts were constructed above. The existing pipeline was dated and prone to leaks, may have ultimately been damaged as a part of the construction or may have failed later on, which would have resulted in the need to excavate the roundabout. DWP coordinated the replacement and relocation of the pipeline as well as the hydrants and the other appurtenant work with the understanding that the costs would be split with the City. The City’s share of this effort with the Department of Water is $150,000 and is partially offset by credits for work that was not performed by Granite. The net financial impact of this effort is approximately $55,000.
Additional Project Items
In addition to the civil construction work for the Moonridge Project highlighted within this report, there are additional fixtures and amenities that are forthcoming. City Staff is responsible for the installation of the amenities and other fixtures. Staff has completed the placement of the benches while the installation of trash receptacles, bicycle racks, and water fountains is anticipated for Spring 2023. These items are either on order or in staff’s possession and will be placed as weather conditions allow.
FISCAL IMPACT
The established budget for the Moonridge Corridor Improvements Project was $9,000,000 with funding provided through several sources, including Measure I Major Local Highway Program Funds, the General Fund, Measure Y Transient Occupancy Tax, and the American Recovery Program Act. The funding allocation is as follows:
Moonridge Project Budget & Expenditures
MLHP – Measure I $3,200,000
General Fund TOT $3,077,751
Measure Y TOT (Incl. additional approved 8/1/22) $1,849,400 ARPA $1,262,849
Total Final Budget $9,390,000
Construction ($8,971,131)
Construction Management ($ 136,822)
Furniture/Fixtures/Other Construction Elements ($ 185,297) Total Expenditures: ($9,293,250)
Variance ($ 96,750)
The expenditures include the total construction contract with Granite construction ($8,534,485), the additional utility expenses, construction management services, and the additional construction elements such as the fixtures and furnishings that the City has coordinated.
ENVIRONMENTAL CONSIDERATIONS
This action is not subject to environmental review. The City Council previously found that these repairs are categorically exempt from the California Environmental Quality Act (CEQA) under section 15301.C as repair and maintenance of existing bicycle and pedestrian facilities.

SUBJECT: Resolution Authorizing a Professional Services Agreement with the Eden Group for Design Services Associated with the Civic Center/Performing Arts Center Restroom Improvements Project
BACKGROUND
The Big Bear Lake Civic Center and Performing Arts Center was opened for service in 1989. The facility encompasses all City administrative offices as well as a 400-seat performing arts center.
The restrooms located within the lobby serve the offices and the Performing Arts Center and are original to the construction of this building. The approved Capital Improvement Program (CIP) budget includes funding for the Civic Center/Performing Arts Center Restroom Improvements Project with the goal of completing all necessary accessibility improvements, pursuant to the Americans with Disabilities Act, as well as providing for an update and refreshing of the existing facilities.
Staff solicited proposals for design services for this project to identify a firm capable of providing the necessary design services, especially the accessibility requirements, and preparing a complete set of construction plans and specifications. The Eden Group (Big Bear Lake, CA) has proposed to provide these design services and has demonstrated their experience with similar projects of this nature. Staff is recommending that the City Council authorize an agreement for these services with the Eden Group.
DISCUSSION
Included in the approved Capital Improvement Program (CIP) budget for Fiscal Year 2022-23 is funding for the Civic Center/Performing Arts Center Restroom Improvements Project. The primary objective of the project is to make necessary accessibility improvements to the restrooms to ensure compliance with the Americans with Disabilities Act. Additionally, the project will include an update to and refreshing of the facilities as they date to the original construction of the building from 1989.
Staff developed a scope of work document and solicited it to local design firms experienced in these types of projects. The scope of work includes the development of conceptual designs to meet the ADA requirements, selecting the desired finishes and improvements, and developing a complete set of construction plans and specifications for this project. A site visit was conducted, as a part of the RFP process, to allow potential proposers to observe the site to assist with preparing their proposals. Ultimately, the City received one (1) proposal from the Eden Group who is located in Big Bear Lake, CA. The Eden Group’s proposed price is not to exceed $30,000 for the specified scope of work.
The Eden Group has been in business since 1982 and they maintain offices in Los Angeles and Big Bear Lake. They have an extensive resume of projects both in the public and private sectors.
The team assigned to this project have completed similar design services for public restroom projects at major airports, theme parks, and multiple commercial clients.
