Councilman Rodriguez moved approval of Consent Calendar items 1-8. The motion was seconded by Councilman Burton with a unanimous aye vote.

City of Blythe Police Department Monthly Activity Reports for February 2022.

Mayor Reynolds asked the Chief to bring this program to the forefront. You have produced some outstanding numbers and would like you ot elaborate on that.

Chief Dale stated the Quality-of-Life Pilot Program started at the end of January. We had been planning it for quite a while. We don't have a lot of manpower, so we had to move some personnel around. When I speak to the community and City Council, the concern has been homeless and traffic. This program would address that in a limited way until June. We will review the stats and can continue it if it's a worthwhile program. It started out well. We are still getting the bugs out and the best way to approach the homeless. The County has been very helpful with behavioral health staff working with the officers in this program. We are making contact with people every day. We are trying to provide resources and services along with the law enforcement side. The other piece is traffic enforcement. People speak of speeding by schools and blowing stop signs. We have been putting an emphasis on residential neighborhoods Traffic Safety to fund the overtime for this o clam. We are not doing it just to write tickets, br to fix the problem.

No public comment. The item was received and filed.

PUBLIC HEARING:

Categorical Exemption- LG Harvest, LLC Commercial Cannabis Development Project. Interim City Manager Crecelius stated LG Harvest, LLC proposes to develop a -27-
commercial cannabis cultivation facility on a 0.62-acre parcel located at 416 W. Donion Street.

The site is zoned General Industrial which allows for cannabis development. Development would include clearing a dilapidated building on the site and construction of two single story buildings of 6,000 square-feet each for a total indoor grow space of 12,000 square feet.

Surrounding land uses include Interstate 10 to the north, hotels to the west and various commercial and industrial uses to the south and east. Based upon information contained in the administrative record and review of CEQA Guidelines, the City has determined that the LG Harvest Commercial Cannabis Development project is eligible for a Class 32 Categorical Exemption. The project meets each of the five criteria set forth in section 15332 In-Fill Development Projects of the CEQA Guidelines. Therefore, subsequent to the public hearing it is recommended Council adopt a Notice of Exemption for the project and direct staff to file the Notice of Exemption with the County Clerk.

No public comment. Councilman Burton moved to adopt the Notice of Exemption. The motion was seconded by Councilman Rodriguez with a unanimous aye vote.

NEW BUSINESS:

Issuance of Commercial Cannabis Business Permits to T.O.R.O. LLC. Interim City Manager Crecelius stated Malissa Attebery and Henrik and Harmik Torossian, principles of T.O.R.O, LLC submitted applications for Commercial Cannabis business permits for a Cultivation and Distribution operation to be located on vacant land in the 1400 block of E.

Hobsonway. The site is zoned General Commercial which allows for the development of • commercial cannabis structures on lots of at least 5,000 square feet. T.O.R.O. LLC completed the PRC process for the development of the property which includes the construction of one 15,300 sq ft. single story building. The principles of T.O.R.O. completed the owner background investigation with nothing found to preclude them from being issued a Commercial cannabis Permit. On March 3, 2022, staff met with all principles of T.O.R.O. LLC for the Phase III interview required of the application process. After the interview, staff recommends the award of commercial cannabis business permits to T.O.R.O. for Cultivation and Distribution at a Cannabis facility to be constructed in the 1400 Block of E. Hobsonway.

Councilman Rodriguez asked where the project was located.

Travis Pollock, representing T.O.R.O stated the project site is a vacant piece of land on the southside of the street next to the boat shop. They selected east Blythe to stay within the intent of the Ordinance to revitalize that area. The clients are dedicated to Blythe and will be relocating here. Melissa Attebery has been a teacher for 11years. They are looking for ways to support the school district and be a big part of the community.

