December 14, 2021
The December 14, 2021 meeting of the Blythe City Council was called to order at 6:00pm in the Council Chambers by Mayor Reynolds. Also in attendance were Vice Mayor DeConinck and Council Members Rodriguez, Halby and Burton. Staff in attendance included: Interim City Manager and City Clerk Crecelius, Finance Director and City Treasurer Elms, City Attorney Roberto, Chief Building Official Brown, Fire Chief Hasler and Police Chief Dale.
The Pledge of Allegiance was led by Mayor Reynolds.
The Invocation was offered by Councilman Burton.
REPORT FROM CLOSED SESSION: City Attorney Roberto stated as to items #1, #2 and #3, Council disused each item and provided direction. No action was taken.
PRESENTATION:
Recognizing the Palo Verde High School Varsity Football, Girls Golf, Volleyball and Cross County Teams for their Outstanding Athletic Achievements.
Mayor Reynolds welcomed the Palo Verde Yellow Jackets. You are here tonight to be represented for your outstanding sportsmanship, leadership and making the City of Blythe and Palo Verde Valley very proud of each of you. He asked the coaches of Varsity Volleyball, Cross Country, Girls Golf and Varsity Football to introduce their teams. The Girls Golf team had back- to-back IVL Championships. Hadly Phipps is the 5t or 6th person ever in PV history to get an individual league championship. Desiree Soto claimed 3rd in the individual tournament. The Girls Cross Country Team placed 9th and the boys placed 12th. The 2021/22 Yellow Jackets Varsity Football Team and Division 5 Football League Champions presented the City Council with a signed football. We are league champions for the first time in almost 50 years, and CIF Champions for the first time in history of the school. The State Champion bowl was awesome, but nothing takes away their championship. This is something they and the community will never forget.
Mayor Reynolds stated these guys started in flag-football playing for Kent Krisell and Richard Johnson. They worked their way up to champions due to great coaching starting with the head coach all the way down. We are looking for a repeat. We want to keep the momentum going. We thank you for coming. We appreciate you. Merry Christmas and have a prosperous new year. = CONSENT CALENDAR: Items on the Consent Calendar are considered routine and will be enacted with one motion of the Council. If any item requires individual consideration, it will be removed from the consent calendar and acted upon separately.

ORDINANCE NO. 911-21. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, AMENDING CHAPTER 17.08 AND ADDING A NEW CHAPTER 17.33 TO TITLE 17 (ZONING) OF THE BLYTHE
MUNICIPAL CODE REGARDING ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS FOR CONSISTENCY WITH STATE LAW REQUIREMENTS.
Councilman Halby said the four M16' are $15,000 a piece? Chief Dale said yes, they were purchased in 1975. Because they were purchased before gun laws changed in 1986, they are still eligible for sale at retail in other states, not California. They have this huge value, once we properly documented them.
Interim City Manager Crecelius stated this is a pretty good find on the Chief's part. He is basically outfitting the entire patrol staff with new equipment with junk he found in a closet. This is a great item for the City. We can trade in the surplus guns and outfit the department with new equipment.
No public comment. Vice Mayor DeConinck moved approval of the Consent Calendar. Councilman Halby seconded the motion with a unanimous aye vote.
PUBLIC HEARING:
Conditional Use Permit 2111-001, MT Construction. Interim City Manager Crecelius stated MT Construction proposes to remodel a hotel which has been vacant for several years into an apartment complex at 545 E. Hobsonway. Pursuant to the Blythe Municipal Code, a -23-
Conditional Use Permit is required to allow this use in a Commercial Zone. Earlier this year, the applicant applied for, and Council approved, a Zoning Text Amendment to allow for Multi- family Dwelling units in a General Commercial zone by way of a Conditional Use permit. This action was necessary to facilitate this project. The project site is suited for the proposed use, with other residential uses in the vicinity of this property. As the current state of the property is a vacant and dilapidated motel, the project will revitalize this site and enhance the surrounding neighborhood and the City's downtown. Parking, traffic, landscape, and public services have been addressed in the associated conditions of approval. The applicant has completed the PRC and accepted the project conditions. The City has determined the project is exempt from the provisions of CEQA pursuant to section 15332 of the CEQA Guidelines in that it can be seen with certainty that the activity in question will not have a significant effect on the environment. Before final approval of the Conditional Use Permit, the City Council shall make the following findings: That the proposed location of the conditional use is in accord with the objectives of this title and the purpose of the zone in which the site is located; that the proposed location in which the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity; and a Conditional Use Permit issued under the terms of Blythe Municipal Code Title 17.68 shall lapse if no improvements to the real estate concerned have been made, and the holder of the permit shall not have utilized it within one year from the date upon which such permit shall have been granted. Therefore it is recommended, subsequent to the Public Hearing, Council Adopt Resolution No. 2021-043 approving the Notice of Exemption prepared for Conditional Use Permit 2111-001 and Resolution No. 2021-044 approving Conditional Use Permit 2111-001, with conditions.
Councilman DeConinck asked representatives of MT Construction if they would be standard apartments, not for the homeless. It was reported they will be market rate. I have some other rentals here I have fixed up.
Councilman Halby asked what the layout would be. It was reported it would be a mix of studio and 1- and 2-bedroom apartments with a total of 40 units.
Public Comment. Mr. Goad of 617 Street 28" floor Colorado, 80202 stated he stays right next to this place and has spent probably 20 hours in the last 6 months cleaning up trash as it has been left as a pigsty. This faces three roadways. That is a lot of street parking. Have you done an analysis of parking? There is a problem in Blythe with people parking broken down vehicles along the roadway. I worry about the trash and MT Construction concerns me. I don't think I would get involved in this project financially. You should do your due diligence. I see someone putting a turkey together to sell to investors.
Dianna Todd, who owns property across the street asked if government funding is behind this.
She asked questions related to the developer, MT Construction. She asked if they could ever be used as government funded housing. I would like full disclosure from the developer. How is the City profiting from this?
Vice Mayor DeConinck stated all the City is doing is trying to clean up the property. Its an eyesore.
-24-
Interim City Manager Crecelius stated per the developer, they will be market rate housing, not subsidized housing.
Jill Madsen with High Times stated MT Construction is a very attentive contractor and has done great work tor us. Mr. Martinez is a very successful businessman outside of Blythe. He does do very good work and want to put that on the record. He is trying to clean up our town. Any help we can get should be welcomed.
Councilman Burton moved approval of staff's recommendation. The motion was seconded by Councilman Rodriguez with a unanimous aye vote.
RESOLUTION NO. 2021-043. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CONTAINING FINDINGS IN SUPPORT OF APPROVAL OF A NOTICE OF EXEMPTION FOR CONDITIONAL USE PERMIT 2111-001.
RESOLUTION NO. 2021-044. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE CONTAINING INDINGS AND CONDITIONS IN SUPPORT OF APPROVING CONDITIONAL USE PERMIT 2111-001 TO ALLOW THE USE OF A MULTI-FAMILY DWELLING ON A PARCEL DESIGNATED AS C-G (GENERAL COMMERCIAL).
Categorical Exemption- Colorado River Holdings, Inc. Commercial Cannabis Project. Interim City Manager Crecelius stated Colorado River Holdings, Inc. proposes to develop a cannabis facility on a 1.63 acre parcel located at 2881 W. Hobsonway. The proposed site is zoned Service Industrial which allows for the development of cannabis projects. The project site is level with little vegetation, and multiple existing industrial buildings that were previously used in an industrial gas distribution facility. The applicant proposes to develop the site in two phases. Phase I includes installation of an eight-foot- security fence, and renovation of four of the existing buildings totaling approximately 6,400 sq. ft. Phase II consists of the construction of two additional buildings totaling approximately 13,230 sq. ft. and extension of the rehabilitated building on the eastern portion of the property to add an additional 1,491 sq. ft.
Based upon information contained in the administrative record and review of the CEQA Guidelines, the City has determined that the Colorado River Holdings, Inc, cannabis project is eligible for a Class 32 Categorical Exemption. The project fits within the parameters included in CEQA Guidelines 15332 as an Urban Infill Exemption from CEQA as it meets each of the five criteria set forth in section 15332 of the CEQA Guidelines. Therefore, subsequent to the Public Hearing, it is recommended Council adopt a Notice of Exemption for the Colorado River Holdings, Inc. project located at 2881 W. Hobsonway and direct staff to file the Notice of Exemption with the County Clerk.
No public comment. Councilman Rodriguez moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.
CONTINUED BUSINESS:
Cannabis Dispensary License Conditionally issued to HAH 1, LLC. Interim City Manager Crecelius stated on November 19th Have a Heart satisfied all conditions of approval for their Dispensary project. A Certificate of Occupancy was issued the week of November 22nd. As such, staff recommends the monthly progress updates be removed from future agendas. -25-
Jill Madsen with High Times stated the tentative opening date is January 6, 2022. Thank you, we appreciate your patience. It's a process and we have learned a lot. I am glad we have finally made it to the finish line and can work together and generate revenue for our town.
Councilman DeConinck thanked Jill for getting involved and getting it done.
Direction was provided to staff.
NEW BUSINESS:
Issuance of a Commercial Cannabis Cultivation Permit to Green West Enterprises.
Interim City Manager Crecelius stated Michael Ganter of Green West Enterprises submitted an application for a Commercial Cannabis Cultivation business to be located at 1854 E.
Chanslorway. This site is zoned General Commercial which allows for the development of commercial cannabis structures on lots of at least 5,000 sq feet. In 2018, the City Council approved a Zone change for the subject property from Planned Development to General Commercial to allow the property owner to solicit commercial developments. In 2020, staff received a PRC Application from Cornerstone International Investment Group for conditions to construct a Commercial Cannabis facility. The PRC Conditions were issued, a Notice of Exemption was filed for the project and the Site Plan has been approved. The City's Engineer is reviewing the grading plans and has authorized the installation of the 8ft. perimeter wall.
Cornerstone International Investment Group is developing the facility to be leased to Mr. Ganter for his cultivation operation. Michael Ganter, CEO of Green West Enterprises has submitted the information required of the first three phases of the application process, including an in-depth interview with staff. Mr. Ganter completed the owner background investigation with nothing found to preclude him from being issued a Commercial Cannabis Permit. Therefore, staff recommended Council issue a Commercial Cannabis Cultivation permit to Green West Enterprises.
Councilman Halby stated they started building the perimeter wall, correct? Mr. Ganter stated the project before the Cannabis Permit was issued? I appreciate you Mr. Ganter for working with us and showing good faith. The last applicant said he was unable to do anything until the permit was issued.
Interim City Manager Crecelius stated most applicants do the build and cannabis permit process simultaneously. Most of them do not want to start building before the Cannabis Permit is issued but they at least go through the PRC process. If awarded, this will be the twenty fourth Commercial Cannabis Business Permit Council has-awarded since 2018.
Public comment. Mr. Ganter thanked the City. We are looking forward to being part of Blythe.
We have high hopes and going to see this thing through.
Councilman Halby moved approval of staff's recommendation. The motion was seconded by Councilman Rodriguez with a unanimous aye vote.
Purchase of two Fire Apparatuses through Equipment Financing by Lease Purchase. Finance Director Elms stated the City of Blythe Fire Department maintains a fleet of -26-
1 ladder truck, 3 pumper trucks and one squad truck to service the needs of the community. The Department's only ladder truck is a 1988 Pierce fire engine which though mandatory inspections has been deemed inoperable for its intended purpose. This leaves the department with no front- line ladder truck. Rescue and medical aids are the Department's highest level of calls for service.
Due to the age and design of the only squad truck in the fleet, the department is forced to respond to most of these calls in pumper trucks putting unnecessary wear on these engines. The Department's ladder truck has been in service over 30 years and the squad truck has been in service over 40 years. Both are well beyond their useful life per industry standard. Recognizing the high priority of having operable front-line vehicles for the Department to respond to calls for service, the City Manager, Fire Chief and myself have been actively researching the city's options for replacement of these vehicles. During this research, staff learned of a couple of important factors which has brought the action before you tonight. One, there is a lead time of 16+ months for the ladder truck which would mean an in-service date of 2023 if ordered now.
Second, the City is faced with a substantial price increase after the first of the year which may equate to as much as 7% above the current price. If Council approves staff's recommendation to purchase both vehicles now, finance is recommending the purchase of the trucks through lease purchase agreement. The City has an existing relationship with PNC Equipment Finance and has executed previous equipment purchases with the bank. If Council agrees to this financing option, PNC will propose a financing package for staff review. Staff will determine if the rates and terms are competitive and staff will enter into an agreement for the Lease Purchase for the purchase of the fire trucks. Staff plans to purchase both vehicles in accordance with the City's adopted Purchasing Policy through a cooperative purchasing program known as HGAC Buy, which the City has been a member of since 2015. As both trucks have been competitively bid through the program, the City can procure in the time needed and at a competitive price. Staff recommends Council consider the immediate purchase of both trucks through a lease purchase agreement by approving staff's recommendation as outlined in the staff report, bullets 1-4, including the adoption of Resolution No. 2021-045.
Council asked questions related to the financing and repayment of the vehicles.
Chief Hasler stated the guys on the department that use this equipment will have the long-term benefit. It makes our job a lot easier. The Finance Director has been fantastic putting this thing together.
Interim City Manager stated it's not just for the City, but the community because the equipment that we have factors into insurance premiums and our fire department ratings. This ladder truck is going to fill a void. I want to point out that Chief Hasler got the ball rolling and brought to our attention the price increase. I think it will be an additional $70,000 if we don't move now. Also, the enormous about of work performed by Finance Director Elms to put this deal together. Its exciting that before you is the purchase of not 1 but 2 fire vehicles. One of which we have been discussing for several years. That's $1.2 million that we as a city are now at a point to be able to invest in our Fire Department.
Chief Hasler said to touch on the statement about insurance rating, we have an ISO Rating.
Insurance companies go by it. If our equipment is up to date, it makes a big difference in our ISO Rating. We all pay insurance premiums, and this makes a big difference. -27-
Councilman Halby stated this is our Measure K and Cultivation tax monies being put to work.
They help the general fund get in a place where we can make these capital purchases. It's a lease to own, its creative bookkeeping and you have to make your money work for you. I am all for it and think it's a good use of funds.
No public comment. Vice Mayor DeConinck moved approval of staff's recommendation. The motion was seconded by Councilman Rodriguez with a unanimous aye vote.
RESOLUTION NO. 2021-045. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE AUTHORIZING
THE EXECUTION AND DELIVERY OF A LEASE PURCHASE AGREEMENT, AND RELATED INSTRUMENTS FOR THE PURCHASE OF TWO NEW FIRE APPARATUSES.
Introduction and Adoption of Urgency Ordinance No. 913-21-U, Relating to the Implementation of Senate Bill 9 for the Creation of Urban Lot Splits and Two Residential Units per lot. Interim City Manager Crecelius stated on September 16"h, Governor Newsom signed Senate Bill 9 into law, which takes effect January 1st. SB 9 adds two sections to the Government Code relating to the development of two units per lot and urban lot splits on lots zoned single-family residential. Section 65852.21 requires a local agency to ministerially approve a housing development of no more than two residential units, either two new units or one new unit in addition to an existing unit with a minimum unit size of 800 square feet within a single-family residential zone when the proposed development meets all of SB 9's listed requirements. Section 66411.7 requires a local agency to ministerially approve a parcel map for a lot split, referred to as an "urban lot split," in the single-family zone when the subdivision meets all of SB 9's listed requirements. Despite these provisions, it has been predicted that SB 9 will not have as much impact as feared. Because of how houses are situated on existing lots, it would be difficult to place additional units on a developed lot without demolition of the existing structure. SB 9 prohibits demolition or alteration of a structure if it has been rented within the last three years and allows the City to limit demolition of more than 25 percent of existing exterior structural walls in other circumstances. SB 9 also prohibits owners from repeatedly subdividing property and prohibits developers or owners from acting in concert with others to successively develop adjacent properties. The statute allowed for some flexibility, in which staff recommends the City maintain the 25% limit on demolition of exterior walls, do not allow ADUs and JADUs in addition to the 2 units allowed by statue, do not reduce the minimum lot size any further than 1,200 square feet and impose objective development and subdivision standards.
Because SB 9 was not signed into law until mid-September, there was insufficient time to process a Zoning Code amendment. Therefore, it is recommended Council, introduce; by title only, further reading waived, and adopt, by four-fifths vote Urgency Ordinance No. 913-21-U.
There was discussion about the bill and what impacts it may have. It was asked what happens if this is not adopted.
City Attorney Roberto stated this allows you to keep as much local control as you can get under SB 9. If not adopted, the State law would govern.
No public comment. Vice Mayor DeConinck moved approval of staff's recommendation. The motion was seconded by Councilman Rodriguez with a unanimous aye vote. City Clerk Crecelius read the title of the Ordinance into the record. -28-
URGENCY ORDINANCE NO. 913-21-U - AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA ADOPTING CHANGES TO TITLE 16 (SUBDIVISIONS) AND TITLE 17 (ZONING) RELATING ANATON OF SENATE BIL? TO THE IMPLEMENTATION OF SENATE BILL 9 FOR THE CREATION OF URBAN LOT SPLITS AND TWO RESIDENTIAL UNITS PER LOT.

