TREASURER'S REPORT
September 30, 2023

MEETING
DATE: November 8, 2023
TO: Honorable Mayor and Members of the City Council
FROM: Erik Sund, City Manager
SUBJECT: Adopt an Ordinance Amending Section 10.12 of the Big Bear Lake Municipal Code

BACKGROUND & DISCUSSION
At the City Council meeting of February 8, 2023, City Council reviewed penalties during snow conditions. At the same meeting, City Council directed staff to increase the fine under Municipal Code 10.12 (parking under snow conditions) to $400. Therefore, on October 11, 2023 City staff presented a proposed ordinance that would increase the City’s winter parking fine to $400. During that meeting, the City Council discussed the proposed ordinance and instructed staff to update section 10.12.030 to include the verbiage, “during snow conditions” at the end of the first sentence.

In addition, City Council conducted a public hearing, introduced the ordinance, read the title, and waived further reading of the ordinance. The attached ordinance that is being recommended for formal adoption, includes City Council’s revision to section 10.12.030.

FISCAL IMPACT
There is no fiscal impact associated with the adoption of the proposed ordinance.

ENVIRONMENTAL CONSIDERATION
Under section 15378 of the California Environmental Quality Act (CEQA) Guidelines, this is not a project, and, therefore, no environmental review is required.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priorities as it:

1. Supports and invests in sustainable infrastructure projects and programs consistent with the needs of our community

2. Preserves and protects the quality of life for the residents and the businesses

RECOMMENDED ACTION
It is recommended that the City Council adopt an Ordinance Amending Chapter 10.12 (Parking During Snow Conditions – Generally) of Title 10 (Vehicles and Traffic) of the Big Bear Lake Municipal Code Related to Parking Regulations in Mountain Areas.

SUBJECT: Resolution Appointing Erica Stephenson as City Clerk and Rescinding Resolution No. 2023-52

BACKGROUND & DISCUSSION
On October 22, 2018, the City Council adopted Resolution 2018-33 appointing Erica Stephenson as the City Clerk. This appointment was in line with the City Council’s historic practice of appointing a current City employee with a proven commitment to the community, familiarity with local stakeholders and a thorough knowledge of the City of Big Bear Lake’s organization.

On July 1, 2023, Erica Stephenson was promoted to the City’s Assistant City Manager, which resulted in the need to fill the important City Clerk position. Therefore on July 12, 2023, the City Council adopted Resolution No. 2023-52 formally appointing the then Deputy City Clerk Rebecca Cannon to the City Clerk position. On November 1, 2023, Rebecca Cannon resigned her employment from the City of Big Bear Lake, which resulted in the immediate need to once again fill the vital City Clerk roll. Therefore, the City Manager chose Erica Stephenson to serve as the Interim City Clerk until the City Council would be able to take formal action to appoint a new City Clerk. Due to Erica Stephenson’s recent successful tenure as the City Clerk, it is recommended by staff to reappoint her to the City Clerk position, in addition to retaining her Assistant City Manager title and responsibilities.

FISCAL IMPACT
There is no fiscal impact associated with the adoption of this resolution.

ENVIRONMENTAL CONSIDERATION
Under Section 15378 of the California Environmental Quality Act (CEQA) Guidelines, this is not a project, and, therefore, no environmental review is required.

THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Deputy City Manager / Director of Public Works Jared Cheek, Public Works Manager – Capital Projects / Emergency Operations SUBJECT: Resolution Authorizing Bid Solicitation for the Civic Center/Performing Arts Center Restroom Improvements Project

BACKGROUND AND DISCUSSION
Included within the adopted Fiscal Year 2023-24 Capital Improvement Project (CIP) budget is a project entitled Civic Center/Performing Arts Center Restroom Improvements Project. This project is aimed at providing improvements to the facilities to comply with the Americans with Disabilities Act (ADA) as well as provide improved aesthetics to the restrooms, which are original to the construction of the building in 1989. These restrooms are located within the main lobby and are generally utilized by patrons of both the City Hall offices as well as the Performing Arts Center.

In January 2023, the City Council awarded a design consulting agreement to the Eden Group (Big Bear Lake, CA) for the design work associated with this project. The Eden Group has completed all necessary construction drawings, including updated floor plans and finish schedules to complete the scope of the project. Based upon the design received, the engineer’s estimate of probable construction costs is approximately $350,000 and they believe that the construction period will be approximately four (4) months.

Staff is completing the assembly of the bid documents and intends to have them circulated for public bidding by the end of November in order to receive bids in December 2023. Once the bids are received and an apparent contractor has been identified, staff will then be able to refine the construction timeline and mitigation of the construction impacts. Internally, staff from engineering as well as the staff who oversee the Performing Arts Center are coordinating closely to manage the impacts that this project will have on the facility usage.

FISCAL IMPACT
Funding for this project is included in the adopted Fiscal Year 2023-24 Capital Improvement Program (CIP) Budget in the amount of $350,000. The source of funds for this project is the General Fund.

ENVIRONMENTAL CONSIDERATIONS
This project is categorically exempt from the California Environmental Quality Act (CEQA) ITEM 1.4
pursuant to Section 15301.a of the CEQA implementation guidelines as interior alterations to an existing facility.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priority No. 1 as it “supports and invests in sustainable infrastructure projects and programs”.

RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing Bid Solicitation for the Civic Center/Performing Arts Center Restroom Improvements Project.

• Stanfield Cutoff Parking Lot Improvements Project
Contractor: Romans Construction
Date of Completion: October 20, 2023
Approved contact amount $398,686 (Includes $25,000 contingency) Total Project Expenditures $374,786.50
• Sidewalk Repair Services
Contractor: Precision Concrete Cutting
Date of Completion: October 20, 2023
Approved contact amount $65,000
Total Project Expenditures $58,349
• Boulder Bay Park Walkway and Curb Replacements Project Contractor: Siterep Construction Services, Inc.

