Speaking Time Limit: Three-minute time limit for each speaker unless Council specifies a different time limit based on the time allotted for the item and/or the number of speakers.
Written Materials: Council is unable to read written materials presented at the meeting. If a person intends to appear before the Council and provide written material, that written material should be delivered to the City Clerk at least 10 days in advance of the meeting date.

5. COUNCIL APPOINTMENT:
Discussion/Action: Consideration of appointment of Cliff Wagner as interim Biggs City Administrator. 32 hours per week at $75 per hour. Term: indefinite/as needed.
Recommendation: Direct staff.

6. CONSENT CALENDAR
A. Approve warrants 38821 – 38879, 101820241, 102220241 – 102220243, 9303238 - 9303264 for the Month of October 2024 in the amount of $554,980.58.
B. Approve minutes for Special Council Meetings of September 27, 2024, October 1, 2024, October 16, 2024, and October 31, 2024, and Regular Council Meeting of October 8, 2024.
C. Approve second reading of Ordinance No. 436 by reading of title only, “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BIGGS AMENDING TITLE 11 BUILDINGS AND CONSTRUCITON OF THE BIGGS MUNICIPAL CODE.”
D. Adopt Resolution No. 2024-20, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BIGGS ADOPTING THE 2024 BUTTE COUNTY LOCAL HAZARD MITIGATION PLAN.”
E. Acknowledge receipt of Butte County Animal Control Report for the months of September and October 2024.
It is recommended items “A” through “E” be acted on simultaneously unless separate actions are requested by a Councilmember or a member of the audience.
Recommendation: Motion/Second to approve the consent calendar.

1. Butte County Sheriff’s Office Report
2. Discussion/Action: Fire Department 66 Hour Workweek
In September of 2024, CALFIRE Local 2881 and CAL HR negotiated a temporary labor agreement that would reduce the firefighter workweek from 72 hours to 66 hours. The City of Biggs will need to increase their fire department staffing level by one position over the next three fiscal years, beginning with the current fiscal year. The amended contract for FY 24/25 will increase the contract cost by $40,256.00.

Discussion/Action: Landscape Services Agreement
At a previous meeting, the Council discussed the idea of an “as needed” professional services agreement for landscape services.

C. Planning
1. Activity Report
2. Discussion: Revised Site Plan Review 21-13 (Dhami) New Home, 328 Aleut Street Planning staff are requesting that the City Council concur with its approval of Revised Site Plan Review 21-13 (Dhami) for a new home at 328 Aleut Street located at the Northwest corner of 1st and Aleut Streets.
Recommendation: This is informational only.
D. Engineering
1. Activity Report
2. Discussion/Action: Contract Award for Construction of 2nd Street Bicycle and Pedestrian Improvements Project.
The City solicited public bids for the project titled 2nd Street Bicycle and Pedestrian Improvements Project on October 2, 2024. Five bids were received, and Franklin Construction was the lowest responsive bidder.
Recommendation: Motion/Second to authorize the Acting City Administrator to execute a contract with Franklin Construction, Inc., in the amount of $725,749 for the construction of the 2nd Street Bicycle and Pedestrian Improvements Project; and approve a construction cost budget of $800,000 to include a 10.2% contingency for the project.
E. City Administrator
1. Discussion/Action: Vacancy of Vice Mayor/City Council Position.
Vice Mayor/City Council Member Chuck Nuchols submitted his resignation letter on October 10, 2024.
Recommendation: Accept resignation of Vice Mayor and Council Member Nuchols and determine the position of Vice Mayor and Council Member Nuchols has become vacant.
2. Discussion/Action: Nomination and Election of Vice Mayor When the position of Vice Mayor has become vacant, the position should be filled by the Council.
Recommendation: Accept nominations for Vice Mayor or wait until December 10, 2024, meeting to fill the position.

3. Discussion/Action: Filling the Council Member Vacancy Pursuant to Government Code section 36512, the Council has the authority to appoint a successor for the remainder of Mr. Nuchols’ term. Such an appointment is to be made within 60 days from the vacancy or hold a special election.
Recommendation: Consider filling vacancy by appointment or by special election pursuant to Government Code section 36512.
4. Discussion/Action: Fiscal Year 2024-2025 Budget Adjustments Budget adjustments serve to realign the budget to various changes including specific Council authorized projects that necessitate changes to the budget and changes to the expenditure authorization.
Recommendation: Motion/Second to authorize the listed Fiscal Year 2024-2025 Budget Adjustments in the staff report.