It is anticipated that these services will get underway immediately and the anticipated timeline for the design is about four months. Once the design is completed, staff will develop a construction plan and timeline that minimizes disruption to City operations and scheduled events in the Performing Arts Center.
FISCAL IMPACTS
The approved Capital Improvement Program (CIP) Budget for Fiscal Year 2022-23 includes funding for the Civic Center/Performing Arts Center Restroom Improvements Project. This project is funded in the amount of $256,567 with the primary funding source being Community Development Block Grant (CDBG) proceeds.
ENVIRONMENTAL CONSIDERATIONS
This action does not require review pursuant to the California Environmental Quality Act (CEQA).
A CEQA determination for this project will be made after the design is completed and will be brought forward for City Council consideration at a future meeting.
RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing a Professional Services Agreement with the Eden Group for Design Services Associated with the Civic Center/ Performing Arts Center Restroom Improvements Project.

DATE: January 11, 2023
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Director of Public Services
Jared Cheek, Public Works Operations Manager
SUBJECT: Resolution Authorizing the Solicitation of Bids for Annual Street Sweeping Services
BACKGROUND
The Public Works Division is responsible for the maintenance of all public infrastructure within the City, including the City’s roadway network. A key activity for the Public Works team is the annual sweeping of streets within the City. Street sweeping contributes to keeping up the appearance of the City, it removes the cinders and other debris left on the roads from winter operations, and helps the City to maintain compliance with the National Pollutant Discharge Elimination System (NPDES) requirements related to stormwater. Historically, street sweeping has been provided through a combination of in-house staff and contracted services.
Funding is included within the Fiscal Year 2022-23 annual budget for the provision of annual street sweeping services. Staff intends to solicit bids for these services in order to identify and contract a provider to be ready to execute this work at the conclusion of the winter season.
DISCUSSION
The City of Big Bear Lake owns and is responsible for the maintenance of approximate eightyeight (88) miles of streets. Annual street sweeping is a key part of the City’s maintenance programs to maintain the appearance of the City and the overall condition of the City’s street network. Street sweeping assists the City in complying with the NPDES requirements related to stormwater as it removes debris from the roadways which might otherwise be deposited in the City’s drainage system. This work is generally undertaken in the spring and summer, as weather allows, and it removes cinders and other debris left behind from winter operations.
The scope of work for the City’s street sweeping effort is to sweep the entire width of all City streets once per year. Over the years, this effort has been undertaken through a combination of City staff and contracted services. For Fiscal Year 2022-23, funding is included within the budget to allow for contracted services to handle the Citywide street sweeping efforts. Staff is seeking approval to conduct a bid solicitation for these services to identify a qualified contractor. In addition to the contracted services, City staff will continue to perform routine street sweeping which includes weekly service within the Village and along Big Bear Boulevard as well as other areas as needed.
Upon City Council approval, staff will undertake a bid solicitation for these services. Staff intends to present the contract for these services for City Council consideration in April 2023 to allow the services to get underway in May 2023.
FISCAL IMPACTS
Funding is included in the approved Fiscal Year 2022-23 annual budget within the Street Maintenance function.
ENVIRONMENTAL CONSIDERATIONS
This action does not require review pursuant to the California Environmental Quality Act (CEQA) as it is not a project pursuant to the definitions within the Act.
RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing the Solicitation of Bids for Annual Street Sweeping Services.

SUBJECT: General Plan Amendment 2022-044 and Zone Change 2022-045 for the Property Located at 527 Georgia Street
BACKGROUND
The applicants and property owners, Barret Randel and Angie Raskovic, submitted applications General Plan Amendment 2022-044 and Zone Change 2022-045 to change the land use designation and zoning of their property from Commercial General to Single Family Residential.
On December 7, 2022, the Planning Commission held a public hearing and adopted Resolution No. PC2022-25 by a vote of 3 in favor, 0 against, and 2 absent determining the actions exempt from the California Environmental Quality Act (CEQA) and recommending that the City Council adopt a Resolution approving the General Plan Amendment, and adopt an Ordinance approving the Zone Change.
DISCUSSION
The property, addressed at 527 Georgia Street, is located on the south side of Big Bear Boulevard, adjacent to the 76 gas station and across the street (to the east) from the Big Bear Middle School.
The lot, created in 1923, measures 50 feet wide by 145 feet deep and contains 7,250 square feet in area.