Date of Completion: October 27, 2023
Approved contact amount $341,115 (Includes $30,000 contingency) Total Project Expenditures $356,740
ITEM 1.5
Throughout the course of construction on the Boulder Bay Park Project, staff authorized change orders related to necessary grading and the construction of additional replacement sidewalk. The grading was required to achieve ADA compliance based upon field conditions within the park at a cost of $32,863. Staff authorized the replacement of additional concrete sidewalk, that was not included within the original scope, to create a consistent and new finish throughout at an additional cost of $12,760. This project was funded through Community Development Block Grant (CDBG) funds and Measure Y Proceeds. There is sufficient Measure Y proceeds currently available within the adopted CIP budget to cover these cost overruns.

Upon approval by the City Council, staff will proceed to record the Notices of Completion with the San Bernardino County Recorder’s Office. No sooner than thirty-five (35) days from the recording, staff will release all project retention funds assuming that no claims are made against the contractor related to these projects. For each of these projects, retention funds are 5% of the total project billing.

FISCAL IMPACT
These projects were all funded and included within the adopted Fiscal Year 2023-24 Annual Budget. At the time of contract award, the City Council approved contracts amount inclusive of the contractor’s bid as well as additional contingency funds when requested. As indicated within the report, these projects were completed within the City Council approved expenditure limits with the exception of the Boulder Bay Park Walkway and Curb Replacements Project.

The additional expenses related to the Boulder Bay Walkway and Curb Replacement Project, as described above, exceed the project’s authorized expenditures by $15,625. There is sufficient Measure Y funding available within the adopted CIP Budget to supplant the existing budget for the Boulder Bay Park Walkway and Curb Replacements Project.

ENVIRONMENTAL CONSIDERATIONS
At the time of authorizing the bid solicitation, the City Council found these projects to all be categorically exempt from the California Environmental Quality Act (CEQA).

CONSIDERATION OF STRATEGIC PRIORITIES
This recommended action aligns with Strategic Priority No. 1 to “support and invest in sustainable infrastructure projects and programs consistent with the needs of our community”.

RECOMMENDATION
It is recommended that the City Council authorize the filing of Notices of Completion for Fiscal Year 2023-24 Capital Improvement Projects.

DATE: August 9, 2023
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Deputy City Manager/Director of Public Works Jared Cheek, Public Works Operations Manager
SUBJECT: Resolution Awarding a Construction Contract to Roy Allan Slurry Seal, Inc. for the Annual Crack Seal of City Streets Project

BACKGROUND & DISCUSSION
The Public Works Department is responsible for the maintenance and operation of approximately 84 centerline miles of streets within the City. As a part of the City’s effort to maintain and improve the streets, the annual Capital Improvement Program includes several projects focused on street maintenance: street rehabilitation, pothole repairs, line striping and crack sealing. A project entitled Annual Crack Seal of City Streets is included within the CIP and is designed to place an adhesive sealant into the cracks within pavement surfaces along City streets to prevent water intrusion into the pavement. This project will focus on twenty-one (21) street segments and three (3) public parking lots within the City.

Staff conducted a public bid process, consistent with our practices for CIPs, and on August 1, 2023, the City received, publicly opened, and read aloud three (3) sealed bids with the following results:

Contractor Location Bid Amount
Roy Allan Slurry Seal, Inc. Santa Fe Springs, CA $ 72,266 Global Road Sealing, Inc. Garden Grove, CA $ 78,500
American Asphalt South Fontana, CA $103,600
On August 2, 2023, the day after the public bid opening, staff also located a bid submitted by Carter Enterprises Group, Inc. DBA Pavement Rehab Company (Corona, CA). The bid was delivered via FedEX and the mailing envelope was not marked as containing a bid, in accordance with the standard instructions to bidders and, as such, this parcel was not identified as containing a bid until after the bid deadline and opening had passed. In consultation with the City Attorney’s Office, it was advised that the bid should be rejected on the basis of not conforming to the Instructions to Bidders and should be returned to the company, unopened. Staff issued a letter and returned the unopened bid via US Mail on August 2, 2023 (attachment 2).

Staff has reviewed the bid documents for completeness and accuracy. During the review of the bid submitted by Roy Allan Slurry Seal, Inc., staff recognized an inconsistency between the submitted bid price and the total price when tabulated using the bid schedule of line items. The submitted bid, as indicated, was $72,266, however, when tabulating the bid items, as provided, the total was Item 1.9
found to be $68,496. Staff conferred with the City Attorney’s Office and contacted representatives of the firm directly to review the situation. Roy Allan Slurry Seal, Inc. has indicated that they will honor the price of $68,496 as the base bid for this project. Staff has further reviewed the background and experience of Roy Allan Slurry Seal, Inc. and finds that they have extensive history of completing this type of work for many agencies throughout Southern California.

Upon an award of contract, it is anticipated that work on this effort will commence in early September and the work will be completed under the direction and supervision of Engineering Division staff.

FISCAL IMPACT
The adopted Capital Improvement Program (CIP) for Fiscal Year 2023-24 includes funding for the Annual Crack Seal of City Streets Project. Staff is recommending the award of contract in the amount of the base bid, $68,496, as well as an additional contingency fund of $7,000 (approximately 10%) to cover the cost of any unforeseen conditions that may arise throughout the course of construction or accommodate any additional work that needs to be completed through this scope of work. The total contract award, including contingency funds, will be in the amount of $75,496.

