FROM: Erica Stephenson, Assistant City Manager/City Clerk SUBJECT: Authorize a Delegate and Alternate for the County of San Bernardino Solid Waste Advisory Task Force

BACKGROUND & DISCUSSION
The County of San Bernardino Solid Waste Advisory Task Force (SWAT) was formed in 1990, as required by the California Integrated Waste Management Act, to carry out responsibilities mandated through Assembly Bill (AB) 939. SWAT’s purpose is to assist in coordinating the development of the County/City source reduction programs, recycling elements, and to ensure a coordinated and cost-effective regional recycling system. With respect to ensuring a coordinated and cost-effective regional recycling system, the task force works together on all of the following items: 1) identifies solid waste management issues of county-wide or regional concern, 2) determines the need for solid waste collection systems, processing facilities, and marketing strategies that can serve more than one local jurisdiction within the region, 3) facilitates the development of multijurisdictional arrangements for the marketing of recyclable materials, and 4) to the extent possible, facilitates resolution of conflicts and inconsistencies between or among City source reduction programs and recycling elements.

The SWAT roster is comprised of elected officials from incorporated cities in San Bernardino County, as well as representatives from the County and some at-large public members. The task force meets on a bi-annual basis and additionally as needed. Elected officials serve as delegates and as alternates if need be. During this year’s Mayoral Board/Committee selection process, Mayor Melnick appointed Mayor Pro Tem Segovia to serve as the City’s SWAT delegate, and she selected Councilmember Hicks to serve as the alternate.

FISCAL IMPACT
There is no fiscal impact associated with the adoption of this resolution.

ENVIRONMENTAL CONSIDERATIONS
None requiring review under the California Environmental Quality Act (CEQA).

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priorities as it aids in the enhancement of local advocacy strategies and bolsters partnerships with regional partners.

DATE: February 12, 2025
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Assistant City Manager
Jason Watterson, Public Works Manager – Field Operations / Utilities SUBJECT: Authorize a Purchase Order and Maintenance Agreement with Xylem Water Solutions USA, Inc.

BACKGROUND & DISCUSSION
The City’s Sanitation Division is responsible for the maintenance of the sanitary sewer system which includes approximately 200 miles of sewer main, more than 3,000 manholes, and 12 sewer lift stations. The sewer lift stations, also known as pumping stations, move wastewater throughout the City’s sanitary sewer system and ultimately deposit it in larger trunk lines managed by the Big Bear Area Regional Wastewater Agency (BBARWA). The lift stations are critical resources to keep the wastewater moving through the system and preventing overflows. The lift stations are equipped with submersible pumps that are all manufactured by Flygt, a subsidiary of Xylem Water Solutions USA, Inc. (Xylem).

Staff has identified the need to coordinate updated preventative maintenance on these pumps.

Sanitation Division staff will perform routine inspections and minor maintenance work related to these systems, such as changing or topping off fluids. A more thorough maintenance effort involves the pulling of the pumps out of the stations and having them inspected and repaired. When the pumps are pulled out, the maintenance technician is able to change consumable parts such as O-rings and seals as well as make an assessment of the condition of the pump and recommend any further repairs or maintenance. Staff has solicited a proposal for a preventive maintenance cycle at each of the City’s twelve (12) pumping stations from Xylem.

Xylem has prepared a proposal for the preventative maintenance work at each of the City’s lift stations with a total cost of $28,728.60. The proposal includes a price for each station which, based upon the complexity of the station, ranges from $810.20 to $3,594.80 per location. The scope of work is generally the same for each location in that the pump(s) will be pulled from each station and be inspected, have a service performed on them, and an assessment report will be provided for each station that outlines its condition and any additional service or repair that is required. Should the City Council authorize this maintenance effort, work will begin as weather allows and will proceed as is most efficient while ensuring that the utility service stays intact while the work is taking place.

In addition to the preventive maintenance efforts, staff is working to update and improve the communications system that is used in the management of the sewer lift stations. Staff relies heavily upon a Supervisory Control and Data Acquisition (SCADA) system that allows for staff Item 1.9
to see information as to what is happening in the field and adjust the pumps to respond accordingly.

The SCADA system will advise staff if a wet well is at risk of overflowing, if a pump has failed, or if there are any additional errors within the system. This information is able to be viewed remotely, at any time, to save staff a visit to the field to understand what is going on. Additionally, the system is equipped with alarms that will notify the staff of any situations that require their attention.