In 1980, the primary residence was built
on the rear portion of the property. In
1987, a detached garage and second
floor apartment was approved and added
at the front of the property.
In 2003, the City zoning map was adopted and changed the site’s zoning to Commercial-General (C-2), consistent with the underlying General Plan designation of Commercial General (C-G).
Under the new C-2 zoning restrictions, single or multiple family residential uses are no longer allowed as a primary use. Therefore, the two residential structures are now legal nonconforming.
General Plan Amendment and Zone Change Request
The subject property abuts single family residentially-zoned property to the south, and a singlefamily residential designation is appropriate for this property. This request (see Figures 1 and 2) would change the General Plan land use designation from Commercial General (CG) to Single Family Residential (SFR-4), and zoning from Commercial-General (C-2) to Single Family Residential (R-1).
Although the property owner has no plans for any changes, the existing residential uses are more in alignment with residential designations. For example, recent changes to state law pertaining to the single family zone allow “second units” as described in Development Code Section 17.25.130 and “accessory dwelling units” as described in Development Code Section 17.25.210 . If the apartment above the garage were designated in the future as a second unit or ADU, this would conform to a residential designation.
At the December 7, 2022, public hearing, the Planning Commission adopted a resolution finding the actions consistent with the General Plan and Development Code, and recommended the City Figure 1 - General Plan Amendment Figure 2 – Zone Change Amendment Council approve the general plan amendment and zone change requests. The Commission found and further recommends that the Council find that the General Plan Amendment is not in conflict with Government Code Section 65358(b) as this is the first General Plan Amendment request in 2023. Lastly, the Commission found and recommends that the Council find that the proposed change in zoning will not have a substantial adverse effect on surrounding properties or the community in general. The nearby commercially-zoned properties have expanded with additional buildings and parking lots while coexisting with the residential uses on the subject site. Likewise, the properties to the south have been developed with single family residential dwellings. The Planning Commission staff report is attached for convenience.
FISCAL IMPACT
There is no fiscal impact associated with staff’s recommendations for this item.
ENVIRONMENTAL CONSIDERATIONS
The General Plan Amendment is subject to the provisions of SB 18, Tribal Notification under Government Code Section 65352.3. A list of affected tribes was obtained from the Native American Heritage Commission and notices were sent to five tribes on August 31, 2022, beginning a 90-day notification period. The notification period concluded on November 29, 2022, and no tribes requested formal consultation.
These General Plan Amendment and Zone Change applications have been determined to be categorically and statutorily exempt from the California Environmental Quality Act. No physical changes are proposed to the property. The categorical exemption pertains to the existing two dwelling units on the property for which there is no expansion of use. Therefore, the action qualifies as a Class 1 exemption under Section 15301. The statutory exemption pertains to the fact that there will be no direct or indirect physical change to the environment associated with the applications. Therefore, the General Plan Amendment and Zone Change are determined to be “not a project” under Section 15378 of the State CEQA Guidelines.
RECOMMENDATION
It is recommended that the City Council take the following actions:
1. Adopt a Resolution Approving General Plan Amendment 2022-044 and Finding the Action Categorically and Statutorily Exempt From the California Environmental Quality Act and Changing the General Plan Land Use Element Map Designation of 527 Georgia Street (APN 0309-144-24) From Commercial-General (CG) to Single Family Residential (SFR-4).
2. Read the title, waive further reading and introduce an ordinance entitled: Ordinance Approving Zone Change 2022-045 and Finding the Action Categorically and Statutorily Exempt from the California Environmental Quality Act and Changing the Zoning of 527 Georgia Street (APN 0309-144-24) from Commercial-General (C-2) to Single Family Residential (R-1-7200).

NOW, THEREFORE, the City Council of the City of Big Bear Lake does resolve as follows:
Section 1. The City Council hereby specifically finds that all of the facts set forth in the above recitals of this resolution are true and correct.
Section 2. The City Council hereby finds that the General Plan Amendment application is categorically and statutorily exempt from the California Environmental Quality Act under a Class 1 exemption of Section 15301 and Section 15378, respectively, of the State CEQA Guidelines.