ENVIRONMENTAL CONSIDERATION
This is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.C Existing Facilities as the repair and maintenance of existing streets and highways.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priorities as it supports sustainable infrastructure projects consistent with the needs of our community.

RECOMMENDED ACTION
It is recommended that the City Council adopt the attached resolution (attachment 1) entitled:

MEETING
DATE: July 12, 2023
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Deputy City Manager/Director of Public Works Israel Gomez, Associate Engineer
SUBJECT: Resolution Awarding a Construction Contract to Romans Construction for the Stanfield Cutoff Parking Lot Improvements Project

BACKGROUND
Beginning in 2021, the City of Big Bear Lake coordinated with the Big Bear Municipal Water District (MWD) to transfer the Stanfield Boardwalks and parking lot from the MWD to the City of Big Bear Lake. The transaction closed in August 2022 and the City is now the owner of these assets. In the time since the transfer has been completed, the City has coordinated the construction of the Stanfield Boardwalks Improvements Project, the Stanfield Marsh Outdoor Recreation and Education (SMORE) Trail Phase I Project, and the installation of the Stanfield Cutoff Public Restroom. To complete and tie together all of these improvements in the Stanfield area, staff included a project in the Fiscal Year 2023-24 Capital Improvement Program (CIP) budget, which was adopted on June 14, 2023, to pave and improve the Stanfield Cutoff Parking Lot.

DISCUSSION
The Fiscal Year 2023-24 Capital Improvement Program (CIP) budget includes a project to improve and pave the Stanfield Cutoff Parking Lot. This project will compliment the work that has taken place in the area, over the recent years, and will replace the existing curbing, install drainage infrastructure, and pave the parking surface. The existing parking lot is base material meaning it is not an ideal surface as it is uneven and dusty, it does not manage water well, and parking spaces are unable to be delineated.

On April 12, 2023, the City Council authorized staff to proceed with a bid solicitation for this project. A Notice Inviting Bids was advertised, as required, in the Big Bear Grizzly and was posted on the City’s website. On Tuesday, June 27, 2023, staff received, publicly opened, and read aloud five (5) sealed bids with the following results:

Contractor Location Bid Amount
Romans Construction Big Bear Lake, CA $373,686.50
Bear Valley Paving Big Bear Lake, CA $442,130.40
S. Porter, Inc. Big Bear Lake, CA $507,872.75
Granite Construction Co. Indio, CA $559,500.00
Kemcorp Construction, Inc. Ontario, CA $635,000.00
Item 1.8
Staff reviewed the bid documents for completeness and accuracy and has found Romans Construction to be the lowest responsive bidder for this project. Romans Construction is a general engineering contractor that has been in business in Big Bear Lake for many years and they have completed several public works projects for the City in the past.

Upon the award of contract, staff will coordinate the schedule for completion with representatives from Romans Construction. It is anticipated that the work will take approximately six (6) weeks and will require the closure of the Stanfield Cutoff Parking Lot and portions of the boardwalks, at times. Efforts will be made to complete the project expeditiously while minimizing impacts to the area during this peak visitation season.

FISCAL IMPACT
The adopted Capital Improvement Program (CIP ) for Fiscal Year 2023-24 includes funding of $400,000 for this project, with funding derived from Measure Y Proceeds. Staff is recommending the award in the contract amount as well as an additional contingency fund of $25,000 (approximately 7%). The contingency funds will cover the cost of any unforeseen conditions that may arise throughout the course of construction or accommodate any additional work that need be completed within this scope of work. The total contract award to Romans Construction for this project will be in an amount not to exceed $398,686.50.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priorities as it supports sustainable infrastructure projects consistent with the needs of our community.

ENVIRONMENTAL DETERMINATION
At the time that this project was authorized for bid, the City Council found that it is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 Existing Facilities as an alteration of an existing facility with no expansion of use.

RECOMMENDATION
It is recommended that the City Council adopt a resolution entitled Resolution Awarding a Construction Contract to Romans Construction for the Stanfield Cutoff Parking Lot Improvements Project.

BACKGROUND
The City of Big Bear Lake is responsible for the construction, maintenance, and liability of approximately seven (7) miles of sidewalk across the City, including in parks and facilities. It is worth noting that for these purposes, the City is not responsible for the sidewalks along Big Bear Boulevard, which fall under the jurisdiction of Caltrans. In 2021, staff contracted with a vendor to provide a survey and assessment of the City’s sidewalk network to identify hazards or issues in need of repair or replacement.

The City is a member of the California Joint Powers Insurance Authority (CJPIA) that provides risk management for many public agencies across the State. The CJPIA entered into a master services agreement with Safe Sidewalks, Inc. DBA Precision Concrete Cutting (Precision) to provide sidewalk assessment and repair services to its member agencies as these services provide a significant risk aversion resource. Precision performed a comprehensive survey of the City’s sidewalk network and provided the report to staff.

Precision’s primary business is the correction and removal of sidewalk trip hazards through cutting separations in sidewalks that create the trip hazard. Precision has provided a proposal to the City, under the terms of the master services agreement with the CJPIA, to repair the trip hazards that were identified within the sidewalk assessment.

DISCUSSION
Precision provides a specialized approach in that the sidewalk lifts are cut flush and level with the remaining portions of sidewalk. Furthermore, the specific saw blades that are used in this process provide a smooth, clean finish. The result of these efforts is the removal of the trip hazard, improvement of ADA accessibility, and an appropriate finish to the surface. Precision can perform these services on sidewalk lifts or separations with vertical changes between ½” and 2” in height.

For sidewalk lifts that are greater than 2”, this approach is not applicable and the sidewalk would likely need to be replaced.

