STAFF REPORT
Background/History:

On March 24, 2025, the California Department of Forestry and Fire Protection (CAL FIRE), through the Office of the State Fire Marshal, issued updated Fire Hazard Severity Zone (FHSZ) maps for Local Responsibility Areas (LRAs) pursuant to Government Code section 51178. These maps classify land in LRAs into Moderate, High, or Very High Fire Hazard Severity Zones based on fuel loading, slope, fire weather, and other relevant factors.

The LRA map for the City of Bishop for adoption is attached to this report and can be found on the City's Website on the Fire Department's webpage at:
https://cityofbishop.ca.gov/departments/fire/index.php
Analysis/Discussion:

Under Government Code section 51179, cities and other local agencies are required to adopt the State’s FHSZ recommendations for LRAs within 120 days of receiving them. Government Code section 51179(b)(3) prohibits any local agency from decreasing the severity of the zones as identified by the State Fire Marshal. The City cannot, for example, re-designate a very high severity zone to a high or moderate severity zone. However, the City may designate a more severe classification if the Council makes findings supported by substantial evidence justifying the upward redesignation.

Designation as a “Very High Fire Hazard Severity Zone” (VHFHSZ) imposes requirements on property owners within those zones. Key requirements include:
• Defensible Space: Property owners must maintain 100 feet of defensible space around occupied structures (Government Code § 51182).
21 • Building Code Compliance: New construction in VHFHSZ must meet ignition-resistant building standards, including ember-resistant vents, non-combustible roofs, and tempered glass windows (California Building Code Chapter 7A).
• Notice to Buyers: Sellers must disclose to potential buyers when a property lies within a designated VHFHSZ (Government Code § 51183.5).

Economic Impacts:

There is currently no known economic impact associated with the adoption of this ordinance.

Budget Impacts:

There is no immediate fiscal impact associated with adoption of this ordinance. However, designation of fire hazard severity zones will result in increased enforcement burden. Being a volunteer agency, our Fire Department has limited personnel to proactively enforce defensible space requirements. The Fire Chief is currently working with CAL FIRE for assistance in addressing compliance and enforcement challenges.

Legal Review:

City Attorney Pucci has reviewed this item and finds that the recommended action complies with the law.

Recommended Action:

Council to conduct a public hearing and approve the first reading and introduction of an ordinance designating Fire Hazard Severity Zones within the City of Bishop in accordance with Government Code section 51179, incorporating the Fire Hazard Severity Zone (FHSZ) Map issued by the State Fire Marshal entitled “City of Bishop – Inyo County Local Responsibility Area Fire Hazard Severity Zones as Identified by the State Fire Marshal March 24, 2025” by title only.

71 Agenda Item: 10.C
Date of Meeting: May 12, 2025
Department: Police
To: City Council
From: Ethan Aukee
Subject: Police Department Budget Adjustment Request
Prepared On: April 29, 2025

STAFF REPORT
Background/History:

The Police Department and Finance Department were conducting routine review of the Police Department's budget and identified operating expense accounts that will not be fully utilized during FY 2024-25. When assessing the lack of use, a buffer was added to the analysis of each account to ensure that adequate budgets are available for the remainder of planned spending during the FY.

In order to utilize previously approved spending in a manner that best serves both the operational needs of the Bishop Police Department and the safety and well-being of the community, City staff is recommending the reallocation of $19,744.33 from multiple Police Department operating expense accounts to account 001-020-52018 (Police Department – Special Department Supplies).

If approved, these funds will be used to upgrade critical police department equipment in alignment with modern law enforcement practices and regulatory compliance standards. This proposed reallocation is consistent with the City of Bishop’s Strategic Plan, which prioritizes modernization of public safety services and investment in up-to-date resources to ensure efficient and effective policing.

We respectfully request consideration and approval of this reallocation to support the continued advancement of public safety in our community.

Analysis/Discussion:

This budget adjustment proposal is spending neutral. The intention is to reallocate prior approved spending, not to increase overall spending. The goal is to ensure effective and efficient use of existing budgeted funds without incurring additional costs, while also maximizing the utilization of the department’s overall approved budget.

