Resolution - Renewing AB 481 Military Equipment Policy 2025 01 27

STAFF REPORT
Background/History:

On February 14, 2022, Council approved the military equipment policy and associated City of Bishop Municipal Code, Chapter 13.20 – Military Equipment, in accordance with Government Code 7070. Part of maintaining compliance is an annual report to City Council, updating the military equipment and policy as necessary, make the information public and hold a public meeting to discuss the policy and equipment with members of the public. This staff report is presented to ensure full compliance and transparency with the legislative requirements.

Analysis/Discussion:

Since February 14, 2022, there have been no legislative changes to Government Code 7070, Lexipol Policy 706 of the City of Bishop Municipal Code. So, in order to maintain compliance, I have attached an updated military equipment inventory as well as the required report to be presented and discussed with members of the public. It is the goal of the Bishop Police Department to be as transparent as possible with members of the public. Pursuant to Government Code Section 7072(b), a community engagement is required to be held within 30 days of this date. A notice will be presented to the public on a date and time for public comment following this approval.

Economic Impacts:

There are no economic impacts related to this staff report or reporting requirement.

Budget Impacts:

There are no budget impacts as the additional equipment was budgeted for and purchased 22 during the last budget cycle.

Legal Review:

City Attorney Pucci has reviewed this item and finds that the recommended action complies with the law.

Recommended Action:

Council consideration to approve the attached equipment inventory and report so it may be presented to the public and discussed in an open forum with members of the public and the Chief of Police within 30 days of approval and approve the proposed resolution.

23 Bishop Police Department Annual Military Equipment Report This report is prepared in accordance with Department Policy, associated legislative requirements and is provided to the Bishop City Council and members of the public regarding the possession and use of certain equipment in the possession of the Bishop Police Department. The equipment listed in the attached inventory has been deemed Military Equipment in accordance with Government Code 7070. In addition, this report is required under Government Code 7072.

In 2024, The Bishop Police Department required all uniformed patrol Officers to carry a Colt M4 rifle in their patrol unit while on duty. In 2024, none of the patrol rifles were discharged in the line of duty. However, all Officers received the appropriate range training and qualified in accordance with Department Policy. The Bishop Police Department also maintains two sub machine guns in its inventory, which are to be used by personnel assigned to the Inyo County Special Enforcement Detail. The sub machine guns were not used in the line of duty in 2024.

During the calendar year 2024, no complaints related to military equipment were received by the City of Bishop or the Bishop Police Department. If the needs of the Department change during the next year and we acquire additional military equipment, it will only be done so in accordance, with Department Policy, City of Bishop Municipal Code and legislative requirements.

Within 30 days of the publishing of this report I will be available to discuss the Departments military equipment and address any concerns.

STAFF REPORT
Background/History:

The Community Services Department has used the vendor Challenger Sports Soccer to provide youth soccer for our Olympic Kids Summer Camps for the past 6 years. In that time the Community Services Department has analyzed this agreement on an annual basis. The Community Services Department Program staff would recommend the continuation of the services. The current agreement has a term of one-year with the option to extend for one-year as long as parties agree.

Analysis/Discussion:

The Vendor Agreement between the City of Bishop and Challenger Sports will expire on January 21st, 2025. Challenger Sports has provided the Community Services Department with a one-year letter of extension. This letter of extension will be for a one-year term that will end on January 21st, 2026.

Economic Impacts:

None
Budget Impacts:

This Item is accounted for in the 2023-2024 Community Services Parks budget in the amount of $3,600.00.

Legal Review:

Attorney Pucci has reviewed the item and finds the recommended action complies with the law.

Recommended Action:

Council to approve the Challenger Sports Agreement Letter of Extension for a term of one year with the term ending on January 21st, 2026.

