MEETING
DATE: May 14, 2025
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Assistant City Manager
Katya Meyer, Project Manager
SUBJECT: Authorize Agreements with San Bernardino County Public Works and San Bernardino County Flood Control District for Mutual Aid

BACKGROUND & DISCUSSION
At times, situations arise that demand resources beyond what the City normally has on hand. These can include unexpected natural events like severe snowstorms, floods, or wildfires, as well as more foreseeable tasks such as clearing large areas of land or transporting substantial amounts of construction materials. Maintaining the staff and equipment needed to handle these exceptional circumstances year-round is generally too costly for a single municipality or agency. To address this, cities and partner organizations often enter into Mutual Aid Agreements, allowing them to request and provide assistance when needed.

On July 1, 2020 the City and the San Bernardino County (County) Public Works Department and Flood Control District entered into Mutual Aid Agreements to establish a legal framework to facilitate mutual support for both routine operations and emergency response. This framework enabled the exchange of personnel, equipment, and materials necessary to carry out scheduled maintenance activities, minor capital improvement projects, and disaster relief efforts. These Mutual Aid Agreements define the protocols by which the participating Parties may request and provide assistance, contingent upon the availability of resources.

The key provisions of the Mutual Aid Agreements are to allow partner agencies to coordinate on projects, emergency work, and routine maintenance and repair activities. Some of these projects could include work such as routine culvert cleaning, pothole patching, and line striping. Each Party is able to request and provide personnel, equipment, and materials for routine maintenance and emergency support. Participation in providing services is voluntary and subject to the availability of resources from each Party. The financial terms limit any individual project to a maximum of $60,000, and the total expenditure by any Party within a single fiscal year shall not exceed $100,000. The current agreements are set to expire on June 30, 2025, so the City and County now desire to enter into new mutual aid agreements for a five year term, beginning on July 1, 2025.

The approval of these agreements do not obligate any funding or guarantee that they will be used to perform any work; however, having them executed and available for implementation provide an additional resource for staff to consider during periods of need. Current staff is not aware of any utilization of these agreements during the previous five (5) years; however, staff is engaged Item 1.5
with the County to better understand the services and support available through these agreements to integrate these resources into operational planning.

FISCAL IMPACT
There is no direct fiscal impact with execution of these agreements, and services will only be rendered upon mutual determination under the terms of these agreements. Staff will identify available funds within the budget prior to engaging services under these agreements.

ENVIRONMENTAL CONSIDERATIONS
These services do not constitute a project pursuant to the definitions within the California Environmental Quality Act (CEQA) and, therefore, no environmental review is required.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priority No. 1 as it “supports and invests in sustainable infrastructure projects and programs”.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution Authorizing Agreements with San Bernardino County Public Works and San Bernardino County Flood Control District for Mutual Aid.

SUBJECT: Authorize a Professional Services Agreement for the Tour de Big Bear Traffic Control Services

BACKGROUND & DISCUSSION
The Tour de Big Bear is an annual bicycle ride event that is held the first weekend in August and draws more than 2,000 participating cyclists in addition to spectators and other visitors. For 2025, the Tour de Big Bear is scheduled for Saturday, August 2. The Tour de Big Bear is defined, pursuant to the City’s Community Events Grant Policy, as a City Sponsored Signature Event which is an event that has previously demonstrated their significant economic benefit to the Community resulting from their documented large attendance and their contribution to multiple night bookings within the Big Bear Valley. As such, the City’s contribution toward City Signature Events is not defined by the policy but is revisited annually.

Historically, the City’s contribution to Tour de Big Bear has been in-kind services and associated costs valued at approximately $50,000 annually, with the primary focus on event traffic control, and the related costs of Caltrans permits and Sheriff/CHP personnel. Over the years, the traffic control efforts required considerable staff time, resources, and effort so in 2023, staff sought the support of a professional traffic control provider through an RFP. Statewide Traffic Safety and Signs, Inc. DBA AWP Safety (AWP Safety) was the sole respondent and was awarded an agreement to provide the traffic control services beginning in 2023. In 2024, staff recommended a subsequent agreement with the contractor for that year’s Tour de Big Bear event based upon their satisfactory performance and modest inflationary cost adjustment. Staff is again recommending an agreement with AWP Safety to provide traffic control services for the 2025 Tour de Big Bear.

The scope of work for AWP Safety includes working closely with City staff and the Tour de Big Bear organizers to finalize the course route and plan for the event. The contractor provides all labor, materials, and equipment to implement the traffic control plan for the event. As they have now served this event for multiple years, the contractor fully understands the assignment and has demonstrated the appropriate expertise in performance related to this event. This support, as provided by AWP Safety, has drastically reduced the required Public Works staffing for the event both on the day of as well as in the days and weeks leading up to the event. This model has allowed the event to continue to operate as it has while allowing Public Works to focus their efforts on the typical maintenance and project items that are a part of the staff’s summer focus. AWP Safety has proposed to perform the same scope of services that they have for the past two (2) events for a total cost of $43,680, which represents an increase of 4% from last year’s pricing. The proposal is Item 1.6
for the same course layout and routing as in prior years; however, this year’s routing is not finalized due in part to the forthcoming construction of the roundabout at Stanfield Cutoff and Northshore Drive (SR-38). City staff is coordinating closely with Caltrans to determine if the construction activity will disrupt the proposed routing. Should the routing need to be altered, the contractor may need to alter their proposal. As such, staff is recommending a contingency amount of $4,300 (approximately 10%) be added to the contract to address any changes in the traffic control implementation that may be required by Caltrans.