Section 3. Based on the evidence presented to the City Council during the January 11, 2023, public hearing, including public testimony and written and oral staff reports, the City Council specifically finds as follows with respect to General Plan Amendment 2022-044:
1. The General Plan Amendment promotes the goals and objectives of the City of Big Bear Lake General Plan and each element thereof, and leaves the General plan a compatible, integrated and internally consistent statement of goals and policies. The proposed amendment conforms to policies in the Land Use, Community Design, and Housing Elements of the General Plan, specifically Program L 1.1.1 to update the map as necessary, Policy L 3.1(d.) to consider existing parcelization and relationship between uses in designating residential land uses, Policy CD 6.1 to create buildable sites, and Policy H1 to ensure adequate land for residential development.
2. The General Plan Amendment is consistent with the intent of the General Plan Land Use Element for ongoing review and revision of the plan. The application was filed by the property owners, Barret Randel and Angie Raskovic, because of the small parcel size of 7,250 sf and the existing improvements of two dwelling units, the property is impractical for commercial development and more suitable for a residential designation. The land use of the property is currently nonconforming with respect to the commercial designation.
Under a residential designation, it is possible to make the land use conforming.
3. Adoption of this General Plan Amendment will not be in conflict with Government Code Section 65358(b) relating to the number of amendments permitted per year because this amendment is the first amendment action of calendar year 2023.
Section 4. Based on the findings and conclusions as set forth in Sections 1, 2, and 3, above, the City Council hereby adopts a Resolution Approving General Plan Amendment application 2022- 044 and finding the action categorically and statutorily exempt from the California Environmental Quality Act and changing the General Plan Land Use Element map designation of 527 Georgia Street (APN 0309-144-24) from Commercial-General (CG) to Single Family Residential (SFR-4), as provided in Exhibit A.
Section 5. The City Clerk shall certify to the adoption of this resolution.

WHEREAS, the Zone Change application is determined to be categorically and statutorily exempt from the California Environmental Quality Act. No physical changes are proposed to the property.

The Council read the title, waived further reading, and introduced an ordinance approving Zone Change 2022-045; and WHEREAS, on February 8, 2023, the City Council conducted a public meeting on the Zone Change application in Hofert Hall of the Civic and Performing Arts Center, 39707 Big Bear Boulevard, Big Bear Lake, California, 92315, and concluded the public meeting on that date; and WHEREAS, all legal prerequisites to the adoption of this ordinance have occurred.
NOW, THEREFORE, the City Council of the City of Big Bear Lake does ordain as follows:
Section 1. The City Council hereby specifically finds that all of the facts set forth in the above recitals of this ordinance are true and correct.
Section 2. The City Council hereby finds that the Zone Change application is categorically and statutorily exempt from the California Environmental Quality Act under a Class 1 exemption of Section 15301 and Section 15378, respectively, of the State CEQA Guidelines.
Section 3. Based on the evidence presented to the City Council during the January 11 and February 8, 2023, public hearing and public meeting, including public testimony and written and oral staff reports, the City Council specifically finds as follows with respect to Zone Change 2022-045:
1. The zone change is consistent with the City of Big Bear Lake General Plan because the Land Use Element recognizes the need to reevaluate the land use plan and make amendments as needed. Since incorporation, the land use designation of the property has changed. An earlier designation allowed multiple family residential development as a primary land use. The current designation is primarily a commercial zone. The small parcel size, existing residential improvements, and its location abutting residential zoning to the south makes this property impractical for commercial development but suitable for a residential zoning.
2. The site of the proposed zone change is suitable for any of the land uses permitted within the proposed zone district. The predominant land use in Single Family Residential (R-1) zone is a single family residence. The property is presently developed with two legal nonconforming dwelling units. Recent changes to state law and the Development Code allow second units and ADUs in the single family residential zone. Therefore, it is possible to make the two dwelling units on the property conforming with respect to the single family residential zoning.
3. The proposed change in zoning is reasonably beneficial at this time. The proposed amendment adds one parcel to the City’s inventory of residentially-zone land, more importantly, preserves two dwelling units. Both dwelling units are of modest size and, if rented full-time, would provide for affordable housing in compliance with Housing Element Goals H1, H2, H3 and H4, and the policies implementing those goals.
4. The proposed change in zoning will not have a substantial adverse effect on surrounding properties or the community in general. The surrounding commercially-zoned properties have expanded with additional buildings and parking lots while coexisting with the residential uses on the subject site. Likewise, the properties to the south have been developed with single family residential dwellings.
