PUBLIC HEARING:
Categorical Exemption- SAC Health Care Facility Project. Interim City Manager Crecelius stated SAC Health System proposes to renovate an existing vacant office building to be used as a health care facility. The 2.16-acre project site is located at 500 N. Broadway. The west side of the building will be owner occupied space with a new open floor plan to create medical offices for family medicine, pediatrics, and supporting departments. The layout of the east side of the building will remain as is, except for ADA improvements. The applicant proposes to develop in two phases. Phase I consists of use of the clinic in its current state. Phase Il consists of major construction on the west end of the building as well as ADA improvements and upgrades to the parking lot, landscaped areas, and exterior lighting. Based upon information contained in the administrative record and review of CEQA Guidelines, the City has determined that the SAC Health System Health Care Facility project has no conditions as defined in CEOA Guideline 15300.2 that would make it ineligible for the applicable categorical exemptions. The proposed development qualifies for a Categorical Exemption as redevelopment of an existing structure and replacement and reconstruction of existing structure. Therefore, subsequent to the Public Hearing, it is recommended Council adopt a Notice of Exemption- Existing Facilities and Reconstruction of an existing building for the SAC Health System's Health Care Facility project located at 500 N. Broadway in Blythe, CA 92225 and direct staff to file the Notice of Exemption with the County Clerk.
No public comment. Councilman Rodriguez moved approval of staff's recommendation. The motion was seconded by Vice Mayor DeConinck with a unanimous aye vote.
NEW BUSINESS:
Letter of Public Convenience and Necessity- Karma's Calling, LLC. Councilman Halby recused himself from the discussion due to a perceived conflict of interest. Interim City Manager Crecelius stated Karma's calling, located at 221 W. Hobsonway has an active type 47- on sale general license for eating places issued by the ABC. Karma's calling would like to exchange the Type 47 license for a Type 48 ABC license. A Type 48 License is an on-sale general license for public premises such as a bar or night club. Food service is not required with the type 48 license. Karma's calling is in Census Tract 461.02 which currently has five active on- sale licenses at four locations. One license is currently allowed within the census tract. As Karma's calling is exchanging their license, no additional license types will be issued within the census tract. The number will remain at 5 active licenses within the tract at four locations. The issuance of this license is a necessity for this operator and to the public as Karma's is one of the few places in Blythe where patrons may consume beer, wine, and distilled spirits in a venue other than a restaurant. As such, Council may make the finding of a public convenience and necessity. Therefore, it is recommended Council approve the draft letter supporting the issuance of an On-Sale General- Public Premises Type 48 ABC License withing Census Tract 461.02 to Karma's Calling, LLC located at 221 W. Hobsonway with full knowledge of the undue concentration provisions as outlined by the ABC.
No public comment. Councilman Rodriguez moved approval of staff's recommendation. The 24 motion was seconded by Councilman Burton with a unanimous vote from members Reynolds, DeConinck, Rodriguez and Burton.
Councilman Halby rejoined the meeting.
Fiscal Year 2021/22 Budget Amendment and Mid-Year Financial Report. Finance Director Elms stated the City's annual budget is a financial plan based on information available at the time its prepared. As with any plan, changes and conditions may result in the need to modify the original budget. The Mid- year Report is derived from a review of the City's financial activity during the first two quarters of the fiscal year. This review provides an opportunity for the City to make necessary amendments to its original revenue and expenditure projections to better align the budget to actuals. At Mid-year, the General Fund has recorded 42% of projected revenue and expanded 57% of its adopted budget. Revenue estimates are developed based on historical data, trends, and actual receipts. Tax revue is the largest portion of the General Fund's revenue. 65% of the General Fund's revenue is derived from the City's Sales tax, VLF, Property tax and Transient Occupancy tax. Sales tax alone is 31% of the 65% of tax revenue. Mid-year review of actuals shows these revenue streams are performing better than expected. Based on receipt timing for the top 4 revenue sources, actual receipts at mid-year are typically at 20% of projections. They are currently trending at 37%, 17% above average. Fiscal Year 2021/22 is the first full year of Measure K, an additional 1% of sales tax. Despite it only being effective 9 of 12 months in 2021, revenues were far better than anticipated at just above $2 million. This was 20% above the amended budget. Based on timing of distributions from the State, actual revenue received at mid-year would typically average 33%. However, actuals are trending at 67% or $1.16 million; indicating that Measure K is trending well above forecast. As data develops, budget to actuals should stabilize. In addition, other revenue sources are trending at or above target. Based on the Mid-year review, staff is recommending amendments to revenues as identified in Exhibit A, attached. The amendments will account for increases in Measure K, Sales tax, MLV fees, grant funds and other miscellaneous revenue sources of the General Fund. The amended General Fund Revenue budget is proposed at $12.21 million, excluding transfers for a net increase of $585,000. As you are aware, the General Fund supports many of the day-to-day operations of the City including police, fire, community development, streets, parks and recreation. Although not all expenditures follow a straight-line spending patter, operating expenditures should track close to 50% of the budget at midyear. Mid-year expenditures are at 57% with General Government expenditures being the primary factor. General Government expenditures usually track at 75% or greater due to the timing of lump sum pension, liability and debt payments. This makes it look like expenditures overall are trending higher than they are.
