CITY OF BIG BEAR LAKE

TREASURER'S REPORT
March 31, 2024

MEETING
DATE: May 8, 2024
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Assistant City Manager
Jason Watterson, Public Works Manager – Field Operations / Utilities SUBJECT: Authorize a Professional Services Agreement for the Tour de Big Bear Traffic Control Services

BACKGROUND & DISCUSSION
The Tour de Big Bear is an annual bicycle ride event that is held the first weekend in August and draws more than 2,000 participating cyclists in addition to spectators and other visitors. The Tour de Big Bear is defined, pursuant to the City’s Community Events Grant Policy, as a City Sponsored Signature Event which is an event that has previously demonstrated their significant economic benefit to the Community resulting from their documented large attendance and their contribution to multiple night bookings within the Big Bear Valley. As such, the City’s contribution toward City Signature Events is not defined by the policy but is revisited annually.

Historically, the City’s contribution to the Tour de Big Bear has been in-kind services and associated costs valued at approximately $50,000 annually, with the primary focus on event traffic control, and the related costs of Caltrans permits and Sheriff/CHP personnel. The traffic control effort is a significant contribution of staff time, usually requiring 1,000 or more Public Works Staff hours in the weeks leading up to and through the event. The activities include coordinating and organizing the traffic control equipment, assembling signs, laying out the route and staging the materials. The day of the event, to implement the traffic control and event support, generally requires all Public Works employees to work the event, which is approximately twenty-five (25) personnel in addition to management support.

Given the significant impact that this event places upon City Public Works resources, especially during the busy construction and maintenance season, staff sought to use additional contracted support for the Tour de Big Bear in 2023. As the traffic control efforts represent the largest impact to labor resources, staff prepared an RFP for turnkey traffic control services for this event, requesting that proposing firms provide all advance preparation and comprehensive day of event traffic control services. In response to the RFP for these services in 2023, the City received one response from Statewide Traffic Safety and Signs, Inc. (Statewide).

Based upon the results of the RFP, the City Council awarded a Professional Services Agreement to Statewide in the amount of $38,000. Once the agreement was approved, Statewide staff were integral to the planning and coordination, in advance of the event. Representatives from Statewide assisted in the coordination with Caltrans, integrated well with City staff in understanding the Item 1.2
nature of the event and worked closely with them, as well as the Tour de Big Bear representatives, to finalize the plans, layout the course, and execute a safe and successful event.

As anticipated, the usage of Statewide for the 2023 event significantly reduced the City staff obligations for this event, while still delivering a quality event consistent with previous events and the expectations of the event organizers. The day of staffing for Public Works was reduced by more than 50% and the reduced work impacts in the events leading up to the event allowed staff to focus on other, critical Public Works tasks and functions. As we continue to utilize contracted traffic control services and all parties get more comfortable with the event operations, City Staff’s support will continue to be reduced.

As we approach the 2024 event, staff is recommending that we again utilize Statewide for the traffic control services. Given that they were the only respondent to the 2023 RFP and their successful execution of the event, they have demonstrated a partnership with the City and the event promoter which is beneficial to delivering this event effectively and efficiently. Statewide has proposed a price of $42,000 for the 2024 event services, which is an increase of approximately 10% over the cost from last year. The increase is attributable to general inflationary increases as well as a slight scope modification as the event is returning to Bear Mountain for the 2024 edition, which requires additional traffic control along Moonridge Road.

The Tour de Big Bear is scheduled for Saturday, August 3, 2024. The event’s Special Event Permit, including the necessary road closures, was approved by the Planning Commission on March 20, 2024.

FISCAL IMPACT
Funding for the contract traffic control services in the amount of $42,000 is available in the proposed Fiscal Year 2024-25 Annual Operating Budget within the Management Services section.

ENVIRONMENTAL CONSIDERATIONS
Under Section 15378 of the California Environmental Quality Act (CEQA) Guidelines, this is not project, and, therefore, no environmental review is required.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priority No. 5 to “protect and preserve the quality of life for residents and businesses”.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution Authorizing a Professional Services Agreement with Statewide Traffic Safety and Signs, Inc. for Traffic Control Services in Support of the 2024 Tour de Big Bear Event.

