Speaking Time Limit: Three-minute time limit for each speaker unless Council specifies a different time limit based on the time allotted for the item and/or the number of speakers.
Written Materials: Council is unable to read written materials presented at the meeting. If a person intends to appear before the Council and provide written material, that written material should be delivered to the City Clerk at least 10 days in advance of the meeting date.

5. COUNCIL APPOINTMENT: Appointment of City Clerk as Acting City Administrator The City Administrator is currently on leave. The City does not have a process in place for the assignment of City Administrator duties in the absence of the City Administrator.

Recommendation: Appoint the City Clerk as Acting City Administrator during absence of City Administrator, with a stipend of an additional $40/hour for the period during which the City Clerk is the acting City Administrator
6. CONSENT CALENDAR
A. Approve warrants 38748 – 38820, 91720241, 9303210 – 9303233, and 93023434 – 93023437 for the Month of September 2024 in the amount of $411,125.18.
B. Approve minutes for Regular City Council Meeting of September 10, 2024.
C. Approve Resolution No. 2024-17, “RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BIGGS AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE A SUBSTITUTION OF TRUSTEE AND DEED OF RECONVEYANCE” (Smith).
D. Acknowledge receipt of the City of Biggs Recommended Energy and Natural Gas Hedging Strategies, CY 2025 and 2026.
E. Acknowledge receipt of the Treasury Report CARES ACT COVID Expenditures and direct the City Attorney to review it for completeness.
It is recommended items “A” through “E” be acted on simultaneously unless separate actions are requested by a Councilmember or a member of the audience.
Recommendation: Motion/Second to approve the consent calendar.

2. Discussion: CA Housing Laws
Councilmembers and community members have asked questions about the new California housing laws that may relate to the City’s recently approve Housing Element and the potential rezoning of the Sheppard Family property on Sixth Street.
Recommendation: This is a discussion item only.
3. Discussion: Sixth Street Apartment Proposal
At the previous City council meeting, residents presented questions and concerns to the City Council regarding the Sixth Street Apartment Proposal. Staff is prepared to answer questions to the best of their ability.

D. Engineering
1. Discussion/Action: Shift REAP 2.0 Funds from Pedestrian Railroad Crossing to Sidewalk and ADA Compliance.
The shift will allow the City of Biggs to supplement the Caltrans funding for nonreimbursable costs under Caltrans guidelines.
Recommendation: Authorize the City Administrator to shift the REAP 2.0 funds of $158,519 allocated for the Biggs B&E Street Pedestrian and Bike Improvements for the UPRR crossings to the 2nd Street Bicycle and Pedestrian Improvements project.
2. Discussion/Action: Task Order #38 for the Biggs 2nd Street Bicycle/Pedestrian Improvements Project-Additional Engineering Support.
The City has received 2022 RTIP/STIP funds in the amount of $500,000 for construction of the Biggs 2nd Street Bicycle/Pedestrian Improvements.
Recommendation: Authorize the City Administrator to execute Task Order #38 (16-604-303) with Bennett Engineering Service, Inc. for addition engineering support on the 2nd Street Bicycle and Pedestrian Improvement Project E. City Administrator
1. Discussion: Industrial Park Improvements
Council discussion and direction to staff:
a. to provide procedural and fiscal accounting for all work undertaken by the City at the Industrial Park since January 1, 2023.
b. to provide direction to staff regarding the future work.
2. Discussion/Action: Industrial Park Lease for East Barn The City has been taking steps to create a profit center and a place of opportunity for small businesses from the barns and other property designated as the Industrial Park.
Recommendation: Direct staff on lease rates for the East barn as a duck hunting trailer facility. Review the list of needed repairs and discuss the timing of financing the designated repairs.

3. Discussion/Action: Industrial Park Self-Storage – Lease Rates In 2023, the Council established the Biggs Industrial Park at 2837 W. Biggs Gridley Road.
Recommendation: Adopt lease rates (fee schedule) and lease documents for public self-storage at the Biggs Industrial Park.
4. Discussion/Action: C4 Electric Rate Review
Through 2023 and 2024, The City Council held more than six public meetings related to the negative balance accruing in the Electric Fund created by historic and unprecedented price increase in the California utility market.
Recommendation: Give staff direction related to the electric fund.
5. Discussion/Action: Social Media Policy Review
The City of Biggs established a policy that allows social media to provide information to the public.
Recommendation: Direct the City Attorney regarding the City’s Social Medial Policy.
6. Discussion/Action: Landscape Services Agreement
In June 2021, the City of Biggs faced a severe employee shortage and decided to engage Landscape by Stentzel to perform mowing and similar duties.
Recommendation: Authorize the City Administrator (in consultation with the Public Works Superintendent) to enter into an “as needed” Professional Services Agreement for landscape services with additional language requiring proof of adequate insurance or bond, proof of active business license, and proof of no outstanding civic liens or code violations.