At this time, staff is proposing two improvements. First, two of the pump controllers are in need of replacement as they are aging and demonstrating signs of potential failure. These controllers are $8,654 each and are critical to the operation of the system. Additionally, staff is seeking to add secondary notification elements to the system for redundancy. The proposed addition of mechanical sensors and switches will set level controls that will activate pumps and trigger alarms, without staff intervention, should the flow levels exceed the appropriate set points. Having these redundancies in the system is critical especially during times of peak flow, such as during winter weather, and when communication could be compromised. The proposal will purchase thirty-eight (38) sensors for installation across all twelve (12) sites and the sensors range in cost from $591 each to $828 each. The proposal from Xylem includes all identified equipment and installation for a total cost of $61,195.

Historically, the City has utilized Xylem equipment exclusively within our Sanitation System for pumps, motor controls, and communications equipment. Given these circumstances, it is critical to remain consistent with the equipment to ensure that all communications equipment functions as intended. Additionally, utilizing a common manufacturer of pump equipment assists with the maintenance and operations as the parts, trouble shooting, and repairs are all consistent to minimize downtime in the field.

FISCAL IMPACT
The total cost for the proposed maintenance services is $28,728.60 and the total cost for the proposed replacement and additional equipment is $61,195. Funding for these items is included within the adopted Fiscal Year 2024-25 Operating Budget within the Sanitation Fund.

ENVIRONMENTAL CONSIDERATIONS
This action is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to section 15301.B as repair and maintenance of a publicly owned utility system.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priority No. 1 as it “supports and invests in sustainable infrastructure projects and programs”.

RECOMMENDED ACTION
It is recommended that the City Council authorize a purchase order in the amount of $61,195 and a maintenance agreement in the amount of $28,728.60 with Xylem Water Solutions USA, Inc. for supplies and maintenance services in support of the City’s sanitation system; and find this action exempt from the California Environmental Quality Act (CEQA).

THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Assistant City Manager
Israel Gomez-Rosales, Associate Engineer
SUBJECT: Authorize Bid Solicitations for the Annual Citywide Street Sweeping Services and Citywide Line Striping Projects

BACKGROUND & DISCUSSION
The Fiscal Year 2024-25 Capital Improvement Program (CIP) budget includes approximately twenty-two (22) projects or initiatives focused on investment in streets, parks, trails, facilities, sanitation, and equipment infrastructure throughout the City. The anticipated capital investment for Fiscal Year 2024-25, based upon the adopted CIP budget, is greater than $5.4 million.

The City’s purchasing guidelines require that the City Council provide authorization to the staff to proceed with bidding activities for proposed capital improvement projects and services. This report includes a summary overview of each project or service to initiate the bidding activities.

Additionally, pursuant to the California Environmental Quality Act (CEQA), the City Council is required to approve a finding related to each project which, for these projects, will be categorical exemptions.

Upon approval, staff will undertake the bid solicitations in accordance with the City’s purchasing policy and all other applicable regulations. As staff receives the bids and proposals for these respective projects and prepares them to initiate construction and services, the contracts will be presented to the City Council for approval at the appropriate time.

The Public Works Department is preparing a number of Capital Improvement Projects for execution during the 2025 summer construction season. At this time, staff is prepared to proceed with one bid solicitation and a Request for Proposals (RFP) for the projects and services that are outlined below. Staff will present comprehensive details associated with the project budgets, costs, and timelines at the time that each contract is presented to the City Council for consideration.

The proposed projects to be authorized for bidding by this proposed action include:

Annual Citywide Street Sweeping Services
The Annual Citywide Street Sweeping Services will complete comprehensive street sweeping across all 88-miles of City maintained streets one time to remove trash and debris, such as cinders, a part of the City’s compliance with the National Pollutant Discharge Elimination System (NPDES). City staff is responsible for ongoing, routine street sweeping, which focuses on key areas of the City. The contracting of the additional Item 1.10
services will ensure that all streets within the City receive annual street sweeping. It is anticipated that the City Council will consider a maintenance contract for this work in April 2025 to allow the work to commence as soon as weather and road conditions allow.

Adopted Budget: $40,000
CEQA Consideration: This program is not considered a project pursuant to the California Environmental Quality Act (CEQA) and, therefore, no environmental review is required.

Annual Citywide Line Striping Project
The City’s Annual Citywide Line Striping Project serves to repaint all the traffic striping and markings across City streets. The focus of the project is to repaint all traffic lane lines, crosswalks, and roadway legends throughout the City. It is anticipated that the City Council will consider a construction contract for this work in April 2025 to allow the work to commence as soon as weather and road conditions allow.