(Statewide) was the selected vendor for the 2023 event, as they are a well established traffic control provider and were the only respondent to the City’s RFP, and they successfully implemented the necessary traffic control support, resulting in a safe and effective event, for the cost of $38,000; and, WHEREAS, given the success of the 2023 event, which significantly reduced staff time, including the day of staffing by more than 50%, staff is recommending that the City again contract with Statewide for the 2024 event; and,
WHEREAS, Statewide sufficiently performed the services for the 2023 event and are familiar with the nature and technicalities of the event and it is believed that their familiarity with the event will only lead to additional efficiencies and future success for the event; and, WHEREAS, Statewide has proposed to perform the necessary services for the 2024 Tour de Big Bear at a cost of $42,000, which represents an approximately 10% cost increase from last year, attributable to general inflationary increases as well as additional costs associated with a revised Item 1.2
Attachment 1

WHEREAS, the use of these contracted services will greatly reduce both the impact upon City staff and the associated costs of this event; and,

NOW, THEREFORE, BE IT RESOLVED by the City Council that:

1. DATE: May 8, 2024
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Assistant City Manager
Jason Watterson, Public Works Manager – Field Operations / Utilities SUBJECT: Approve Purchase of Standby Generators

BACKGROUND & DISCUSSION
The City’s Sanitation Division is responsible for the maintenance of the sanitary sewer system which includes approximately 200 miles of sewer main, more than 3,000 manholes, and 12 sewer lift stations. The sewer lift stations, also known as pumping stations, move wastewater throughout the City’s sanitary sewer system and ultimately deposit it in larger trunk lines managed by the Big Bear Area Regional Wastewater Agency (BBARWA). The lift stations are critical resources to keep the wastewater moving through the system and preventing overflows. Given their importance, the sites are equipped with redundant electricity either through built in emergency generators or electrical connections to receive power from portable generators.

The City’s lift stations are all in excess of thirty (30) years old or older and the standby generators that serve these stations date to the original construction of each station. As such, these generators are obsolete and inefficient in addition to no longer being compliant with California Air Resources Board (CARB) and South Coast Air Quality Management District (SCAQMD) standards. As such, beginning with Fiscal Year 2021-22, funds have been allocated annually for replacement generators in the Five-Year Capital Improvement Program (CIP) budget. Since the time that this practice has been instituted, the backup generator at Lift Station No. 12 has been successfully replaced.

Staff has standardized the usage of Kohler diesel generators for these facilities as they are available in a variety of sizes and configurations to meet the diverse needs of our Sanitation sites and equipment and Kohler is regarded as a leading manufacturer of portable power systems.

Furthermore, having consistent generators throughout the system allows for more effective maintenance and upkeep given the availability and consistency of replacement parts. Kohler generators are available to the City at a discounted price through our membership in Sourcewell, a national purchasing collective available to governmental agencies. Bay City Electric Works maintains the Sourcewell contract (Contract No. #092222-KOH) for these Kohler generators which offers pricing for these units at approximately 30% below list price.

Staff has identified three (3) lift stations that are high priorities for replacement generators. Staff has worked with Bay City Electric Works to provide the appropriate specifications and cost proposals for the identified generators and they are outlined in the table below:

Item 1.3
Station Location Specified Generator Total Cost
1 Meadow Park / Eagle Point Kohler Model 150REOZJF (150 KW) $ 91,856.25 9 City’s Sewer Ponds Kohler Model 60REOZK (60 KW) $ 63,358.79 10 Stanfield / Big Bear Blvd Kohler Model 50REOZK (49 kw) $ 63,358.79 TOTAL $218,573.83
The costs above include the purchase price of the diesel generators, inclusive of the Sourcewell, discount as well as all necessary accessories, freight and start up services from Bay City Electric Works. The primary accessory is an automatic transfer switch (ATS) for each unit which automatically switches the generator on when it detects a disruption in electrical service. In addition, the generator for Station 1 has additional emissions management requirements because of its size so the pricing provided above includes the required diesel particulate filter system. It is estimated that these units would be delivered to Big Bear Lake within 10-12 months from executing the order.