Total year end expenditures for all departments are anticipated to come under budget at a margin of 4%. As indicated in Exhibit A, staff is proposing minor amendments to appropriations in the General Fund. The amended General Fund expenditure budget is proposed at 10.193 million.
Excluding transfers, the net increase is $158,000. Appropriations for operating transfers out an increase of $45,000. The Mid-year budget review shows no indication of major variances in the water or sewer enterprise funds as indicated in the attached Mid-year budget report. Exhibit A does provide for proposed budget amendments to other funds including Measure A and Capital Streets from known cost changes in budgeted street projects. The amendment includes revenue received from the City's first allocation of ARPA Funding and amendments to the City's Risk Management Fund for an increase in liability program 25 assessments. It is recommended Council receive and file the Mid-year report and adopt Resolution No. 2022-004, amending the FY 21/22 Budget as referenced in Exhibit A.
Mayor Reynolds thanked the Community again for the passage of Measure K. We still have a hill to climb, but this helps.
No public comment. Vice Mayor DeConinck moved approval of Resolution No. 2022-004. The motion was seconded by Councilman Burton with a unanimous aye vote.
RESOLUTION NO. 2022-004. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNI MENDING THE OPERATING AND CAPITAL BUDGET FOR FISCAL YEAR 2021-2022 Housing Element Update. Interim City Manager Crecelius stated since 1969, California has required that all local governments adequately plan to meet the housing needs of everyone in the community. Local governments meet this requirement by adopting housing plans as part of their General Plan. The City's Housing Element was last updated in 2014, with a period of 2013 through 2021. The City released a Request for Proposals for the preparation of the 6h Cycle Housing Element Update on December 1st. Proposals were received from The Holt Group in the amount of $63,000, Realty Planners Group, Inc. in the amount of $59,850 and Willdan in the amount of $115,765. After a review of the proposals submitted, staff determined the Holt Group was the responsive bidder due to their qualifications and experience working in rural communities in Southern California. They are also vastly familiar with the City of Blythe, having completed numerous engineering and planning projects in the City. It is recommended Council authorize the Interim City Manager to execute Agreement No. 2022-006 A between the City and The Holt Group and issue a purchase order in an amount not to exceed $63,000 for preparation of the City's 6 Cycle Housing Element Update.
Public comment. Lindsay Holt of the Holt Group thanked Council for the opportunity to provide planning services to the City.
Councilman Rodriguez moved approval of Agreement No. 2022-006. The motion was seconded by Councilman Burton with a unanimous aye vote.
San Luis Way Street Rehabilitation Project. Interim City Manager Crecelius stated Council adopted the budget with Measure A funds for the rehabilitation of San Luis Way from Barnard to Wisconsin Street. In December, the City released an Invitation for Proposals for the Project. Bids were received from Rove Engineering in the amount of $385,365, Pyramid Construction in the amount of $430,808.79 and Granite Construction in the amount of $411,114.
After a review of the proposals submitted, Rove was deemed the responsive and responsible bidder. It is therefore recommended Council authorize the Interim City Manager to execute Agreement No. 2022-007 A with Rove Engineering, Inc. contingent upon all bonds and proper contract documents being fully executed to the satisfaction of the City Attorney; issue a purchase order to Rove Engineering, Inc. in an amount not to exceed $385,365, authorize $35,000 for contingencies, project inspection and engineering services, authorize the Interim City Manager to approve change orders during construction not exceeding $15,000, authorize the Interim City Manager to enter into Agreement No. 2022-008 with the Holt Group for construction surveying 26 and issue a purchase order to The Holt Ground in an amount not to exceed 29,850 and establish a project budget of $450,215.
No public comment. Councilman Rodriguez moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.
Lovekin-Barnard Street Rehabilitation Project. Interim City Manager Crecelius stated Council adopted the budget with Measure A funds for the design and rehabilitation of Lovekin from Hobsonway to Barnard and Barnard from Lovekin to Main Street. The design was completed in the fall of 2021. In December, the City released a Request for Proposals for the street rehabilitation. Bids were received from Rove Engineering in the amount of $949,365, Pyramid Construction in the amount of $1,053,588.91 and Granite Construction in the amount of $1,179,711. After review of the proposals submitted, Rove Engineering was deemed the responsive and responsible bidder. It is therefore recommended Council Authorize the Interim City Manager to execute Agreement No. 2022-009 A with Rove Engineering, Inc. contingent upon all bonds and proper contract documents being fully executed to the satisfaction of the City Attorney and issue a purchase order to Rove Engineering, Inc. in an amount not to exceed $949,365.00, authorize an additional $50,500 for contingencies, project inspection and engineering services and authorize the Interim City Manager to approve change orders during construction not exceeding $15,000 and establish a project budget of $999,865.00.
No public comment. Councilman Rodriguez moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

Sabrina Pineda of 1325 Bruce Court asked for an update on the new playground equipment for Engvik Park.
A resident of 318 N. 1st street asked Council to consider increasing funding to the Police Department. Since I moved here 4 years ago, I have been burglarized twice. My neighbor has been burglarized three times. We don't feel safe. Our Police Department is not lacking quality, we are lacking quantity. We need additional resources, officers, and training. I think we would also benefit from body cams for our officers. Our officers deserve to be invested in.

NEW BUSINESS:
Issuance of Commercial Cannabis Permits to Puffzy, Inc. Interim City Manager Crecelius stated Artour Zadourian and Berta Hovanesian, Principles of Puffzy, Inc. submitted applications for Commercial Cannabis business permits for Cultivation, Distribution and Manutacturing to be located on vacant land at 675 W. Wells Street. The site is zoned General Commercial, which allows for the development of commercial cannabis structures on lots of at least 5,000 square feet. Puffzy, Inc. has completed the PRC process for the development of this property which includes the construction of one 18,000 sq ft. building. The building has a mezzanine for a total floor space of 21,000 sq ft. Principles for Puffzy, Inc. completed the owner background investigation with nothing found to preclude them from being issued a Commercial Cannabis Permit. It should be noted that Ms. Hovanesian is also a principle of the Gr&Be/Lotus Cultivation, Manufacturing and Distribution facility located on W. Hobsonway. Lotus opened in the fall of last year. On February 17, 2022, staff met with Principles of Puffzy, Inc. for the Phase III interview required of the application process. After the interview staff recommends the award of Commercial Cannabis Business permits to Puffzy, Inc. for Cultivation, Distribution and Manufacturing for a Cannabis facility to be located at 675 W. Wells. Street.
Public Comment. Travis Pollock of AZ Premiere Management stated I was hired by the clients to 28 help them through the local and state application process and am also a local operator. This is for a project at 675 W. Wells Street for a 21,000 sq. ft. new building. Puttzy Inc. is comprised o wo sole members, one of which is in the audience today. The property is zoned correctly an meets all typical development standards. Puffzy has made charitable donations throughout the community and is planning to hire strictly from the community. Puffzy is associated with another cultivation facility here and will have support with staffing. We appreciate staff and ask that you approve this project.
Councilman Rodriguez moved approval of the cannabis permits. The motion was seconded by Councilman Burton with a unanimous vote.
Sewer Repair at Hobsonway and Lovekin Blvd. Interim City Manager Crecelius things are changing rapidly and have changed since the posting of the Agenda on Friday. As you know, no local contracts can make the repair. Today, Interim Public Works Director Hamblen was in contract with Rove Engineering who has worked in the City previously. They will provide a quote. Based on what was found, the area of the collapse is very close to the fiber optic hub that runs the east and west coast. The risk factor is very high working in this area. The request would be to relocate this sewer line away from that hub, so they are not working near it. Due to this, the repair may be above my authority of $200,000. Per the purchasing policy, anything above $200,000 requires a formal bid. We were hoping we could do this within $200,000 which only requires obtaining 3 quotes. Formal bidding takes time, we must prepare a bid package, release it for Request for Proposals, allow at least one month for them to prepare their bids, and bring it to a Council meeting for approval. We are looking at 2-3 months before we can even start the repair. Due to that, the temporary sewage pumps in place to keep the sewer flowing, complaints from businesses in the area, and the impacts from the road closure we deemed this an emergency.
We need to get this repaired as soon as possible. I would like to change the recommendation to ask Council to deem this an emergency. This action requires a 4/5" vote of Council. This would allow us to obtain quotes, still find the most responsible and responsive bidder, but would waive the formal bidding process. Once we have a few quotes, we can move forward with the repair.
This would remove the cap on my authority. I would keep Council appraised as we move forward.
City Attorney Roberto stated in addition to the finding that there is an emergency, we need Council to make a finding that the emergency will not permit a delay resulting from a competitive solicitation for bids and the action is necessary to respond to the emergency. We need 4 votes for all items.
Interim City Manager Crecelius stated since we are deeming it an emergency, we can't waste time and delay the project. We want to deem it an emergency to save time by waiving the formal bidding process. We will perform our due diligence and get competitive quotes, but we don't have time to prepare bid specs and do a pre-bid meeting, a month of waiting on proposals, etc.
Mayor Reynolds asked if the blockage was detrimental to opening Hobsonway. Interim Public Works Director Hamblen stated yes, due to the amount of material that has been pulled out of the area, we will have a collapse if we open the road. We have pulled 4-5 yards of material out of the area which has created a void.
29 Council discussed one proposal for repair, relocating the line to move it away from the fiber optic hub. Construction is estimated at 1 month under this scenario.
City Attorney Roberto stated first, you will make a finding that an emergency exists. Second, you will make a finding that based on the facts presented in the record, the emergency will not permit a delay resulting from a competitive soliton for bids and the action is necessary to respond to the emergency.
No public comment. Vice Mayor DeConinck moved approval of the City Attorney's recommendation. The motion was seconded by Councilman Burton with aye votes from Reynolds, DeConinck, Rodriguez and Burton.
Resolution Authorizing Submission of a Notification of Intent to Comply with SB 1383 Pursuant to a Corrective Action Plan as Prescribed by SB 619. Interim City Manager Crecelius stated over the past two years, the City has been working on an exemption to SB 1383, the methane emissions reduction targets set by Governor Brown in 2016. Due to a lack of infrastructure in the city and the distance to organic waste disposal sites, the collection of green waste will be difficult for the City and its waste hauler, CR&R to implement. After the City was unsuccessful in obtaining a waiver from SB 1383, planning for its implementation began. The current plan includes a three-cart collection system, with green and organic waste being collected in a green cart. The green waste would be transported to a composting facility in Yuma, Arizona.
To facilitate this, a transfer station is necessary to move waste from the trash hauler to a truck for transporting. CR&R is currently working with Riverside County Planning to build this station in their yard on S. Broadway. In October, Governor Newsom signed SB 619 to provide punitive relief for local agencies that are not compliant with SB 1383. As the deadline to comply was January 1, 2022, SB 619 will provide some relief to the city, as we work through the challenges of implementation. Pursuant to SB 619, agencies who are not in compliance with SB 1383 may submit to CalRecycle by March 1, 2022, a Notification of Intent to Comply. The NOIC requires the City to provide an overview of SB 1383 compliance efforts, identify the sections that are not in compliance and provide a timeline for implementation. Should CalRecycle approve the submission, the agency would be relieved from civil penalties associated with noncompliance. It is anticipated a new solid waste service will be implemented within the next year, and with approval of the SB 619 action plan, the City's deadline to fully comply with SB 1383 would be extended to June 30, 2023. There are several other requirements of SB 1383 in addition to the collection of organic waste. The other significant impact to the City is the procurement of organic material, such as mulch or compost. The City is required to procure .08 times the City's population. Per this calculation, the City must procure 1,120 tons per year. So, once we truck our organic waste to Yuma for composting, we will be required to purchase 1,120 tons of it back for use as the City sees fit. I am not sure at this time what the City will do with 1,120 tons of compost. Approval of the proposed resolution will authorize staff to submit the required with implementing the new solid waste program services and policies with temporary relief from penalties. Therefore, it is recommended Council Adopt Resolution No. 2022-005 and direct the Interim City Manager to execute and file the Notification of Intent to Comply with Senate Bill 1383 by March 1, 2022. In the agenda packet there was a Resolution and a NOIC. Since the 30 Agenda was published, CR&R has finalized the NOIC and a copy of the final draft was provided to you this afternoon. Copies were also made available to the publish. The recommendation is to adopt the Resolution along with the NOIC as provided to you today.
The Council asked questions related to the procurement piece of the legislation.
No public comment. Councilman Rodriguez moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

MEETING DATE: March 8, 2022
SUBJECT: Rejection of Bids - PV College Bolted Water Reservoir Project PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Council reject all bids received on February 17, 2022 for the PV College Bolted Water Reservoir Project and direct staff to re-advertise the project.
FISCAL IMPACT: The City anticipated $500,000 in Federal funding through the Community Project Program. The project was approved for funding, but the funding for these projects has yet to be appropriated at the Federal level. Staff is now working with the State Water Quality Board for emergency funding for the project.
BACKGROUND: The College Tank is located within Palo Verde College and services the college and Mesa Ranch area of the City's water utility system. This 500,000-gallon tank was installed over 20 years ago when the college relocated to the Mesa. This created demand on the system for water and fire flow protection. The tank has been repaired several times and is leaking. To maintain water utility operations in this area, staff believes the tank needs to be replaced as soon as possible.
In 2021, The Holt Group was tasked with preparing the project design documents for the replacement of the bolted steel water reservoir. The design was completed, including review of the plans by the State Water Board, and the project was put out to bid in January 2022. Six contractors attended the pre-bid meeting and project walk.
STAFF REPORT: The Palo Verde College Bolted Water Reservoir Project consists of site prep for the installation and connection of a 500,000-gallon manufactured water reservoir to the City's water system. The project documents and specifications prepared for the project included all work necessary for the construction and placement of the tank. At the bid opening on February 17, 2022, the following bids were received:
RSH Construction $1,185,500.00
Superior Tank $1,202,000.00
The bids received are more than double the anticipated project funding level and 30% above the engineer's estimate. The bids submitted were from tank manufacturers, using sub-contractors for the site prep, connection and installation of the tank. After review of the bids received, staff believes it would be more cost advantageous to procure the tank and bid its installation separately. This may result in more competitive bids for the City and could also allow local 52 contractors an opportunity to participate in the bid.
Pursuant to the Public Contract Code and the Blythe Municipal Code, it is within Council's discretion to reject any and all bids received and provide direction to staff on future action, which may include abandoning the project, re-advertising for bids, or, by passage of a resolution by four-fifths (4/5) vote of the Council, declaring the project can be performed more economically by City employees and having the work performed by force account.
Staff is recommending that Council reject all bids and direct staff to re-advertise the project.
Once Council has rejected the bids, staff will prepare new bid documents, which will be distributed in accordance with the requirements of the Public Contract Code and Blythe Municipal Code and to all contractors who routinely work on street related projects in the City.
After the new bids are received and reviewed, staff will report to Council and ask for direction/award of the contract for this project.

STAFF REPORT
MEETING DATE: March 8, 2022
SUBJECT: Emergency Sewer Repairs at Hobsonway and Lovekin Blvd.
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council review the emergency action in place for the collapsed sewer line at Hobsonway and Lovekin Blvd. It is further recommended Council, by a 4/5 vote, determine there is a need to continue the emergency repairs.
FISCAL IMPACT: Unknown.
BACKGROUND: In early February, Public Works was notified of a sewer back up at Sure Stay Motel located on the corner of Hobsonway and Lovekin. Crews believed there was a breach in the line and worked to determine where. Due to the size of the line, no local operators had the equipment necessary to camera the line to determine the location. Crews set up temporary measures to keep the line flowing, and closed Hobsonway as a precaution until the repair could be made. On February 18, 2022, CV Pipeline sent a camera down the line and determined the line was collapsed on the north and south sides of the sewer manhole.
Per Section 2.66.070 of the Blythe Municipal Code and the City's Purchasing Policy, in cases of emergency, the Council, after making a finding, based on substantial evidence clearly stated in the meeting minutes, that the emergency will not allow for a delay resulting from a competitive solicitation for bids, and that the action is necessary to respond to the emergency, may be a four- fifths vote of the Council, repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes without giving notice for bids to let contracts.
Due to the extent of the collapse and its repair, the location of the pipe in a main City corridor as well as its location to highly trafficked fiber optic lines, Council took action at the February 23, 2022 Special Meeting to deem the repairs an emergency and, by a four-fifths (4/5) vote of the Council, made the required finding that the emergency would not allow for a delay resulting from a competitive solicitation for bids, and that the action was necessary to respond to the emergency.
STAFF REPORT: Per Public Contract Code section 22050(c)(1), the City Council is required to review the emergency action at its next regularly scheduled meeting and at every regularly scheduled meeting thereafter until the action is terminated, to determine, by a four-fifths (4/5) vote, that there is a need to continue the action. Council is required to terminate the action at the earliest possible date that conditions warrant, so the remainder of the work may be completed by giving notice for bids.
As the repairs to the collapsed sewer line are still ongoing, staff recommends that the City Council determine, by four-fifths (4/5) vote, that there is a need to continue the emergency sewer 54 repairs at Hobsonway and Lovekin Blvd.