In addition to coordinating the traffic control support agreement, City Staff will continue to coordinate the Caltrans encroachment permit approval process, and coordinate the deployment of necessary resources from the Sheriff’s Department and the California Highway Patrol to provide additional traffic management support. The costs associated with these additional support services are anticipated to be approximately $10,500.

For the 2024 event, the City anticipated expenditures of $50,000 and the actual costs were $51,782.

During the budget adoption process for the FY 2024-25 Budget, the City Council directed staff to pare down the financial support of the Tour de Big Bear beginning in 2025 by 25%. In response to this request, the City’s financial support of this event will be capped at $37,500 based upon the previous budget of $50,000. Staff has provided a financial overview of the City’s contribution to the Tour de Big Bear and indicated that the event organizers will be responsible for all event costs above $37,500. The event organizers have acknowledged and committed to the expenses as outlined within this report.

FISCAL IMPACT
Financial support provided to Tour de Big Bear in the amount of $37,500 is included in the proposed Fiscal Year 2025-26 Annual Operating Budget within the Management Services section.

The total contract award to Statewide Traffic Safety and Signs, Inc. DBA AWP Safety will be $47,980, which is inclusive of a $4,300 contingency amount should the route need to be altered.

Costs associated with this contract and other support provided to Tour de Big Bear in excess of the $37,500 budget will be reimbursed by the event organizer.

ENVIRONMENTAL CONSIDERATIONS
Under Section 15378 of the California Environmental Quality Act (CEQA) Guidelines, this is not project, and, therefore, no environmental review is required.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priority No. 5 to “protect and preserve the quality of life for residents and businesses”.

RECOMMEND ACTION
It is recommended that the City Council adopt a Resolution Authorizing a Professional Services Agreement with Statewide Traffic Safety and Signs, Inc. DBA AWP Safety for Traffic Control Services in Support of the 2025 Tour de Big Bear Event.

SUBJECT: Authorize an Amendment to the Waste Disposal Agreement with the County of San Bernardino

BACKGROUND & DISCUSSION
In 1998, the City of Big Bear Lake and fourteen (14) other cities within San Bernardino County entered into a Waste Disposal Agreement (WDA) with the County’s Department of Public Works – Solid Waste Management Division. The Solid Waste Management Division operates the County’s Waste Delivery System, which includes the necessary infrastructure for the disposal of solid waste including transfer stations and landfills. The Cities party to this agreement direct the disposal of their solid waste to the County’s system for a set price per ton that is established within the agreement.

The original agreement was established in August of 1998 with a fifteen (15) year term to expire in 2013. The agreement has been amended several times related to the adjustments of various terms and to extend the expiration date. The agreement was most recently amended in 2022, with Amendment No. 8, to establish an annual solid waste tonnage rate of $40.75 and further stipulates that at no time shall the Waste Disposal Agreement rate exceed 85% of the County approved general public gate rate to access disposal facilities. The WDA does not presently include a provision for acceptance of green/organics waste.

The City has contracted with Big Bear Disposal (BBD) for solid waste collection and hauling services within the City since 1991. Pursuant to the WDA, BBD hauls all solid waste collected within the City to the transfer station located near Baldwin Lake. BBD is assessed a fee pursuant to the rate set in the WDA and the County manages the disposal of the solid waste from that point.

The costs associated with the disposal of solid waste are included in the costs of BBD’s contract and are covered in the City’s payment to BBD for these services.

In 2022 Senate Bill 1383 went into effect, with the primary purpose of statewide methane greenhouse gas reduction targets to reduce organic waste disposal. As part of the regulations, California jurisdictions are required to divert organic/green waste from landfills and direct the disposal of organic material to appropriate collection facilities. Presently, BBD disposes of organic waste at the Victor Valley Materials Recovery Facility in Victorville, CA as well as at the County Transfer Station. The transfer station that is located in the Bear Valley has the capacity and ability to accept green waste for disposal, in accordance with SB 1383, however, there is not a stipulated price for the disposal of organic waste included in the WDA.

Item 1.7
The proposed Amendment No. 9 to the WDA establishes a rate for the disposal of organic waste through the County’s Waste Delivery System. The rate will be set at $100 per ton, effective July 1, 2025, and will allow for annual rate increases consistent with the other elements of the WDA.

