Staff anticipates the presentation of the construction contracts for City Council consideration beginning with the June 14, 2023 meeting and, at that time, staff will provide comprehensive project budgets, anticipated costs and timelines. In 2021, Precision performed an assessment of the City’s sidewalk network to identify necessary replacements, repairs, and trip hazards.
Precision has proposed to perform repair and trip hazard remediation services on the identified sidewalk segments under the terms and pricing made available to all CJPIA member agencies. The repair methodology will result in all sidewalk separations and lifts being cut to ensure a smooth, safe, and accessible path. Staff is also preparing a project for sidewalk that is in need of replacement and that will be brought forward for consideration at a future meeting.

SUBJECT: Resolution Authorizing Bid Solicitations for Upcoming Capital Improvement Projects and Finding the Projects Exempt from the California Environmental Quality Act
BACKGROUND
Beginning in Fiscal Year 2021-22, as a part of the budget adoption process, the City Council adopted a Five-Year Capital Improvement Program Budget that includes a variety of projects to improve streets, parks, trails, facilities, sanitation, and equipment throughout the City. For Fiscal Year 2022-23, the City Council again adopted a Five-Year Capital Improvement Program Budget which includes twenty-nine (29) projects or initiatives within the above areas of focus for the current Fiscal Year. Additional projects will again be considered as a part of the forthcoming budget adoption for Fiscal Year 2023-24.
The City’s purchasing guidelines require that the City Council provide authorization to the staff to proceed with bidding activities for the proposed capital improvement projects. This report includes a summary overview of each project to initiate the bidding activities. Additionally, pursuant to the California Environmental Quality Act (CEQA), City Council is required to approve a finding related to each project which, for these projects, will all be categorical exemptions.
Upon approval of the proposed resolution, staff will undertake the bid solicitations in accordance with the City’s purchasing policy and all other applicable regulations. Given the timeline for these proceedings, it is anticipated that the subsequent construction contracts will be presented for City Council consideration at the meeting on June 14, 2023 to allow for these projects to be constructed during the summer construction season.
DISCUSSION
The Public Services Department, including staff from the Engineering and Public Works Division, are preparing a number of Capital Improvement Projects for execution during the 2023 summer construction season. At this time, staff is prepared to proceed with the below bid authorizations.
Staff anticipates presentation of the construction contracts for City Council consideration beginning with the meeting of June 14, 2023 to allow work to commence shortly thereafter. Staff will present comprehensive details associated with the project budgets, costs, and timelines at the time that each construction contract is considered.
Item 1.5
The proposed projects to be considered through this action include:
Annual Street Rehabilitation Project
The Annual Street Rehabilitation Project will perform street rehabilitation efforts, including both pavement reconstruction and asphalt mill and overlay activities on approximately 2.5 miles of City streets. The work will be bid in two scopes, one for street reconstruction and one for roadway milling. Consistent with past practice, some streets will be paved by public works staff.
Budget: $1,400,000
CEQA Consideration: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.c Existing Facilities as repair and maintenance of existing streets and highways.
Pothole Patching and Permanent Street Repairs Project
The City’s Annual Street Rehabilitation Project (referenced above) will improve or reconstruct approximately 2.5 miles of streets this year. Given the winter impacts experienced this year, there are potholes and other road issues that need to be addressed on the remaining street network (approximately 85 miles). This project will identify and make permanent repairs to potholes, trenches, and other localized pavement issues to prevent further roadway degradation and maintain the streets until they are scheduled for larger, widespread improvement.
Budget: An allocation of $250,000 will be requested within the FY 2023-24 Budget.
CEQA Consideration: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.c Existing Facilities as repair and maintenance of existing streets and highways.
Street Sign Reinforcement Project
The Street Sign Reinforcement Project will replace and reset sign posts in concrete footings along Moonridge Road and throughout the City. While standard construction details allow for street sign posts to be driven into the ground, our weather and ground conditions have indicated that the street signs need to be set in a concrete base to maintain their stability and prevent them from falling. This project will provide concrete bases and reset approximately 150 posts and signs throughout the City.
Budget: An allocation of $75,000 will be requested within the FY 2023-24 Budget.
CEQA Considerations: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.c Existing Facilities as repair and maintenance of existing streets and highways.
Civic Center Roof Replacement Project
The Civic Center roof is in excess of twenty (20) years old and there are considerable leaks throughout the building. The proposed project will replace the roof with composite shingles, similar to the existing, and install new ice barrier, insulation and a snow melt system. Additionally, the project will replace damaged plywood as a part of the roof underlayment as well as damaged facia and soffit along the roof line. The engineer’s estimate for this project is approximately $700,000.
Budget: $350,000 is available in the adopted budget. Staff is preparing updated budget figures for consideration as a part of the adoption of the Fiscal Year 2023-24 Budget.
CEQA Consideration: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (a) Existing Facilities as repair and maintenance of an existing public facility with no expansion on use.
Boulder Bay Park Walkway and Curb Replacements Project
The Boulder Bay Park and Walkway and Curb Replacements Project will focus on replacing the existing asphalt and decomposed granite walkways in concrete. In addition, the project will add new curbs to delineate the existing landscape areas.
Budget: $245,550
CEQA Considerations: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.c as an alteration of an existing pedestrian walkway with no expansion of use.
Stanfield Marsh Outdoor Recreation and Education (SMORE) II Project The Stanfield Marsh Outdoor Recreation and Education (SMORE) II Project will continue the construction of the path that was paved as a part of the SMORE I Project.
The trail will pick up at Division Creek and continue eastbound to Division Drive to the north of the existing properties.
Budget: $610,000
CEQA Considerations: A CEQA Notice of Exemption for this project was filed on August 24, 2017. This Notice of Exemption is still valid and no further action is required.
Rathbun Creek Trail Phase III Project
The Rathbun Creek Trail Phase III project will extend the Rathbun Creek Trail from its current terminus at Elm Street and Sonoma Drive to Moonridge Road and Sonoma Drive, with its alignment along the west side of Sonoma. The paved trail will be approximately twelve (12) feet wide and be lined with a fence. Additional improvements will be made along the roadway to fortify the separation of the trail from the road. The project will require the removal of approximately thirty (30) trees.
