Speaking Time Limit: Three-minute time limit for each speaker unless Council specifies a different time limit based on the time allotted for the item and/or the number of speakers.

State law requires every City and County in California to have a General Plan which contains several required Elements and to amend its Plan periodically to reflect changing conditions and/or compliance with State and Federal laws.

Recommendation: Approve Resolution No. 2024-03, “A RESOLUTION OF THE CITY OF BIGGS APPROVING GENERAL PLAN AMENDMENT 2024-01.”

1. Discussion/Action: Farris Road Lease
In 2023, the Council established the Biggs Industrial Park and approved tenant leases at subsequent meetings. Throughout this process, City staff has been able to identify what organization or corporation owns or maintains fiber optic switching buildings on City property at 3951 Farris Road.

Recommendation: Authorize the City Administrator to contract for Real Estate research services to ascertain who owns that fiber optic facility on City property, with costs not to exceed $5,000 and a 3% fee on the collection of tenant back rent payments.
2. Discussion/Action: Policy Statement on Energy Procurement California has an excessive amount of agricultural biomass due to recent forest wildfires, downturns in various agricultural commodity prices, and poorly executed recycling and waste management policies.
In a recent meeting with SunWest Mill’s ownership, it became apparent that a great deal of time and energy could be saved if the City established a clear policy statement related to ag waste biomass energy projects (and others).
Recommendation: Approve the attached Energy Project Development Policy Statement.
3. Discussion/Action: Biggs Solar RFP 2023
Electricity costs continue to rise throughout California. Compounding the affordability problem is the cost of interconnection and transmission costs.
Recommendation: Motion/Second to authorize City Staff to issue an RFP for Solar energy generation services and bring qualified responses to the City Council for consideration.
4. Discussion/Action: Water Rate Adjustment
Proposition 218, passed by the people of the State of California, requires municipalities to base city service costs, such as water and sewer, on the actual costs of providing the services to the resident ratepayers. Sewer rates were last adjusted in 2013 and water rates were last adjusted in 2011.
Upon review of past and current budgets, it is clear that the costs of operating the sewer and water utilities exceed the revenue generated from the tariffs in the current fee schedule.
Recommendation: Direct staff to proceed with the process of adjusting water rates to meet the cost of service more closely for the successive five budget cycles (until the 2029-2030 budget) based on the published Consumer Price Index, with rates set each fiscal year based on the increase or decrease in the CPI from the previous year.

Additionally, a motion would be in order to direct City Staff to present to the City in the 2024-2025 Budget process a program by which 100% of water customers have meters to calculate their usage by 2025.