Section 4. Based on the findings and conclusions as set forth in Sections 1, 2, and 3, above, the City Council hereby adopts an Ordinance approving Zone Change application 2022-045 and finding the action categorically and statutorily exempt from the California Environmental Quality Act and changing the General Plan Land Use Element map designation of 527 Georgia Street (APN 0309-144-24) from Commercial-General (C-2) to Single Family Residential (R-1-7,200), as provided in Exhibit A.
Section 5. The City Clerk shall certify to the adoption of this ordinance and shall either: (a) have this ordinance published in a newspaper of general circulation within 15 days after its adoption or (b) have a summary of this ordinance published twice in a newspaper of general circulation, once five days before its adoption and again within 15 days after its adoption.

BACKGROUND
According to the records of San Bernardino County, the primary residence was built on the rear portion of the property in 1980. In 1987, Plot Plan Review application 87-36 was approved by the City to construct the detached garage and second floor apartment in front of the residence, as was allowed at the time under the Commercial- Multi Family (C-2) zoning. (See Attachment 3, 1987 Building Permit Plans 527 Georgia).
In 1999, the adopted General Plan Land Use Element designated the subject site as CommercialGeneral (C-G). In 2003, the zoning map was adopted and changed the site’s zoning to Commercial-General (C-2), consistent with the General Plan. At that time, other changes to the Commercial-General designation included new restrictions that no longer allow single or multiple family residential uses as a primary use. Therefore, the two residential structures, which were legally entitled and constructed under the 1987 General Plan and Development Code, are now legal nonconforming uses.
General Plan Amendment 2022-044 and Zone Change 2022-045 – 527 Georgia Street Planning Commission Date: December 7, 2022
ANALYSIS
At this time, the property owner has no plans to change the existing residential uses. If the General Plan Amendment and Zone Change applications are approved, the two dwelling units on-site would still be considered legal non-conforming under Development Code Section 17.03.320.
However, recent changes to state law pertaining to the single family zone allow second units as described in Development Code Section 17.25.130 and Accessory Dwelling Units as described in Development Code Section 17.25.2101. If the apartment above the garage were designated either a second unit or ADU, the land use would be considered conforming.
As noted previously, the property abuts single family residentially-zoned property to the south.
Therefore, a single-family residential designation is appropriate for this property. The property is not adjacent to multiple-family residential zoning, therefore, a multiple family designation is not under consideration. As currently developed, the subject site is more in alignment as a residential property than a commercial property.
Development Code Conformance
The minimum lot size in the Commercial-General zone is 20,000 sf in area. The minimum lot area in the Single Family Residential (R-1) zone is 7,200 sf in area. The lot area of the subject property is 7,250 sf, therefore the lot is not in compliance with the commercial lot size standard, but is compliant with the residential standard.
The property’s lot width is only 50 feet, which does not comply with the minimum commercial or residential lot width of 60 feet. However, the lot was legally created in 1923, before adoption of the minimum lot standards in 1951, and this lot width is considered legal nonconforming. The lot depth dimension of 145 feet complies with both the commercial and residential lot depth requirement.
No new development is proposed on the property. An evaluation of the existing development with respect to the Single Family Residential standards is shown in the table below.

Vacation Rentals
Vacation rentals are regulated through Municipal Code Chapter 4.01. As shown in Ordinance Attachment C, the Vacation Rental Eligibility Table (Attachment 4 of this report) only one of the dwelling units on the property is eligible to be a vacation rental if the two dwelling units on the property continue to be legal nonconforming.
However, if the land use on the property is changed to a conforming use through the designation of one or more units as a second unit/two-unit project under Development Code Section 17.25.130 (SB 9) or designation of the apartment over the garage as an ADU, then provisions in the state law and the Development Code prohibit these units from being a vacation rental (rented for less than 30 days). Additionally, the provisions of Municipal Code Chapter 4.01 Ordinance Attachment C pertaining to ADUs and Development Code Section 17.25.130(e)(9)(B) pertaining to second units (SB 9) further prohibit the primary dwelling unit from being a vacation rental when these sections are invoked.
The Development Code provisions would allow the full-time occupancy of one or both of the units.

SUMMARY CONSISTENCY ANALYSIS
L 1.1.1
Update the General Plan Land Use Map as
needed through the General Plan
Amendment process
The property owner seeks to designate
the land Residential and is requesting this
amendment.
L 3.1 (d.)