Budget: $1,600,000
CEQA Considerations: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (c), Existing Facilities, as the minor alteration of existing streets and Section 15304 (h) Minor Alterations to Land as the establishment of bicycle trails on existing rights-of-way.
Sanitary Sewer Cured In Place Pipe Project
The Sanitary Sewer Cured in Place Pipe (CIPP) Project will install CIPP lining in approximately 10,000 linear foot of sewer main. The liner will serve to correct existing concerns or deficiencies within the existing sewer mains such as root intrusion, pipe collapse, or erosion without the need to excavate the street. This CIPP lining process is effective and far more cost efficient than replacing sanitary sewer main. The efforts will be focused on the area of the City that is north of Big Bear Boulevard, South of Lakeview Drive, between Temple Lane and Forest Road.
Budget: $350,000
CEQA Considerations: The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (b) as the operation, repair, and maintenance of public owned utilities.
Stanfield Cutoff Parking Lot Improvements Project
The Stanfield Cutoff Parking Lot Improvements Project will make improvements to the existing parking lot area that is presently base material and decomposed granite. This project will replace all of the existing, damaged curb and pave the parking lot in asphalt, which will allow for proper parking spaces to be marked. This project is being proposed to tie together all of the recent improvements that the City has executed within the area.
Budget: Staff will be requesting a budget allocation of $400,000 in the Fiscal Year 2023- 24 Capital Improvement Program budget for these improvements.
CEQA Considerations: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 as an alteration of an existing facility with no expansion of use.
Staff will proceed expeditiously with the bid solicitations for the identified projects and will return to the City Council for the consideration of the construction contracts at the appropriate time. The action being considered within this report only authorizes staff to conduct the bid solicitations, it does not propose any budget amendments nor guarantee any construction contracts to be awarded.
FISCAL IMPACT
The actions contemplated within this report have a minor fiscal impact limited to the costs associated with preparing and soliciting construction bids. The contemplated projects are funded within the adopted Capital Improvement Program (CIP) Budget for Fiscal Year 2022-23 or will be requested in the Fiscal Year 2023-24 Capital Improvement Budget. A complete fiscal analysis of each project will be reviewed at the time that the construction contract is presented for consideration.
ENVIRONMENTAL CONSIDERATIONS
The above referenced projects are all categorically exempt from the California Environmental Quality Act (CEQA) pursuant to the sections indicated for each project.
RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing Bid Solicitations for Upcoming Capital Improvement Projects and Finding the Projects Exempt from the California Environmental Quality Act.

SUBJECT: Resolution Authorizing a Notice of Completion for the Stanfield Cutoff Restroom Project
BACKGROUND
Included in the Fiscal Year 2021-22 Capital Improvement Program budget was a project to establish a public restroom facility in the parking lot at Stanfield Cutoff, at the corner of Stanfield Cutoff and Big Bear Boulevard. In November 2021, the City Council authorized the purchase of a prefabricated restroom facility from the Public Restroom Company; which would be fabricated offsite and has a lead time of about a year. In June 2022, the City Council awarded a construction contract to Bear Valley Paving to complete the necessary utility and site improvements for the restroom to be installed.
DISCUSSION
The Stanfield Cutoff parking lot, at the corner of Stanfield Cutoff and Big Bear Boulevard, was identified as a priority location for a public restroom facility. Given the priority nature of this project, the City and Visit Big Bear partnered on this project with Visit Big Bear pledging $125,000 toward the project from the Tourism Impact Mitigation Funds.
Work commenced on the site improvements in the summer of 2022. The restroom facility was installed during the week of December 5, 2022. The restroom was put into service on February 10, 2023.
The initial project award to Bear Valley Paving was $144,100. Throughout the course of the work, there were additional costs incurred of $27,540 (approximately 19%). These costs were incurred from the upsizing and extending of the sewer connection, adding additional concrete to the landing around the restroom, and additional preparation of the site. As winter had hit prior to the installation of the restroom unit, there was additional prep work required to remove snow and moisture from the soil.
FISCAL IMPACT
The total expenditure with Bear Valley Paving was $171,640. Funding for the Stanfield Cutoff Restroom Project was included in the Fiscal Year 2021-22 Capital Improvement Program Budget.
Item 1.6
Visit Big Bear contributed $125,000 toward this project. The City’s funding was derived from Measure Y proceeds and Sanitation Infrastructure funds.
ENVIRONMENTAL CONSIDERATIONS
At the time of authorizing the bid solicitation, the City Council found this project to be categorically exempt from the California Environmental Quality Act (CEQA).
RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing a Notice of Completion for the Stanfield Cutoff Restroom Project.

SUBJECT: Resolution Authorizing a Professional Services Agreement with Safe Sidewalks, Inc. DBA Precision Concrete Cutting for Sidewalk Repair Services
BACKGROUND
The City of Big Bear Lake is responsible for the construction, maintenance, and liability of approximately seven (7) miles of sidewalk across the City, including in parks and facilities. It is worth noting that for these purposes, the City is not responsible for the sidewalks along Big Bear Boulevard, which fall under the jurisdiction of Caltrans. In 2021, staff contracted with a vendor to provide a survey and assessment of the City’s sidewalk network to identify hazards or issues in need of repair or replacement.
The City is a member of the California Joint Powers Insurance Authority (CJPIA) that provides risk management for many public agencies across the State. The CJPIA entered into a master services agreement with Safe Sidewalks, Inc. DBA Precision Concrete Cutting (Precision) to provide sidewalk assessment and repair services to its member agencies as these services provide a significant risk aversion resource. Precision performed a comprehensive survey of the City’s sidewalk network and provided the report to staff.
Precision’s primary business is the correction and removal of sidewalk trip hazards through cutting separations in sidewalks that create the trip hazard. Precision has provided a proposal to the City, under the terms of the master services agreement with the CJPIA, to repair the trip hazards that were identified within the sidewalk assessment.