The WDA includes terms and a calculation formula for annual rate adjustments, which are based upon the Producer Price Index and Employment Cost Index, both generated by the US Department of Labor statistics. The current Waste Disposal Agreement with San Bernardino County, as amended, is effective through June 30, 2026.

The approval of the proposed Amendment No. 9 will provide Big Bear Disposal with options for the disposal of organic waste that is generated in Big Bear Lake. The costs associated with waste disposal are borne by Big Bear Disposal pursuant to their franchise agreement and this rate structure will have no effect on the customer rates for solid waste services.

FISCAL IMPACT
These costs are included within the solid waste services rates paid through the City pass through to Big Bear Disposal, which is collected on the annual property tax roll.

ENVIRONMENTAL CONSIDERATIONS
None requiring review pursuant to the California Environmental Quality Act (CEQA).

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priority No. 1 as it “supports and invests in sustainable infrastructure projects and programs”.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution Authorizing Amendment No. 9 to the Waste Disposal Agreement with the County of San Bernardino.

AMENDMENT NO. 9 TO THE
WASTE DISPOSAL AGREEMENT NO. 98-744
This Amendment No. 9 (“Amendment No. 9”) is entered into on June 10, 2025, by and between the City of Big Bear Lake (“City”) and San Bernardino County (“County”) with reference to that certain Waste Disposal Agreement No. 98-744 entered into on August 25, 1998 by and between the City and the County (“WDA”). The City and the County are hereinafter individually referred to as “Party” and collectively as “Parties.” Recitals
A. The Parties have previously entered into the following amendments to the WDA. Amendment No. 1 to the WDA was to implement the “Article 19 Solid Waste” component of the County’s waste management system and define the City’s share of that revenue. Amendment No. 2 was to increase the annual maximum limits of “Article 19 Solid Waste” in the County landfill system. Amendment No. 3 allowed the County to charge the fee of $10.00 per ton (prorated) for identified controllable waste of the City (e.g., roll off container trucks and other County/City vehicles such as pickups and dump trucks) and have such waste subject to being processed in the recycling program. Amendment No. 4 allowed the County to calculate the annual cost of living adjustment earlier in the calendar year. Amendment No. 5 extended the end date of the WDA to June 30, 2016. Amendment No. 6 extended the term of the WDA to June 30, 2021, applied an annual fixed WDA renewal discount adjustment of $0.82 per ton for the term of the WDA, and allowed the County to enter into agreements to accept in-County waste from non-WDA users of the Disposal System at a rate lower than the WDA Contract Rate in exchange for sharing the net revenue generated from those agreements. Amendment No. 7 reset the WDA Contract Rate and extended the term for five (5) years to June 30, 2026. Amendment No. 8 capped the WDA Contract Rate in order to maintain a 15% buffer between the WDA Contract Rate and the County’s posted gate rate.

B. This Amendment No. 9 is intended to allow the City to divert and deliver green waste/organics to the Big Bear Transfer Station.

NOW THEREFORE, in consideration of the foregoing recitals and the following covenants and promises, the Parties agree as follows:

1. Amended Section 3.6. COUNTY PROVISION OF THE WASTE DIVERSION SERVICES shall be amended by adding the following:
(E) Green Waste/Organic Diversion. The City of Big Bear Lake may divert its green waste/organics to the Big Bear Transfer Station at the current rate of $100.00 per ton. Such rate shall be adjusted annually by CPI, beginning July 1, 2025.

1. Calculation of Annual Adjustment. The Green Waste/Organics Fee shall be adjusted annually and such adjusted rate will be effective July 1st of each year, beginning July 1, 2025. The annual adjustment shall be according to the following procedure:

Obtain the Consumer Price Index for Los Angeles-Long Beach-Anaheim, CA (“CPI”) (Series ID CUURS49ASA0 – Not Seasonally Adjusted, All Items, Base Period: 1982- 84=100) as published by the Bureau of Labor Statistics (“BLS”), U.S. Department of Labor, and calculate the year-to-year percentage change for the 12-month period April to April. Should this index no longer be published by the BLS, then the BLS replacement index shall be used. If no replacement index is published, then the Parties shall meet and agree upon a replacement index. The rate shall be increased annually by any positive change in the CPI and effective each July 1, beginning July 1, 2025 and through the end of the Contract term and any extensions thereof. The rate will not change if the annual change in the CPI-U index for the preceding 12-month period April to April is zero or negative. If the annual change in the CPI-U index for the preceding 12-month period April to April is negative, all Parties agree that the negative change in the CPI-U index will be used in the subsequent year’s calculation of the net annual change in the CPI-U index.

Item 1.7
Exhibit A
In no case will the current adjusted base rate ever be decreased. For example, if the annual change in the CPI-U index for the preceding 12-month period April to April is negative two percent (-2%), then the rate will remain the same effective that July 1. The following year, if the annual change in the CPI-U index for the preceding 12-month period April to April is positive three percent (3%), then the rate effective that July 1 will increase by the net 1%.