No public comment. Councilman Rodriguez moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

Reiection of Bids- PV College Bolted Steel Water Reservoir Project. Interim City Manager Crecelius stated in January, staff released a notice inviting bids for the Palo Verde College Water Reservoir project. The project consists of the installation of a 500,000-gallon water reservoir to replace the current reservoir servicing the College and surrounding area. The -28-
current tank is over 20 years old, leaking and in need of replacement. Last year staff applied for $500,000 in funding for this project through the Community Project Program. The project was supported by Congressman Ruiz and approved for funding, but the funding has yet to be appropriated. However, today staff received word that the House will vote on an appropriations package which includes this project and believes it will be on the floor as of tomorrow. By the end of this week, we should know if we received funding for this project. At the same time, staff has also been working with the State Water Quality Board for emergency funding to complete the project. Two bids for the project were received on February 17, 2022 from RSH Construction in the amount of 1,185,500 and Superior Tank in the amount of $1,202,000. The bids are double the anticipated project budget and 30% above the engineer's estimate prepared by The Holt Group. The bids submitted were from tank manufacturers, using sub-contractors for the site prep, connection, and installation of the tank. After review of the bids received, staff believes it would be more cost advantageous to procure the tank and bid its installation separately. This may result in more competitive bids for the City and could also allow local contractors an opportunity to participate in the bid. Pursuant to the Public Contract Code and the Blythe Municipal Code, it is within Council's discretion to reject any and all bids received and provide direction to staff on future action, which may include re-advertising for bids. Staff is recommending that Council reject all bids and direct staff to re-advertise the project. Once Council has rejected the bids, staff will prepare new bid documents, which will be distributed in accordance with the requirements of the Public Contract Code and Blythe Municipal Code. After funding for the project has been secured and new bids are received and reviewed, staff will report to Council and ask for direction/award of the contract for this project.

No public comment. Vice Mayor DeConinck moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

Emergency Sewer Repairs at Hobsonway and Lovekin Blvd. Interim City Manager Crecelius stated since February, Public Works has been working to repair the collapsed sewer line at Hobsonway and Lovekin Blvd. On February 23rd at the Special Meeting, Council deemed the repair an emergency in an effort to expedite the repair work. As the repairs to the collapsed sewer line are ongoing, staff recommends Council review the emergency action in place for the collapsed sewer line at Hobsonway and Lovekin Blvd. It is further recommended Council, by a 4/5 vote, determine there is a need to continue the emergency repairs.

Councilman Halby asked how long the repairs would take. It was estimated at 30-45 days depending on damage and availability of building materials.

Mayor Reynolds asked if the road could be re-opened. It was reported we know we have a sink hole on the southside. Once we get in there, we will se the extemi of the damage and repair as No public comment. Councilman Rodriguez moved approval of the emergency repairs. The motion was seconded by Councilman Burton with a unanimous aye vote.

ORAL REPORTS:
-29-_
Interim City Manager Crecelius reported last week I informed you of the Clean California Local Grant; but want to make an announcement for the public. A press release is forthcoming. The City, in partnership with Palo Verde Valley Transit Agency, with the help of RCTC and Climate Resolve applied for $2.9 million for improvements at Public Works, Miller Park, the PVVTA Park n Ride and ADA bus stop improvements and amenities. Last week we received word we were awarded the grant. That's $2.9 million in State funding coming to the City. We have until 2024 to use the funding. Part of the grant includes beautifying the city so we will have several community clean up days, ribbon cuttings and hope to encourage public participation in the grant. The Outlook Conference is back after a two-year hiatus and scheduled for April 7, 2022.

This week, with the help of Chief Dale we submitted a letter of support to the California Assembly supporting ABI 599 which opposes Prop 47. The intent is to repeal a lot of Prop 47 which was implemented to change felony sentencing laws in California. It reclassified certain thefts and drug possession charges from felonies to misdemeanors. It authorized resentencing for defendants serving sentences for felonies now classified as misdemeanors and authorized defendants who had completed their sentences to have their convictions reclassified. Locally, it tied our officers' hands. Now, any theft under $950 is basically a slap on the wrist. Law Enforcement throughout California has supported the repeal of Proposition 47.

