Speaking Time Limit: Three-minute time limit for each speaker unless Council specifies a different time limit based on the time allotted for the item and/or the number of speakers.
Written Materials: Council is unable to read written materials presented at the meeting. If a person intends to appear before the Council and provide written material, that written material should be delivered to the City Clerk at least 10 days in advance of the meeting date.

B. Approve minutes for Regular Council Meeting of January 9, 2024.

D. Adopt Ordinance No. 433 by reading of title only, “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BIGGS AMENDING TITLE 14 ZONING OF THE MUNICIPAL CODE REGARDING IMPLEMENTATION OF THE 2022-2030 HOUSING ELEMENT UPDATE.”
E. Receive and file the corrected 2022 Power Content Label.
F. Acknowledge receipt of the January 2024 Butte County Animal Control Report.
Action: It is recommended items “A” through “F” be acted on simultaneously unless separate actions are requested by a Councilmember or a member of the audience.
Recommendation: Motion/Second to approve the consent calendar.

1. Discussion/Action: Feral Cat Control Program
At the May 9, 2023, City Council Meeting, the Council agreed to continue participating in the Feral Cat Control Program at a cost not to exceed $3,000 for six months.
Recommendation: Direct staff whether the Council would like to continue to participate in the Feral Cat Control Program with Paws Clinic of Oroville for the next six months at a cost not to exceed $3,000.
2. Discussion/Action: Water and Sewer Fund Balances
The costs of operating the sewer and water utilities exceed the revenue generated from the tariffs in the current fee schedule. Reductions in staff levels and efforts to reduce costs have been unable to keep pace with the increased costs of goods and the increases in compliance, reporting, and regulatory expenses.

Recommendation: Direct staff to proceed with the process of adjusting sewer and water rates to meet the actual cost of service more closely for the successive five budget cycles (until the 2029-2030 budget) based on the published Consumer Price Index, with rates being set each fiscal year based on the increase or decrease in the CPI from the previous year.
Or
Direct the City Administrator to make Water System Rate adjustments on or about March 1, based on Ordinances 347 and 366 and move forward with sewer rates being adjusted by CPI analysis.
3. Discussion/Action: Industrial Park Repairs
After inspecting the Industrial Park facilities, the Public Works Superintendent and the City Administrator have identified items for construction and repairs.
Recommendation: Authorize the City Administrator to spend rental income generated from the Industrial Park for repairs and improvements at the Industrial Park and trade park tenants for facility improvements and repairs.
4. Discussion/Action: Industrial Park Self Storage – Lease Rates The Council approved leases for three tenants at subsequent meetings. Tenants have made improvements that allow for additional utilization of the eastern portion of the park. This space is proposed to be made available for lease to create additional revenue.
Recommendation: Adopt lease rates and lease documents for public self-storage at the Biggs Industrial Park.
5. Discussion/Action: Community Clean-Up Day
Additional “clean up” funding was discovered this year through the CA Department of Transportation Clean California Dump Day program. CalTrans can pay up to 100% of the cost through a simple short-term agreement process expiring June 30, 2024. It is proposed that the City of Biggs partner with CalTrans for an event on Saturday, May 11, from 9 a.m. to 1 p.m. at 7th and B Street.
Recommendation: Authorize the City Administrator to enter into an agreement with the CA Department of Transportation for a Community Clean Up day on May 11, 2024.
6. Discussion/Action: Travel Policy and Procedures
At a previous meeting, staff was directed to update City policy related to Council and Staff Travel procedures.