Economic Impacts:

No significant economic impacts.
72 Budget Impacts:

This budget adjustment does not increase overall City spending in FY 2024-25. The detailed reallocation is as follows (All accounts are Police Department operating expense accounts):

Increase
001-020-52018 (Special Department Supplies) 19,744.33
Decrease
001-020-52006 (Recruitment) (1,412.24)
001-020-52009 (Training) (6,417.73)
001-020-52012 (Office Supplies) (1,011.37)
001-020-52013 (Communications) (2,096.43)
001-020-52014 (Meetings & Travel) (4,078.39)
001-020-52015 (Professional Services) (1,925.28)
001-020-52019 (Misc. Dues & Subscriptions) (1,464.06)

Subject: Second Reading and Adoption of an Ordinance to Amend Section

2.24.020 of the Bishop Code of Ordinances, Relating to the Planning Commission
Prepared On: May 6, 2025
Attachments: Ordinance - Relating to the Planning Commission

STAFF REPORT
Background/History:

The Bishop City Planning Commission currently consists of seven members appointed after nomination and approval by a majority vote of the City Council. Members are not required to live in the city. California law allows a city planning commission to consist of five members living inside the city. This ordinance would reduce the Commission to five and require that members live in the city. The resolution would make corresponding changes to the Council Standards and Procedures Manual, which would become effective on the effective date of the amendment.

Analysis/Discussion:

The aim of this amendment is to seat a Planning Commission drawn from residents of the City of Bishop.

The ordinance would achieve this aim by amending Section 2.24.020 of the Bishop Code of Ordinances. The amendment would reduce the number of commissioners from seven to five.

The amendment would also add language requiring planning commissioners to reside inside the city limits of Bishop. As currently enacted, Section 2.24.020 specifies “[i]n making appointments to the commission, the city council shall endeavor to appoint the best members to the commission whether or not such persons are residents and citizens of the city. 74 The resolution would make corresponding changes to the Council Standards and Procedures Manual.

On April 28, 2025, the City Council held a public hearing and approved the first reading and introduction of the proposed ordinance by title only.

On April 28, 2025, the City Council also approved the proposed resolution that would make the corresponding changes to the Council Standards and Procedures Manual to be effective on the effective date of the proposed ordinance.

Economic Impacts:

This amendment will not result in economic impacts to the city.

Budget Impacts:

This amendment will not result in any substantial budget impacts.

Legal Review:

City Attorney Pucci has reviewed this item and finds it complies with the law.

Recommended Action:

Council consideration to approve the second reading and adoption of the proposed ordinance by title only.

Agenda Item: 11.A
Date of Meeting: May 12, 2025
Department: Public Works
To: City Council
From: Nora Gamino
Subject: First Reading and Introduction of an Ordinance Amending Title 13 of the Bishop Municipal Code – Water and Sewer Service Regulations Prepared On: May 6, 2025
Attachments: Ordinance No. XXX Update to Title 13 Water and Sewer Ordinance 2025 05 12

STAFF REPORT
Background/History:

The City of Bishop periodically reviews its municipal code to ensure that provisions are current, consistent, and support efficient public service delivery. Staff has identified several areas of Title 13 (Public Services) that require update or clarification to ensure orderly, efficient, and cost-effective administration of the City's water and sewer services. The proposed amendments include:

Limiting properties to one water and one sewer connection per parcel to reduce redundancy.

Updating terminology to reflect current job titles (e.g., replacing “public works supervisor” with “public works superintendent”).

Clarifying responsibilities between the Public Works and Finance departments.

Ensuring that all food service establishments are required to install and maintain functioning grease interceptors.

Prohibiting the use of garbage grinders in restaurants and commercial food establishments.

Repealing outdated provisions regarding annual payment discounts.

Clarifying billing practices related to backflow testing.

The changes are administrative in nature and do not affect service levels or rates.

Analysis/Discussion:

Several sections are being revised to align terminology with current staffing titles—specifically, replacing references to the “public works supervisor” with “public works superintendent.” This change ensures that the municipal code accurately reflects the City’s organizational structure and current job titles.
81 New sections are proposed to limit each parcel to a single water and a single sewer connection. These changes are intended to eliminate redundant utility connections, which can lead to inefficiencies in maintenance, increased infrastructure costs, and complications in utility management. The ordinance also requires that each water service connection be separately metered. This requirement aligns with Senate Bill 552 (SB 552), which emphasizes the importance of water loss control and system efficiency as part of statewide drought preparedness efforts.

Water meters are a critical tool for promoting conservation and operational efficiency. By measuring actual usage, meters allow property owners to monitor consumption, identify leaks, and make informed decisions about water use. For the City, metering improves system oversight, enhances planning and forecasting, and supports targeted conservation efforts during drought conditions. These benefits contribute to the City’s long-term water reliability and compliance with state mandates for drought resilience.

The ordinance also repeals outdated provisions that allowed property owners to prepay their annual water and sewer charges in exchange for a 5% discount. While originally intended to reduce administrative burden, these provisions are no longer consistent with the City’s billing practices and now result in a measurable loss of revenue. Over the past four fiscal years, these discounts have averaged approximately $46,800 per year in foregone revenue. In addition, it costs the City an estimated $5,000 annually in staff time and administrative overhead to process these advance payment discounts.

Given that modern billing systems have streamlined monthly payment processing, the original justification for offering this discount no longer applies. Eliminating the discount will ensure fair and consistent billing, simplify administration, and help preserve revenue needed for ongoing utility operations and infrastructure investments.

The ordinance strengthens the City’s requirements for grease interceptors by explicitly requiring their installation and maintenance at all food service establishments and other commercial or industrial facilities that discharge fats, oils, or grease. This update provides clearer enforceability and better protects the City’s sewer infrastructure from blockages and costly maintenance issues.

Additional changes include:

Clarifying that testing fees for backflow preventers are billed separately from regular utility bills, rather than being included in bi-monthly billing.

Revising language to prohibit the use of garbage grinders in commercial food establishments, simplifying enforcement of existing waste discharge controls.

Minor editorial corrections to align with existing City policies and practices.

These updates are administrative and regulatory in nature and are not expected to affect service levels or impose new costs on utility users. The ordinance provides the City with clearer authority and improved tools to manage its utility systems effectively.

Economic Impacts:

There is no direct economic impact associated with this ordinance. The amendments streamline administrative procedures and reflect current City operations.

Budget Impacts:
82 Repealing the 5% advance payment discount is expected to increase annual water and sewer revenue by approximately $46,800 and reduce administrative processing costs by an estimated $5,000, resulting in a total fiscal benefit of nearly $51,800 per year to the City’s water and sewer funds.

Legal Review:

City Attorney Pucci has reviewed this item and finds that the recommended action complies with the law.

Recommended Action:

Council consideration to approve the first reading and introduction of the proposed Ordinance amending Title 13 of the City of Bishop Code of Ordinances relating to water and sewer service regulations, by title only.

Subject: Letter Proposal to Provide Environmental Consulting Services for the Proposed LADWP Training Facility Project
Dear Ms. Budnyk:

HELIX Environmental Planning, Inc. (HELIX) holds a design professional service agreement for as needed, on-call environmental consulting services with the City of Bishop (City) valid though June 1, 2027. We have been asked by the City to provide environmental consulting services for the proposed Los Angeles Department of Water and Power (LADWP) Training Facility located in the Laws neighborhood of City. The project is proposed by LADWP as the landowner of the subject parcels.

LADWP proposes to develop the project site, consisting of three parcels, into an indoor/outdoor training facility in support of existing LADWP water service operations. The four subject parcels are identified as APNs 10-480-06, -07, -10, and -11 consisting of a total of approximately 44.9 acres. The subject parcels consist of the following City of Bishop General Plan Land Use Designations and Zoning: Industrial (M-1); General Commercial (C-H); Parks/Open Space (O-S); and Office and Professional (O-P). Access to the subject parcels would be located on Wye Road east of Spruce Street and from U.S. Highway 6 north of Wye Road. The project site is bisected by the Bishop Creek Canal flowing in a southeasterly direction.

We understand that the proposed LADWP Training Facility would include the following elements: outdoor training area; indoor training facility; high-bay training area; warehouse fleet shops; fleet maintenance yard; multiple water equipment shops; water construction headquarters building; water construction equipment storage facility; covered/uncovered surface parking lots; landscape improvements; security fencing and access control; and a vehicular bridge spanning Bishop Creek Canal.

Project entitlement requires approval of a rezone application by the City along with compliance with the California Environmental Quality Act (CEQA). Accordingly, the City shall be identified as Lead Agency while City of Los Angeles shall be a responsible agency under CEQA. Regulatory 100

permitting would likely be triggered for the potential impacts associated with the proposed bridge.

HELIX understands that LADWP will undertake technical studies (e.g., biological resource assessments, aquatic resource delineation, cultural resource assessment, etc.) in support of the proposed project. LADWP and/or their consultants will also prepare a CEQA Initial Study (likely leading to a Mitigated Negative Declaration) with the City identified as the Lead Agency. Per the City’s request, HELIX has prepared this scope of services to assist City staff with entitlement processing of the proposed project, including a peer review of the Initial Study on behalf of the City, as well as attendance at project team meetings.

SCOPE OF SERVICES
Task 1: CEQA Initial Study Peer Review
HELIX will conduct a peer review of the administrative draft Initial Study as prepared by LADWP.

The Initial Study shall identify the City as the CEQA Lead Agency and LADWP as a responsible agency under CEQA. Referenced and/or appended technical studies are excluded from this peer review. The Initial Study shall be transmitted electronically to HELIX in Microsoft Word™ format.

HELIX will provide comment on the Initial Study in track changes mode. Comments may be open-ended in nature and/or direct LADWP to make specific changes to the document. HELIX assumes all edits will be accepted and open-ended comments addressed to the City’s satisfaction. LADWP shall be responsible for any additional data collection and/or analysis needed per the recommended edits. HELIX has allocated a total of 60 hours of labor by the project manager and environmental planner for this task.

Deliverable. Initial Study peer review in track changes mode and transmitted electronically to City of Bishop/LADWP.

Task 2: Coordination Meetings
HELIX will staff a total of five coordination meetings with the City, LADWP, and the larger project team throughout the life of the project. Meetings shall largely consist of discussion of project schedule, roles and responsibilities of the City/LADWP and/or other regulatory entities, scope and extent of technical study required to support the CEQA document, and other miscellaneous project logistics. HELIX shall advise the City as to CEQA compliance recommendations and land use entitlement processing before, during, or after the meetings.

Meeting attendance shall be virtual (MS Teams or Zoom); no deliverables are associated with the task. HELIX has allocated a total of 40 hours of labor by the project manager and environmental planner for this task.

Deliverable. N/A
101
Letter Proposal to Ms. Anastasiia Budnyk Page 3 of 4
November 1, 2024
Task 3: Tribal Consultation under CEQA (AB 52) Support Services The Initial Study for the proposed project shall be prepared by LADWP; however, the City is required to undertake tribal consultation under CEQA (formerly known as Assembly Bill 52 tribal consultation) with the three tribes that have requested said consultation with the City:

Bishop Paiute Tribe; Big Pine Tribe; and Cabazon Band of Mission Indians.

HELIX will support the City with preparation of tribal consultation invitation letters to be transmitted to the tribes via certified mail on City letterhead. HELIX will maintain the administrative record of tribal consultation and provide LADWP with the results upon termination of formal consultation; the administrative record shall be integrated into and/or appended to the draft Initial Study prior to circulation for public comment. HELIX attendance at on-site project meetings, if requested by the tribe(s), is not included. Requests for additional consultation services beyond the initial 30-day invitation period and/or for preparation/ dissemination of project information beyond any technical information prepared by LADWP in support of the proposed project is excluded from this task. HELIX has allocated a total of 24 hours of labor by the environmental planner in support of this task.

Deliverable. Compilation of the administrative record for formal tribal consultation under CEQA (assumed to be the initial 30-day invitation period).

ASSUMPTIONS AND LIMITATIONS
The following assumptions and limitations are a material component of this proposal. • The City/LADWP shall provide HELIX with current available digital baseline data and project plans for producing all maps and graphics, which should be submitted in one of the following formats: .dxf, .dwg (AutoCAD), .shp (ArcView shapefiles), .gdb (ArcGIS geodatabase) or .kmz (Google Earth). In some cases, .pdf files will be acceptable. • LADWP shall provide technical analysis or any other information necessary to adequately address environmental topics per Appendix G of the CEQA Guidelines as required/requested by the City and as related to the engineering design of the project. • HEILX assumes the three tribes shall not request formal consultation under CEQA beyond the 30-day invitation period. Additional tribal consultation support services can be provided with additional authorization by the City.
• Requested revisions to the Initial Study, including additional data collection and/or analysis, shall be undertaken by LADWP to the satisfaction of the City. Our scope of services includes one-round of peer review of the administrative draft Initial Study. 102
Letter Proposal to Ms. Anastasiia Budnyk Page 4 of 4
November 1, 2024