Consider topography, existing parcelization,
existing land uses, infrastructure availability
and relationship between uses in designating
residential land uses
Because of the property size and the
existing residential improvements, the lot
is impractical for commercial development
and more suitable for a residential
designation.
CD 6.1 Ensure that each legally-created lot is
buildable
As evidenced by the land use entitlements
and building permits that have been
issued on the property, the lot is buildable.
The existing improvements on the
property are in compliance with the
residential development standards.
H1 Ensure availability of adequate land capacity
The property is currently developed and

is appropriate to have a Residential
designation.
FINDINGS
The Commission must determine that the proposed amendment promotes the goals and objectives of the City of Big Bear Lake General Plan and adopted elements in order to approve this General Plan Amendment. The Zone Change request must also be found consistent with the General Plan. Facts to support these findings are shown in the following paragraphs:
2. The General Plan Amendment is consistent with the intent of the General Plan Land Use Element for ongoing review and revision of the plan because the property owner has brought this request forward for consideration. Because of the small parcel size of 7,250 sf and the existing improvements of two dwelling units, the property is impractical for commercial development and more suitable for a residential designation. The land use of the property is currently nonconforming with respect to the commercial designation. Under a residential designation, it is possible to make the land use conforming.
General Plan Amendment 2022-044 and Zone Change 2022-045 – 527 Georgia Street Planning Commission Date: December 7, 2022
3. Adoption of this General Plan Amendment will not be in conflict with Government Code Section 65358(b) relating to the number of amendments permitted per year because this amendment is the second amendment action of calendar year 2022. Processing of this application may extend into 2023, and in this situation, the amendment may be the first amendment in calendar year 2023.
4. The current designation is a primarily commercial zone. The small parcel size, existing residential improvements, and its location abutting residential zoning to the south makes this property impractical for commercial development but suitable for a residential zoning.
6. The proposed change in zoning is reasonably beneficial at this time. The proposed amendment adds one parcel to the City’s inventory of residentially-zoned land and, more importantly, preserves two dwelling units. Both dwelling units are of modest size and, if rented full-time, would provide for affordable housing in compliance with Housing Element Goals H1, H2, H3 and H4, and the policies implementing those goals.
ENVIRONMENTAL DETERMINATION
The General Plan Amendment is subject to the provisions of SB 18, Tribal Notification under Government Code Section 65352.3. A list of affected tribes was obtained from the Native American Heritage Commission and notices were sent to five tribes2 on August 31, 2022, beginning a 90-day notification period. The notification period concluded on November 29, 2022, and no tribes requested formal consultation.

General Plan Amendment 2022-044 and Zone Change 2022-045 – 527 Georgia Street Planning Commission Date: December 7, 2022
These General Plan Amendment and Zone Change applications have been determined to be categorically and statutorily exempt from the California Environmental Quality Act, and therefore are not subject to the requirements of early tribal notification under AB 52.
As stated earlier, no physical changes are proposed to the property.
The Notice of Exemption is attached to this report as Attachment 2.
PUBLIC OUTREACH
A Notice of Public Hearing has been prepared for this item. The notice was mailed to 25 surrounding property owners on November 22, 2022. It was published in the legal advertisement section of The Grizzly newspaper on Wednesday, November 23, 2022. This notice was posted in three public places and on the City’s website www.citybigbearlake.com. As of the date of writing this staff report, no public correspondence has been received.
APPEAL PROCEDURE
As the recommended actions by the Planning Commission are not final, but rather are recommendations to the City Council, there is no appeal procedure for such action. Upon the Planning Commission’s action, the General Plan Amendment and Zone Change applications will be scheduled for a public hearing before the City Council in 2023.

MEETING
DATE: January 11, 2023
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Director of Public Services
SUBJECT: Resolution Amending the Professional Services Agreement with the Caritas Acquisitions IV, LLC (“Caritas”) for the Management of the Leisure Bear Mobile Home Park through December 31, 2023
BACKGROUND
In November 2021, the City Council authorized the execution of a 99-year ground lease with Bear Valley Mutual Water Company for 19-acres of property located between Big Bear Boulevard and Big Bear Lake. The property includes considerable open space and lake frontage as well as existing restaurant uses and a 59-space mobile home park. The lease agreement became effective on August 1, 2022 and the City has assumed the controlling interest in the property.