DISCUSSION
Precision provides a specialized approach in that the sidewalk lifts are cut flush and level with the remaining portions of sidewalk. Furthermore, the specific saw blades that are used in this process provide a smooth, clean finish. The result of these efforts is the removal of the trip hazard, improvement of ADA accessibility, and an appropriate finish to the surface. Precision can perform these services on sidewalk lifts or separations with vertical changes between ½” and 2” in height.
For sidewalk lifts that are greater than 2”, this approach is not applicable and the sidewalk would likely need to be replaced.
Item 1.7
Precision’s assessment of the City identified a total of 958 sidewalk hazard locations with vertical changes of greater than ½”. Using the criteria range of ½” to 2”, Precision’s process can eliminate approximately half of the identified hazards. The remaining hazard areas would need to be remediated through other methods such as patching or replacement.
Precision provides a pricing schedule for these services that is based upon the height and length of the repair. Small repairs, between ¼” to ½” in height, are $37.00 per unit, Medium repairs, between ½” to 1” in height, are $74.00 per unit, and Large repairs, between 1” and 2” in height, are $148.00 per unit. The proposed price to repair the nearly 450 trip hazards that can be cut is approximately $65,000 using this methodology, or about $4.00 per square foot. For comparison, the cost to replace sidewalk is typically $12.00 to $15.00 per square foot.
Staff is proposing that Precision be authorized to initiate the repairs that were outlined within their assessment report. As Precision maintains an agreement with the CJPIA they have extensive experience with cities throughout California and current staff has experience working with them in other agencies. Additionally, as the terms of the agreement between CJPIA and Precision Concrete Cutting are made available to member agencies, the City can take advantage of “piggy backing” on this agreement to satisfy the City’s purchasing policy.
Additionally, staff is preparing a sidewalk replacement project to be undertaken later this year that will focus on beginning the removal and replacement of sidewalk sections that cannot be repaired under these methods. The City’s adopted Five-Year CIP contemplates sidewalk repair and replacement as an ongoing effort over the next several years and staff believes that employing both of these strategies will provide an effective sidewalk management program.
FISCAL IMPACT
Staff is proposing that the agreement be established for a total fee not to exceed $65,000. Funding for these services are included in the adopted Fiscal Year 2022-23 Capital Improvement Program Budget.
ENVIRONMENTAL CONSIDERATIONS
Under Section 15301.C of the CEQA Guidelines, these repairs are categorically exempt and, therefore, no environmental review is required.
RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing a Professional Services Agreement with Safe Sidewalks, Inc. DBA Precision Concrete Cutting for Sidewalk Cutting Services.

SUBJECT: Resolution Awarding a Construction Contract to EverFence Corporation for the Knickerbocker Channel Fence Replacement Project
BACKGROUND
Included in the adopted Fiscal Year 2022-23 Capital Improvement Program budget was funding to replace the existing chain link fence along the Knickerbocker Channel, near the Village. The Knickerbocker Channel Trail provides a pedestrian and bicycle facility along the Knickerbocker Channel from the Village to Veterans Park. A previous project replaced a significant portion of the fencing along the channel with black wrought iron fencing, however, a portion of approximately 350 linear feet was left in chain link. The chain link is in need of replacement and is proposed to be replaced with black wrought iron to match the existing sections of fence.
In August 2022, staff conducted a bid solicitation for this project and received five (5) bids, all of which significantly exceeded the engineer’s estimate and budget. The CIP budget includes $75,000 and, at that time, the lowest bid received was approximately $112,000. On September 19, 2022, the City Council took action to reject all bids and authorize staff to resolicit bids for this project.
Staff revised the design to install the new section of fencing adjacent to the channel walls, rather than on top of them. The core drilling and concrete work required to install the fence on top of the channel wall was believed to be a significant contributor of costs to this project. With the redesign completed, staff again solicited bids for this effort in February and March 2023.
DISCUSSION
Staff conducted a public bid solicitation for this effort and on March 16, 2023, the city received, publicly opened, and read aloud eight (8) sealed bids with the following results:
Contractor Location Bid Amount
EverFence Corporation Santa Fe Springs, CA $ 41,888
Golden Bay Fence Plus Iron Works Inc. Stockton, CA $ 65,715 Red Hawk Services, Inc. Perris, CA $ 72,739
Alcorn Fence Company Sun Valley, CA $ 76,690
S. Porter, Inc. Big Bear Lake, CA $ 78,540
J&A Engineering Corp. DBA J&A Fence Azusa, CA $108,000
Item 1.8
Quality Fence Co., Inc. Paramount, CA $114,140
In-Line Fence & Railing Co., Inc. Ramona, CA $131,954
Staff has reviewed the bids received and determined them to be complete, accurate, and in order.
EverFence Corporation has been found to be the lowest responsive bidder and has the demonstrated experience to complete this project. Staff has contacted references, provided within the bids, for projects that EverFence has completed within the Cities of Maywood and Monrovia and they have received satisfactory feedback.
Staff has been in communication with representatives of EverFence and work can commence within a matter of weeks upon approval of this contract. It is estimated that once the work begins, it will be completed within three (3) weeks.
FISCAL IMPACT
Funding for this project is included in the Fiscal Year 2022-23 Capital Improvement Program Budget in the amount of $75,000.
ENVIRONMENTAL CONSIDERATIONS
Under Section 15301.C of the CEQA Guidelines, this project is categorically exempt, and therefore no environmental review is required.
RECCOMENDATION
It is recommended that the City Council adopt a Resolution Awarding a Construction Contract to EverFence Corporation for the Knickerbocker Channel Fence Replacement Project.