Subject: Community Services Department - Purchase of Tractor Prepared On: February 3, 2025
Attachments: Tractor Purchase Order

Garton Tractor

STAFF REPORT
Background/History:

The Community Services Department staff maintains the landscaping equipment for operations at the City Park. The John Deere Tractor currently in service has been an essential piece of equipment. However, the John Deere Tractor has outlived its useful life. This piece of equipment has been identified for replacement in the 2023-2024 budget. The Community Services Department has solicited quotes for three vendors and selected the quote from San Joaquin Tractor in the amount of $49,407.00.

Analysis/Discussion:

The City of Bishop Purchasing Policy allows for the City Administrator to authorize purchases that are budgeted for up to the amount of $25,000.00. Any amount over $25,000.00 requires City Council approval. The purchase amount for the Kioti Tractor from San Joaquin Tractor is for $49,407.00 and requires the City Council to authorize and approve this purchase.

Economic Impacts:

None.

Budget Impacts:

This item was budgeted within the adopted FY 2024-25 budget, however, the item was under budgeted. The budget increase needed to complete this purchase is being presented for approval within the mid-year budget adjustments report on February 10, 2025.

Legal Review:

Recommended Action:

Council to approve the expenditure for the Kioti Tractor from San Joaquin Tractor and authorize the City Administrator to sign the Purchase Order in the amount of $49,407.00. 45 Approved By: Ethan Aukee 2/3/2025

STAFF REPORT
Background/History:

Strategic Plan Item 4.6 - Real-Time Crime Center Initiative In alignment with Item 4.6 of the City of Bishop's Strategic Plan, which focuses on modernizing workflows and implementing contemporary policing techniques to enhance departmental efficiency, the Police Department has identified the development of real-time crime centers as a key initiative. These centers, incorporating downtown camera networks and Automatic License Plate Readers (ALPRs), are recognized as essential tools for advancing modern policing practices and improving operational effectiveness.

As a direct result of the strategic plan's directive, the Police Department has prioritized this project and included it in the FY24/25 project list. This initiative, which has already received approval from the City Council, is allocated a budget not to exceed $187,500.00.

Analysis/Discussion:

The City of Bishop Police Department is considering the purchase of cameras and Automatic License Plate Readers (ALPRs) to be deployed in the downtown core area. This initiative aims to enhance crime prevention and improve the efficiency of investigations. National statistics indicate that surveillance technologies such as cameras and ALPRs can significantly aid in reducing crime rates. For example, cities that have implemented such technologies have seen a 20-30% reduction in certain types of crime, particularly property crimes and theft. ALPRs, in particular, have been effective in identifying stolen vehicles, tracking suspects, and solving cases more quickly.

Flock Safety, a leading vendor in this field, is at the forefront of the competition due to its advanced, reliable technology. Flock Safety stands out as the only provider that integrates 59 seamlessly with Axon Evidence.com, a platform the Bishop Police Department already uses for managing evidence and case files. This integration allows for streamlined data sharing and case management, providing officers with a more efficient and effective way to handle investigations. The combination of Flock Safety’s technology and Axon’s platform will enhance the department's ability to quickly respond to crime, make informed decisions, and improve public safety in the downtown area.

Economic Impacts:

The purchase of a Flock Safety contract for a five-year term, which includes the acquisition and subscription for ten (10) devices, has been carefully evaluated and aligned with the FY24/25 budget. The total cost of the contract, including both the devices and associated subscription fees, is not to exceed $187,500.00. This amount was previously approved by the City Council and is allocated within the current fiscal year's budget.

The financial commitment will cover the following:

1. Device Acquisition: The purchase of ten (10) Flock Safety devices, designed to enhance the Police Department’s crime prevention and investigative capabilities.

2. Subscription Fees: Ongoing subscription costs for the five-year contract period, which will ensure continuous access to the system’s features, software updates, and technical support.

3. Integration and Maintenance: Costs associated with the integration of the Flock Safety system with the Axon Evidence.com platform, as well as routine maintenance and operational support to ensure the system's optimal functionality.

The allocation of $187,500.00 ensures that this critical technology can be fully implemented within the budgeted amount, enhancing both operational efficiency and public safety.