Adopted Budget: $150,000
CEQA Consideration: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.c Existing Facilities as repair and maintenance of existing streets and highways.

Staff will proceed with the bid solicitation and RFP for the identified projects and will return to the City Council for the consideration of the construction contracts at the appropriate time. The action being considered within this report only authorizes staff to conduct the bid solicitations and RFP, it does not propose any budget amendments nor guarantee any contracts to be awarded.

FISCAL IMPACT
The actions contemplated within this report have a minor fiscal impact limited to the costs associated with preparing and soliciting construction bids and a Request for Proposals (RFP). The contemplated projects are funded within the adopted budget for Fiscal Year 2024-25. A complete fiscal analysis of each project will be reviewed at the time that the contracts are presented for consideration.

ENVIRONMENTAL CONSIDERATIONS
The Annual Citywide Street Sweeping Services is not considered a project, and is therefore not subject to environmental review. The Annual Citywide Line Striping Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.c Existing Facilities as repair and maintenance of existing streets and highways.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priority No. 1 as it “supports and invests in sustainable infrastructure projects and programs”.

RECOMMENDED ACTION
It is recommended that the City Council authorize staff to proceed with bid solicitations and Request for Proposals (RFP) for the Annual Citywide Street Sweeping Services and the Citywide Line Striping Projects; and find the Annual Citywide Line Striping Project exempt from the California Environmental Quality Act.

SUBJECT: Authorize a Notice of Completion for the Village Accessibility Improvements Project

BACKGROUND & DISCUSSION
Work has been completed for the Village Accessibility Improvements Project (CDBG BBLK-23- 1-03L/0278 ) and the time is appropriate for the City Council to accept the work as complete and direct the filing of the Notice of Completion. A project summary is included below:
• Village Accessibility Improvements Project (CDBG BBLK-23-1-03L/0278) Contractor: All American Building Services
Date of Contract Award: August 14, 2024
Date of Completion: December 10, 2024
Approved Contact Amount: $323,200.00 (Includes $29,000.00 contingency) Total Project Expenditures: $332,950.00
Over/Under Contract: $ 9,750.00 over authorized contract budget The Project scope included sidewalk improvements and repairs within the Village area to comply with the Americans with Disabilities Act (ADA) standards for accessibility. The project constructed new sidewalks and replaced existing sidewalks and access ramps to include truncated domes and updated slopes and elevations. This project was funded, in part, through the Community Development Block Grant, which is administered through San Bernardino County.

During construction, the Public Works staff identified additional improvements within the area related to ADA improvements and general concrete repairs that could be completed concurrently with this scope of work. Staff directed the contractor to repair various sections of damaged curb within the Knickerbocker and Pennsylvania parking lots. The sidewalk was also extended to the corner of Pine Knot Ave. along Village Dr. to provide an improved connection point for ADA compliance. This work element also included the removal of a tree at the corner for improved sight distance at the intersection which will enhance safety for the vehicles and pedestrians moving through the area. Finally, as this project was designed to improve ADA access and parking within the area, an opportunity was identified to provide one (1) additional ADA parking space in the Pennsylvania Lot. In order to accommodate this addition, a light fixture was relocated and additional concrete and paving work was required to provide the appropriate accommodations.

Item 1.11
The total cost impact of the extra work was $38,750, as outlined above. This was $9,750 above the authorized construction contract, making the total expenditure for the project $332,950. Staff has identified available funding within the approved Capital Improvement Program budget that can be utilized to fund the extra expenses on this project.

FISCAL IMPACT
At the time of contract award, the Village Accessibility Improvements Project (CDBG BBLK-23- 1-03L/0278) was approved with a total budget of $323,200. As outlined within this report, the total expenditures inclusive of all construction and construction support costs was $332,950, which is $9,750 over the authorized contract budget. The additional expenses are able to be absorbed by available funds within the approved Capital Improvement Program budget.

ENVIRONMENTAL CONSIDERATIONS
At the time of authorizing the bid solicitation, the City Council found the project to be categorically exempt from the California Environmental Quality Act (CEQA).

CONSIDERATION OF STRATEGIC PRIORITIES
This recommended action aligns with Strategic Priority No. 1 to “support and invest in sustainable infrastructure projects and programs consistent with the needs of our community”.