The proposed action includes only the purchase of the generators, it does not include installation.

The installation of these generators will need to be performed by a qualified, licensed electrical contractor and the selection of that contractor is subject to the City’s bidding and purchasing guidelines. Staff will work to prepare the plans and specifications for the installation of these generators and will conduct a public bid process in Winter/Spring 2025. The intention is to closely align the award of construction contract for the installation of these generators with their delivery schedule. Staff will return to the City Council at the appropriate time for the authorization to solicit construction bids as well as for the consideration of the construction contract.

FISCAL IMPACT
The total cost for the purchase of these generators is $218,573.83. Funding is available in the adopted Capital Improvement Program (CIP) budget with funding derived from the Sanitation Fund.

ENVIRONMENTAL CONSIDERATIONS
This action is not subject to the California Environmental Quality Act (CEQA) as it is not a project pursuant to Section 15378 of the CEQA Guidelines. A CEQA finding will be made at a later City Council meeting as a part of the consideration of a construction contract to install these generators.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priority No. 1 as it “supports and invests in sustainable infrastructure projects and programs”.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution Approving the Purchase of Standby Generators from Bay City Electric Works to Support the City’s Sanitation Facilities.

DATE: May 8, 2024
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Assistant City Manager
Jason Watterson, Public Works Manager – Field Operations / Utilities SUBJECT: Approve Purchase of Fleet Vehicles

BACKGROUND & DISCUSSION
The City’s Public Works Department is responsible for the management and maintenance of the City’s motor fleet which includes a variety of vehicles and equipment for use in support of City operations. Staff maintains, and updates annually, a vehicle replacement schedule with the goal of maximizing the useful life of the City assets while also minimizing the ongoing maintenance and operating expenses and replacing the vehicles accordingly. Funding for the replacement of fleet vehicles is included within the annual Capital Improvement Program (CIP) budget.

The City’s motor fleet includes a variety of light duty trucks and passenger vehicles, medium and heavy duty pickup trucks, and specialized heavy equipment such as tractors, dump trucks, and sewer trucks. These vehicles and equipment support all City operations from Public Works to Code Compliance, inspectors, project managers, and administrative staff. Vehicles are both assigned to certain positions or job functions or are a part of the vehicle pool for use as needed.

Staff has reviewed the vehicle needs of the City as well as identified vehicles to be replaced for the current Fiscal Year. With these specifications, staff has obtained quotes for the needed vehicles.

In recent years, the general market for the purchase of vehicles has changed making fleet vehicles challenging to obtain with less competitive pricing and longer lead times. Given these circumstances, staff has looked to different dealers and options for the purchase of fleet vehicles than we have in the recent past to ensure that we are locating the preferred vehicles with competitive pricing.

Staff has identified the following vehicles for replacement:

Year Make Model
2006 Jeep Liberty
2008 Ford Escape Hybrid
2008 Ford Escape Hybrid
2016 Ram 1500 Pickup
These vehicles were primarily assigned to the general City Hall pool of vehicles, serving Code Compliance, Neighborhood Preservation, Building & Safety, Engineering and other general uses.

Item 1.4
The vehicles were identified primarily based upon age and condition of the vehicles, with the 2016 RAM being the result of damage. The vehicles that are being replaced will be removed from the motor fleet and disposed of in accordance with the City’s purchasing policy and guidelines. The City’s historic practice has been to consign retired fleet vehicles to an auction house where they handle the disposition of the vehicle and delivering the sale proceeds to the City.