Item 1.7
Precision’s assessment of the City identified a total of 958 sidewalk hazard locations with vertical changes of greater than ½”. Using the criteria range of ½” to 2”, Precision’s process can eliminate approximately half of the identified hazards. The remaining hazard areas would need to be remediated through other methods such as patching or replacement.

Precision provides a pricing schedule for these services that is based upon the height and length of the repair. Small repairs, between ¼” to ½” in height, are $37.00 per unit, Medium repairs, between ½” to 1” in height, are $74.00 per unit, and Large repairs, between 1” and 2” in height, are $148.00 per unit. The proposed price to repair the nearly 450 trip hazards that can be cut is approximately $65,000 using this methodology, or about $4.00 per square foot. For comparison, the cost to replace sidewalk is typically $12.00 to $15.00 per square foot.

Staff is proposing that Precision be authorized to initiate the repairs that were outlined within their assessment report. As Precision maintains an agreement with the CJPIA they have extensive experience with cities throughout California and current staff has experience working with them in other agencies. Additionally, as the terms of the agreement between CJPIA and Precision Concrete Cutting are made available to member agencies, the City can take advantage of “piggy backing” on this agreement to satisfy the City’s purchasing policy.

Additionally, staff is preparing a sidewalk replacement project to be undertaken later this year that will focus on beginning the removal and replacement of sidewalk sections that cannot be repaired under these methods. The City’s adopted Five-Year CIP contemplates sidewalk repair and replacement as an ongoing effort over the next several years and staff believes that employing both of these strategies will provide an effective sidewalk management program.

FISCAL IMPACT
Staff is proposing that the agreement be established for a total fee not to exceed $65,000. Funding for these services are included in the adopted Fiscal Year 2022-23 Capital Improvement Program Budget.

ENVIRONMENTAL CONSIDERATIONS
Under Section 15301.C of the CEQA Guidelines, these repairs are categorically exempt and, therefore, no environmental review is required.

RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing a Professional Services Agreement with Safe Sidewalks, Inc. DBA Precision Concrete Cutting for Sidewalk Cutting Services.

MEETING
DATE: August 9, 2023
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Deputy City Manager/Director of Public Works Jared Cheek, Public Works Operations Manager
Jacky Chan, Associate Civil Engineer
SUBJECT: Resolution Awarding a Construction Contract to Siterep Construction Services, Inc. for the Boulder Bay Park Walkway and Curb Replacements Project

BACKGROUND & DISCUSSION
The adopted Fiscal Year 2023-24 Capital Improvement Program (CIP) budget includes funding to replace the existing walkways and curbs at Boulder Bay Park. Boulder Bay Park has existing asphalt and decomposed granite walkways throughout the park. This project contemplates replacing the existing walkways, which are aged and in disrepair, in concrete. The replacement of these walkways, in concrete, will meet all current ADA standards, improve the park user experience, and reduce maintenance issues and concerns. Additionally, existing curbing will be replaced and new curbing will be added along the walkways as well as around the landscaped areas.

Staff conducted a public bid process, consistent with our practices for CIPs, and on July 27, 2023, the City received, publicly opened, and read aloud nine (9) sealed bids with the following result:

Contractor Location Bid Amount
Siterep Construction Services, Inc. San Dimas, CA $311,115.27 J. Cardenas, Inc. Victorville, CA $323,893.00
Samuel Randazzo General Engineering Big Bear City, CA $350,000.00 KNC Construction Apple Valley, CA $352,850.00
LOAMC Builders, Inc. Fontana, CA $354,435.00
Kormex Construction, Inc. Ontario, CA $388,000.00
S. Porter, Inc. Big Bear Lake, CA $426,906.00
Issa Electric, Inc. Riverside, CA $435,000.00
Bear Valley Paving Big Bear Lake, CA $574,430.00
Staff has reviewed the bid documents for completeness and accuracy and has found the submittal of Siterep Construction Services, Inc. to be the lowest responsive bid for this project. Staff has reviewed the background of Siterep Construction Services, Inc. and found that they have similar experience on public works projects, including concrete work which is a key element of this project. Their previous public experience includes the Cities of Covina and Vernon, the California Highway Patrol, and the California Department of Corrections. Staff contacted provided references Item 1.7
and they received satisfactory feedback on their work performance.

Upon an award of contract, it is anticipated that work on this effort will commence in early September, after the Labor Day holiday. This project will require the complete closure of Boulder Bay Park for the duration of the improvements. Staff will be coordinating an outreach and notification process in advance of the work taking place.

This project is funded, in part, by Community Development Block Grant (CDBG) funds which are administered by San Bernardino County. This project is eligible to utilize these funds as the removal of architectural barriers and providing enhanced ADA accessibility is an eligible expenditure under the program guidelines. Staff has been in close contact with the County related to these funds and have received their authorization to proceed with awarding the construction contract.

FISCAL IMPACT
The adopted Capital Improvement Program (CIP) for Fiscal Year 2023-24 includes funding for this project in the amount of $300,000 with approximately $38,000 of it being derived from CDBG proceeds and the balance available in Measure Y funds. Staff is requesting a total contract award of $341,115.27, which includesthe base bid amount and an additional contingency fund of $30,000 (approximately 10%) to cover the cost of any unforeseen conditions that may arise through the course of construction. The total contract award will require the appropriation of an additional $42,000 in Measure Y funds.

ENVIRONMENTAL CONSIDERATION
At the time that this project was authorized for bid, the City Council found that it is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.C Existing Facilities as an alteration of an existing pedestrian walkway with no expansion of use.