RECOMMENDED ACTION
It is recommended that the City Council approve the total contract expenditures with All American Building Services of $332,950 for the Village Accessibility Improvements Project (CDBG BBLK23-1-03L/0278), accept the project as complete, and authorize staff to file a Notice of Completion for this project.

SUBJECT: Award a Construction Contract – Village Accessibility Improvements Project

BACKGROUND & DISCUSSON
Within the adopted Capital Improvement Program (CIP) as a part of the Fiscal Year 2023-24 Budget, the City Council adopted the Village Accessibility Improvements Project. The scope of work for this project is to construct additional ADA accessible sidewalk along Village Drive, between Pine Knot Avenue and Stocker Road, and improve and repair existing sidewalk, and construct replacement ADA ramps. In addition, the project will make ADA improvements to portions of the Pennsylvania Parking Lot.

The City Council authorized staff to conduct a bid solicitation for this project, in accordance with the City’s purchasing guidelines, on February 14, 2024. Staff finalized the design for the project in the Spring of 2024. The project was advertised twice in the Big Bear Grizzly and posted on the City website and PlanetBids. On August 1, 2024, staff received, publicly opened, and read aloud three (3) bids with the following result:

Bidder Location Base Bid Price
All American Building Services Santa Clarita, CA $294,200.00 Bear Valley Paving Big Bear Lake, CA $346,345.00
Kormex Construction, Inc. Ontario, CA $376,110.00
Staff has reviewed the bids received for completeness and accuracy and the contractors backgrounds for qualifications and experience. All American Building Services is an experienced general engineering contractor with experience working on similar projects for public entities including the City of Lancaster, Palm Springs Unified School District, and Adelanto Elementary School District.

Staff is recommending the award of contract in the amount of $294,200 as well as the establishment of a contingency fund of $29,000 (approximately 10%) to cover the cost of any unforeseen conditions that arise throughout the course of construction.

Work is anticipated to begin around September 3, 2024 and will take approximately eight (8) weeks to complete. The work will be staged in a manner to minimize impacts on businesses and any events that are taking place in the Village during this period.

Item 1.11
Attachment 1

FISCAL IMPACT
The total requested authorization for this project, including the base bid and construction contingency is not to exceed $323,200. Sufficient funding is available within the adopted Fiscal Year 2024-25 CIP for the completion of this project. A portion of the funding for this project, approximately $170,000 is derived from the Community Development Block Grant, which are funds awarded by the County of San Bernardino Community Development & Housing Department. Projects that make accessibility improvements and remove physical barriers are an eligible use of these funds.

ENVIRONMENTAL CONSIDERATIONS
At the time that the City Council authorized the bid solicitation for this project, the project was found to be categorically exempt from the California Environmental Quality Act (CEQA) pursuant to section 15301.C Existing Facilities as the repair or maintenance of existing streets and highways.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council's Strategic Priority Number 1 as it “supports and invests in sustainable infrastructure projects and programs”.

ITEM REPORTS

MEETING
DATE: February 12, 2025
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Erica Stephenson, Assistant City Manager/City Clerk Monica M. Molina-Connolly, Executive Assistant
SUBJECT: Approve a Resolution of Opposition to South Coast Air Quality Management District’s Proposed Amended Rules 1111 and 1121

BACKGROUND & DISCUSSION
The South Coast Air Quality Management District (South Coast AQMD) is a regional air pollution control agency representing Los Angeles, Orange, Riverside and San Bernardino counties with responsibility for regulating stationary sources of air pollution. Currently, South Coast AQMD is considering amending two rules that would have a significant impact on up to 17 million South Coast homeowners, renters and businesses. Proposed Amended Rules (PARs) 1111 and 1121, would establish zero-Nox emissions limits for residential and commercial space heating and residential water heating.

Rule 1111 would regulate air emissions from gas-powered central furnaces; and Rule 1121 would regulate air emissions from residential-type, natural gas-powered water heaters. The proposed rules would impose substantial financial burdens on Big Bear Lake residents and businesses.

Transitioning to electric heat pump technologies requires costly appliance replacements, electric panel upgrades, and infrastructure adjustments. Furthermore, the substantial costs of compliance could compel owners of older, multifamily properties to sell or redevelop their buildings, potentially leading to a decrease in affordable housing available throughout the region.