CPI-U (new) – CPI-U (old)
CPI-U (old)

2. Effective Date. This Amendment No. 9 shall be effective July 1, 2025 and will remain effective for the term of the WDA agreement and any term extensions.

3. Execution of Amendment No. 9. This Amendment No. 9 may be executed in any number of counterparts, each of which so executed shall be deemed to be an original, and such counterparts shall together constitute one and the same Amendment No.9. The Parties shall be entitled to sign and transmit an electronic signature of this Amendment No. 9 (whether by facsimile, PDF or other email transmission), which signature shall be binding on the Party whose name is contained therein. Each Party providing an electronic signature agrees to promptly execute and deliver to the other Party an original signed Amendment No. 9 upon request.

4. Reaffirmation of Prior Terms and Provisions. Except as modified in this Amendment No. 9 (or in any prior Amendment(s)) all other terms and conditions of the WDA, as previously amended, shall remain in full force and effect.

TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Sean Sullivan, Assistant City Manager
Miguel Cabanas, PE, PLS Engineering Manager
SUBJECT: Authorize Installation of a Stop Sign for Santa Clara Boulevard at the Intersection of Fox Farm Road

BACKGROUND & DISCUSSION
Fox Farm Road is identified as a collector roadway within the City’s General Plan Circulation Element. Fox Farm runs from Garstin Drive on its west end, across Big Bear Boulevard, and to the easterly City limit. Fox Farm Road, from Big Bear Blvd to the east serves primarily residential neighborhoods. The posted speed limit is 30 MPH from Big Bear Blvd to Crystal Lake Drive and 35 MPH from Crystal Lake Drive to the easterly City limit. There are existing stop controls for Fox Farm Road at the intersections of Scandia Road, Silver Pick Road, Crater Lake Road and Crystal Lake Road.

Fox Farm Road and Santa Clara Blvd intersect at a T-intersection. Currently, the intersection is served by a YIELD sign on the minor-street approach (Santa Clara Blvd). In April 2025, City staff received requests from residents in the area to consider the installation of a STOP sign on the minor-street approach in lieu of the existing YIELD sign. The concerns cited by residents include site distance for vehicles turning from Santa Clara Boulevard to Fox Farm Road, in either direction, and that because there is a YIELD sign, vehicles on Santa Clara do not come to a full stop at the intersection.

The installation of STOP signs and pavement markings is subject to guidelines established by the 2014 California Manual on Uniform Traffic Control Devices (CAMUTCD), Section 2B.06. The City of Big Bear Lake Engineering Division used these guidelines in conjunction with engineering judgement to determine the following:

Per Caltrans Highway Design Manual, the required “stopping sight distance” is 200 feet for a roadway with a design speed of 30 MPH. The existing “stopping sight distance” is approximately 125 feet due to the presence of mature pine trees on the south side of Fox Farm Road. The existing stopping sight distance is deficient by approximately 75 feet.

The CAMUTCD states that a STOP sign on the minor-street approach should be considered if engineering judgement indicates that: “a restricted view exists that requires road users to stop in order to adequately observe conflicting traffic on the through street or highway”.

Item 1.8
Based on the findings above and in accordance with the CAMUTCD guidelines, Section 2B.06(B), the requested STOP sign meets the necessary warrants.

Should the City Council approve the installation of the STOP this evening, Public Works will schedule the installation for within four (4) weeks. Prior to the installation of the sign, temporary signage will be placed in the area to advise of a forthcoming traffic pattern change. Once the STOP sign isinstalled, there will be visibility flags placed on the post and the warning signage will remain in place temporarily to create awareness of the traffic changes.

FISCAL IMPACT
The costs associated with this proposal, including the engineering review and the installation of the STOP sign, are available within the adopted Fiscal Year 2024-25 Annual Budget.

ENVIRONMENTAL CONSIDERATIONS
This action is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.c as a minor alteration of existing streets and highways without an expansion of use.

CONSIDERATION OF STRATEGIC PRIORITIES
This item aligns with the City Council’s Strategic Priorities Nos. 1 and 5 as it “supports and invests in sustainable infrastructure projects and programs consistent with the needs of our community” and it contributes to “preserve and protect the quality of life for the residents and businesses”.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution Authorizing the Installation of a STOP Sign on the Minor-Street Approach of the Intersection of Fox Farm Road and Santa Clara Boulevard; and Finding the Project Categorically Exempt from the California Environmental Quality Act (CEQA).

SUBJECT: Authorize a Notice of Completion for the PAC Restrooms Improvements Project

BACKGROUND & DISCUSSION
Work has been completed for the PAC Restrooms Improvements Project and the time is appropriate for the City Council to accept the work as complete and direct the filing of the Notice of Completion. A project summary is included below:

PAC Restrooms Improvements Project
Contractor: Cornerstone Construction Co.

