Subject: ORDINANCE - Second Reading and Adoption of an Ordinance Relating to Regulating Electric Mobility Devices
Prepared On: August 6, 2025
Attachments: E Mobility Device Ordinance - with Revisions
STAFF REPORT
Background/History:
Electric mobility devices—including electric bicycles, electric scooters, and electrically motorized boards/skateboards—have become increasingly popular in Bishop as environmentally responsible transportation alternatives for residents and visitors. However, with this popularity comes public safety concerns, as operators of these devices face higher injury risks than traditional riders, and accidents involving motor vehicles result in more serious injuries and greater property damage.
Analysis/Discussion:
The proposed ordinance establishes a regulatory framework that balances safety with transportation accessibility while respecting state law limitations. The ordinance incorporates all California Vehicle Code requirements and exercises local authority only where permitted.
Key provisions of the ordinance exercising local authority include the following:
· Sidewalk Operations: Class 1 and 2 e-bikes and motorized boards are permitted on sidewalks at speeds not exceeding 5 mph, except near schools during school hours, places of worship during services, and parks during events. Class 3 e-bikes and e-scooters are prohibited on all sidewalks except when entering or leaving adjacent property. · Speed Limits: 15 mph maximum on bicycle paths; posted limits in bicycle lanes. 25 · Parking: Devices must be parked upright without obstructing traffic, walkways, or accessibility features.
· Prohibited Locations: Devices are prohibited wherever bicycles are prohibited and where designated by City Council resolution due to safety hazards.

STAFF REPORT
Background/History:
Over the past several years City Council and City Staff have discussed the structural issues and varying other issues with the Chamber of Commerce / Visitor Center. In May of 2024 at the City's annual Strategic Planning meeting it was discussed thoroughly. About 2 years ago the City and the Chamber starting collaborating on finding a new location for the Chamber.
One such idea was trying to lease the old Mo-Mart property (empty lot to the north of Holy Smokes Texas Style BBQ) This option unfortunately did not work out. The Chamber has continued to pursue other options.
On June 4, 2025, I met with Bishop Area Chamber of Commerce and Information Center Executive Director Tawni Thomson and delivered to her a Notice to Vacate the building by October 30, 2025.
Also on July 28, 2025, Willdan Engineering, an independent third party company that provides building inspection services, performed an inspection of the Chamber building. The results of this inspection found that all additions that came after the A-frame were in an unstable condition and therefore a Red Tag was placed on those portions of the building.
Analysis/Discussion:
As part of the Red Tag, a further assessment of the building was suggested. A structural engineer will be needed to do this assessment. I contacted Wood Rodgers Incorporated, who has structural engineers on staff, to get a quote for the assessment. See attached quote. The cost for services $20,285 is below the spending authority of the City Administrator and does not need City Council approval. The assessment will be two separate tasks: 1. To assess the full repair of the building; and 2. Can the A-frame remain if all additions are removed? 32 Recommended Action:
Council to discuss and give Staff direction.

Project elements include, but are not limited to:
Perform a site observation to assess the condition of the existing building structural gravity and lateral force resisting system. The intent of the structural assessment technical memorandum is to determine the general condition of the structural framing and foundation. Provide a qualitative rating description of the deficient members and make recommendations of portions of the building that might remain in service.
B. SCOPE OF SERVICES
The project scope of the services for the full project is listed below by tasks.
Task 1 – Project Management & Meetings
For this task, we will perform the following:
Initiate a virtual (MS Teams or equal) Kick-Off Meeting to discuss the City’s goals and needs for the Project.

Round trip mileage to the project site (530 miles plus/minus) and fee for one night of a hotel room are included in the fee for this task. One (1) Wood Rodgers Engineer will perform one (1) site observation and will observe the readily accessible portions of the existing structure. During the site observation, the Wood Rodgers Engineer will use the Thoedolite iPhone application to photo document areas of visible structural deficiencies and locations. Take measurements of possible structural member net section losses for qualitative rating descriptions. No destructive or non-destructive testing will be performed. No existing finishes will be removed to access or expose structural elements.
Wood Rodgers will review and process photos and observation notes. The photos will be numbered and shown on a site map based on the photograph GPS data. The photos and the schematic existing building diagram will be documented in the appendix section of the structural assessment technical memorandum.

1. Introduction
This report documents findings from a life-safety inspection of the Chamber of Commerce Building, conducted on behalf of the City of Bishop Department of Building and Safety. The building consists of:
- North Section: An original A-frame structure, which includes a checkout counter and retail sales area.
Exterior restrooms are attached but currently closed due to disrepair. - South Expansion Area: A later addition constructed over a stream maintained by LADWP, which flows west to east along the southern side of the building.
It is noted that at the time of its construction, the southern expansion was likely in full compliance with required setbacks from the water’s edge. However, over the years, ongoing erosion has caused the stream to encroach directly against the structure, significantly compromising its foundation integrity.
2. Hazard Conditions
- The expansion area (southern portion) is constructed on pier-and-beam framing with a concrete masonry unit (CMU) perimeter wall.
- Currently, approximately 60% of the cantilevered portion of the foundation has been undermined by the stream’s erosion.
- The watercourse now directly abuts the CMU foundation wall, putting the structure at imminent risk of collapse due to:
- Loss of bearing support
- Soil displacement and scouring
- Unstable footings
40 City of Bishop Department of Building and Safety
3. Recommendation
It is my professional opinion that:
- The southern expansion area is unsafe for occupancy and must be immediately evacuated. - A Red-Tag Order should be issued for this portion of the building due to the structural risk posed by stream undermining.
- A full structural evaluation must be conducted by a California-licensed Structural Engineer or Architect to assess safety and remediation options.
4. Building Status Summary
Building Portion Status Reasoning
A-frame (North) Occupancy Permitted Not affected by erosion; no structural deficiencies
observed.
Expansion (South) Red-Tag Recommended Stream erosion has undermined foundation;
structure unsafe for
occupancy.
5. Code Authority and Enforcement
This recommendation is based on the following provisions:
- CBC §116 – Unsafe Structures and Equipment
- California Health and Safety Code §17920.3 – Substandard Buildings - CBC §105 – Permits Required (future repair work)
- City of Bishop Municipal Code and applicable ordinances The City of Bishop Building Department shall post a Red-Tag Notice and require immediate evacuation of the affected area. No re-occupancy shall occur without structural clearance and proper permits.
6. Next Steps
- Red-Tag Order: To be posted for the expansion area (southern portion). - Evacuation: Immediate removal of all occupants from the red-tagged area. - Engineering Evaluation: Submit stamped report from a licensed engineer/architect within 15 calendar days.
- Permit Process: Any future structural remediation requires a full permit review through the City of Bishop.
- Monitoring: City officials will continue to monitor the condition pending further assessment and remediation.
