Agenda Item: 16.C
Date of Meeting: April 14, 2025
Department: Finance
To: City Council
From: Ethan Aukee
Subject: COPS Fund Budget Adjustment Request
Prepared On: April 8, 2025
STAFF REPORT
Background/History:
While conducting our monthly budget review, it was determined that the Police Department would not utilize excess spending approved within the COPS Fund, specifically, within expense account 033-033-52019 (Misc. Dues and Subscriptions). Based on the rules and requirements of the COPS Fund, it's recommended that City staff attempt to spend the current amount budgeted. Therefore, it's recommended to repurpose the approved spending.
Analysis/Discussion:
In order to effectively utilize the approved spending within the fund, City staff are recommending a decrease of $14,000 in expense account 033-033-52019. This decrease would be repurposed by reallocating $10,000 to 033-033-56029 (Capital Equipment Replacement) and $4,000 to 033-033-52018 (Special Department Supplies). The capital funding would be used to obtain a camper shell for a PD vehicle. The special department supplies funding would be used for general items needed within the Police Department.
Economic Impacts:
No significant economic impacts.
Budget Impacts:
The budget impacts are spending neutral. No additional spending authority is being requested. The account level impacts are listed below.
Decrease of budget within expense account 033-033-52019 in the amount of $14,000.00 Increase of budget within expense account 033-033-56029 in the amount of $10,000.00 Increase of budget within expense account 033-033-52018 in the amount of $4,000.00 Legal Review:
Legal review is not required for this item.
Recommended Action:
City Council to review and approve the proposed budget adjustment request. 81 Approved By: Ethan Aukee 4/8/2025

From: Ethan Aukee
Subject: Public Works Budget Adjustment Request
Prepared On: March 20, 2025
STAFF REPORT
Background/History:
While reviewing the City's budget during our routine monthly budget review, it was determined that City staff needed to propose an adjustment to the Public Works budget.
Analysis/Discussion:
Within the Sewer Fund, it was determined that additional spending authority is needed for expense account 002-051-56027 (Capital Improvement). The reasoning behind the need is due to unreasonably delayed billing by the vendor associated with the SCADA Upgrade Project. Invoices were received for work completed in the prior fiscal year. The City made reasonable efforts during the close of FY 2023-24 to contact all vendors and request timely billing for services rendered, however, this vendor did not adhere to the requests made. When budgeting for FY 2024-25, the City made assumptions that the work completed in FY 2023-24 would be billed in a timely manner, so only the work expected in FY 2024-25 was budgeted for the corresponding fiscal year. City staff did not consider a need for FY 2024-25 adjustment until this vendor provided the unreasonably delayed invoices. Fortunately, a project within the Professional Services expense account (002-051-52015) will cost significantly less than anticipated, so approved spending within this account can be repurposed to cover the increased spending within the Capital Improvement (002-051-56027) expense account.
With regard to the overall SCADA Upgrade Project, City staff adequately budgeted for the project as a whole. The current budget discrepancy and need for adjustment stems from:
- The FY 2024-25 budget being developed and approved in May-June 2024. - FY 2023-24 closing invoices and assumptions for receiving closing invoices in July-August 2024.
- Invoices received in February 2025 for services rendered prior to July 2024.
In short, these varied timelines and City staff's assumption that business would be conducted as routinely expected, led to the current discrepancy in the FY 2024-25 budget. 83 Moving forward, the City will increase its efforts to encourage vendors to invoice in a timely manner at the end of a fiscal year. Additionally, City staff will work on improving the City's budgeting practices to ensure that safeguards are put in place to produce more accurate budgeting, regardless of variables such as those described within this report.
Economic Impacts:
No economic impacts associated with this budget adjustment.
Budget Impacts:
Decrease in budget for expense account 002-051-52015 in the amount of $40,000.00.
Increase in budget for expense account 002-051-56027 in the amount of $40,000.00.
Net neutral budget adjustment within the Sewer Fund.
Legal Review:
Legal review is not required for this item.
Recommended Action:
City Council to review and approve the requested budget adjustment.

Subject: Refund of Business License Credit Balance to Licensee Prepared On: March 24, 2025
STAFF REPORT
Background/History:
Business licensee #1325 made an online payment for their business license in January 2025 but accidentally applied the payment to their utilities account. Being that the payment was incorrectly applied, their business license account showed a delinquency at the end of January and the account accrued a delinquency penalty. City staff advised the licensee that the delinquency penalty would be waived, being that the initial payment was made in a timely manner. The licensee opted to keep the existing payment made applied to their utilities account as is and reissue payment for the business license. The licensee accidentally made payment on the business license amount plus penalty, as they issued payment before City staff was able to adjust the invoice.
The licensee has requested a refund, rather than retaining a credit balance on their business license account.
Analysis/Discussion:
Per City of Bishop Municipal Code:
Under Section 5.08.030, titled "Mistakes by administrator; prorating taxes; refunds," the city does not issue refunds for business license taxes except in cases where a tax, penalty, or portion thereof was erroneously assessed and collected. The relevant portion states:
"No license tax paid nor any part thereof shall be refunded or prorated, except that any license tax, penalty, or part thereof which has been erroneously assessed and collected shall be refunded by the city administrator upon approval by the city council." The City is asserting that a $20.00 penalty was erroneously assessed and collected, and therefore, is requesting City Council approval to issue a refund to the licensee in the same amount.
85 Economic Impacts:
None.
Budget Impacts:
None.
Legal Review:
City Attorney Pucci has reviewed this item and finds that the recommended action complies with the law.
Recommended Action:
City Council to approve the refund of a $20.00 credit balance to business license #1325.