Staff is proposing to replace the vehicles in question with other models as well as adding addition vehicles to better meet the needs of our staff. This action will allow the purchase of three (3) of each of the following vehicles, for a total of six (6) vehicles:

Year Make Model Price (each) Assigned to
2024 Ford Maverick, Light Truck 4X4 $ 34,394 Neighborhood Preservation /Code Compliance
2025 Ford Explorer, SUV 4X4 $ 46,785 City Hall Pool
Staff has obtained quotes for these vehicles through a piggyback of a competitive bid contract that was previously conducted by a local agency that meets the needs of this purchase to establish competitive pricing. In June 2021, the City of Long Beach awarded a competitively bid fleet contract to a number of vehicle dealerships in California that is currently valid through 2024. Staff contacted representatives from these contracted dealerships and one, Frontier Ford (Santa Clara, CA), was able to provide vehicle quotations consistent with the established terms of this agreement. Throughout this process, staff also contacted National Fleet Auto Group, who we frequently purchase fleet vehicles from through Sourcewell and the State of California contract, to obtain vehicles quotes from them. National Fleet Auto was unable to offer pricing given their current order volume. The City’s purchasing policy and guidelines allows for the purchase of goods and services through cooperative purchasing, such as piggybacking off of other available contracts.

The proposed purchase order is for three (3) each of the above vehicles. The vehicles all have four wheel drive, are all white in color, and the options are consistent with the typical standards for vehicles within our fleet. The dealer has advised that delivery time on these vehicles will be approximately six (6) months from the time of executing the order.

Additionally, staff has been seeking an additional Public Works truck, which is standardized as a RAM 2500. Of late, these trucks have been purchased through an out of state dealership; however, their availability has also been recently challenging. Staff has been able to locate a RAM 2500 with the appropriate snow plow package, meaning that this vehicle is equipped as our standard Public Works trucks are. The vehicle is in stock at Victorville Motors and available for immediate delivery, whereas, most other trucks of this nature have a minimum six (6) month lead time. The vehicle is available for a base price of $60,200 and is $65,601 out the door. The City last purchased a 2022 RAM 2500, which is identical but for the model year, in December 2022 and the base pricing was $60,074 and out the door for $64,730. Given the negligible difference in price from previous purchases and given the availability for immediate delivery, staff is recommending that we proceed with the purchase of this vehicle.

FISCAL IMPACT
Funding for the purchase of fleet vehicles is available in the adopted CIP budget for Fiscal Year 2023-24 in the amount of $350,000. The total purchase expense for these seven (7) vehicles, inclusive of all taxes and fees, is approximately $310,000.

1 as it “invests in sustainable infrastructure project and programs”.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution Approving the Purchase of Fleet Vehicles.

DATE: May 8, 2024
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Assistant City Manager
Andrew Mellon, Community Development Manager
SUBJECT: Authorize Submission of the 2023 Housing Element Annual Progress Report

BACKGROUND & DISCUSSION
In 2017, the Governor signed a group of fifteen (15) housing bills to address affordable housing issues in California, with many of the provisions in these bills becoming effective on January 1, 2018. Among these bills is AB 879, which made the Housing Element Annual Progress Report (APR) applicable to charter cities as well as adding a number of additional housing element reporting requirements to the report. Prior to the passage of AB 879, charter cities, such as the City of Big Bear Lake, were not required to submit the APR to the State Department of Housing and Community Development (HCD).

In accordance with the legislation, cities must report on every housing unit approved or denied for the prior year. The reporting criteria includes entitlements for housing developments, building permits issued, and permits completed (final occupancy) for all residential unit activities during the previous calendar year. The APR is to be considered for approval, annually, at a regularly scheduled City Council Meeting. The APR must be submitted to the State Department of Housing and Community Development (HCD) and the State Office of Planning and Research (OPR) by April 1st of each year. Since 2018, HCD has enforcement power to require submittal of a Housing Element APR and limit state grant funds to cities which do not comply. Staff does not anticipate any negative actions as a result of this submittal slightly beyond the established deadline.

The 2023 APR reports on the progress made related to implementation of the 2021-2029 Housing Element, which was certified by HCD effective October 10, 2022. This APR has been prepared and will be submitted in accordance with Government Code Section 65400. The APR is a standardized spreadsheet, created by HCD, that is to be submitted without alteration or adjustment, including formatting. Within the report, data is only provided for applicable categories or as data is available, meaning that some sections of the report may appear blank. The City of Big Bear Lake Planning Division webpage includes a number of documents, including the 2021-2029 Housing Element, which can be viewed https://www.citybigbearlake.com/housingelement.