MEETING
DATE: November 8, 2023
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Deputy City Manager / Director of Public Works Katya Meyer, Project Manager
SUBJECT: Resolution Authorizing Submittal of Application(s) for all Eligible CalRecycle Grant and Payment Programs

BACKGROUND AND DISCUSSION
The California Department of Resources, Recycling, and Recovery (CalRecycle) offers funding and grant opportunities to jurisdictions throughout the state in furtherance of the statewide goals of reducing, reusing, and recycling solid waste generated and the preservation of landfill capacity in order to protect public health, safety, and the environment. In order for jurisdictions to be eligible for grant funding and payment programs opportunities through CalRecycle, the City must adopt a resolution delegating a signing authority, and establishing the length of the authorization period to apply to grant and payment programs, up to a maximum of five (5) years.

In previous years the City has applied for and received funding from CalRecycle through the City/County Payment Program Beverage Container Recycling Program, which has helped the City to purchase beverage recycling containers and water bottle fill stations. This fall, staff intends to apply for the SB 1383 Local Assistance Grant to help with implementation of SB 1383, which was designed to achieve organic waste reduction goals statewide. The City intends to use the funding for procurement of organic waste products in the form of mulch or compost and for other efforts to assist with citywide edible food recovery requirements as included within SB 1383.

The proposed resolution would authorize the City Manager, or their designee, to execute any documents related to CalRecycle payment or grant programs which would include any applications for programs as well as any related agreements, amendments, and requests for payments associated with these programs. This authorizing resolution would allow the City to apply for, and implement, any CalRecycle grant or payment programs through November 2028.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action. The approval of this resolution will allow the City to pursue future grant opportunities which could generate fund for City programming.

ITEM 1.6

ENVIRONMENTAL CONSIDERATIONS
Authorizing future grant applications does not constitute a “Project” under the California Environmental Quality Act (CEQA) under the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment, as identified in CEQA Guidelines Section 15061(b)(3).

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priority No. 1 as it “supports and invests in sustainable infrastructure projects and programs”.

RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing Submittal of Application(s) for all CalRecycle Grant and Payment Programs for which the City of Big Bear Lake is Eligible, through November 8, 2028.

MEETING
DATE: November 8, 2023
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Deputy City Manager / Director of Public Works SUBJECT: Resolution Authorizing a Professional Services Agreement with Birtcher Anderson & Davis Associates, Inc. for the Management of the Leisure Bear Mobile Home Park through December 31, 2024

BACKGROUND & DISCUSSION
In November 2021, the City Council authorized the execution of a 99-year ground lease with Bear Valley Mutual Water Company for 19-acres of property located between Big Bear Boulevard and Big Bear Lake. The property includes considerable open space and lake frontage as well as existing restaurant uses and a 59-space mobile home park. The lease agreement became effective on August 1, 2022 and the City has assumed the controlling interest in the property. Since the City has become responsible for the oversight of the Leisure Bear Mobile Home Park, the management and operation of the park has been contracted to the Caritas Corporation.

Beginning in August 2022, the Caritas Corporation took on all management and oversight responsibilities of the Leisure Bear Mobile Home Park. Caritas, supported significantly through a subconsultant, Birtcher Anderson & Davis Associates, Inc., performed all typical property management functions related to the engagement of residents, collection of rents, and provision of maintenance and operations services. The agreement with Caritas, which initially for the first several months of the City’s control of the facility, was extended through the 2023 calendar year.

In September 2023, Caritas informed staff that it would not be positioned to extend their management agreement beyond its current expiration on December 31, 2023. Given their existing relationship with the property, staff contacted representatives from Birtcher Anderson & Davis Associates, Inc. to discuss a continuation of property management of the Leisure Bear Mobile Home Park.

Birtcher Anderson & Davis Associates, Inc. (Bircher) is a California based property management, development, and real estate investment firm. Birtcher has a number of real estate and property management ventures across industrial, business parks, office and retail properties, as well as mobile home parks. Birtcher currently manages 32 mobile home parks, accounting for more than 4,200 units, across California. Many of the parks that Birtcher manages are parks that are owned or overseen by Caritas, including Leisure Bear Mobile Home Park. Birtcher staff provides the current onsite management presence and management functions for Leisure Bear.

Birtcher has reviewed the scope of work and the terms of the agreement that is currently in place between the City and Caritas and has proposed to enter into an agreement with the City under ITEM 1.7
nearly identical terms to that agreement. Birtcher will perform a matching scope of work at the same costs associated with the current agreement with Caritas. The scope of work calls for typical asset and property management functions of the mobile home park. Generally, they will be responsible for all financial functions, including collecting rent and paying expenses, maintaining the park through varying avenues of service delivery, and being available to and interacting with the residents. The detailed scope of work is included within the agreement.

In August 2023, the City Council approved a consulting agreement with Birtcher Anderson & Davis Associates, Inc. for site assessment, feasibility study, and master planning efforts associated with the Leisure Bear Mobile Home Park.

FISCAL IMPACTS
Under the proposed agreement, Birtcher will receive $11,750 per month ($141,000 annually) in property management fees which is payable from the revenues generated through the operations of Leisure Bear Mobile Home Park. As these services are funded through the recognized revenues from the mobile home park operations, which are sufficient to bear these expenses, this agreement does not have a fiscal impact to any of the City’s operating accounts or approved budget. The agreement does also allow for management reimbursables and other operating expenses, as included within the budget for the operations of Leisure Bear Mobile Home Park.

ENVIRONMENTAL CONSIDERATIONS
Pursuant to Section 15378 of the California Environmental Quality Act (CEQA) Implementation Guidelines, this is not a project and, therefore, no environmental review is required.