Chief Dale said after fourteen years of stellar service, Sgt. Iniguez has moved on. This opened a sergeant's position which was an opportunity for promotion. The promotions were made last week. Corporal Burt was promoted to Sergeant and will remain in the Patrol division. Officer Gandara was promoted to Corporal and will be transferred to the Detective Bureau. Officer Moreno was promoted to Corporal and will remain in the Detective Bureau. We will backfill by hiring one new officer. Milton Acevedo will be sworn in on March 21s!. We will also hold a promotional ceremony at the same time. We hired Rebecca Smith in the limited term receptionist position.

MEMBER COMMENT:

Councilman Burton stated a few years ago the School District invested in the barn project to encourage more students to participate in the FFA program. It affords students who don't have property a place to keep their animals.

Vice Mayor DeConinck stated the taxpayers paid for that though property taxes.

PUBLIC COMMENT:

Kristi Kirk, a Senior Deputy District Attorney in Riverside County stated her whole career has been based in the eastern division. My ultimate dream was to be a judge. I am a prosecutor, and you don't often get appointed right now. A spot has opened up in the eastern region due to the retirement of Judge Wells. I have his full endorsement. I have put in for his seat and am here to introduce myself in person and seek your endorsement. I am endorsed by DA Mike Hestrin. I am endorsed by almost all of the peace officer associations including PORAC. For the June 7th election there are 4 open judicial seats. The DA's office has a rare opportunity to run for all four seats and show what the DA's office can present in judges.

Angela Colangeli stated she is sharing her son Steven's story as he took his life on October 27, 2021. During our grieving time we started a program to get resources to Blythe. We are holding a -30-
mental health and suicide awareness program. It will be a march and rally on March 26th. We have resources coming from Riverside County and resources from Blythe. My son was diagnosed with schizophrenia five years ago. I have been his advocate. During his illness there were a lot of things I didn't know. Now that he has passed, I've had time to research and found a lot of resources for Blythe. Blythe is part of Riverside County, and they forget us so I started advocating for everyone. We have an HIV van coming to do testing, COVID-19 testing, suicide awareness, therapists, etc. I learned we have two companies with therapists from Loma Linda doing zoom therapy in Blythe. This has been happening for two years and I had no idea. SAC Health will have therapists by the end of the year for the Blythe area. I am here to let you know what we have going on in our community and hope you can attend. We don't have our 501c3, so we are co-sponsored by KERU until we get it. Any money collected will be for our community.

It could be used for travel and help the caretakers with self-care. This is a call for action to share my son's legacy. We are working on identification bracelets. We hope to carry it on and bring more resources. This is for my son, and I am not going to stop.

ADJOURN: The City Council meeting was adjourned at 7:03pm.

THAT TRI TEL CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: April 12, 2022
SUBJECT: Surplus Firearms Trade In
PRESENTED BY: Garth V. Dale, Chief of Police
PREPARED BY: Garth V. Dale, Chief of Police
RECOMMENDATION: Council deem the attached list of firearms as surplus property and authorize staff to trade in the firearms to Arms Unlimited for store credit at current market value.

The store credit will be used to acquire new firearms, ammunition, and other firearm related equipment.

FISCAL IMPACT: $1,850.00 in store credit to purchase new firearms and related equipment.

BACKGROUND: When City equipment is no longer in use by a department, or has met its useful life, Council must deem it surplus to dispose of the asset. In the past, the Blythe Police Department has sold surplus firearms to one of the three local businesses certified and licensed by the State of California and Federal Agencies to sell firearms, ammunition and shooting supplies. However, due to the federal classification of the firearms being traded in, special federal licensing is required. None of the local businesses who sell firearms have this special licensing.