Date of Contract Award: November 13, 2024
Date of Completion: May 1, 2025
Approved Contact Amount: $447,308 (Includes $57,500 contingency) Total Project Expenditures: $435,108
Over/Under Contract: $ 12,200 under the authorized contract budget The Project scope included the removal of existing partition walls to accommodate the relocation of fixtures such as toilets and sinks, to accommodate ADA improvements. Wall and floor finishes were also replaced with new tile that will improve the aesthetics as well as the maintenance of the restrooms. Additional fixtures, including mirrors, hand driers, soap dispensers and water filling station were upgraded as part of the project.

Throughout the course of construction, once the existing restroom was demolished, the contractor and staff identified several existing issues that needed to be corrected in order to accommodate these improvements. SUBJECT: Award of Construction Contract – PAC Restrooms Improvements Project

BACKGROUND & DISCUSSION
The Civic Center and Performing Arts Center were constructed in 1989 and serve as the City’s administrative offices, public meeting space, and a gathering space for the performing arts. The primary restroom facilities for the public and visitors to this space are located in the lobby area, between City Hall and the Performing Arts Center and date to the original construction of this building. As the building is nearly thirty-five (35) years old, it was determined that elements of the restrooms are not currently compliant with elements of the Americans with Disabilities Act (ADA).

In January 2023, the City Council authorized a design consulting agreement with the Eden Group (Big Bear Lake, CA) to perform the necessary redesign of the restrooms to meet the necessary ADA compliance as well as a general rehabilitation of the finishes. The scope of work includes the removal of partitions and walls to accommodate the relocation of fixtures, including toilets and sinks, to meet the current ADA specifications. Given the invasive nature of these improvements requiring extensive demolition and reconstruction, this project will also provide a significant upgrade to the existing finishes within the restrooms. The improvements require that the restrooms be demolished to the framing to facilitate the necessary ADA improvements. The scope of work will replace the fixtures, maintaining the existing toilet fixture count in each restroom, as well as all finishes including partitions, flooring, lighting, paint, and restroom accessories.

The City Council authorized this project for bidding in November 2023 as the optimal schedule for constructing this project is in the winter months as activity within the Performing Arts Center is reduced allowing this work to take place with minimal disruption to ongoing activities. There were some delays in finalizing the construction plans, which required the project to be deferred to the 2024-25 winter season where the Performing Arts Center is scheduled to be dark for the month of January. When the project was authorized for bid in November 2023, the Engineer’s Estimate of the construction costs was approximately $350,000. As the plans were updated, including a plan check review from the Building and Safety Division, the Engineer’s Estimate was revised to $453,000 based upon plan changes and ongoing escalation of construction costs.

Staff issued the project for public bid, in accordance with the City’s purchasing guidelines and the California Public Contract Code, in October 2024. A Notice Inviting Bids was published in the Item 2.1
Attachment 2
Grizzly and on Planetbids.com on October 3 and October 10, 2024. A mandatory pre-bid conference and site inspection was held on October 14, 2024 and was attended by approximately thirteen (13) perspective bidders. On Wednesday, October 30 the City received, publicly opened, and read aloud seven (7) sealed bids with the following results:

Bidder Location Base Bid Amount
Cornerstone Construction Co. Victorville, CA $ 389,808.00 Dale Plumbing & Construction Hemet, CA $ 419,542.00
Coelho, Inc. Santee, CA $ 434,732.20
All American Building Services Santa Clarita, CA $ 472,455.00 EC Construction Yucaipa, CA $ 484,301.90
MLC Constructors, Inc. Corona, CA $ 627,380.00
DLG Contractors, Inc. Santee, CA $ 680,169.28
As is standard practice for the City, all bid documents are reviewed for completeness and accuracy and additional background review is conducted on the apparent low bidder. Through staff’s review of the bid documents, a number of clerical errors were identified within the bid schedule on six (6) of the seven (7) received bids. The clerical errors equate to the calculating the total bid based price using the furnished bid schedule, which includes fifty-eight (58) bid items. Pursuant to the City’s standard bid documents, “in case of a discrepancy between the written price and the numerical price, the written price shall prevail.” In analyzing the bids, which is provided in the above table, the bid ranking is based upon the written prices furnished in each of the bids received and upon the review of the clerical discrepancies within any of the received bids, the correction of the errors would not alter the ranking of the bidders. As such, the clerical errors can be waived as irregularities within the bidding process, as the right to do so is afforded the City as the bidding entity.

Cornerstone Construction Company is a licensed General Engineering (“A”) and General Building (“B”) contractor in good standing with the State of California and they meet all requirements to complete this project. They have an extensive resume of residential, commercial, and public construction projects.

On Monday, November 4, 2024, staff received a bid protest letter from DLG Contractors, Inc., one of the project bidders, protesting six (6) of the bids received on a number of grounds including incomplete bid submittals as well as a failure of all bidders to adhere to the required listing of project subcontractors. Staff and the City Attorney reviewed the bid protest letter and found that the protest raised was without merit. The review found that the cited instances of issues with the bid documents, such as missing corporate seals and other document issues, amount to irregularities, none of which provide an advantage to one bidder over another. Furthermore, the review found that the cited issues related to the declaration of subcontractors were not applicable to the specific bid requirements. The City Attorney and staff determined that this bid protest was without merit and would not impact the award of contract to the identified lowest bidder. A letter from the City was issued in response to the bid protest on November 5, 2024. Copies of the bid protest and related correspondence are attached to this report.