No public comment. Councilman Rodriguez moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.
The Council meeting was adjourned for the Successor Agency Meeting.

Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: January 11, 2022
SUBJECT: Investment Report for Second Quarter Fiscal Year 2021-2022 December 31, 2021
PRESENTED BY: Christa Elms, City of Treasurer
PREPARED BY: Christa Elms, City of Treasurer
RECOMMENDATION: City Council accepts and files the Quarterly Investment Report.
FISCAL IMPACT: None.
STAFF REPORT: The City of Blythe has for many years invested all excess cash (cash not needed for daily operations) for all City funds and the Successor Agency with the California State Local Agency Investment Fund (LAIF). LAIF offers the City and the Agency liquidity and safety. There are more profitable investment instruments on the market, but risk increases with yield.
ATTACHMENTS: Attached for your review are copies of the following:

STAFF REPORT
MEETING DATE: January 11, 2022
SUBJECT: Acceptance of Donation- CVSP
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council accept a donation for the Joe Wine Recreation Center in the amount of $12,863.67 from Chuckwalla State Prison. It is further recommended Council authorize staff to purchase gym floor covers for the basketball court at the Rec Center funded by this donation......
FISCAL IMPACT: $12,863.67 to support the programs and operation of the Joe Wine Blythe Recreation Center.
BACKGROUND: Staff at Chuckawalla Valley State Prison donated $12,863.67 to the Recreation Center on December 14, 2021. The funds were collected through their inmate food sell program. Monies collected through these sales are donated to various organizations throughout the community including, but not limited to the Recreation Center, PAL, Little League, Fairgrounds, etc.
STAFF REPORT: Staff intends to use $7,000 of the donated funds to purchase gym floor covers for the basketball court at the Rec Center. This will allow the Center to offer programs in the gym aside from basketball without damaging the gym floor.
The gym floor is costly to maintain; and staff does as much as feasible to extend the useful like between seals. This cover could further help prevent unnecessary wear and tear on the floor when the hosts dances and other activities in the gym. The remainder of the donated funds will be used for various programs and activities at the Recreation Center.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: January 11, 2022
SUBJECT: User Fee Cost Recovery Policy
PRESENTED BY: Christa Elms, Director of Finance
PREPARED BY: Christa Elms, Director of Finance
RECOMMENDATION: It is recommended that the City Council adopt the User Fee Cost Recovery Policy set out in Attachment A to this report.
FISCAL IMPACT: This report has no direct financial impact. However, approval of the recommended User Fee Cost Recovery Policy has the potential for revenue enhancement through full cost recovery.
BACKGROUND: While a primary mission of government is to satisfy community needs, many city services solely benefit specific individuals or businesses. When certain services provided especially benefit a particular group, then governments should consider charges and fees on the direct recipients of those that receive benefits from such services. A User Fee Cost Recovery Policy provides a foundation for effective cost recovery and alleviates unintended subsidization of services from general fund resources.
STAFF REPORT: Since 2015 the City has put emphasis on the need to review and establish user fees that recover costs and alleviates unintended subsidization from general fund resources by undertaking comprehensive user fee studies. In 2015, the City conducted a water and sewer rate study, and in 2018 contracted with an outside consultant to conduct a citywide user fee study, both of which the City had not conducted in well over a decade.
Government Finance Officer Association (GFOA) recommends as best practice that government agency's adopt policy making sure that fees are fair and equitable, and that provides general rules for the City to follow in setting fees and charges. The City currently does not have such policy in place. Staff has developed a policy for Council's review and consideration that sets general provisions, consideration for establishing cost recovery levels, regular review of fees and charges, and frequency of when user fee studies should be conducted.
In general, if adopted, the User Fee Cost Recovery Policy attached herewith as Attachment A, will be guidelines for incorporating best practices in establishing user fees while ensuring that the City adequately recovers costs for services from those who receive direct benefits from the service.

User Fee Cost Recovery Policy
Introduction:
alleviating unintended subsidization of these services from General Fund resources.
Purpose:
The purpose of the User Fee Cost Recovery Policy is to provide general guidelines and to incorporate best practices for establishing user fees and charges to ensure that the City adequately recovers costs for services it provides to the public. The purpose of the Policy is also to establish requirements for the regular review and update of fees and charges to ensure that fees and charges keep pace with changes in the cost of providing services. The Policy identifies factors that will be considered in setting fees, the level of cost recovery, and the frequency of conducting comprehensive user fee studies.
Policy:
General Provisions
• The full cost of providing a service shall be calculated to provide a basis for setting a user fee or charge. Full cost should be based on both direct and indirect costs. • The general policy of the City is for user fees and charges to be set at full cost recovery. - • Based on factors outlined in this Policy, it may be deemed appropriate to recover at less. than full cost, therefore, user fees and charges can be set below full cost recovery levels. • Revenue from each user fee should not exceed the related reasonable total cost of providing the service.
• The method of assessing and collecting fees should be as simple as possible to reduce the administrative cost of collection.