The enclosed report includes a number of tables and sections to include the required information, and some of the key highlights are outlined below. Table A contains a list of all permits submitted in 2023, of which there were seventeen (17) new single family homes and six (6) new ADUs.

During this period, there were three (3) building permits issued for Accessory Dwelling Units Item 1.5
(ADU). As shown in Table A2 of the APR, for the calendar year 2023, the City completed building permits for a total of forty (40) single family residential dwelling units and four (4) multiple family residential condominium permits. There are not any local programs which target low- and moderate-income families on units built to be sold, so the 44 dwellings are determined to fall within the Above-Moderate income category. Table B automatically populates the data provided in Tables A and A2, to summarize the City’s progress toward the Regional Housing Needs Assessment (RHNA) during the 8-year Housing Element cycle. Table D of the APR provides a status of the Housing Element programs that are being implemented. There is no reportable action in Tables C, E, F, F2, G, H, J or K. The completed spreadsheet constitutes the APR and will be submitted to the State.

FISCAL IMPACT
There is no fiscal impact associated with this action.

ENVIRONMENTAL CONSIDERATIONS
The APR is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15378 of the CEQA Guidelines. The APR is an administrative report that, by itself, authorizes no development or any discretionary action, and therefore is exempt from CEQA.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council's Strategic Priority No. 5 as it “protects and preserves the quality of life for the residents”.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution Authorizing the Submission of the 2023 Housing Element Annual Progress Report as Required by Government Code Section 65400.

Name of Program Objective Timeframe in H.E Status of Program Implementation H1-A Adequate Housing
Inventory
Maintain adequate sites to
encourage/facilitate housing
development
Ongoing/annual review
In 2022, the City created a High Density Residential (HDR) land use designation and corresponding High Denstiy Residential R-4 zone, to accomodate the 6th cycle RHNA.

H1-B Variety of Housing
Establish a minimum density in the R-3
zone, such as 12 units/acre or density
increase, such as 24 units/acre, to
encourage a variety of housing
development, and establish a new R-4
zone with a density range of 20 – 24
units/acre
2022-2024
The City replaced the Workforce Housing Overlay with a High Density Residential (HDR) land use designation and corresponding High Denstiy Residential R-4 zone. The zoning desination applies to 6 vacant sites previously zoned R-3. This zoning and designation allows for a minimum of 20 units/acre and a maximum of 24 units/acre and removes the 2-acre minimum lot size requirement. These changes accomodate the City's 6th Cycle RHNA.

The City is drafting additional updates and will be evaluating local incentives and changes to encourage ADU and second unit production.

H2-F Employee Housing
Work with local employers to identify
employee housing needs and potential
strategies. City will contact at least three
of the largest employers annually
Annual review
The largest employers have indicated that affordable housing in Big Bear Valley is an important part of attracting and retaining needed employees but have not identified new strategies. One local grassroots group, the Big Bear Workforce Housing Initiative, created a program to incentivize owners of vacation rental homes to rent longterm to qualified local employees. The City continues to work with the group to identify strategies.

H2-G Incentives for
Needed housing
Create incentives to encourage
development of needed workforce
housing
Incorporate 3 additional
incentives by 2024
The City will identify meaningful incentives and will draft a Development Code Amendment to including at minimum three incentives.

H3-A Review and Update
Development Review
Procedures and Fees
Minimize the time and cost of the
development review process. Ensure
that development fees are reasonably
related to the cost of providing service.
2022, review annually
The City processed a Development Code Amendment in 2022. The project created a new High Density Residential (R-4) zone, removed the 2-acre minimum lot size for parcels zoned for 20 units/acre and established a minmum and maximum density range (20-24 units/acre). The changes provide clarity and reduce processing time. Other amendments included compliance with state law related to Low Barrier Navigation Centers, reasonable accomodation process, and Emergency Shelter parking requirements.