Staff is recommending the award of construction contract for the PAC Restrooms Improvements Project to the lowest responsive bidder, Cornerstone Construction Co. (Victorville, CA) in the amount of $389,808. Staff is additionally requesting a construction contingency amount of $57,500 (approximately 15%) to cover the cost of any unforeseen conditions that arise throughout the course of construction. Finally, an amount of $20,000 is requested for consultant support related to any necessary plan revisions or clarifications and other support required to complete this construction project.

Should the City Council approve the construction contract this evening, it is anticipated that work will begin in December, after the conclusion of scheduled meetings and events. It is anticipated that the work activity will last approximately ninety (90) days and will be confined to the restroom area to the extent possible. As a provision of the construction contract, the awarded contractor will furnish and maintain a temporary restroom facility that is of a trailer or building construction that will have climate control and running water for the duration of the construction activity. These facilities will allow for public use related to the Civic Center and allow meetings and events to continue while minimizing disruption.

FISCAL IMPACT
The anticipated cost of this project including the construction contract, contingency funds, and consultant support services will not exceed $467,308. Funding is available in the adopted Capital Improvement Program Budget.

ENVIRONMENTAL CONSIDERATIONS
At the time that the City Council authorized staff to proceed with the public bid for this project, the City Council also found that this project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301.A of the CEQA implementation guidelines as interior alterations to an existing facility.

CONSIDERATION OF STRATEGIC PRIORITIES
This action aligns with the City Council’s Strategic Priority No. 1 as it “supports and invests in sustainable infrastructure projects and programs.”.

RECOMMENDED ACTION
It is recommended that the City Council adopt a Resolution Awarding a Construction Contract to Cornerstone Construction Co. for the PAC Restrooms Improvements Project.

MEETING
DATE: May 14, 2025
TO: Honorable Mayor and Members of the City Council
THROUGH: Erik Sund, City Manager
FROM: Erica Stephenson, Assistant City Manager/City Clerk SUBJECT: Introduction of an Ordinance Amending Big Bear Lake Municipal Code Chapter

1.12 (City Council), Chapter 2.12 (Planning Commission) and Chapter 13.24 (Board of Water and Power Commissioners), Concerning Residency Requirements and Proof Thereof for City Council, Planning Commission and Board of Water and Power Commission Candidates, Applicants and Members; And Concerning the Procedure for Removal of Planning Commissioners and Board of Water and Power Commissioners

BACKGROUND & DISCUSSION
The City Council’s current proof of residency requirements were established on October 17, 2022 by the adoption of Ordinance No. 2022-507. At the time, the City Council had come to the consensus that in order for a City Councilmember to be an effective representative of the Big Bear Lake community, they needed to be a full-time permanent resident. Therefore, they took action to adopt more stringent proof of residency requirements to ensure that City Council candidates and seated Councilmembers do in fact live full-time in the same Big Bear Lake district they purport to represent. This Municipal Code also mandated that City Councilmembers annually recertify their Big Bear Lake residency with the City Clerk throughout the member’s term of office. It further required both City Councilmembers and City Council candidates sign an Affidavit declaring under penalty of perjury, that their verified Big Bear Lake address is their primary residency and legal domicile for all purposes as defined under State law.

At the February 25, 2025 Special City Council Meeting, the City Council engaged in a review and discussion of the City’s existing residency requirements and determined the need to clarify and expand upon the City’s current Municipal Code regulations. The City Council expressed that the primary objectives of this update were to enhance some of the City Council residency documentation requirements, as well as, to establish proof of residency requirements for appointed Planning Commissioners and members of the Board of Water and Power (DWP) Commission. In addition, the City Council requested to extend their Affidavit requirements to these appointed officials and to clearly define the method by which the City Council may remove an appointed Planning and/or DWP Commissioner. Through this process, it was determined that a City Council applicant seeking an appointment to fill a vacant seat should also be required to adhere to the same residency requirements as a City Council candidate participating in the election process.

At the April 9, 2025 Regular City Council Meeting, City staff presented the proposed Ordinance revisions to the City Council for their consideration. During that meeting, the City Council discussed the updated Ordinance and determined that further revisions were needed to the “proof of residency” requirements prior to adoption. They directed staff to redraft a few sections of the Ordinance, to require City Council candidates/applicants, as well as, Planning Commission and Item 2.2
Department of Water and Power Board applicants to submit a signed affidavit attesting to their residency, instead of the previously required submittal of various residency documents. City staff and the City Attorney’s office have incorporated the suggested revisions into the proposed Ordinance that is being presented tonight for the City Council’s consideration.

FISCAL IMPACT
There is no significant fiscal impact associated with the adoption of this Ordinance.