While we support South Coast AQMD’s mission to improve air quality, we have serious concerns about the economic impact and feasibility of these proposed amendments. We urge the South Coast AQMD Governing Board to delay consideration of these rules and engage in a more robust information gathering and public outreach process to ensure residents are properly informed and that questions regarding cost, technology and the availability of potential incentives can be addressed. Currently, PAR 1111 and 1121 set unrealistic standards and timelines, placing an insurmountable financial burden on residents and businesses. Additionally, the proposed 2026 implementation date does not provide adequate time for businesses to plan and budget for these significant investments.

The attached proposed resolution is similar to the resolution that was approved at the San Bernardino Council of Governments (SBCOG) meeting on January 8, 2025. SBCOG staff had cited, “Due to the potential cost increases to homeowners, renters, and businesses associated with the implementation of Rules 1111 and 1121, staff recommends that the SBCOG Board adopt Item 2.1
Resolution No. 25-059 opposing the proposed rules.”
The South Coast AQMD has continued the discussion of amending Rule 1111 with the Stationary Source Committee, with the intent of meeting in February and the South Coast AQMD conducting a hearing in May of 2025. The discussion of a high altitude exemption will be discussed at Stationary Source Committee meeting. Please reference attachment 2, which is an information sheet that the South Coast AQMD has drafted on this rule making process.

FISCAL IMPACT
There is no fiscal impact associated with the adoption of this resolution.

ENVIRONMENTAL CONSIDERATIONS
Adopting this resolution, would not require review under the California Environmental Quality Act (CEQA).

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priorities as it aims to preserve and protect the quality of life for both residents and businesses in our community.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution in Opposition to the South Coast Air Quality Management District’s Proposed Amended Rules 1111 and 1121.

RESOLUTION NO. 2025-XX

RESOLUTION IN OPPOSTITION TO THE SOUTH COAST
AIR QUALITY MANAGEMENT DISTRICT’S
PROPOSED AMENDED RULES 1111 AND 1121
WHEREAS, the South Coast Air Quality Management District (South Coast AQMD) is a regional air pollution control agency representing Los Angeles, Orange, Riverside, and San Bernardino counties with responsibility for regulating stationary sources of air pollution; and, WHEREAS, the South Coast AQMD is considering two rules that would have a significant impact on up to 17 million South Coast homeowners, renters, and businesses: Proposed Amended Rule 1111 would regulate air emissions from gas-powered central furnaces; and Rule 1121 would regulate air emissions from residential-type, natural gas powered water heaters; and, WHEREAS, Rules 1111 and 1121 would impose high cost to consumers while providing limited measurable air quality benefits for the four-county South Coast AQMD service area; and, WHEREAS, the two rules would ban the use of natural gas-powered furnaces and water heaters in new construction, taking effect in 2026. These rules would phase out existing natural gas furnaces and water heaters in existing single-family homes, multi-family housing, and businesses in 2027; and, WHEREAS, housing affordability is and will remain a top public policy priority for San Bernardino County and the City of Big Bear Lake for the foreseeable future. Local governments are being pressured to build more housing. Specifically, housing people can afford. Any regulations that increase these costs deserve scrutiny to ensure that the increased costs are met with an equal or more significant amount of benefit to the consumer; and,
WHEREAS, unlike most South Coast AQMD rules that regulate large stationary sources of air pollution like oil refineries and warehouses, Rules 1111 and 1121 specifically target individual homeowners, apartment buildings, and businesses large and small, meaning that families and business owners will directly bear the costs of these two rules; and,
WHEREAS, Rules 1111 and 1121 would require retrofitting homes, apartments, and businesses with electrical panel upgrades, extensive new plumbing, and physical renovations to accommodate compliant units; and,
WHEREAS, for apartment owners and long-term rental homeowners, the cost to replace natural gas water heaters and furnaces with all-electric units will be passed down to tenants, leading to rent increases and placing additional financial pressure on renters in a region already struggling with housing affordability; and,
WHEREAS, Rules 1111 and 1121 will increase electricity demands. Transitioning to all-electric water heaters and furnaces means an increased demand on an electric grid that has not proven capable of consistently meeting existing demand. Water heaters and furnaces are essential elements in any house, apartment, or business. Millions of new electric water heaters and furnaces would draw power from the grid and raise the risk of power brownouts or outages.

Item 2.1
Attachment 1
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Big Bear Lake that:

1. Proposed Amended Rules 1111 and 1121 will have a profound impact and impose significant costs on Big Bear Lake’s homeowners, renters and businesses.

2. The City Council of the City of Big Bear Lake opposes Proposed Amended Rules 1111 and 1121 and urges the South Coast AQMD to indefinitely delay or cease consideration of these two anti-consumer regulations immediately.