EVERFENCE CORPORATION FOR THE KNICKERBOCKER
CHANNEL FENCE REPLACEMENT PROJECT
WHEREAS, the Knickerbocker Channel Trail provides a pedestrian and bicycle facility along the Knickerbocker Channel from the Village to Veterans Park; and, WHEREAS, the channel and trail is currently lined with two types of fence, predominantly wrought iron and portions of chain link fence and the existing chain link is failing, creating potential safety hazards and diminished aesthetics; and, WHEREAS, funding of $75,000 is included in the adopted Fiscal Year 2022-23 Capital Improvement Program budget to replace approximately 350 linear feet of fencing along the east side of the channel from the Knickerbocker Parking Lot to Village Drive; and, WHEREAS, in August 2022, staff conducted a public bid solicitation and received five (5) bids for this project, all of which were significantly over the project’s engineer’s estimate and established budget; and,
WHEREAS, on September 19, 2022, the City Council adopted a Resolution rejecting all bids and authorized staff to resolicit bids for this project; and, WHEREAS, staff conducted redesign of the project and established that the fence would be installed adjacent to, rather than on top of, the channel wall as the construction within the wall would be extensive and contribute to additional costs on the project; and, WHEREAS, in February and March 2023, staff conducted a bid solicitation utilizing the updated design; and,
WHEREAS, on March 16, 2023, staff received, publicly opened, and read aloud eight (8) sealed bids for this project; and,

FROM: Sean Sullivan, Director of Public Services
SUBJECT: Resolution Ordering the Preparation of an Engineer’s Report and Resolution of Intent to Levy and Collect Assessments within the Village Maintenance Assessment District No. 1-92
BACKGROUND
Village Maintenance District No. 1-92 (District) was formed to provide funding for the maintenance of the Village streetscape improvements on Village Drive and Pine Knot Avenue.
The District is governed by the Landscaping and Lighting Act of 1972, which specifies procedures for implementing and managing the District. Each year, an Engineer’s Report, prepared by a registered Professional Engineer, must be prepared and submitted to the City Council to establish assessments for each parcel within the District. A Resolution Ordering the Preparation of an Engineer’s Report must first be approved each year, followed by a Resolution of Intention that sets a public hearing for a later date. The intent of the public hearing is to receive any protests regarding the District assessments.
On June 21, 2021, the City Council adopted Resolution No. 2021-80, which established the rate implementation for Village Maintenance District No. 1-92 covering Fiscal Year 2021-22 through Fiscal Year 2025-26. The rates for the forthcoming assessment for Fiscal Year 2023-24 will be implemented according to this resolution, which was adopted pursuant to a Proposition 218 majority protest process.
DISCUSSION
The Village Maintenance District (District) No. 1-92 provides for critical maintenance and upkeep within the Village area, focused on streetlights, sidewalks, ornamental structures, and landscaping.
The work within these areas includes routine items such as snow removal, streetlight maintenance and lamp replacement, maintenance and replacement of signs and other decorative facilities. In addition, there is a large focus on sweeping, pressure washing, litter collection and trash removal, and graffiti abatement. These efforts are focused along Village Drive and Pine Knot Avenue, known as the “Village L”, which is the area of the Village experiencing the heaviest visitor traffic.
The District was established in 1992 pursuant to the requirements of the Landscaping and Lighting Act of 1972. In 1996, California Voters approved Proposition 218, the Right to Vote on Taxes Act, which added further requirements to the levying of assessments, including that all assessments must be approved by at least 50 percent of the ballots cast by property owners subject to the Item 1.9
assessments. All actions to be taken on the adjustment of any assessments, new or existing, must be supported by a detailed Engineer’s Report. The Engineer’s Report, to be prepared by a registered Professional Engineer, shall include a description of the district, a scope of the maintenance activities to take place within the district, and the budget required to complete those activities. The accompanying Engineer’s Report for Fiscal Year 2023-24 was prepared under the direction and supervision of the City Engineer.
The Engineer’s Report outlines assessments based upon both General Benefits and Special Benefits. A general benefit is something that would benefit the public at large in the area, whether they own properties or not, while a special benefit is derived from the property owners in the area due to enhanced maintenance efforts directly benefiting their properties. The current ratio determining the special benefit and general benefit is 44% special benefit and 56% general benefit.
As such, the collected assessment from the parcel owners would represent 44% of the revenue and expense for the operation of the District. The City would contribute the remaining 56% of the revenue to satisfy the general benefit element.
In an effort to bring the assessments within the District to a level consistent with the costs of rendering the maintenance services within the District, a five-year incremental increase to the assessments beginning in Fiscal Year 2021-22 was approved by the District assesses in June 2021.
The rate structure outlined below was presented to the City Council and was ultimately adopted pursuant to a Proposition 218 majority protest process. On June 21, 2021, the City Council adopted Resolution 2021-80 approving the below rate schedule for the Village Maintenance District No. 1-92 through Fiscal Year 2025-26.
Year FY 2021-22 FY 2022-23 FY 2023-24 FY 2024-25 FY 2025-26 Assessment Rate $ 23.00 $ 28.00 $ 33.00 $ 38.00 $ 43.00 Total Collection $ 118,266 $ 143,976 $ 169,686 $ 195,396 $ 221,106 Pursuant to the adopted rate schedule, the assessment for Fiscal Year 2023-24 will be $33.00 per linear foot of property frontage. The adopted rate over the 5,142 linear feet of assessed frontage will generate $169,686 in assessment for the upcoming Fiscal Year. Pursuant to the established 44% special benefit / 56% general benefit distribution, the general benefit contribution for this period will be $215,980 for a total District revenue of $385,666. The proposed District expenditures for Fiscal Year 2023-24 are approximately $500,000.
FISCAL IMPACT
The revenues and expenditures associated with the Village Maintenance Assessment District No. 1-92 will be included in the proposed Fiscal Year 2023-24 Budget.
ENVIRONMENTAL CONSIDERATIONS
Under Section 15378 of the California Environmental Quality Act (CEQA) Guidelines, this is not a project, and, therefore, no environmental review is required.

IX. INTRODUCTION
BACKGROUND
This report is prepared in compliance with the requirements of Article 4, Chapter 1, of the Landscaping and Lighting Act of 1972 (The “Act”), which is Part 2 of Division 15 of the California Streets and Highways Code, Article 4.3, Section 53739 of the California Government Codes (the “Code”), and Articles XIII C and XIII D to the California Constitution (the “Articles”).