ENVIRONMENTAL CONSIDERATIONS
This Ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the State CEQA Guidelines, California Code Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

RECOMMENDED ACTION
It is recommended that the City Council read the title, waive further reading and introduce an ordinance entitled: Ordinance Amending Big Bear Lake Municipal Code Chapter 1.12 (City Council), Chapter 2.12 (Planning Commission) and Chapter 13.24 (Board of Water and Power Commissioners), Concerning Residency Requirements and Proof Thereof for City Council, Planning Commission and Board of Water and Power Commission Candidates, Applicants and Members; and Concerning the Procedure for Removal of Planning Commissioners and Board of Water and Power Commissioners.

REPORTS

AGENDA REPORT
Service, Quality, Community
DATE: April 22, 2025
TO: Board of Commissioners
FROM: Reginald A. Lamson, General Manager
RE: General Manager’s Report
Capital Projects
Garstin Water Operations Facilities:

On March 14, 2025, DWP received, reviewed, and signed the Letter of Intent to Meet Conditions and the Request for Obligation of funds. The proposed loan terms are $15.4 million, at 3.25% for 40-years. Interim financing will be required for this project. The current interest rate for interim financing is 3.25%. Interim financing will be in place until construction is completed, which is estimated to take about 24-months. Once completed, the USDA loan will close and the interest rate will be 3.25% or lower, if interest rates go down between now and then.

On January 18, 2024, staff met with Bear Valley Electric Service (BVES) staff regarding upgrading the electric/solar service for the Garstin Site and the electrical service for Lake Plant Well Nos. 5 & 6 sites. BVES is fine with eliminating the current electric services for Lake Plant Well Nos. 5 & 6 sites and combining them with the upgraded Garstin electric/solar service. On October 16, 2024, DWP submitted an application to upgrade the electrical service for the Garstin Facility. The new electrical service will include a pad-mounted transformer that will be located northeast of the northeast corner of the proposed operations building.

DWP staff has replaced certain sections of mainline on the Garstin site in anticipation of constructing the new facilities. These facilities will be connected to the water system during June of 2025.

Replenish Big Bear:

The Replenish team submitted a work plan to evaluate existing domestic wells within 200 feet of the high-water level and determine if the Project will impact their water quality. Approximately eighty (80) private wells have been located. Of these 80 wells, only 41 of them are within 200 feet of the lakes high water level. Most of these wells are drilled within alluvium and will not be impacted by the Project. Tom Harder will have a report on which wells, if any, will be impacted by the Project. The 100% RO treatment also reduces or eliminates the blending requirement for percolating reclaimed/lake water into Sand Canyon. The meeting with DDW has greatly enhanced the feasibility of the Project and the Replenish Team is preparing a detailed percolation plan for DDW’s consideration.

Tom Harder is finalizing his report on which wells (within 200’ of the high-water line), will be impacted by the Replenish Big Bear Project. The current lake level is about 4-feet from full, which is higher than it has been since 2012. The high lake levels allow for an easy comparison of lake levels versus static water levels. Tom has provided a list of 10 wells, around the lake, that he would like surveyed to compare lake level versus static water level. Mike Stephenson and I have surveyed 4 of the 10 wells and hope to complete the survey over the next couple of weeks.

WSC was authorized to finalize the permit application to the Regional Board and submitted the Report of Waste Discharge package on February 28, 2022. The Regional Board provided informal comments and requested additional information during the month of May 2022. WSC provided additional information on June 1, 2022. Regional Board provided comments on August 26, 2022. On September 15, 2022, BBARWA sent a letter to the Regional Board requesting clarification regarding Surface Water Augmentation regulations. The Replenish team submitted the additional information requested within the August 26, 2022 Regional Board Letter on October 14, 2022.

On August 25, 2021, BBARWA approved a MOU for agencies that may benefit from the Replenish Big Bear Project. The MOU has been distributed to other valley agencies for consideration. CSD approved the MOU on September 20, 2021, DWP approved the MOU on September 28, 2021, and the City of Big Bear Lake City Council approved the MOU on November 1, 2021. The Replenish Big Bear Team met with County Supervisor representatives and gave them a draft of the MOU for their consideration. The County approved the MOU in July 2022. The Replenish Team is working with each agency to determine how and how much they can contribute towards the project. Each agency will pay their “fair Share” of the O&M costs and possibly capital costs, which will reduce the Project costs for the general public. DWP’s proposed annual cost for percolation within Sand Canyon was presented to and approved by the Board on September 27, 2022. Additional cost-sharing meetings have been conducted.

Environmental Scoping Meetings and the Public comment period have been completed. Grant Funding opportunities are discussed below. Follow-up meetings to respond to some of the comments submitted during the Environmental Comment period were conducted with Mojave Water Agency and East Valley Water District during March. The Replenish team will continue to work with these Agencies and their concerns will be addressed within the environmental documents.

David Lawrence provided a Project update Power Point Presentation during the September 26, 2023 Board meeting. A similar presentation has been given to CSD and BVBGSA. The draft EIR was presented to the BARRWA Board on December 19, 2023 for final comments.