Subject: Resolution - Conflict of Interest Code
Prepared On: March 27, 2025
Attachments: Resolution No. 2024-19 - The City's Current Conflict of Interest Code A Proposed Resolution Pertaining to the Local Conflict of Interest Code and Repealing Resolution No. 2024-19
STAFF REPORT
Background/History:
Every local agency in California is required to have a Conflict of Interest Code that enumerates the positions within the agency which involve the making or participation in the making of decisions which may foreseeably have a material effect on any financial interest. For each numerated position, the Code must list the specific types of investments, business positions, interest in real property, and sources of income which are reportable. Codes should also determine the extent to which any “consultant” has any such responsibilities.
If a position is listed within the Code, then the individual(s) in the position must file a Statement of Economic Interest (Form 700) with the City Clerk within 30 days of assuming office, and file annually thereafter by the applicable deadline.
The City must update its Code whenever necessitated by changed circumstances, including the creation of new positions. In every even numbered year, the City must review its code, and take actions relating to the update of its Code pursuant to Government Code Section 87306.5.
Typically, this involves the City Clerk providing a staff report to the City Council detailing whether, and to what extent staff recommends any revisions to its Conflict of Interest Code. If there are such recommended revisions, as is presently the case, the City Council will take action to revise the code by adopting a resolution amending the Conflict of Interest Code, as appropriate. When determining whether revisions or updates to the code are appropriate, the City should consider whether any new or revised positions should be subject to the Code, and whether all positions listed in the Code are still actually positions within the City.
Analysis/Discussion:
After conducting a review of the current Conflict of Interest Code (Resolution No. 2024-19), 87 City staff recommended the revised list of designated positions and their respective disclosure categories found on the proposed resolution’s appendix.
Economic Impacts:
There is no economic impact.

From: Ethan Aukee
Subject: Purchase of a Used Type 3 Fire Engine
Prepared On: April 10, 2025
STAFF REPORT
Background/History:
Currently the Bishop Fire Department does not have a true Type 3 Fire Engine. The Bishop Fire Department has Type 1's, Type 2's (2007 and 2011), and aerial fire apparatus. Our Type 2's have been used for wildland fires since the purchase of those vehicles and prior to adopting modern day firefighting tactics and strategies.
A true Type 3 Fire Engine's primary purpose is to fight wildland fires. The Bishop Fire Department has Type 1's, Type 2's and aerial fire apparatus, but not a true Type 3.
The purchase of a Type 3 will enhance our suppression capabilities by effectively pumping a progressive hose lay, relay pumping, and having adequate space on the apparatus for equipment.
The reason this is being proposed now, versus next year's budget, is because time is of the essence. Fire season is here and it's not even May. We all know in California, fire season is almost year-round and the apparatus that we have researched and found for sale will likely not be available in the upcoming weeks/months.
With our current fleet, as recent as the Silver Fire, we were presented with operational issues with the pump capacity of our first out brush engines (E3 and E4, both Type 2's) with not being able to properly pump our progressive hose lay and an ineffective relay pump operation.
With a Type 3, we would not have these issues or concerns.
Analysis/Discussion:
Recently, Fire Department staff has identified the availability of multiple, used, Type 3 Fire Engines. These engines appear to be in good condition and would serve as a useful and needed addition to the Fire Department's fleet of apparatus. The Fire Department's initial plan was to present the purchase of a Type 3 Fire Engine during the City's upcoming strategic planning meeting, for consideration of inclusion in the FY 2025-26 budget. Being that quality used options are available now, and it's reasonable to assume that quality used options might 107
not be available in FY 2025-26, the Fire Department has decided to present a request to purchase within the current FY 2024-25.
A new Type 3 Engine typically costs $300,000-$500,000. The Fire Department posits that purchasing a used engine, in good condition, allows for significant savings to the City, while still providing a higher quality service to the public.
Although this report requests maximum spending in the amount of $150,000.00, the Fire Department anticipates this apparatus purchase to range $120,000-$150,000.
A Type 3 Engine is a useful piece of equipment for both provision of service to the local community, as well as for mutual aid deployments. This type of equipment, when made available for the use of other entities, has the potential to generate significant revenue for the Fire Department. Any revenue generated by use of this equipment, net of associated expenses, could be used to increase reserves and replace aging Fire Department equipment in future years.
Pursuant to the Joint Powers Agreement (JPA) between the City of Bishop and the Rural Fire Protection District, the total cost would be split evenly between these two entities. Execution of a purchase would be contingent upon approval from both parties of the above referenced JPA, as well as adherence to all applicable code/policy relating to purchasing.

Increase of spending approval within capital expense account 001-021-56028 (Capital Improvement) in the amount of $75,000.00.
Legal Review:
City Attorney Pucci has reviewed this item and finds that the recommended action complies with the law.