The City of Big Bear Lake currently operates and maintains the City of Big Bear Lake Village Maintenance Assessment District No. 1-92 (the “District”) to fund the maintenance of various amenities located throughout the Village such as planters and sidewalks. Since the passage of Proposition 218, the “Right to Vote on Taxes Act”, which added Articles XIII C and XIII D to the California Constitution (The Articles), new procedures must be followed to levy assessments under the Landscaping and Lighting Act of 1972. These Articles requires that all assessments be supported by a detailed Engineer’s Report prepared by a registered professional engineer. The report includes the information required by law for the assessment district.
The Act and Articles also provide for the increase of existing assessments or the implementation of a cost-of-living adjustment factor (CPI), all for the express purpose of installing, maintaining, and servicing lighting and landscaping improvements. The costs associated with the installation, maintenance, and servicing of the improvements may be assessed against those properties which are specially benefited by the installation, maintenance, and servicing. A City may increase assessments or apply a CPI factor for an assessment district after complying with the requirements of the Act and the provisions of the Articles.
The City initiates proceedings for the annual levy of assessments for the district by passing a resolution that states that the levy is proposed under the Act and Articles. This resolution also describes the improvements, describes the name and location of the district, and finally orders an engineer, who is a registered professional engineer, certified by the State of California, to prepare and file a detailed report.
The report prepared by the engineer must include plans and specifications for the improvements. The report must also include an estimate of the costs of the improvements, a diagram, or map of the assessment district showing the boundary of the district, and an explanation of the estimated costs of the improvements against the parcels or lots, which benefit from the improvements. Once the report is completed, it is presented to the City Council for its review and approval as presented, or it may be modified and approved.
After the report is approved, the City Council may adopt a Resolution of Intention that declares its intent to levy assessments within the assessment district, describes the improvements, gives the district a distinct name, and refers to the report for details of the district. The Resolution of Intention also sets a time and place for a hearing on the annual assessments.
X. PLANS AND SPECIFICATIONS
The improvements for the District may be generally described as follows:
The operation, maintenance, and servicing of streetlights, sidewalks, and ornamental structures, landscaping, including trees, shrubs, grass, and other ornamental vegetation, and appurtenant facilities, including irrigation systems, located in public places within the boundaries of the District.
Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation, and servicing of the streetlights, sidewalks, planters, benches, decorative signs, and ornamental structures, landscaping and appurtenant facilities, including repair, removal, or replacement of all or part of any of the ornamental structures, landscaping or appurtenant facilities; providing for the life, growth, health, and beauty of the landscaping, including cultivation, irrigation, trimming, spraying, fertilizing, and treating for disease or injury; the removal of trimmings, rubbish, debris and other solid waste, sweeping and snow removal from public sidewalks; and the cleaning, sandblasting, and painting of walls and other improvements to remove or cover graffiti. Servicing means the furnishing of electricity for the lighting and operation of the streetlights and ornamental structures, landscaping, and appurtenant facilities, and water for the irrigation and control of the landscaping and the maintenance of any of the ornamental structures, landscaping, and appurtenant facilities.
The improvements were installed under Assessment District No. 23-91 and were designated the “Village Improvements.” Improvements for APN 308-135-01 (Holiday Inn) and APN 308-146-02 (Tropicali) were installed by the developers of these properties and annexed to the District as Annexation No. 1. Improvements for “The Club”, Tract 16126 (APN 308-137-07) were installed by the developer of this property and annexed to the District as Annexation No. 2. Reference is hereby made to said plans and specifications for the improvements described above and they are by reference made a part of this report to the same extent as if said plans and specifications were attached hereto.
All improvements consisting of sidewalks, landscaping, street trees, streets, streetlights, landscaping and signs exist at the present time.
Plans and Specifications for the improvements for the District are voluminous and are not bound in this report but by this reference are incorporated and made a part of this report. The Plans and Specifications are on file in the office of the City Clerk and the City Engineer where they are available for public inspection.
XI. ASSESSMENT
All assessed lots or parcels of real property within the District are listed on Assessment Rolls that are on file in the office of the City Clerk and the City Engineer and are hereby made a part of this report by reference. Each Assessment Roll states the net amount to be assessed upon assessable lands within the District for fiscal year 2023/24, shows the fiscal year 2023/24 assessment upon each lot and parcel within the District and describes each assessable lot or parcel of land within the District. These lots and parcels are more particularly described on the County Assessment Roll, which is on file in the office of the San Bernardino County Assessor and by reference is made a part of this report. A summary sheet showing the Assessor Parcel Numbers is within this report.
XII. ESTIMATED MAINTENANCE COSTS
The Act provides that the estimated costs of maintenance for the improvements may include the total maintenance costs for the entire fiscal year 2023/24, including incidentals, which may include reserves to operate the District.
The Act also provides that the amount of any surplus, deficit, or contribution be included in the estimated cost of improvements. The net amount to be assessed on the lots or parcels within the district is the proportional share of maintenance, and servicing costs with adjustments either positive or negative for reserves, surpluses, deficits, and/or contributions.
A detailed budget is available in the office of the Director of Government Services of the City of Big Bear Lake. A description of detailed budget items is included herein as “Appendix B”.
In analyzing the continual deficit operations associated with the District, beginning in Fiscal Year 2021/22, the City Council adopted an increase to the assessment of $4.99 for Fiscal Year 2021/22 and a subsequent increase of $5.00 per foot per year through Fiscal Year 2025/26.
The following table is an abbreviated budget for the District reflecting the approved assessment increases through Fiscal Year 2025/26:
*The District collects the parcel assessments as provided which represent 44% of the cost of operating the District for the special benefit as received by the assessed parcels. The City contribution from the General Fund represents 56% of the District operating revenue to for the costs associated with the General Benefit, which is available to the general public.

If any parcel submitted for collection is identified by the County Auditor/Controller to be an invalid parcel number for the current fiscal year, a corrected parcel number and/or new parcel number will be identified and resubmitted to the County Auditor/Controller. The assessment amount to be levied and collected for the resubmitted parcel or parcels shall be based on the method of apportionment and assessment rate approved in this Report. Therefore, if a single parcel has changed to multiple parcels, the assessment amount applied to each of the new parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment.