On March 19, 2024, BBARWA had a special meeting to update the public on the Replenish Big Bear Project and receive direction from the Board after the presentation. The meeting was well attended, and many members of the public spoke in favor and against the Project. The majority of the public were in favor of the Project. Some of the Board members had some concerns and staff needed additional time to properly address their concerns. BBARWA staff have contacted WIFIA (the primary funding agency), and they indicated that a 6-month pause would not affect the terms of the loan. Over the next few months, BBARWA and other Bear Valley stakeholders will work together to develop letters of intent to better defined how each agency will participate with the Project and a public workshop will be conducted to further educate the public about Project details.

Pilot testing is now complete. A public workshop was conducted, and the treatment equipment met or exceeded expectations.

On August 12, 2024, the BBARWA Board considered certifying the environmental impact report and voted not to certify it. On January 22, 2025, BBARWA’s Board directed staff to conduct a Public Hearing for the Board to reconsider certifying the EIR. The Board also directed staff to complete the Preliminary Design Report and prepare construction drawings and specifications for the Advanced Treatment Facilities. On February 13, 2025, at 9:00 am, the City had a special meeting to discuss water matters related to the project. I provided a history of DWP during this meeting. On February 26, 2025, The BBARWA Board Certified the EIR. On April 10, 2025, I provide a presentation of the Project to the Rotary Club. The members asked very good questions and there was only positive feedback received. BBARWA, MWD, CSD, and DWP have been meeting to reevaluate how each agency may participate with the Replenish project.

SAWPA Santa Ana River Watershed Weather Modification Pilot Program (No Change):

On November 23, 2021, the Santa Ana Watershed Project Authority (SAWPA) provided a presentation to the Board on the Santa Ana River Watershed Weather Modification Pilot Program (Program). The Board requested staff investigate the Program and bring it back to the Board. On January 25, 2022, the Board approved financial support for the Program in the amount of $3,000 annually for four years.

On October 13, 2022, we received the following update from SAWPA: “Unfortunately with the timing of CEQA completion for the project in June and securing an operations contractor in early August, we were unable to get the pilot project operations contractor on board in sufficient time to make the Nov. 2022 seeding start date, particularly with the need to execute 10 separate local seeding site operator agreements in the watershed. Consequently, the pilot project was postponed to start seeding to November 2023. In some ways, the delay works better for our efforts to secure 50% grant funding from the State as well since this grant funding would not be available from the State until late 2023.”
On August 16, 2023, participating partners received the attached update. The highlights are as follows:

1. The project received $861,400 in Prop. 1 grant funding from DWR.

2. Biological Surveys are underway.

3. Equipment Set-Up is scheduled for September/October 2023

4. 1st Year Operation Period November 15, 2023 – April 15, 2023

5. 1st Year Pilot Report June 1, 2023
On November 15, 2023, SAWPA announced that the Program went live on that day and will continue through April 2027. For more information, visit the weather modification webpage at https://sawpa.gov/santa-ana-river-watershed-weather-modification/. SAWPA also established an email address, [email protected], for public inquiries regarding the Program.

Board members attended a SAWPA presentation and tour of the Weather Modification Pilot Program on Tuesday, April 9, 2024.

Bear Valley Basin Groundwater Sustainability Agency (No Change):

On February 16, 2023, the BVBGSA had a Board meeting. The primary purpose of the meeting was to consider a proposal from Tom Harder and Associates to prepare the first Groundwater Sustainability Plan (GSP) Annual Report. The annual report is a requirement of the GSP. The report contains groundwater level information, water pumping information, and computes groundwater storage volume for the Bear Valley Basin. The BVBGSA Board approved the proposal and the funding of $10,277.50 will come from each of the four member agencies. The GSP Annual Report was submitted to DWR on April 1, 2023.

On June 20, 2023, the BVBGSA had a Board Meeting. The primary purpose of the meeting was to adopt the FY 2023/24 Budget. David Lawrence provided an update on Replenish Big Bear to the Board including the following: The Replenish Big Bear Team will be submitting the Pilot Study Report to the Regional Board. The pilot equipment including the UV disinfectant and General Manager’s Report

advanced oxidation process have been delivered. BBARWA will be piloting the equipment through September to ensure we can support the claims that we have made for the Replenish Big Bear Project. On July 19, 2023, BBARWA held an Open House and Pilot Tour. From 2:00 pm - 3:00 pm, the Regional Board and local Board members had an opportunity for a Pilot Tour and the public was invited to join BBARWA from 3:00 pm - 6:00 pm. Over 300 people attended the event.

On November 13, 2023, the BVBGSA Board approved an agreement with Tom Harder to prepare the GSP 2022/23 Annual Report contingent upon concurrence of approval by the member agencies that will be responsible for reimbursing the BVBGSA. The 2022/23 Annual Report was filed with DWR-SGMA on March 21, 2024. Tom Harder has begun work on the 2023/2024 Annual Report.