CONSIDERATION OF STRATEGIC PRIORITIES

MEETING
DATE: November 8, 2023
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Deputy City Manager / Director of Public Works Jason Watterson, Public Works Manager – Field Operations / Utilities SUBJECT: Resolution Ratifying Expenditures Associated with Emergency Repairs of Sanitary Sewer Lift Station No. 12

BACKGROUND AND DISCUSSION
Among the assets that make up the City’s sanitary sewer system are twelve (12) sewer lift stations, also known as pump stations, that move wastewater throughout the City’s system. The lift stations ultimately move the wastewater into the larger wastewater treatment system managed by the Big Bear Area Regional Wastewater Agency (BBARWA). The lift stations are critical elements of the City’s system as the movement of wastewater prevents sewer overflows.

During recent routine maintenance activities, staff identified issues within the electrical system that services Lift Station No. 12. Lift Station No. 12 is located on Cove Drive and pumps the wastewater collected in the surrounding neighborhoods into a large trunk line that runs along the lake. Troubleshooting of the issue identified that the existing, underground electrical conduit is corroded allowing water intrusion into the electrical system, resulting in electrical shorts and unsafe conditions. As we approach the winter season, the conduit, wiring, and electrical system enclosures must be replaced to prevent water intrusion, resulting from rain or snow, which would hinder the normal operation of this critical system. If this work is not completed prior to the winter season, it is likely that the problem will persist or get worse and that the lift station will not operate appropriately during the winter season, which generally strains the sanitary sewer system due to inflow and infiltration concerns related to precipitation.

Staff contacted two local electricians, Ludecke Electric Service and Big Bear Electric, with whom the City has frequently worked with. Ludecke indicated that they were not positioned to complete this assignment at this time. Big Bear Electric has inspected the job and provided staff with a proposal of $35,053. They have the personnel resources and access to the necessary equipment to undertake this work immediately. As of the posting of this agenda, work is anticipated to begin during the week of November 6 and would be completed in approximately four (4) working days.

Big Bear Electric is a well-established electric service provider with a focus on commercial, industrial, and public electrical work with an expertise in pumps and motor controls, such as sewer lift stations. Big Bear Electric has previously performed similar work for the City of Big Bear Lake.

ITEM 1.8
Pursuant to the City’s Bid Policy and Procedure (No. 1986-36), this situation is considered an emergency whereby the failure of a sanitary sewer lift station could threaten public health and welfare. Under these circumstances, the City’s competitive bid procedures do not apply.

Adherence to the bid procedures, within this instance, may further an emergency scenario due to the time required to conduct a public bid.

FISCAL IMPACT
Funding for these repairs is available within the adopted Fiscal Year 2023-24 Annual Operating Budget within the Sanitation Fund.

ENVIRONMENTAL CONSIDERATIONS
This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.b Existing Facilities of the CEQA implementation guidelines as repair and maintenance of a publicly-owned utility system.

CONSIDERATION OF STRATEGIC PRIORITIES

RESOLUTION NO. 2023-XX

RESOLUTION RATIFYING EXPENDITURES ASSOCIATED WITH EMERGENCY REPAIRS OF SANITARY SEWER LIFT STATION NO. 12
WHEREAS, the City’s Sanitary sewer system includes twelve (12) sewer lift stations, also known as pump stations, that move wastewater throughout the City’s system, ultimately depositing wastewater into the treatment system operated by the Big Bear Area Regional Wastewater Agency (BBARWA); and,
WHEREAS, the sewer lift stations are critical assets within the system to properly handle wastewater and prevent sewer overflows; and,
WHEREAS, recently, staff identified issues associated with the electrical system at Lift Station No. 12, located on Cove Drive, during recent routine maintenance activities; and, WHEREAS, subsequent troubleshooting activities determined that the existing, underground electrical conduit is corroded allowing water intrusion into the electrical system, resulting in electrical shorts and unsafe conditions; and,
WHEREAS, as we approach the winter season, the conduit, wiring, and electrical enclosures must be replaced to prevent water intrusion, resulting from rain or snow, which would hinder the normal operation of this critical system and failure to address these situations may prevent regular operation of these facilities; and,
WHEREAS, staff contacted two local electrical service providers, Ludecke Electric Service and Big Bear Electric, Inc., to review the situation and provide proposals to address the electrical issues; and,
WHEREAS, Ludecke Electric Service indicated that they were not positioned to propose on the work at this time and Big Bear Electric, Inc. has the personnel and material resources to undertake this work and provided a proposal of $35,053 to complete the work; and, WHEREAS, the City’s Bid Policy and Procedure (No. 1986-36) stipulates that an emergency situation that threatens public health and welfare, such as a sewer lift station failure, creates an exemption from the competitive bidding process to remedy the emergency situation; and, WHEREAS, Big Bear Electric, Inc. is positioned to begin the work during the week of November 6 to remedy this situation; and,
WHEREAS, these repairs are categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.b of the CEQA implementation guidelines as repair and maintenance of a publicly-owned utility system.

NOW, THEREFORE, BE IT RESOLVED BY the City Council of the City of Big Bear Lake that:

1. An emergency situation exists related to the conditions of Sewer Lift Station No. 12 in accordance with the Bid Policy and Procedure (No. 1986-36).

2. The expenditure of $35,053 with Big Bear Electric, Inc. to complete the necessary electrical repairs to this facility is approved.

3. This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.b of the CEQA implementation guidelines as repair and maintenance of a publicly-owned utility system.

INDEPENDENT AUDITORS’ REPORT
To the Board of Directors
of Big Bear Lake Resort Association, Inc.

Opinion
We have audited the accompanying financial statements of the Big Bear Lake Resort Association, Inc. (a nonprofit organization), which comprise the statement of assets, liabilities, and net assets—income tax basis, as of March 31, 2023 and 2022, and the related statements of revenues, expenses, and other changes in net assets—income tax basis, cash flows and functional expenses for the years then ended, and the related notes to the financial statements.