XIV. METHOD OF ASSESSMENT
BACKGROUND
The Landscaping and Lighting Act of 1972 provides that assessments may be apportioned upon all assessable lots or parcels of land within a district in proportion to the estimated benefits to be received by each lot or parcel from the improvements. In addition, Articles XIII C and XIII D of the California Constitution require that a parcel's assessment may not exceed the reasonable cost of the proportional special benefit conferred on that parcel. The Proposition provides that only special benefits are assessable, and the City must separate the general benefits from the special benefits conferred on a parcel. A special benefit is a particular and distinct benefit over, and above general benefits conferred on the public at large, including real property within the district. The general enhancement of property value does not constitute a special benefit.
SPECIAL BENEFIT
Each and every parcel within the District receives a particular and distinct benefit from the improvements over and above general benefits conferred by the improvements.
The improvements confer a particular and distinct special benefit upon parcels within the District because of the nature of the improvements. The proper maintenance of landscaping specially benefits parcels within the District by moderating temperatures, providing oxygenation, and attenuating noise from the adjacent streets, thereby enhancing the environmental quality of the businesses and the pedestrian areas within the Village. The spraying and treating of landscaping for disease reduces the likelihood of insect infestation and other diseases spreading to private landscaping located throughout the properties within the District. The proper maintenance (including water and electricity costs) of the streetlights, sidewalks, landscaping, ornamental and decorative structures, and appurtenant facilities reduces property-related crimes (especially vandalism) against properties in the District. This is accomplished through the abatement of graffiti and by providing an attractive environment and one where all businesses are highly visible and well lighted. The removal and hauling of snow (sidewalks and parking stalls) in the winter and refuse throughout the year provide a safe, clean and attractive location for business. Finally, the proper maintenance of landscaping, and ornamental and decorative structures improves the attractiveness of the properties within the District and provides a positive visual experience each and every time a trip is made to or from the businesses. All of the abovementioned attributes contribute to a specific enhancement for each of the parcels within the District.
GENERAL BENEFIT
In addition to the special benefits received by the parcels within the District, there are incidental general benefits conferred by the proposed improvements.
The proper maintenance (including water and electricity costs) of street lighting, sidewalks, landscaping, and appurtenant and ornamental facilities within the District provide a safe, clean and attractive destination for visitors. The spraying and treating of landscaping within the District for disease reduces the likelihood of insect infestation and other diseases spreading to landscaping located throughout other properties within the City. The removal of snow from sidewalks provides a safe path for visitors to the Village shops. The maintenance (including electricity costs) of streetlights provides a safe environment for pedestrians and motorists visiting the Village. The removal of refuse from the Village provides visitors with a clean and attractive destination. Finally, the proper maintenance (including water and electricity costs) of street lighting, sidewalks, landscaping, and ornamental structures provides a positive visual experience and enhances the City of Big Bear Lake’s role as a resort community and vacation destination. All of the above-mentioned constitutes incidental general benefits conferred by the improvements.
The total benefits are thus a combination of the special benefits to the parcels within the District and the general benefits to the public at large and to adjacent property owners. The portion of the total Village Improvement maintenance costs, which are associated with general benefits, will not be assessed to the parcels in the District, but will be paid from other City Funds.
Because the village improvements are located immediately adjacent to properties within the District, and are maintained solely for the benefit of the properties within the District, any benefit received by properties outside of the District is merely incidental. The City will contribute additional funding for any maintenance costs in the District, which are not recovered from assessments.
APPORTIONMENT
Each of the parcels within the district has access to the improvements and the maintenance and servicing thereof. Since the parcels front onto the street and sidewalk improvements, the benefits to each parcel are based on the width of the parcel fronting the improvements. In the District, all parcels are assessed based on the front linear footage of the parcel to be assessed. For fiscal year 2022/23, there is a total of 5,142 front linear feet within the Village. See the Assessment Roll included herein as Appendix “A” for individual parcel data.
The following formulas are used to calculate each property’s District assessment.
Total Balance to Levy*/Total Front Linear Footage = Levy per Front Linear Foot (Rate) Parcels Total Front Linear Foot × Levy per Front Linear Foot (Rate) = Parcel Levy Amount Table 1 below is a sample levy calculation for a parcel in the District.

SUBJECT: Resolution Approving Vacation of a Portion of Lakeview Drive and Spruce Road Right-of-Way and Finding the Action Categorically Exempt from the California Environmental Quality Act
BACKGROUND
Vacation of Right-of-Way application 2022-145 was submitted by Funf Ventures represented by Mr. Sven Simon. The application requests to abandon portions of Lakeview Drive and Spruce Road adjacent to the property at 40433 Lakeview Drive (APN 0308-062-01). A retaining wall and parking spaces for the unoccupied restaurant, formerly known as the Cowboy Express Steakhouse, encroach into an approximately 1,007 sf portion of the right-of-way. The applicant requests that these improvements be allowed to remain and be repaired, therefore, this portion of right-of-way is requested to be vacated and merged with the adjacent private property.
Right-of-way vacations are regulated by Streets & Highways Code Section 8300 et. seq. and several steps must occur. The first step in the process is a determination of consistency with the General Plan. This was completed on February 1, 2023, with the adoption of Planning Commission Resolution No. PC 2023-02.
The second step in the road abandonment process occurred on March 8, 2023. The City Council adopted Resolution No. 2023-14, a resolution of intent to vacate the right-of-way and establishing an April 12, 2023, public hearing date. Additionally, the City Council adopted Resolution No. 2023-15 determining the right-of-way abandonment exempt from the Surplus Land Act. Review of this application continues today with holding a public hearing and adoption of a resolution approving of the vacation of right-of-way. Once approved, the resolution is recorded finalizing the road abandonment and property transfer. The property owner may then obtain a building permit to repair the retaining wall.
DISCUSSION
The Lakeview Drive and Spruce Road rights-of-way were originally created by Talmadge’s Lakeview Park Tract, March 12, 1917. The subject property, located at the northwest corner of the intersection, contains 10,580 sf in area. County records indicate the property was developed in 1969.