PASSED, APPROVED AND ADOPTED this 12th day of February, 2025.

REPORTS

AGENDA REPORT
Service, Quality, Community
DATE: January 28, 2025
TO: Board of Commissioners
FROM: Reginald A. Lamson, General Manager
RE: General Manager’s Report
Capital Projects
Garstin Water Operations Facilities:

On October 17, 2023, WSC, DWP, and USDA conducted a Teams meeting to meet the new USDA personnel and receive comments to the draft Preliminary Engineering Report (PER).

USDA was also interested in possibly funding the solar component, what storm damage occurred during the 2022/23 winter storms, and grant funding to help maintain current capital spending levels. On July 5, 2024, Staff and WSC submitted the final draft of the PER to USDA for review.

Staff submitted additional requested data to the USDA engineer on July 8, 2024. The engineer requested additional data on July 16, 2024, and staff completed the request on July 17, 2024.

On July 31, 2024, DWP and USDA had a zoom meeting to discuss their review of the PER. On August 2, 2024, Staff submitted a Sole Source Procurement Request for the Solar equipment, electrical service, battery backup, and backup generator; a revised project cost estimate that described some of the line items and reallocated the costs on those line items, but the total project cost is still the same; the final NEPA environmental report; and an Interim Finance Waiver Request. On September 12, 2024, USDA provided a revised version of the PER for our review. Staff and WSC reviewed this version of the PER, filled in most of the requested data, and submitted it to USDA on September 13, 2024. On September 17, 2024, USDA, WSC, and staff had a Teams meeting and USDA provided additional information to assist staff in completing the PER. Staff submitted additional data before noon on September 17, 2024, and USDA is finalizing the PER for submittal to Washington DC. On October 8, 2024, USDA had a few clarification questions regarding the PER and informed us that the interest rate dropped from

3.25% to 3.125%.

On October 15, 2024, USDA requested clarifications regarding DWP’s Short-lived Asset Reserve Account and the information was provided. On December 4, 2024, USDA’s new Environmental Coordinator requested several clarifications to the August 8, 2024 NEPA document. All of the information requested was provided by 7:30 am, on December 5, 2024.

Also on December 4, 2024, additional financial document clarifications were requested, and the information was provided that day. On December 10, 2024, USDA requested and DWP provided clarifications regarding our service area boundaries and the number of customers in each area.

On December 16, 2024, USDA requested and DWP provided additional NEPA document clarifications. On December 20, 2024, USDA requested additional NEPA clarifications and General Manager’s Report
January 28, 2025

provided two additional NEPA related forms for DWP to fill out. All requested information was provided that day. On January 8, 2024, USDA informed us that the NEPA document review was completed and they requested updated balance sheets for the City and DWP because the ones that we submitted for the first quarter were older than 45-days. DWP and the City prepared preliminary balance sheets for the second quarter and submitted them on January 8 th and January
10th. On January 16, 2024, additional clarifications regarding the financial statements were requested and DWP provided it that day. USDA hopes to have a Letter of Conditions for us to consider soon. USDA assured us that funding will be in place so that we can start construction in Spring of 2025.

DWP staff has advised Big Bear Mountain Resort (BBMR) staff that relocating the snowmaking pipeline is no longer required for the project. BBMR located (potholed) their snowmaking pipeline within DWP’s Garstin site and has finalized their scope of work to line the existing pipeline. BBMR lined a section of their pipeline through the Garstin site, during the week of September 9th. BBMR has completed their lining work.

On December 7, 2023, Staff worked with Southwest Gas staff and determined the location of their facilities (standard and high-pressure gas lines) within the existing easements on the east side of DWP’s property, near the K-Mart Parking lot.

On January 8, 2024, Staff met with City staff regarding Planning Commission scheduling, permitting, and drainage modifications near the existing customer parking area. City staff provided some of the Planning Commission’s preferences and PBK has incorporated some of those preferences into the Garstin Plans.

PBK and staff met with the City on April 30, 2024 to finalize the Planning Commission’s submittal requirements. City staff liked the revisions that were made to the project elevations.

City staff provided PBK with the requirements for a submittal to the Planning Commission. PBK submitted plans for review during the week of July 22nd. On August 28, 2024, PBK presented the Project to DRC, received minor comments, and submitted revised plans to the Planning Department on September 10, 2024. The Planning Commission approved the Garstin Project during their meeting on October 2, 2024. The Building Department is reviewing the Garstin plans and the Water Quality Management Plan (WQMP). The Building Department review is scheduled to be completed in December. On January 22, 2025, the Building Department provided minor comments to the WQMP. PBK plans on submitting a revised WQMP during the week of January 27, 2025.