Budget Impacts:

This item was approved in general fund spending for FY 24/25.

Legal Review:

City Attorney Pucci has reviewed this item and finds it complies with the Law.

Recommended Action:

Review and approve 5-year contract with Flock safety for a combination of 10 live view cameras and automatic license plate recognition cameras (ALPR's).

Prepared On: January 30, 2025

Blackpoint LLC quote

STAFF REPORT
Background/History:

The Bishop Police Department has submitted an application for $50,000.00 from the Homeland Security grant, administered through Inyo County, to purchase state-of-the-art handheld radios. The Department was granted $49,629.00. These funds will be used to replace the department’s aging radio technology, ensuring more reliable communication for officers and improving overall operational efficiency. Bids were sought as per the City of Bishop purchasing policy. Only two vendors responded of the three contacted. Blackpoint LLC at $48,830.08 and 49er Communications at $53,808.68, Haloid Solutions never responded. It should be noted there are only limited radio dealers who can also program our radios and Blackpoint LLC holds the encryption key which is mandatory for our P25 compliance.

Analysis/Discussion:

Radio communication is a critical component of law enforcement operations, serving as one of the foremost tools for ensuring officer safety and effective service to the community. It is essential that communication equipment remains up-to-date and fully functional to support officers in the field, enabling them to respond swiftly and effectively in dynamic situations.

Upgrading to state-of-the-art handheld radios will enhance the safety, coordination, and efficiency of the Bishop Police Department, ultimately benefiting both our officers and the public we serve.

Economic Impacts:

The purchase will be fully covered by a no match grant.

Budget Impacts:

General Fund revenue account, 001-000-34141 PD Grants, increase of $49,629.00.

General Fund expense account, 001-020-55043 Law Enforcement Grant, increase of 67 $49,629.00.

STAFF REPORT
Background/History:

The City adopted a FY 2024-25 budget prior to the start of the 2024-25 fiscal year. Following the conclusion of December, City staff analyzed the adopted budget in reference to actual performance through 50% of the fiscal year. City staff attempted to adjust revenue accounts to more accurately reflect expected revenue. With regard to expense accounts, City staff attempted to decrease expenses where possible, while ensuring that all planned spending for the remainder of the fiscal year is approved by City Council.

A main focus of the Finance Director during this process is to more accurately reflect capital outlay in the capital expense accounts. Some of the capital expense accounts include a budget figure for larger projects that will not be actualized during the fiscal year. These accounts are being adjusted to more accurately reflect the cash activity associated with the portion of projects that will be completed during the fiscal year.

Analysis/Discussion:

Analysis within this staff report is limited to the General Fund. Analysis of the other substantial City funds is included in the attachments.
71 - General Fund budgeted revenue would increase from $11,535,564 to $12,023,189. The majority of the $487,625 increase in budgeted revenue can be attributed to prior year TOT collected pursuant to prior year audit results, as well as interest earned on bank deposits. - General Fund budgeted "expenses" (including transfers out) would decrease from $13,706,566 to $13,586,842. This bottom line decrease of $119,724 can be attributed to decreases in capital expense accounts to more accurately reflect capital outlay for the fiscal year. The adjusted budget maintains an operating surplus. - If the budget adjustments are approved as presented, and all revenue is earned and all expenses are incurred, the net effect on cash within the General Fund would be a decrease of $1,563,653. At the start of FY 2024-25, the General Fund maintained a cash balance of $10,612,319, and if the adjusted budget is actualized, the General Fund should maintain a cash balance of $9,048,666 at the conclusion of the fiscal year.

All substantial budget adjustments include commentary within the attached, respective reports.

Economic Impacts:

There are implicit economic impacts associated with the City's budget and the adjustments being presented.

Budget Impacts:

All budget impacts are included within the reports being presented.

Legal Review:

City Attorney Pucci has reviewed this item and finds that the recommended action complies with the law.

Recommended Action:
