Agenda Item #: 5
Date: August 28, 2025 For Meeting Of: September 9, 2025 Subject: Set Date for Special Municipal Election for the Recall of One Council Member Position.
Recommended Action: That the City Council:
1. Discuss and Issue a Call to Set a Special Municipal Election Date; and
2. Determine Voting Method Preference; and
3. Authorize Use of Prasch Hall at No-Charge to Humboldt County Registrar of Voters For In-Person Voting
4. Approve Resolution No. 1240 Calling a Special Municipal Election for the Proposed Recall of Councilmember Scafani
SUMMARY:
At their August 27, 2025 meeting, City Council members voted unanimously to approve Resolution 1239 to “Certify the Sufficiency or Insufficiency of Recall Petitions Seeking Removal of Councilmembers Napier, Sawatzky and Scafani and continued the discussion to set a municipal election date to their special meeting of Tuesday, September 9th.
The Council must now: 1) Council select a Tuesday between December 9th and January 12th for the election 2) determine whether to conduct the elections entirely by mail or with a polling place in addition to mailed ballots. Council is also asked to 3) request that the Humboldt County Registrar of Voters perform full services to the City relating to the conduct of a Special Municipal Election, and 4) waive rental charges for use of Prasch Hall as a voting location.
DISCUSSION:
Proposed Election Dates

With the decision to consider the item on September 9th, available Tuesday dates between December 6th and January 12th are:
• Tuesday, December 9 - Preferrable
• Tuesday, December 16- Preferrable
• Tuesday, December 23 – Not recommended as it is two days prior to Christmas • Tuesday, December 30 - Not recommended as it is two days prior to New Year’s Day • Tuesday, January 6, 2026
The Humboldt County Registrar of Voters recommends Council select either Tuesday, December 9th or 16th for the Special Municipal Election
Voting Method and Location
Given the number of registered voters in the City of Blue Lake (less than 1,000), California Elections Code Section 4000 allows for the possibility of conducting the election as an all-mailed ballot election.
This option is available when the recall is not consolidated with a regularly scheduled election. The decision to conduct the election entirely by mail is subject to legal review and must comply with notice, accessibility, and voter service requirements
Alternatively, the Council could call an at-the-polls election, which would still involve mailing ballots to all registered voters but, in addition to accepting ballots by mail, the County Elections would staff at least one polling place at which voters could vote in person (or return mailed ballots) on election day.
Staff recommends the combination of mail-in and in-person voting. Further, to reduce some cost, staff recommends the City Council waive the Prasch Hall rental fee to the County of Humboldt’s Registrar of Voter’s office.
Additional Information
The recall ballot will include only one question: "Shall Elise G. Scafani be recalled (removed) from the office of Blue Lake City Council Member?" (Elections Code Section 11382, and 11320).
Unlike prior elections, instead of holding a simultaneous election for successor, State law amended in 2023 now provides that if a recall is successful, a vacancy is created in the office that shall be filled according to standard City vacancy procedures through either a City Council appointment or by a subsequent special municipal election. If the incumbent resigns or otherwise vacates the office, the recall election still proceeds in per Elections Code Section 11302.
FISCAL IMPACT: The County provided estimate for the Special Municipal Election is anticipated to be between $10,000 to $12,000 (or more), and is the City’s sole responsibility to cover. Staff recommends Council approve funding in an amount not to exceed $15,000 inclusive of contingency of $3,000 for unforeseen cost. This cost has not been budgeted. 4 Agenda Item: 5
Submitted By: Jill K Duffy, Interim City Manager
ALTERNATIVES:
1. Not to set a date certain. This is not recommended as the County Registrar of Voters will be required to set the Special Election date.

Agenda Item #: 6
Date: September 3, 2025 For Meeting Of: September 9, 2025 Subject: Approval of Memorandum of Understanding with Redwood Coast Mountain Bike Association.
Recommended Action: That the City Council:
1. Discuss and Approve the Memorandum of Understanding with Redwood Coast Mountain Bike Association; and
2. Direct the Interim City Manager to Sign the Agreement; and
3. Other direction as appropriate.
SUMMARY:
The City Council is requested to discuss and approve the Memorandum of Understanding (MOU) between the City and Redwood Coast Mountain Bike Association (RCMBA) to formalize their role in fundraising, volunteer coordination and community outreach in support of the Blue Lake Bike Park.
DISCUSSION:
The Blue Lake Bike Park project kicked off in earnest in September of 2020 following the presentation by the City Manager on a conceptual bike park project. During the meeting of September 22, 2020, Council directed staff to 1) return with a site plan; 2) explore partnerships and funding options; and 3) that staff return to Council with a project proposal. At their meeting of June 22, 2021, a verbal update was provided to Council that the bike park project was in the design phase and being developed in partnership with the Redwood Coast Mountain Bike Association, Friends of Annie and Mary and the Humboldt Skate Collective.
The bike park project has generated significant community enthusiasm and support with financial and volunteer work hours committed towards this endeavor over the past three years. RCMBA is a local nonprofit organization and has been instrumental in these efforts, rallying support and coordinating volunteers to advance the project.
Staff recommends formalizing the group’s role through an MOU to ensure accountability, transparency and collaboration related to fundraising, project completion, long-term maintenance of the facility, insurance coverage and access to the City property for public use. Additionally, the agreement assists with compliance with City Resolution 1077 pertaining to donation management.

General Counsel Ryan Plotz has reviewed and approved as to form this draft MOU and the draft agreement is under review by Erike Young of the California Insurance Risk Authority (CIRA), a statewide joint powers authority that provides risk management and insurance coverage services to the City.
FISCAL IMPACT: None with this action.
ALTERNATIVES:
The City Council could choose not to approve recommendation and provide direction to staff as determined appropriate. This is not recommended as development of the bike park requires the participation and support of the biking and skating community – their involvement is essential for the success of this project.

Recommended Action: That the City Council:
1. Receive update from City Manager Recruitment Adhoc Committee Members Members Scafani and Napier; and
2. Receive draft City Manager Brochure Content, as presented; and
3. Discuss and Establish Salary Range for Position of City Manager; and
4. Consider Amendment of Recruiter’s Scope of Services Agreement for Recruitment efforts.
5. Other direction as appropriate.
SUMMARY:
The City Council is requested to receive the draft Recruitment Brochure as presented for the City’s recruitment for City Manager, to discuss and establish a salary range for the position of City Manager and consider amending the recruitment scope of services with Tripepe Smith.
DISCUSSION:
In May of 2025, the prior City Manager and City Council mutually agreed to separate ways. At their regular meeting of June 24th the Council secured the recruitment services of Christine Martin of Tripepe Smith to 1) develop a candidate profile, 2) marketing materials, 3) outreach and recruitment, and 4) evaluation and screening of candidates. During this presentation, Council acknowledged they would have the opportunity to approve publication materials.

Proposed Steps and Timeline:
The proposed steps and timeline will be presented at the meeting.
Discuss and Establish Salary Range
In May of 2025, Council approved a proposed salary range for the Acting City Manager position at $96,000 to $106,000 annually. While this range aligns with some comparable salaries within our local context, it is notably lower than those cities within Humboldt County. A review of neighboring cities— Fortuna, Arcata, Rio Dell, and Ferndale—indicates that their top-end salaries for similar roles vary significantly, with an average (excluding Eureka, which offers the highest) of approximately $150,015.
Specifically, Rio Dell’s top salary is around $135,555, and Fortuna’s is approximately $164,800.
The goal is to balance a competitive salary range with a compelling overall compensation package that will attract qualified, experienced candidates capable of leading the City of Blue Lake effectively.
It is important to consider that adjusting the salary range upward could enhance our competitiveness and attract highly qualified candidates. However, such an increase will represent a significant leap from past salary practices in Blue Lake. In addition to salary, a total compensation package could also include various benefits and incentives (e.g. relocation assistance, vehicle allowance, additional time off etc.) to make the position more appealing and enhance the City’s attractiveness, and demonstrate our commitment to supporting our future City Manager.
Discussion of Possible Amendment of Scope of Services with Tripepe Smith The Ad Hoc Recruitment Committee recommends that Council consider proposes to amend the existing agreement with Tripepe Smith to include the following expanded scope of services. • Conduct personal interviews with top candidates to assess skills, background, experience, and interpersonal skills, using either City-preferred questions/criteria or the existing framework. • Notify non-selected candidates that they are no longer in consideration. • Assist the City Council in negotiating employment terms with the preferred candidate. • Conduct education, DMV, background, and credit checks on the final candidate. • If the selected candidate resigns or is terminated for cause within one year, Tripepe Smith will perform a follow-up search at no additional consultant cost.
FISCAL IMPACT: To be determine due to being unknown at the time of report preparation.