H3-B Emergency Shelters

Navigation Centers
Work with local organizations and
charitable groups to facilitate services
for the homeless and locate a housing
shelter in the City. City will contact at
least 3 local organizations annually to
share opportunity sites and provide
technical assistance
Adopt Ordinance in 2022
The City processed a Development Code Amendment in 2022, in compliance with state law for low barrier navigation centers and emergency shelter parking requirments. The City participated in regular meetings with a local organization, the Mountain Homeless Coalition, which owns and operates extremely low income housing units in the CIty and continues to explore possibilities for expanding housing in the mountain area.

H3-C Transitional and
Supportive Housing
Facilitate the provision of transitional
and supportive housing consistent with
State law by adopting a code
amendment
Adopt Code Amendment
by October 2024
Not implemented. The City will draft an Amendment to update Transitional and Supportive Housing standards and process. In 2023, there were no requests for transitional or supporitvie housing and should the City receive future requests prior to adoption of an ordinance, the City will refer to state law in order to be consistent with current state requirements.

H3-D Housing Information
Facilitate the consolidated provision of
information as it pertains to housing
programs, education, and incentives
with specific intent of informing the
community of all housing-related
opportunities, including Development
Code standards, such as allowing the

H4-B Housing Repair and
Rehabilitiation
Provide information on the County’s
housing repair and rehabilitation
programs. Because this is a County
administered program, it is unknown by
the City how many residents pursue and
ultimately take advantage of this
program. The City will geographically
target outreach to the low/moderate
resource areas and will offer repair and
rehabilitation information to 100% of
code-enforcement cases where home
repairs are necessary
Ongoing and disseminate
any updated information

and connectivity between City facilities.

Annually apply for CDBG
funds. Specific placebased CIP projects per the
5-Year CIP schedule,
which is reviewed and
updated annually. The
current schedule is 2020-
2025.

The City was unsuccessful competing in the state parks grant program for the Village plaza, but continutes to explore oppurtunities to make place-based improvements in low income tracts using state and federal grants.

H5-C Facilitate Tenant
Protection Act of 2019
Make information about the Facilitate

ITEM REPORTS

MEETING
DATE: May 8, 2024
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Assistant City Manager
SUBJECT: Authorize a Professional Services Agreement for the Preparation of a Relocation Impact Report and Relocation Plan Related to the Leisure Bear Mobile Home Park

BACKGROUND & DISCUSSION
In November 2021, the City Council authorized the execution of a ground lease with Bear Valley Mutual Water Company for 19-acres of property located between Big Bear Boulevard and Big Bear Lake. The lease became effective on August 1, 2022, at the conclusion of the City’s due diligence efforts, and has an initial term of ninety-nine (99) years, with the opportunity for extensions of up to an additional thirty (30) years. The first year of this lease, staff focused on maintaining the existing uses on the property, including the Leisure Bear Mobile Home Park, the restaurant uses, and residential properties. As the City entered the second year of the lease in August 2023, the focus has transitioned to the master planning efforts related to the long-term improvements and uses of the site.

The master planning effort has been focused on two key elements: 1. Public Park Amenities and

2. The Leisure Bear Mobile Home Park. On August 9, 2023, the City Council awarded consulting agreements in support of these efforts to qualified and experienced firms. SWA Group (Laguna Beach, CA) was contracted to lead a public engagement and conceptual design process related to the anticipated public park amenities. Birtcher, Anderson & Davis Associates (San Juan Capistrano, CA) was contracted to lead the assessment and master planning effort associated with the Leisure Bear Mobile Home Park.

Birtcher, Anderson & Davis Associates (Birtcher) outlined a scope of work that included a comprehensive analysis of the existing conditions of the existing mobile home park and options and opportunities related to the future disposition of the mobile home park. Specifically, their scope of work included:

1. Existing Site Review and Analysis – provide a comprehensive plan, overview of the process, and an economic analysis related to the complete renovation of the existing park on the existing site.