On January 18, 2024, Staff met with Bear Valley Electric Service (BVES) staff regarding upgrading the electric/solar service for the Garstin Site and the electrical service for Lake Plant Well Nos. 5 & 6 sites. BVES is fine with eliminating the current electric services for Lake Plant Well Nos. 5 & 6 sites and combining them with the upgraded Garstin electric/solar service. On October 16, 2024, DWP submitted an application to upgrade the electrical service for the Garstin Facility. The new electrical service will include a pad-mounted transformer that will probably be located near the Greenhouse.

DWP staff has replaced certain sections of mainline on the Garstin site in anticipation of constructing the new facilities. These facilities will be connected to the water system during the Spring of 2025. On January 6, 2025, PBK, Motive, and DWP staff conducted an on-site, final plan review workshop. PBK and Motive coordinated Motive’s scope of work with PBK’s electrical engineer sub-consultant so that the bid documents clearly describe the general General Manager’s Report

contractor’s scope of work and Motive’s scope of work. Phasing of construction was also finalized. DWP provided redlined drawings and comments to the project drawings. PBK is incorporating Motive’s and DWP’s comments into the bid packet and plans on having a completed bid packet completed by the end of February.

Replenish Big Bear:

The Replenish team submitted a work plan to evaluate existing domestic wells within 200 feet of the high-water level and determine if the Project will impact their water quality. Approximately eighty (80) private wells have been located. Of these 80 wells, only 41 of them are within 200 feet of the lakes high water level. Most of these wells are drilled within alluvium and will not be impacted by the Project. Tom Harder will have a report on which wells, if any, will be impacted by the Project. The 100% RO treatment also reduces or eliminates the blending requirement for percolating reclaimed/lake water into Sand Canyon. The meeting with DDW has greatly enhanced the feasibility of the project and the Replenish Team is preparing a detailed percolation plan for DDW’s consideration.

Tom Harder is finalizing his report on which wells (within 200’ of the high-water line), will be impacted by the Replenish Big Bear Project. The current lake level is about 4-feet from full, which is higher than it has been since 2012. The high lake levels allow for an easy comparison of lake levels versus static water levels. Tom has provided a list of 10 wells, around the lake, that he would like surveyed to compare lake level versus static water level. Mike Stephenson and I have surveyed 4 of the 10 wells and hope to complete the survey over the next couple of weeks.

WSC was authorized to finalize the permit application to the Regional Board and submitted the Report of Waste Discharge package on February 28, 2022. The Regional Board provided informal comments and requested additional information during the month of May 2022. WSC provided additional information on June 1, 2022. Regional Board provided comments on August 26, 2022. On September 15, 2022, BBARWA sent a letter to the Regional Board requesting clarification regarding Surface Water Augmentation regulations. The Replenish team submitted the additional information requested within the August 26, 2022 Regional Board Letter on October 14, 2022.

On August 25, 2021, BBARWA approved a MOU for agencies that may benefit from Replenish Big Bear Project. The MOU has been distributed to other valley agencies for consideration. CSD approved the MOU on September 20, 2021, DWP approved the MOU on September 28, 2021, and the City of Big Bear Lake City Council approved the MOU on November 1, 2021. The Replenish Big Bear Team met with County Supervisor representatives and gave them a draft of the MOU for their consideration. The County approved the MOU in July 2022. The Replenish Team is working with each agency to determine how and how much they can contribute towards the project. Each agency will pay their “fair Share” of the O&M costs and possibly capital costs, which will reduce the project costs for the general public. DWP’s proposed annual cost for percolation within Sand Canyon was presented to and approved by the Board on September 27, 2022. Additional cost-sharing meetings have been conducted.

Environmental Scoping Meetings and the Public comment period have been completed. A project Piloting schedule is provided with the project charts. Grant Funding opportunities are discussed below. Follow-up meetings to respond to some of the comments submitted during the Environmental Comment period were conducted with Mojave Water Agency and East Valley Water District during March. The Replenish team will continue to work with these Agencies and General Manager’s Report

their concerns will be addressed within the environmental documents. Pilot testing of proposed treatment equipment continues and BBARWA provided tours of the pilot equipment on July 19, 2023.