About the City of Blue Lake
Tucked away in the heart of Humboldt County’s Mad River Valley, the City of Blue Lake offers a truly distinctive small-town lifestyle surrounded by some of Northern California’s most breathtaking natural landscapes. With just over 1,200 residents, Blue Lake is a place where neighbors know one another, community spirit runs deep and life moves at a pace that balances work and play.
What sets Blue Lake apart is its prime location. Just five miles inland from the foggy coastline, the City frequently enjoys clear skies and sunshine, making it a haven for those who thrive outdoors or garden at home.
The Mad River, also known as Baduwa’t, skirts along the edge of town, providing access to fishing, rafting and kayaking, while surrounding timberlands and mountain trails attract cyclists, hikers and runners. The region reflects Blue Lake’s roots as a former timber town and its ongoing connection to agriculture. Nearby Korbel hosts a working lumber mill, a nod to the area’s logging heritage, while the surrounding countryside is dotted with family-run farms raising cattle, sheep and organic produce — all of which contribute to the area’s distinctive rural character. Within a short drive, residents can find themselves among the towering redwoods, at the Pacific Ocean’s edge or even skiing to the east in the winter months, a true outdoor lover’s paradise.
Beyond its physical beauty, Blue Lake is also known for its cultural vibrancy, deeply rooted in the heritage of the indigenous communities of the region. The world-renowned Dell’Arte International School of Physical Theatre anchors a creative community that draws artists, performers and audiences from around the globe. Seasonal festivals, street fairs and live performances fill the City throughout the year, while local landmarks like the Blue Lake Museum and historic downtown preserve its rich heritage. Community facilities such as The Mad River Grange, Perigot Park and Victor Prasch Community Hall provide gathering places for everything from youth sports to concerts, skating nights and potlucks.
Despite its rural setting, Blue Lake is conveniently located near the larger cities of Arcata, Eureka and the community of McKinleyville, bringing proximity to Cal Poly Humboldt, shopping and regional connections.
Whether you’re drawn to its nature, culture or welcoming spirit, Blue Lake is a place people love to call home. 19 Working for the City of Blue Lake

Agenda Item #: 8
Date: September 3, 2025 For Meeting Of: September 9, 2025 Subject: Review of Outstanding Vendor Obligations and Fiscal Oversight Recommended Action: That the City Council:
1. Receive a Report regarding unbudgeted and unauthorized vendor payment obligations incurred in Fiscal Year 2023-24 and 2024-25; and
2. Provide direction to staff on payment authorization; and
3. Other direction as appropriate.
DISCUSSION:
Background
During a recent review of the City’s accounts payable and outstanding invoices, staff identified unbudgeted and/or unauthorized financial obligations without Council authorization, including the following:
1) Approximately $131,040 in outstanding vendor invoices associated with the Blue Lake Bike Park; and
2) A total of $81,678 in donations (cash) received between 2021 through 2025, with approximately $50,000 received over the identified thresholds for the bike park that were not processed in accordance with Resolution 1077 requirements which mandates that any donation exceeding established thresholds, particularly those designated for a specific purpose, must be formally accepted by City Council. The received donation funds have been expended on bike park related expenses.
Payments for these obligations will require, among other things, budgetary adjustments for the applicable fiscal year’s activity, and formal project and expense approval to ensure compliance with procurement and contracting policies.
A list of invoices and donations received above the threshold will be presented at the meeting.