Staff’s immediate focus is transitioning the resources to maintain and support the existing land uses on the site including the restaurants, residential units, and the mobile home park. The intent of the City is to maintain and improve the mobile home park for the benefit of the residents. In order to properly manage and support the mobile home park, staff identified a professional consultant to provide the necessary management services related to the mobile home park. On August 15, 2022, the City Council authorized a professional services agreement with Caritas Acquisitions IV, LLC (“Caritas”), a nonprofit corporation, for the asset and property management services associated with the Leisure Bear Mobile Home Park. Caritas has extensive experience in the realm of mobile home park development and management as well as affordable housing.
The agreement with Caritas expired on December 31, 2022 as it was intended for an interim period while Caritas learned more about the park and its needs to form the basis of a long-term agreement.
Caritas has requested that the City extend the current agreement for the period of one year rather than enter into a long-term agreement at this time. Staff is supportive of Caritas’ request and is recommending that the City Council amend the current agreement through the period ending December 31, 2023.
DISCUSSION
Effective August 1, 2022, the City of Big Bear Lake now represents the controlling interest in the described 19-acres of property through a 99-year ground lease from Bear Valley Mutual Water Company. The initial intent of this acquisition is to maintain and sustain the existing land uses while ultimately developing plans for enhanced public access and a park on the remaining available open space.
A key land use existing on the property is a 59-space mobile home park known as Leisure Bear Mobile Home Park. Throughout the due diligence review and at the July 18, 2022 City Council meeting, the City Council expressed their intent to maintain the mobile home park for the tenants.
As a means of honoring these intentions, staff believes that an appropriate property management partner can assist the City in being good stewards of this property. Staff identified Caritas as a partner to assist with the efforts related to the due diligence analysis. As staff was pleased with their expertise, their approach to the project, and their willingness to work as a partner with the City, the City and Caritas entered into a preliminary property management agreement.
Under the agreement that was approved through December 31, 2022, Caritas has provided the following services to the Leisure Bear Mobile Home Park:
• Asset and Property Management of the property
• Collection of all rents from the tenants
• Payment of all operating expenses from the collected rent revenue • Taking all steps to reasonably manage the property including coordinating and monitoring routine maintenance and repairs
• Coordinate any necessary modifications of leases and submit them to the City for execution • Hire, supervise, and terminate any independent contractors or service providers needed to manage and operate the property
• Receive all tenant communication and coordinate with the City as to any needed responses • Receive and manage all funds, issues payments for utilities and other expenses, and maintain accounting records and accountability to the City for all funds associated with the property
Under this arrangement, Caritas provides for onsite management in the office two (2) days per week as well as daily availability of a live in representative. Additionally, Caritas has worked to instill a sense of community within the mobile home park by getting to know the residents, preparing small treats for some of the recent holidays, and hosting a small Christmas gathering with gifts for the children living in the park. Caritas has demonstrated their commitment to the community and their expertise in managing communities of this nature.
Caritas has requested an extension of the existing agreement, rather than the execution of a new agreement, in order to continue to analyze and review the resources required to manage this park.
As they have only been on site for a little more than four (4) months, they are seeking additional time to experience the park and its needs so that a management contract going forward, for a longterm period, is well structured and developed to best meet the needs of the community in a costeffective manner. This extension period will benefit both the City and Caritas in determining the best overall approach for a long-term agreement for the management of the Leisure Bear Mobile Home Park. Under the proposed extension, the scope of services, available resources, and compensation will remain the same as it has been during the interim period.
Pursuant to the existing agreement, Caritas receives $11,750 per month which is payable from the existing revenues associated with the operations of Leisure Bear Mobile Home Park. Staff has reviewed the operational revenues and expenses from the initial contract period and there are sufficient resources available to fund the management expenses of Caritas.
FISCAL IMPACTS
The total cost associated with the proposed agreement is $141,000 for the period ending December 31, 2023. As these services are funded through the recognized revenues from the mobile home park operations, this agreement does not have a fiscal impact to any of the City’s operating accounts or approved budget.
ENVIRONMENTAL CONSIDERATIONS
None requiring review pursuant to the California Environmental Quality Act.
RECOMMENDATION
It is recommended that the City Council adopt a Resolution Amending the Professional Services Agreement with the Caritas Acquisitions IV, LLC (“Caritas”) for the Management of the Leisure Bear Mobile Home Park through December 31, 2023.