Considerations for Establishing Cost Recovery Levels
The following factors will be considered when setting fees and cost recovery levels:
• Community-wide versus Private Benefit - The use of general-purpose revenues is appropriate to fund community-wide services, while charging user fees at the full cost of providing a service is appropriate for services which solely benefit specific individuals or businesses, such as the issuance of building permits, it is expected that individuals or businesses receiving that benefit pay for all of the cost of that service. • Service Recipient versus Service Driver - Particularly for services associated with regulated activities (development review, code enforcement), from which the community primarily benefits, cost recovery from the "driver" of the need for the service (applicant, violator) is appropriate.
• Consistency with City Policies and Objectives - City policies and Council goals focused on long-term improvements to community quality of life may impact desired fee levels as fees can be used to change community behaviors, promote certain activities, or provide funding for pursuit of specific community goals.
• Impact on Demand - The fee amount and its effect on the demand of the service shall be considered. Increasing a fee amount might not always raise revenues, but instead may have the opposite impact. A fee set above what the public is generally willing to pay will lessen the demand for the service, and, as a result, a sensitivity analysis of consumer demand shall be considered when setting fees.
• Feasibility of Collection - It may be impractical or too costly to establish a system to appropriately identify and charge each user for the specific services received. The method of assessing and collecting fees should be as simple as possible to reduce the administrative cost of collection.
Annual Review
User fees may be updated annually on July Ist to include an escalation based on the Consumer Price Index, All Urban Consumers (CPI-U), for the Riverside-San Bernardino-Ontario, CA area...
CPI-U will be based on the annual index change from the prior calendar year. Annual increases shall be approved administratively by the City Manager; provided no inflationary adjustment may. exceed the cost of providing the service. The resulting calculation for each fee shall be rounded to the nearest whole dollar. The CPI-U adjustment will be reflected in the resolution adopting the schedule of user fees and charges.

Frequency of User Fee Cost Studies
A comprehensive user fee study analyzing a service's cost, the level of service provided, the means by which it is provided, and fees charged, and a review of this Policy, shall be conducted at least once every five (5) years. Following such fee study, staff will provide recommendations to the City Council regarding changes to the City's adopted fees and charges. In the interim, the Finance Director will annually recommend for the City Manager's approval adjustments to fees based on CPI-U in accordance with this Policy.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: January 11, 2021
SUBJECT: City-wide Salinity Study- Colorado River Basin Water Quality Control Board Order R7-2016-003
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council authorize the Interim City Manager to execute Agreement No. 2022-001 A, Amendment No. 1 to Professional Service Agreement _between the City and The Holt Group for the City-wide Salinity Study.
FISCAL IMPACT: The allocation of additional funding in the amount of $9,500, increasing the total agreement to $24,500. The funds are budgeted in the Sewer Enterprise Fund.
BACKGROUND: On June 30, 2016, the Colorado River Basin Regional Water Quality Control Board (RWQCB) adopted Board Order R7-2016-0013. The order regulates the waste discharge requirements of the City, as the owner and operator of the Blythe Municipal Wastewater Treatment Plant. The Order also required a City-Wide Salinity Study.
At the February 14, 2017 meeting, Council authorized staff to outsource a Work Plan and Time schedule for the Study to the Holt Group. The Work Plan and Time Schedule was submitted to the Water Quality Control Board on June 30, 2017. On October 6, 2017, the City received approval for the plan. In May 2018, the City released a Request for Proposal to conduct the City- wide Salinity Study. Council awarded the study to The Holt Group in July 2018. The time schedule to complete and submit the findings and recommendations of the City-wide Salinity Study to the Board was June 30, 2020. At some point, a six-month extension was. granted to the City and the report was submitted to the Regional Water Quality Control Board on December 31, 2020.
In April 2021, Council awarded a contract in the amount of $15,000 to the Holt Group for additional work outside of the original scope, to provide further information and comments to the Regional Board on the Salinity Study in an effort to comply with Board Order R7-2016- 0013.
STAFF REPORT: The study's purpose was to identify the source of salt (TDS) entering the City's sewer system; and the entities responsible. The current discharge limits are 400 mg/L above water supply TDS level. If the City is found to be in violation of the order, the Board may issue penalties of $5,000 per day where violation occurred or $10 for each gallon of water discharged. The study identified that the City's large water users were the contributors of the increased TDS levels.
In April 2019, Council discussed the initial results in a Study Session. It was determined that Culligan and Sparklets were contributors to the increased TDS. The City then refurbish the -53-
evaporation ponds at the Wastewater Treatment plant. This enabled Culligan and Sparkletts to discharge at the Wastewater Treatment Plant, vs. directly into the City's sewer system. Although this greatly reduced the City's TDS level, it was not. enough to bring the City into compliance.
Since then, City staff and The Holt Group have worked with the City's other large water users:
hotels, laundromats and car washes to further decrease the TDS entering the City's sewer system. After several discussions and letters, the hotel owners entered a pilot program. From January - March 2021, hotel owners did not use their water softeners. During this pilot program, data was collected to determine the result this had on the City's TDS levels. As this pilot program provided data showing this reduced the City's TDS levels, the hotel owners agreed to discontinue use of their salt-based softeners.
Also, the staff and the Holt Group believes there is justification to support an increase in TDS limits above the 400mg/L currently in place. As we continue to work with the State Board on our proposal to increase our limits for compliance, it is necessary to amend the contract to include additional funding for the on-going work and extend the term through the current fiscal year. No other terms or conditions of the agreement have been negotiated in this amendment.

RE: Contract Amendment #1 to the Contract for the City of Blythe - Salinity Study Control Effort Support Dated April 6, 2021
THG Project No. 100.286
Dear Ms. Crecelius:
The Holt Group completed the City of Blythe (City) Salinity Study and submitted the required Report to the Regional Water Quality Control Board on December 31, 2020 to comply with the subject Board order.
We received correspondence dated September 9, 2021 from the Board. The following tasks are required to verify and ensure compliance with the Board order. The Salinity Study presented a plan to reduce salt discharges from large commercial customers that use commercial size water softeners. Because of the extremely high level of hardness in the Blythe water, these large water softeners discharge water into the sewer system with TDS levels that exceed the Sewer Use Regulations limits. The following tasks will provide support to City Staff in these efforts.
I. SCOPE OF WORK
A. Prepare Memoranda and Reports
1. The Holt Group will prepare memoranda and reports in response to Regional Water Board inquires.
2. Provide response to the Regional Water Board correspondence dated September 9, 2021. = =