Item 2.1
Figure1- Property Location
A recent survey of the property revealed that the retaining wall and portions of the parking lot were located in the rights-of-way of Lakeview Drive and Spruce Road. To resolve this encroachment and allow the repair of the retaining wall, staff recommends abandonment of the rights-of-way.
No public utilities will be affected by the road abandonment and all existing utilities will remain in the public right-of-way.
Figure 2- Photograph, Current Property Condition
Figure 3, at right, graphically represents the
existing structures and improvements, and
shows the shaded portion of the Lakeview
Drive and Spruce Road rights-of-way
proposed for abandonment.
The request is consistent with the following
General Plan policies:
• General Plan Circulation Element
Policy C 1.1(c.), because the wider than
normal right-of-way widths allow the
minimum right-of-way widths of
Lakeview Drive and Spruce Road (as
established in the General Plan
Circulation Element) will be maintained
upon completion of the road
abandonment; and
• Circulation Element Policy C 1.2 (b.)
because no changes to the pavement
widths of Lakeview Drive or Spruce
Road result from the abandonment of
the right-of-way; and
• Circulation Element Policy C1.6. because
the existing driveway access to 40433
Lakeview Drive and the circulation
patterns along Lakeview Drive and
Spruce Road are maintained in their
existing conditions.
ENVIRONMENTAL DETERMINATION
The requested action is not a “project” under Public Resources Code Section 21065, and is exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15061(b)(3), the “common sense exemption.” This Section states that where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, then the activity is not subject to CEQA. A Notice of Exemption is attached as Attachment 2.
PUBLIC OUTREACH
Notice of this public hearing was prepared in accordance with Division 9, Part 3 of the Streets and Highways Code, beginning with Section 8320 and Development Code Section 17.03.030. The 15- day public notification included:
Figure 3 – Shaded right-of-way area to be abandoned
• Physical Posting – Streets and Highways
Code Section 8323 requires the public
hearing notice to be posted on the portion
of right-of-way proposed for abandonment.
Shown in Figure 4 at right is one of the three
public notice signs posted on March 20,
2023.
• Direct mailing – In accordance with Streets
and Highways Code Section 8321, the
public hearing notice was mailed to 29
surrounding property owners on March 21,
2023.
• Publication in the local newspaper –
Pursuant to Streets and Highways Code
Sections 8320 and 8322, the public hearing
notice was published for two consecutive
weeks, on March 22 and March 29, 2023, in
the legal advertisement section of The
Grizzly newspaper.
• Posting in three public places – In accordance with Development Code Section
17.03.030.B., the public hearing notice was posted in three public places, specifically, City Hall, the Pine Knot Post Office, and the Interlaken Shopping Center Post Office. • Posting on the City’s website – The public notice was posted on the City Council public notice section of the City of Big Bear Lake website, www.citybigbearlake.com.
As of the writing of this report, no public correspondence has been received in response to the public notification.
FISCAL IMPACT
Pursuant to Streets and Highways Code Section 8355, the property is being sold to the adjacent property owner. The appraised value of the property is $13,0001 . Under Streets and Highways
Code Section 8357, the funds shall be obtained from the applicant and deposited into the City’s General Fund.
RECOMMENDATION
It is recommended that the City Council take the following actions:
1. Open and hold a public hearing on Vacation of Right-of-Way Application 2022-145; and
2. Adopt a Resolution Approving Vacation of Right-of-Way Application 2022-145 for an Approximately 1,007 Square Foot Portion of Lakeview Drive and Spruce Road Adjacent to 40433 Lakeview Drive (APN 0308-062-01) and Finding the Action Categorically Exempt from the California Environmental Quality Act.

WHEREAS, the applicant, Funf Ventures, represented by Mr. Sven Simon, submitted Vacation of Right-of-Way application 2022-145 requesting that the City vacate an approximately 1,007 square foot portion of rights-of-way of Lakeview Drive and Spruce Road adjacent to the property at 40433 Lakeview Drive (APN 0308-061-01). The portion of right-of-way to be abandoned is legally described and graphically depicted in Exhibits A and B attached to this Resolution; and WHEREAS, the dedication of Lakeview Drive and Spruce Road occurred by the recording of Talmadge’s Lakeview Park Tract, March 12, 1917, as recorded in Book 20, Pages 23-24 of the records of the County of San Bernardino; and
WHEREAS, these street vacation proceedings have been conducted in accordance with Division 9, Part 3 of the Streets and Highways Code, beginning with Section 8320; and WHEREAS, on February 1, 2023, the Planning Commission adopted Resolution No. PC2023-02 determining that the requested vacation of right-of-way is consistent with the General Plan; and WHEREAS, on March 8, 2023, in a regular meeting, the City Council adopted Resolution No. 2023-14 declaring a notice of intent to vacate a portions of Lakeview Drive and Spruce Road and establishing a date and time of a public hearing on the abandonment set for April 12, 2023, at 5:00 pm; and
WHEREAS, on March 8, 2023, in a regular meeting, the City Council also adopted Resolution No. 2023-15 declaring that the property to be vacated is exempt surplus land under the Surplus Land Act, as supported by written findings; and
WHEREAS, the action to abandon a portion of right-of-way is determined not to be a project under Public Resources Code Section 21065 and is exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15061(b)(3) the common sense exemption.
This Section states that where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, then the activity is not subject to CEQA. It is determined that the vacation of right-of-way of portions of Lakeview Drive and Spruce Road will have no significant environmental impact. A Notice of Exemption is retained in the permanent case file; and
WHEREAS, the City conspicuously posted a Notice of Public Hearing for the Vacation of Rightof-Way application in excess of 15-days prior to the hearing in three locations along Lakeview Drive and Spruce Road; published the notice two successive weeks prior to the hearing in the legal advertisement section of an newspaper of general circulation; mailed the notice to twenty-nine surrounding property owners; posted the notice in three public places, and placed the notice on the City’s website. Said notices stated the date, time, and location of the public hearing; and WHEREAS, on April 12, 2023, the City Council conducted a duly noticed public hearing on Vacation of Right-of-Way application 2022-145 in Hofert Hall of City Hall, 39707 Big Bear Boulevard, Big Bear Lake, CA 92315, and concluded the meeting on this date; and WHEREAS, all prerequisites to the adoption of this resolution have been met.