In our opinion, the financial statements referred to above present fairly, in all material respects, the assets, liabilities, and net assets of Big Bear Lake Resort Association, Inc. as of March 31, 2023 and 2022, and its revenues, expenses, and other changes in net assets for the years then ended in accordance with the basis of accounting Big Bear Lake Resort Association, Inc. uses for income tax purposes described in Note 2.

Basis for Opinion
We conducted our audits in accordance with auditing standards generally accepted in the United States of America.

Our responsibilities under those standards are further described in the Auditor’s Responsibilities for the Audit of the Financial Statements section of our report. We are required to be independent of Big Bear Lake Resort Association, Inc. and to meet our other ethical responsibilities in accordance with the relevant ethical requirements relating to our audits. We believe that the audit evidence we have obtained is sufficient and appropriate to provide a basis for our audit opinion.

Basis of Accounting
We draw attention to Note 2 of the financial statements, which describes the basis of accounting. The financial statements are prepared on the basis of accounting Big Bear Lake Resort Association, Inc. uses for income tax purposes, which is a basis of accounting other than accounting principles generally accepted in the United States of America. Our opinion is not modified with respect to this matter.

Responsibilities of Management for the Financial Statements Management is responsible for the preparation and fair presentation of these financial statements in accordance with the income tax basis of accounting described in Note 2; this includes determining that the income tax basis of accounting is an acceptable basis for the preparation of the financial statements in the circumstances. Management is also responsible for the design, implementation, and maintenance of internal control relevant to the preparation and fair presentation of financial statements that are free from material misstatement, whether due to fraud or error.

To the Board of Directors
of Big Bear Lake Resort Association, Inc.

Auditor’s Responsibilities for the Audit of the Financial Statements Our objectives are to obtain reasonable assurance about whether the financial statements as a whole are free from material misstatement, whether due to fraud or error, and to issue an auditor’s report that includes our opinion.

Reasonable assurance is a high level of assurance but is not absolute assurance and therefore is not a guarantee that an audit conducted in accordance with generally accepted auditing standards will always detect a material misstatement when it exists. The risk of not detecting a material misstatement resulting from fraud is higher than for one resulting from error, as fraud may involve collusion, forgery, intentional omissions, misrepresentations, or the override of internal control. Misstatements are considered material if there is a substantial likelihood that, individually or in the aggregate, they would influence the judgment made by a reasonable user based on the financial statements.

In performing an audit in accordance with generally accepted auditing standards, we:
 Exercise professional judgment and maintain professional skepticism throughout the audit.  Identify and assess the risks of material misstatement of the financial statements, whether due to fraud or error, and design and perform audit procedures responsive to those risks. Such procedures include examining, on a test basis, evidence regarding the amounts and disclosures in the financial statements.  Obtain an understanding of internal control relevant to the audit in order to design audit procedures that are appropriate in the circumstances, but not for the purpose of expressing an opinion on the effectiveness of Big Bear Lake Resort Association, Inc.'s internal control. Accordingly, no such opinion is expressed.  Evaluate the appropriateness of accounting policies used and the reasonableness of significant accounting estimates made by management, as well as evaluate the overall presentation of the financial statements.  Conclude whether, in our judgment, there are conditions or events, considered in the aggregate, that raise substantial doubt about Big Bear Lake Resort Association, Inc.'s ability to continue as a going concern for a reasonable period of time.

We are required to communicate with those charged with governance regarding, among other matters, the planned scope and timing of the audit, significant audit findings, and certain internal control related matters that we identified during the audit.

NOTE 1: ORGANIZATION BACKGROUND AND OPERATIONS
Big Bear Lake Resort Association, Inc. is a non-profit 501(c)(6) operation in Big Bear Lake, California, whose main purpose is to provide advertising for Big Bear Valley, a community comprised of Big Bear Lake, Big Bear City, Fawnskin, Sugarloaf and Baldwin Lake. It manages the Big Bear Lake Visitors Center, the Visitors Guide, as well as the BigBear.com website.

A majority of their funding comes from the Tourism Business Improvement District (TBID), as well as community partnerships and voluntary dues. TBID funds are managed by the entity and programs are implemented according to a designated written management district plan (The Plan), whereby they must provide annual reports to the City Council. An important note about TBID funds is that they cannot be used for government programs.

An elected Board of Directors makes most policy decisions and assists in directing operations in accordance with The Plan. A staff of about twelve individuals run all administrative functions, marketing, events and the Visitor Center office located at 40824 Big Bear Boulevard in Big Bear Lake, California.

NOTE 2: SUMMARY OF SIGNIFICANT ACCOUNTING POLICIES
A. Basis of Accounting
The financial statements have been prepared on the income tax basis of accounting, which is the basis used for tax reporting purposes. Income tax basis of accounting differs from Generally Accepted Accounting Principles (GAAP), which is required by for all publicly traded and regulated companies. Big Bear Lake Resort Association is not contractually or otherwise required to issue GAAP financial statements; therefore, the income tax basis method has been chosen as the most reasonable format for this entity.

B. Revenue and Expense Recognition
In accordance with the income tax basis accounting, all revenues and expenses are recognized based on the timing of cash receipts and disbursements. As a result, revenues are recognized only when cash is received, and expenses are recognized only when cash is paid. This differs from GAAP, where revenue is recognized when earned, and expenses are recognized when incurred. As of March 31, 2023, there was one exception regarding a prepaid wage deposit in the amount of $47,000 paid to ADP Payroll Services.

C. Inventories
The Visitor Center maintains certain Inventories related primarily to gift items and Adventure Passes for access to US Forest Service lands. Inventories are priced at the lower of cost or net realizable value, with cost being determined on the first-in, first-out, basis.