2. New Park Development on a Replacement Site – overview the process(es) and evaluate the costs associated with closing the mobile home park and relocating residents to other options, including a potential new mobile home park in the area, move residents into Item 2.1
existing mobile home parks within the area, or consider cash buyouts of the existing owners.

3. Resident Demographic Analysis & Inventory – work with the City and the outreach consultant to build a comprehensive inventory of the residents, with key personal and demographic information, to assist in the analysis of options associated with the mobile home park.

Work has been underway on this effort since August 2023 and staff has worked closely with the Birtcher team throughout this process. Staff is currently reviewing a draft of the report that includes detailed information and findings related to the above scope of work as well as detailed estimates of probable costs associated with the potential options for the future of the Leisure Bear Mobile Home Park.

As this report will be a key tool in the determination of the path forward related to the Leisure Bear Mobile Home Park, Birtcher has recommended that the City consider preparing a Relocation Impact Report and a Relocation Plan. Supplemental to the scope of work that Birtcher is currently coordinating, a Relocation Impact Report is a statutory requirement, pursuant to California Mobile Home Residency Law, should a mobile home park be identified for a change of use, closure or should residents be asked to relocate. It important to note that none of these situations are presently applicable or in effect related to Leisure Bear.

Given the statutory nature of these reports, there are limited firms with the subject matter expertise who prepare them. Birtcher staff coordinated a proposal from Overland, Pacific and Cutler (OPC) as they are a highly regarded firm in this field. OPC has provided a scope of work that is consistent with the statutory requirements for a report of this nature. Should the City engage OPC for this effort, the generated report would include:
• Findings from detailed interviews with all of the park residents to include supporting background information as well as insight and feedback relevant to their needs, concerns, and interests related to a potential relocation.
• A feasibility analysis of moving existing mobile home units to other parks including costs proposals to support the overall analysis.
• Market research and analysis reporting availability for relocation within other mobile home parks within a 30-mile radius.
• Market research and analysis related to alternate rental housing of reasonably comparable size and quality within a 15-mile radius.
• Integrate appraisal values of existing mobile homes into overall cost estimate.

This data would be used to prepare a written plan to describe a potential relocation program and the associated benefits, resources, mitigation measures, and a total of estimated relocation costs.

The plan will be completed in conformance with all statutory requirements in the event the City may ultimately decide to act upon it. The scope of work is reflective of the statutes and certain elements, such as the radii of search areas for alternative housing, is prescribed by those regulations.

It is important to understand that the City has not yet made a determination as to the path forward related to the Leisure Bear Mobile Home Park. Despite the name of the proposed report, staff is not pursuing this Relocation Impact Report as a finite determination of the direction that the City is taking related to the Leisure Bear Mobile Home Park. Rather, staff believes that the information to be garnered from a report of this nature would be invaluable to the ultimate decision making process, which will be heavily influenced by the results of these master planning efforts.

Although the nature of the report, and its prescribes uses, relate the closure of a mobile home park, staff’s intent is to use this process solely for informational purposes. Staff will not initiate further proceedings beyond generating the report and analyzing the collected data.

Staff is coordinating a community meeting with the residents of the park in the coming weeks, at which, they will be updated on the overall master planning process. This proposed report preparation effort will also be addressed with the residents at that time.

FISCAL IMPACT
The proposed cost of this Professional Services Agreement is $35,300. Sufficient funding is available within the adopted Fiscal Year 2023-24 Annual Budget for the master planning efforts related to the 19-acre property.

ENVIRONMENTAL CONSIDERATIONS
This action is not subject to the California Environmental Quality Act (CEQA) as it is not defined as a project pursuant to Section 15378 of the CEQA Implementing Guidelines.

CONSIDERATION OF STRATEGIC PRIORITIES
This action aligns with the City Council’s Strategic Priorities No. 1 as it “supports and invests in sustainable infrastructure projects and programs” No. 5 as it “preserves and protects the quality of life for the residents”.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution Authorizing a Professional Services Agreement with Overland, Pacific and Cutler for the Preparation of a Relocation Impact Report and Relocation Plan Related to the Leisure Bear Mobile Home Park.