BACKGROUND: The City is a member of the Public Entity Risk Management Authority for general liability and workman's compensation coverage. PERMA has roughly thirty government agency members who participate in the pooled liability program.
As of June 30, 2021, PERMA's liability program reflects a negative net position of $1.8 million.
Pool funding contributions paid by each member are estimated by the actuary for the funds needed to pay claims that occur in the fiscal period, at the confidence level set by the Board. The funding pays for losses with values over the member's retention (the City's retention is $50,000 per claim) and within the $1 million pooled retention. An excess liability pool pays any losses that exceed $1 million.
Due to sharp increases in claim liabilities that has affected public agencies throughout California, over the last few years, the actuarial projections were not sufficient to collect enough money from members to pay incurred losses. Ove the past 11 years, members experienced thirty-two closed claims with values over $250,000. Eleven claims had values over $1 million.
Additionally, 24 open claims during the same period have values over $250,000. These losses are much higher than previous coverage periods in PERMA's 35-year history.
STAFF REPORT: To address the liability program shortfalls, PERMA improved confidence level funding from 65% to 80% in 2019-20 to address the increasing severity and frequent losses and declining assessments in the liability program. Over the summer, PERMA staff reviewed all loss reserves for accuracy and sufficiency and defense attorneys were contacted to ensure appropriate budget levels were in place. In 2021-22 they reallocated expenses from a 95%/5% (liability/worker's compensation) to a 90%/10% split. They worked with their risk control contractor to recraft the risk control plan to address high-severity loss areas which include dangerous condition and police claims. They also transferred equity from one program year to another year if sufficient funds were available. With those changes in place, $9.5 million is needed from the membership to ensure the program returns to a positive financial position and pay member claims.
-61-
An Ad Hoc Committee was formed and provided recommendations to the PERMA Board of Directors on November 4,2021 with a financial plan presented to the Board on December 2, 2021. The plan allows members to select either a 1, 5 or 7 year repayment plan. A 1% discount was offered to agencies who pay their full assessment by June 30, 2022.The City's net assessment is $186,474. Staff recommends paying the full assessment at $184,609, which reflects the 1% discount rate.
It should be noted that PERMA is not insolvent. As an entity, it is in a surplus position overall.
As a risk-sharing pool however, PERMA needs to hold sufficient funds to ensure that members have coverage for losses and that each program is property funded. The assessment plan along with appropriate contribution rates going forward will serve to protect PERMA members.

GERMA
December 20, 2021
At its December 2, 2021, meeting, the PERMA Board unanimously approved a liability program financial plan. The plan addresses deficits in program years and places responsibility for the deficits on the members who participated in the deficit years in accordance with the joint powers agreement.
The deficits of 2015-16 through 2020-21 were funded through a transfer of surplus in older program years, an assessment, and application of ERMA dividend funds. The components of this plan are as follows:
1. The Board approved a transfer of $11,562,166 surplus from program years 2005-06 through 2014-15 to 2015-16 to 2020-21.
2. The Board declared an additional $9,526,836 in assessments.
3. The Board approved the application of ERMA dividends to reduce member assessments, where applicable.
4. The assessment calculated funds for the program years to reach zero at an 80% confidence level.
5. Members with worker' compensation surplus available may elect to use the surplus to reduce their assessment.
Each member's share is reflected in the attached documents. PERMA has also prepared a two- page memo which summarizes the financial status of the liability-program as well as the plan elements the Board adopted for use at your city/agency.
Members must return an election agreement to PERMA by January 31st, 2022. The complete deficit share will be due and payable by members who do not sign and return the payment agreement. Payments not received by July 15, 2022, will be subject to the PERMA penalty provisions outlined in the Liability Program Document.
Included in this communication is the payment election form, a recap of the assessments by member, and a summary of the information regarding the liability financial plan which was presented to the Board of Directors during several meetings in 2021. 36-951 Cook Street, Suite 101

STAFF REPORT: Staff intends to submit a grant applicant in the amount of $800,000 to fund the design and construction of a replacement water tank for Mesa Ranch. This tank has been identified by the State of California for replacement. Replacing the tank will conserve water and relive year-round water supply demand.