NOW, THEREFORE, BE IT RESOLVED by the City Council that:
1. All of the facts set forth in the above recitals of this Resolution are true and correct.
2. The City Council finds that the vacation of right-of-way application is not a project under Public Resources Code Section 21065 and is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3). This section states that where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, then the activity is not subject to CEQA. A Notice of Exemption is retained in the case file.
3. Based on evidence presented to the City Council at the April 12, 2023, public hearing, including public testimony and written and oral agenda reports, the Council specifically finds as follows with respect to Vacation of Right-of-Way application 2022-145 to vacate approximately 1,007 square feet of right-of-way at the northwest corner of Lakeview Drive and Spruce Road:
a. The vacation of right-of-way is consistent with the General Plan because the request is consistent with Circulation Element Policy C 1.1(c). The existing right-of-way widths of Lakeview Drive and Spruce Road at the northwest corner of the intersection are wider than normal and exceed minimum right-of-way widths established in the General Plan. Upon completion of the road abandonment, the minimum right-of-way widths along Lakeview Drive and Spruce Road will be maintained. Additionally, no changes will occur in the pavement widths of Lakeview Drive or Spruce Road, in compliance with Circulation Element Policy C1.2(b). The property at 40433 Lakeview Drive is currently improved. There will be no changes to the driveway access or circulation patterns along Lakeview Drive and Spruce Road, in compliance with Circulation Element Policy C 1.6. b. No public utility easements are affected by the road abandonment and all existing public utility improvements including sewer, water, and electricity lines will remain in the public right-of-way.
4. Based on the findings and conclusions set forth in statements 1, 2, and 3, above, the City Council hereby adopts a Resolution approving Vacation of Right-of-Way application 2022-145, as described herein for the property shown in Exhibits A and B.
5. Pursuant to Streets and Highways Code Section 8325, the City Clerk shall cause a certified copy of the resolution of vacation, attested by the clerk under seal, to be recorded without acknowledgement, certificate of acknowledgement, or further proof, in the office of the recorder of the county in which the property is located. Upon such recordation, the vacation of right-of-way is complete.

SUBJECT: Consideration of Beautification Brochure, Created by the Economic Development Advisory Committee (EDAC)
BACKGROUND
On October 17, 2022, the City Council considered and provided direction on two recommended items from the Economic Development Advisory Committee (EDAC). For the first recommendation, City Council directed staff to proceed with a master plan concept for the 19-acre lakefront property, leased from Bear Valley Mutual Water Company. That effort is currently in process.
For the second item, City Council considered EDAC’s recommendation on a proactive and community-driven approach to beautify Big Bear Boulevard. Rather than initiate the desired beautification through regulatory (i.e. code enforcement) actions, property owners and businesses would be enlisted towards voluntary property improvements. Specifically, EDAC members proposed the creation of a brochure to encourage simple property clean-up and maintenance for successful beautification results on an ongoing basis. With the anticipated community/voluntary effort, it is hoped that City-initiated enforcement actions pursued under the Municipal Code could be minimized. The City Council agreed with this concept and, on October 17, 2022, allocated up to $1,500 for printing and mailing costs for a brochure to initiate a community-wide campaign.
DISCUSSION
On December 13, 2022, the EDAC met to collaborate on messaging, images, content, and publicity for the beautification brochure. Committee members agreed there were opportunities for public recognition of voluntary improvements, such as by the Big Bear Chamber of Commerce, and believe that an effort led and supported by local commercial businesses would serve as a foundation for generating and instilling community pride on a larger scale. There was much discussion and input by the group, and the EDAC decided to form a subcommittee of four members to work on brochure details for subsequent presentation and approval by the EDAC.
On February 14, 2023, the EDAC met to review the draft prepared by the subcommittee and finalize specifics of the brochure to enhance messaging, verify accuracy and comprehension. The Committee collaborated to ensure the brochure is attractive, informative, straightforward, and includes graphics and examples. A quick response (QR) code is included to link to a new “Beautify Item 3.1
Big Bear” site, which would be created through the City’s webpage. The EDAC recognizes the City Council’s priority for a beautification focus on the commercial corridors. However, the recommended brochure can encourage similar efforts on all properties throughout the City.
On March 14, 2023, the EDAC approved the final details of the brochure, and recommended City Council consideration and approval of the beautification brochure (see attached).
With approval of the beautification brochure, the EDAC has successfully completed the final actionable item as directed by the City Council.
NEXT STEPS
Should the City Council have comments on the brochure, staff can finalize the changes before sending the document out for printing and mailout to property owners. Prioritization for notification and enforcement would be all properties along: 1) Big Bear Boulevard; 2) Moonridge Corridor; and 3) other commercial areas. In addition, the EDAC members have committed, through their respective organizations (i.e. Big Bear Chamber of Commerce, Visit Big Bear, Big Bear Association of Realtors) and the general community for those at-large members, to proactively communicate the message and need for beautification in these areas.
City staff anticipates long-term use and availability of the brochure and website for ongoing communication to encourage community-wide beautification. The brochure would also be a handout used in the field by code compliance officers.
FISCAL IMPACT
At the October 17, 2022 meeting, the City Council allocated $1,500 to print and mail the beautification brochure. No other significant costs are anticipated related to this program. The addition of a special page to support “Beautify Big Bear” is expected to be minimal, as existing staff would use the brochure information to create the webpage links.
ENVIRONMENTAL CONSIDERATIONS
Under Section 15378 of the California Environmental Quality Act (CEQA) Guidelines, this is not a project, and, therefore, no environmental review is required.
RECOMMENDATION
It is recommended that the City Council review the beautification brochure, provide feedback and direct staff to proceed with printing and mailing the final document.