David Lawrence provided a Project update Power Point Presentation during the September 26, 2023 Board meeting. A similar presentation has been given to CSD and BVBGSA. The draft EIR will be presented to the BARRWA Board on December 19, 2023 for final comments.

On March 19, 2024, BBARWA had a special meeting to update the public on the Replenish Big Bear Project and receive direction from the Board after the presentation. The meeting was well attended, and many members of the public spoke in favor and against the Project. The majority of the public were in favor of the project. Some of the Board members had some concerns and staff needed additional time to properly address their concerns. BBARWA staff have contacted WIFIA (the primary funding agency), and they indicated that a 6-month pause would not affect the terms of the loan. Over the next 2 to 3 months, BBARWA and other Bear Valley stakeholders will work together to develop letters of intents to better defined how each agency will participate with the project and a public workshop will be conducted to further educate the public about Project details. Pilot testing is now complete. The design consultant estimates that pilot study results and revised cost estimates will be available in the fall of 2024. A public workshop was conducted, and the treatment equipment met or exceeded expectations.

On August 12, 2024, the BBARWA Board considered certifying the environmental impact report and voted not to certify it. On January 22, 2025, BBARWA’s Board directed staff to conduct a Public Hearing for the Board to reconsider certifying the EIR. The Board also directed staff to complete the Preliminary Design Report and prepare contract drawings and specifications for the Advanced Treatment Facilities. On January 28, 2025, at 9:00 am, The City will have a special meeting to discuss water matters related the project. I will provide a history of DWP presentation (attached) during this meeting.

SAWPA Santa Ana River Watershed Weather Modification Pilot Program (No Change):

On November 23, 2021, the Santa Ana Watershed Project Authority (SAWPA) provided a presentation to the Board on the Santa Ana River Watershed Weather Modification Pilot Program (Program). The Board requested staff investigate the Program and bring it back to the Board. On January 25, 2022, the Board approved financial support for the Program in the amount of $3,000 annually for four years.

On October 13, 2022, we received the following update from SAWPA: “Unfortunately with the timing of CEQA completion for the project in June and securing an operations contractor in early August, we were unable to get the pilot project operations contractor on board in sufficient time to make the Nov. 2022 seeding start date, particularly with the need to execute 10 separate local seeding site operator agreements in the watershed. Consequently, the pilot project was postponed to start seeding to November 2023. In some ways, the delay works better for our efforts to secure 50% grant funding from the State as well since this grant funding would not be available from the State until late 2023.”
On August 16, 2023, participating partners received the attached update. The highlights are as follows:

1. The project received $861,400 in Prop. 1 grant funding from DWR.

2. Biological Surveys are underway.

3. Equipment Set-Up is scheduled for September/October 2023

4. 1
st Year Operation Period November 15, 2023 – April 15, 2023

st Year Pilot Report June 1, 2023
On November 15, 2023, SAWPA announced that the Program went live on that day and will continue through April 2027. For more information, visit the weather modification webpage at https://sawpa.gov/santa-ana-river-watershed-weather-modification/. SAWPA also established an email address, [email protected], for public inquiries regarding the Program.

Board members attended a SAWPA presentation and tour of the Weather Modification Pilot Program on Tuesday, April 9, 2024.

groundwater storage volume for the Bear Valley Basin. The BVBGSA Board approved the proposal and the funding of $10,277.50 will come from each of the four member agencies. The GSP Annual Report was submitted to DWR on April 1, 2023.

On June 20, 2023, the BVBGSA had a Board Meeting. The primary purpose of the meeting was to adopt the FY 2023/24 Budget. David Lawrence provided an update on Replenish Big Bear to the Board including the following: The Replenish Big Bear Team will be submitting the Pilot Study Report to the Regional Board. The pilot equipment including the UV disinfectant and advanced oxidation process have been delivered. BBARWA will be piloting the equipment through September to ensure we can support the claims that we have made for the Replenish Big Bear Project. On July 19, 2023, BBARWA held an Open House and Pilot Tour. From 2:00 pm - 3:00 pm, the Regional Board and local Board members had an opportunity for a Pilot Tour and the public was invited to join BBARWA from 3:00 pm - 6:00 pm. Over 300 people attended the event.

On November 13, 2023, the BVBGSA Board approved an agreement with Tom Harder to prepare the GSP 2022/23 Annual Report contingent upon concurrence of approval by the member agencies that will be responsible for reimbursing the BVBGSA. The 2022/23 Annual Report was filed with DWR-SGMA on March 21, 2024. Tom Harder has begun work on the 2023/2024 Annual Report.