MEETING DATE: January 11, 2022
SUBJECT: Audited Financial Statements for the Fiscal Year 2020-2021 PRESENTED BY: Christa Elms, Director of Finance
PREPARED BY: Christa Elms, Director of Finance
RECOMMENDATION: Receive and file the City's audited financial statements and related documents for fiscal year 2020-2021
FISCAL IMPACT: None
BACKGROUND: The City is required to complete an independent audit of its financial statements at the end of each fiscal year. The audit for the fiscal year 2020-2021, was conducted by Teaman, Ramirez and Smith, Inc. In addition to the audit the independent firm prepares the City's financial statements in conformance with Generally Accepted Accounting Principles (GAAP). On January 6, 2022, the Finance Committee, Staff, and management from the independent firm met for a comprehensive review of the audit and financial statements. It is City Council's policy as per Resolution 09-827 to present the results of the annual audit in open meeting.
STAFF REPORT: Teaman, Ramirez and Smith, Inc. has completed the fiscal year 2020-2021 audit of the City's financial statements. Staff is pleased to report that, the auditor's opinion on the City's fiscal year 2020-2021 financial statements is an "Unmodified Opinion". That is, the auditors have reported, in their opinion, that the financial statements present themselves fairly, in all material respects, as it relates to the respective financial position of the government activities, the business-type activities, each major fund, and the aggregate remaining fund information of the City of Blythe as of June 30, 2021. This is also referred to as a "Clean Opinion" and is the best level of an audit opinion the City may receive. The financial statements have been prepared assuming the City will continue as a "Going Concern" due to the financial condition of various funds.
Teaman, Ramirez and Smith, Inc. also-provided the City with a Management Report. The Management Report is intended to provide management and those charged with governance with valuable information regarding the organization. The report discloses significate audit matters, difficulties encountered, corrected or uncorrected misstatements, disagreements with management, audit findings, and other compliance issue that are found. The auditor's report disclosed no difficulties, findings, or noncompliance matters as result of their tests. In auditing of the financial statements, the auditors consider the City's internal controls over financial reporting to determine the audit procedures that are appropriate for the purpose of expressing an opinion of the financial statements. A deficiency in internal controls may result in -99-
material weakness. A deficiency or combination of deficiencies in internal controls may lead to repree autor reportion and marconio found no cents on or mole bai red o City's internal controls.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: January 11, 2022
SUBJECT: 2021 Year in Review
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file the year in review report for 2021.
FISCAL IMPACT: None
BACKGROUND: 2021 was a busy and productive year for the City of Blythe. As such, staff thought it prudent to highlight some of the accomplishments of 2021.
STAFF REPORT: The City's priorities for 2021 included economic development and blight abatement to clean up the city. On that front, in mid-2021 Council approved and funded the Graffiti Abatement Program. The city now has a part time employee covering graffiti on an on- going basis. Whereas before, graffiti was covered by city staff every 4-6 week. Staff has seen a decrease in graffiti since the program was implemented. The City Council was also instrumental in fighting to keep the County Animal Shelter open and operational through this fiscal year. The Council continues to support the Chamber of Commerce and its events. The City partnered with the Chamber to host a successful Community Clean up Day. The City maintains a presence at ICSC, in hopes of attracting new businesses to Blythe. Aside from Council directives, below are highlights from the city departments:
Police Department: The Police Department responded to approximately 1,500 calls for service per month for a total of 18,000 calls over the 2021 calendar year. In September, a néw Police Chief was seated. He initiated a department inspection and is working on a number of items, such as the quality-of-life pilot program which will be rolled out in early 2022. New equipment was purchased, and the CAD system was implemented. The CAD system was much needed infrastructure and wilf enhance calls for service within the community. The Department also updated the Emergency Operation Plan which is instrumental in the event of a natural disaster.
The Police Department was instrumental in the organization of the National Night Out hosted for the community in Todd Park and continued to partner in the Christmas Parade and Civil Servants for Santa.
Fire Department: The City's Volunteer Fire Department responded to approximately 50 calls for service each month for just under 600 in the year. These calls included structure, vehicle and brush fires, medical aids and bees. In 2021, over $1 million in funding was allocated to the Fire Department to upgrade equipment and vehicles, the latest of which was approval to purchase two fire vehicles. The Fire Department once again put on a spectacular 4* of July Fireworks show and participated in community events such as the Christmas parade and Civil Servants for Santa. -101-
Public Works: In 2021, Acacia Street from Barnard to Hobsonway was repaved. Street Rehabilitation plans for the Lovekin/Barnard Street Rehabilitation project were designed and put out to bid. The San Luis Way rehabilitation project from Barnard to Wisconsin-Street are also out to bid. Both projects will be completed in the spring of 2022. Staff will work to identify future street improvement projects for funding and construction. Public Works Crews rehabilitated the playground equipment at Todd and Appleby parks which included the installation of new fall protection. New riding lawn mowers for use in the City's parks and landscaped areas were purchased. The City devoted a significant amount of time to SB 1383, Organic Recycling. Staff continues to work with CR&R to comply with these mandates. A number of capital improvements were made at the Wastewater Treatment Plant. Plans were designed to replace the aging water reservoir at the College. The project will move forward once the grant funding awarded is allocated by the Federal Government. Public Works partnered with the Palo Verde Valley Transit Agency to prepare a grant for the Clean California Local Grant Program from the California Department of Transportation. The application requests funding for a perimeter wall and solar lighting at the Public Works Yard, restroom at the CNG Station, solar lighting at Miller Park with improvements to public access, paving and parking, improvements to Transit's Park and Ride on Main Street, outdoor public engagement space, bus stop improvements and amenities and public outreach and community clean up. The grant will be submitted in February. .. -
Development Services Department. It was a busy year for the Development Services Department with 18 PRC's processed in 2021. This is a record number of PRC submittals for the City. Staff is working with the applicants to develop these projects. In 2021, 527 building permits were issued. Certificate of Occupancy's were issued to Gr&Ge a Commercial Cannabis Cultivation, Distribution and Manufacturing facility, the Holiday Inn Express, Have A Heart/High Times Dispensary and Dollar General (west). With a focus on cleaning up the City, 255 code cases were opened and 253 code cases were closed throughout the year. The Department partnered with the Chamber of Commerce to host a well-received Town Hall meeting directed at Code Enforcement. The department continued to work through the court system to obtain abatement warrants to demolish and clean several blighted and abandoned properties in the City.
Finance Department: Finance continues to prepare balanced budgets and improved the city's financial position in 2021. The most significant improvements included receiving Measure K Sales tax revenue and the repayment the Golf Course Loan in the amount of $1 million dollars.
The loan repayment was a recommendation of the State auditor. It also moves us closer to the removal of the going concern in the City's audited financial statements. Finance continues to allocate budget surpluses as adopted in the City's Reserve Policy to further enhance the City's net position and ability to fund services in the event of a revenue shortfall or a necessary capital • expenditure. The Finance Department also implemented a new purchasing policy to streamline— the purchase of supplies and equipment.
Recreation Center: The Recreation Center was required to be closed for a large part of 2021 due to COVID-19 mandates. It is now open and back in full swing. They hosted successful youth flag-football and soccer programs this fall. They initiated a survey through the water utility bill gauging the public's interest in new programs being considered for the Center. They plan to host several special events such as the continuation of the father daughter dance and addition of mother son dance in spring of 2022 and the youth basketball program.
Cannabis: In 2021, 8 Commercial Cannabis applications were submitted for review. Of the 8,2 were awarded, with 5 moving through the four-phase application process. At the December Council meeting the 24th Commercial Cannabis license was awarded by Council since program -102-
adoption in late 2017. Currently 7 licenses are active.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: January 11, 2021
SUBJECT: Agreement between City and Retail Strategies for Economic Development Activities.
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council authorize the Interim City Manager to execute an agreement between the City and Retail Strategies once reviewed and approved by the City Attorney and authorize a purchase order not to exceed $135,000 for the term of the agreement.
FISCAL IMPACT: $135,000. Staff recommends Council allocate American Recuse and Recovery Act (ARRA) funds for this economic development opportunity.
BACKGROUND: Retail Strategies, founded in 2011 is the national expert in recruiting businesses on behalf of communities. Retail Strategies exists to give communities an advantage in attracting businesses. Their mission is to provide the real estate expertise, tools, and human effort that position towns to allure national businesses.
Attracting new retail to a community is complex, connection critical and a time-consuming endeavor. Retail Strategies gives communities the option to outsource retail recruitment services to well connected, experienced, and licensed retail real estate professionals. Their activities pay a return in sales taxes, added jobs and businesses.
For client communities, Retail Strategies identifies and aggressively executes a tailored strategy to attract new retailers, restaurants and hotels. They attend more than 10 ICSC conferences and multiple RetailLive! retail real estate trade shows across the country to meet with industry professionals to showcase opportunities.
Their process includes engaging the client to understand their story of opportunity to leverage attributes toward expanding businesses. They serve as a conduit between communities and national retailers to ensure the story of opportunity resonates with the right retail audience. They work as an extension of staff, adding specific expertise and amply efforts and visibility. They provide feedback, answer questions, and solve problems to position market growth.
STAFF REPORT: The City has attended several ICSC Conferences over the last few years with the purpose of attracting new business to Blythe, specifically retail and restaurants. What we have found is it takes years to build relationships and get the attention of retailers who could potentially expand their operations in the City. We have looked at options such as Retail Strategies in the past but were not in a financial position to purse it. We now have a unique opportunity with the American Recovery and Rescue Act funds released due to the pandemic.
The $135,000 necessary for this three-year venture may be funded using these dollars with no -104-
impact to the General Fund.
At the ICSC Here, We Go. 2021 Conference held in Las Vegas December 6-7, Mayor Reynolds, Councilman Rodriguez and I met with a representative of Retail Strategies to discuss their program. We again met with Retail Strategies on December 15, 2021, to further discuss a partnership between Retail Strategies and the City. After that meeting, they provided the attached ICSC Recap Report which is a quick recap of what they were able to accomplish on behalf of their clients at the show.
Although the term of the agreement is 3 years, there is an option to cancel at the end of each year without penalty. The alternative is entering a 1-year agreement in the amount of $50,000. With the cost savings, and ability to terminate the contract each year, staff recommends moving forward with the three-year agreement. Staff believes three years is necessary to really evaluate the service, at it takes about 2 years from start to finish to develop a site in California.
This partnership is also a creative way for the City to focus on economic development without the addition of personnel. The City could have a planned and on-going economic development effort with a partnership with Retail Strategies.

