5. PUBLIC HEARING: Code Amendment 2023-02, Title 14 of Biggs Municipal Code This hearing is in response to the most recent comments from the State Department of Housing and Community Development (HCD) regarding final certification of the City of Biggs 2022-2030 Housing Element Update.

Recommendation: Introduce Ordinance No. 433 by reading of title only: “AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BIGGS AMENDING TITLE 14 ZONING OF THE MUNICIPAL CODE REGARDING IMPLEMENATION OF THE 2022-2030 HOUSING ELEMENT UPDATE.”

A. Approve warrants: 38118, 38126, 38135 – 38183, 121220231, 121820231, 9302936 – 9302982 for the Month of December 2023 in the amount of $424,315.63.
B. Approve minutes for Regular Council Meeting of December 12, 2023.

Action: It is recommended items “A” through “C” be acted on simultaneously unless separate actions are requested by a Councilmember or a member of the audience.
Recommendation: Motion/Second to approve the consent calendar.

Discussion/Action: Sheriff Department Services
The City of Biggs has an ongoing agreement with Butte County Sheriff Kory Honea’s office for law enforcement services.
Recommendation: Receive a presentation from the Butte County Sheriff’s Office. Ask questions and give direction related to the implementation of law enforcement activities in the City of Biggs.

E. City Administrator
1. Discussion/Action: Development Impact Fee – Multifamily There is a misalignment in the Development Fee Schedule and municipal Code. The Municipal Code refers to Development Impact Fees for “Multifamily Residential,” but the current fee schedule does not.
Recommendation: Approve Resolution No. 2024-01, “A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF BIGGS ESTABLISHING DEVELOPMENT IMPACT FEES.”
2. Discussion/Action: Development Impact Fees – Comparison – Findings State law and the Municipal Code call for a review of development fees every five years.
Recommendation:
a. Provide direction to staff related to adjusting and updating development impact fees.
b. Approve Resolution 2024-02, “RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BIGGS FINDING FUNDS COLLECTED FOR DEVELOPMENT IMPACT ARE NECESSARY TO PROTECT THE CITY’S FINANCIAL
SUSTAINABILITY AS ALLOWED BY LAW.”
3. Discussion: Butte Subbasin Agreement Amendment
The City of Biggs joined a consortium of other agencies to comply with new California groundwater regulations cost-effectively. The costs of compliance will be borne by each party based upon and amendment to the previous agreement which initiated the group.
Recommendation: Direct staff.