D. Property and Equipment
Property and equipment are carried at cost. Big Bear Lake Resort Association computes depreciation on the tax basis using the 200% double declining balance over the following estimated useful lives:

Buildings - 39 years Improvements - 15-39 years
Equipment - 5 years Furniture and fixtures - 7 years

When a restriction expires, net assets with donor restrictions are reclassified to net assets without donor restrictions and reported in the statement of activities as net assets released from restrictions. H. Functional Expenses
The costs of providing the various program and supporting services have been summarized on a functional basis in the statement of revenues, expenses, and other changes in net assets – income tax basis. The statement of functional expenses presents the natural classification detail of expenses by function. Accordingly, certain costs have been allocated among the program services and supporting services benefitted.

I. Use of Estimates
The preparation of financial statements in conformity with the income tax basis of accounting requires management to make estimates and assumptions that affect the reported amounts of assets and liabilities, and disclosure of contingent assets and liabilities, at the dates of the financial statements and the reported amounts of revenues and expenses during the reporting periods. Actual results could differ from those estimates, and those differences could be material.

NOTE 4: CONCENTRATION OF CREDIT RISK
The Association may be subject to credit risk on its cash. At March 31, 2023 and 2022, the Organization maintains its cash balances at two institutions. Accounts at the institutions are insured by FDIC, which covers up to $250,000 for substantially all depository accounts. At various times throughout the year, the balances in these accounts may be in excess of federally insured limits. Management believes the Association is not exposed to any significant credit risk on cash. At March 31, 2023 and 2022, the amount of uninsured cash balances at these institutions totaled $5,907,149, and $5,405,407, respectively.

NOTE 5: TBID FUNDING
A majority of revenue for Big Bear Lake Resort Association comes from Tourism Bureau Improvement District (TBID) Funds, which is a special assessment program designed to fund marketing activities. Currently, the City of Big Bear Lake assesses all lodging 3% and ticket sales of the ski resorts 2% on a quarterly basis and retains an administrative fee of 1%. Accordingly, Visit Big Bear recognizes gross revenue and records the administrative fee as a processing fee. Payments are made on a quarterly basis, and recognized when deposited. The funds are then appropriately used in accordance with a written management district, which contains documentation on assessment rates, collection, budget and activities to be funded. An annual report is required to the City Council as oversight on the use of TBID funds. To the Board of Directors
Big Bear Lake Resort Association, Inc. dba Visit Big Bear Big Bear Lake, California
We have audited the financial statements of the Big Bear Lake Resort Association, Inc. dba Visit Big Bear (Visit Big Bear) for the years ended March 31, 2023 and 2022. Professional standards require that we provide you with information about our responsibilities under generally accepted auditing standards as well as certain information related to the planned scope and timing of our audit. We have communicated such information in our letter to you dated August 9, 2023. Professional standards also require that we communicate to you the following information related to our audit.

Significant Audit Matters
Qualitative Aspects of Significant Accounting Practices Management is responsible for the selection and use of appropriate accounting policies. The significant accounting policies used by Visit Big Bear are described in the notes to the financial statements. No new accounting policies were adopted and the application of existing policies was not changed during fiscal years 2021-2022 and 2022-2023. We noted no transactions entered into by Visit Big Bear during the year for which there is a lack of authoritative guidance or consensus. All significant transactions have been recognized in the financial statements in the proper period.

Accounting estimates are an integral part of the financial statements prepared by management and are based on management’s knowledge and experience about past and current events and assumptions about future events.

Certain accounting estimates are particularly sensitive because of their significance to the financial statements and because of the possibility that future events affecting them may differ significantly from those expected.

The financial statement disclosures are neutral, consistent, and clear.

Significant or Unusual Transactions
Management is responsible for the policies and practices used to account for significant or unusual transactions.

No significant unusual transactions have occurred during fiscal year 2022-2023 or fiscal year 2021-2022.

Difficulties Encountered in Performing the Audit
We encountered no significant difficulties in dealing with management in performing and completing our audit.

To the Board of Directors
Big Bear Lake Resort Association, Inc.

Big Bear Lake, California
Corrected and Uncorrected Misstatements
Professional standards require us to accumulate all known and likely misstatements identified during the audit, other than those that are trivial, and communicate them to the appropriate level of management. We are pleased to report that no such misstatements were identified during the course of our audit.

Disagreements with Management
For purposes of this letter, a disagreement with management is a financial accounting, reporting, or auditing matter, whether or not resolved to our satisfaction, that could be significant to the financial statements or the auditor’s report. We are pleased to report that no such disagreements arose during the course of our audit.

Management Representations
We have requested certain representations from management that are included in the management representation letter dated September 28, 2023.

Management Consultations with Other Independent Accountants In some cases, management may decide to consult with other accountants about auditing and accounting matters, similar to obtaining a “second opinion” on certain situations. If a consultation involves application of an accounting principle to Visit Big Bear’s financial statements or a determination of the type of auditor’s opinion that may be expressed on those statements, our professional standards require the consulting accountant to check with us to determine that the consultant has all the relevant facts. To our knowledge, there were no such consultations with other accountants.

Other Audit Findings or Issues
We generally discuss a variety of matters, including the significant events or transactions that occurred during the year, business conditions affecting Visit Big Bear and business plans and strategies that may affect the risks of material misstatements, the application of accounting principles and auditing standards, with management each year prior to retention as Visit Big Bear’s auditors. However, these discussions occurred in the normal course of our professional relationship and our responses were not a condition to our retention.

Restriction on Use
This information is intended solely for the use of the Board of Directors and management of Visit Big Bear and is not intended to be, and should not be, used by anyone other than these specified parties.

Very truly yours,
Brea, California