We heard from many retailers in growth mode. They are
actively seeking sites. Secondary markets are hot and
second-generation space is in demand. Retail closures of dying brands are freeing up space for new and emerging 453 brands. Investors have realized the false hype of the retail EXHIBITORS apocalypse with a renewed confidence in brick-and-mortar investment. Despite the challenges of the labor force, supply chain, and construction costs, retail sales remain at historical highs for year-over-year sales.

Through our Recruitment partnership, we invite our Clients to attend one of our Monthly sessions in Birmingham where we will cover topics ranging from Retail Trends to Best Practices for Retail Recruitment.
If Social Distancing measures prohibit our in-person workshops, we also offer a virtual version of Retail Academy where you can learn at your own pace online.
Following Retail Academy, community leaders will leave a better understanding of the retail and valuable knowledge to position your market as a primary destination for new retail and restaurants.
While Retail Strategies will be performing the heavy task of retail recruitment, we believe it is important for our Clients to also understand the process so they can be better leaders in their community.

CITY OF BLYTHE
CITY COUNCIL MEETING
STAFF REPORT
blythe
MEETING DATE: January 11, 2022
SUBJECT: Funding a Part Time/Temporary Department Assistant I Position at the Police Department for FY 2021/22
PRESENTED BY: Garth V. Dale, Chief of Police
PREPARED BY: Garth V. Dale, Chief of Police
RECOMMENDATION: Council fund a temporary, part time Department Assistant I Position at range 30 of the Clerical MOU, to assist the police department due to a long-term absence of the Forensic Technician.
FISCAL IMPACT: An amount not to exceed $20,000 through the end of the fiscal year. Salary savings from unfilled positions at the Police Department are available in the current budget to fund this part-time, limited term position.
BACKGROUND: Following the financial crisis in 2008, several positions at the Blythe Police Department were unfilled. Duties of the evidence technician were added to other employees at the police department, with the Forensic Technician handling most of those duties. If an employee is not available for an extended period of time, duties will not be accomplished. As the Department is already operating on reduced staffing levels, there is no available staff to pick up the extra workload from a long-term absence. This could affect the prosecution of criminal cases as well as the entire operation of the police department.
STAFF REPORT: Currently, the Blythe Police Department does not have an evidence technician. These duties are handled by the forensic technician who also handles duties involving administrative tasks for the department. These duties include, but are not limited to procurement, records keeping, grant application preparation, staff projects and reports, inventory, supply monitoring, financial document preparation, monitoring department budget status and preparing training and travel expense authorization documents. Soon, the permanent, long-term employee who is assigned these duties will be taking an approved leave of absence. In order to keep the department running at its current level of efficiency and fulfill its mission, staff proposes to add a part-time employee to perform administrative duties within the Police Department. This will free up the Community Service Officers to perform the Evidence and Forensic Technician duties during the long-term absence. This part-time Department I position has previously been used by the Police Department in 2003 and in 2010 and 2011.