Staff recommends that the Council:
1. Review the identified vendor obligations and consider directing staff to determine accuracy of the invoices, services performed and schedules for payment. In some cases, vendors may need to submit additional supporting documentation or other verification for the submitted invoice.
This may include prior written authorization from a City representative to proceed.
2. Direct staff to identify a financial plan addressing payment sources and a phased funding approach for the bike park project.
3. Review and update internal controls and procurement procedures to ensure:
a. Donations exceeding the established threshold receive formal Council acceptance; and b. No project expenditures are incurred without explicit Council authorization.
4. Direct staff to return to Council with a proposed pathway for the bike park project to facilitate informed discussion and direction to enable successful completion.
FISCAL IMPACT: No fiscal impact for receiving report.

DISCUSSION:
The Regional Transportation Improvement Program (RTIP) is a short-range planning document that identifies and implements the priorities in a region’s long-range transportation plan. In Humboldt County, implementation of the RTIP fund allocation is performed by the Humboldt County Association of Governments (HCAOG)
The City of Blue Lake Truck Route Project, identified in the 2017 regional transportation plan, was funded through the State Transportation Improvement Plan (STIP) to improve the existing truck route along Greenwood Ave and Hatchery Road over two phases into a multi-modal transportation corridor by implementing road rehabilitation measures, traffic calming measures, and various pedestrian and bicycle improvements: 1) Phase 1 – The Greenwood Avenue Phase, was completed in 2024; and 2) Phase 2 proposes to complete the remaining portion of the truck route from the intersection of Greenwood Avenue and Railroad Avenue to the Hatchery Road bridge.
The City is currently pursuing STIP/RTIP funding to construct Phase 2, the Railroad Avenue-Hatchery Road Phase of the project, from the 2026 RTIP in the amount of $2,768,000.00. This phase would construct improvements on the remaining portion of the truck route from the intersection of Greenwood Avenue and Railroad Avenue to the Hatchery Road bridge.

Submitted By: Jill K Duffy, Interim City Manager
Agenda Item #: 10
Date: September 4, 2025 For Meeting Of: September 9, 2025 Subject: Second Street Pedestrian Bridge Repair – Approve Change Order Recommended Action: That the City Council:
1. Approve Change Order for the Second Street Pedestrian Bridge Repair in an amount not to exceed $15,000; and
2. Authorize the reallocation of TDA funds, as requested.
3. Other direction as appropriate.
SUMMARY:
To approve a change order in the amount of $13,711 for additional repair work required on the Second Street Pedestrian Bridge after the discovery of more extensive dry rot than initially anticipated. Given the critical role of the bridge in the community and the ongoing status of the repair, it is recommended that the change order be approved to ensure the completion of repairs and timely reopening of the route in an amount not to exceed $15,000.
DISCUSSION:
In the spring of 2025, the City Engineer was directed to assess the eastern footing of the 2nd Street wooden pedestrian bridge. Observations revealed settling at the southeastern approach and significant dry rot at the base of the glulam beams at the eastern footing. As the bridge serves as a primary pathway for community members and children using this bridge on the City’s Safe Routes to School immediate action was necessary to ensure the protection of public safety.
City staff solicited repair quotes from several local contractors in late March of 2025, including Kernan, Wahlund, and GRS. Kernan Construction Company was selected for the project due to their responsiveness, experience and availability. A contract was secured in an amount not to exceed $34,000 in early August 2025 for Kernan to commence the work, using plans prepared by SHN.
Upon initiation of the repair, further dry rot was detected, necessitating additional efforts and resources beyond the original scope of work. SHN provided guidance for expanded repair measures, and Kernan estimated the cost of additional work at $13,711 through the submittal of a change order.

36 Agenda Item: 10

FISCAL IMPACT:
Due to the unexpected increase in repair costs, SHN approached Humboldt County Association of Government (HCOAG) on behalf of the city for their consideration to redirect approved Transportation Development Act funds originally allocated for traffic calming measures at 2nd and G Street ($34,000) to cover the bridge repair expenses. This matter will be considered by HCOAG at their regular meeting in October.
ALTERNATIVES:
1. Not to authorize the Change Order. This alternative is not recommended for the following reasons:
• The project is currently mid-repair, and discontinuing work could lead to further deterioration of the bridge, potentially increasing future repair costs. • Immediate damage requires fixing to prevent safety hazards. • The Safe Routes to School pathway needs to be reestablished and reopened promptly to serve the community and ensure public safety.