STAFF REPORT: Currently, The Blythe Police Department has five older AR 15 type rifles.

Since acquiring new rifles recently, these rifles are no longer in service. These five rifles can be legally transferred to a licensed police supply company for in store credit.

Staff contacted other police and firearms supply businesses and determined Arms Unlimited submitted the only bid and offered the most store credit. The equipment obtained with the store credit will serve the Blythe Police Department and the City of Blythe for the next ten to fifteen years.

Arms Unlimited will only sell the listed firearms to buyers meeting all Federal and State guidelines and waiting periods. All Store credit from Arms Unlimited will be exchanged for firearms, ammunition, and other firearms equipment, easing the burden on the General Fund.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
LISHER
MEETING DATE: April 12, 2022
SUBJECT: Donation of Ballistic Vests and Helmets
PRESENTED BY: Garth V. Dale, Chief of Police
PREPARED BY: Garth V. Dale, Chief of Police
RECOMMENDATION: Ratify the donation of the attached list of expired ballistic vests and helmets made to the California Governor's Office of Emergency Services Law Enforcement Branch for Ukraine.

FISCAL IMPACT: None.

BACKGROUND: When City equipment is no longer in use by a department, or has met its useful life, it is considered surplus.

In early March, the California Governor's Office of Emergency Services Law Enforcement Branch ("Cal OES") contacted California law enforcement agencies including the Blythe Police Department to request donations of ballistic helmets, ballistic vests and other tactical safety equipment for Ukraine. The State indicated it has been working with the Ukrainian Consulate in San Francisco, philanthropic organizations and NGOs on organizing and providing humanitarian assistance and commodities for individuals and families remaining in Ukraine. Cal OES indicated the Ukrainian Consulate specifically requested these items and is aware that the equipment will be beyond its expiration date.

STAFF REPORT: The Blythe Police Department had a large pile of expired bullet resistant vests and riot helmets that could no longer be utilized by personnel. The items were beyond their usable life and had expired certification. The Police Department previously identified these items as surplus property for disposal.

The City of Blythe could not sell this equipment due to the potential liability associated with them failing or falling into the wrong hands, the equipment could not be sold at auction and had little to no value.

Generally, staff presents surplus property that has been deemed for disposal by itemized listing to the City Council prior to its disposal. Here, however, due to the limited value of this surplus equipment, the difficulties the City would face in disposing of the equipment in a different manner, and the time sensitive nature of the request from Cal OES, the Interim City Manager approved of the donation to Cal OES. Cal OES picked up the equipment on Saturday, March 19, 2022.

Staff is requesting that the City Council ratify the donation of the surplus equipment.

STAFF REPORT
MEETING DATE: April 12, 2022
SUBJECT: Investment Report for Third Quarter Fiscal Year 2021-2022 March 31, 2022
PRESENTED BY: Christa Elms, City of Treasurer
PREPARED BY: Christa Elms, City of Treasurer
RECOMMENDATION: City Council accepts and files the Quarterly Investment Report.

FISCAL IMPACT: None.

STAFF REPORT: The City of Blythe has for many years invested all excess cash (cash not needed for daily operations) for all City funds and the Successor Agency with the California State Local Agency Investment Fund (LAIF). LAIF offers the City and the Agency liquidity and safety. There are more profitable investment instruments on the market, but risk increases with yield.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: April 12, 2022
SUBJECT: Emergency Sewer Repairs at Hobsonway and Lovekin Blvd.

PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council review the emergency action in place for the collapsed sewer line at Hobsonway and Lovekin Blvd. It is further recommended Council, by a 4/5 vote, determine there is a need to continue the emergency repairs.

FISCAL IMPACT: Unknown.

BACKGROUND: In early February, Public Works was notified of a sewer back up at Sure Stay Motel located at the corner of Hobsonway and Lovekin. Crews believed there was a breach in the line and worked to determine its location. Due to the size of the line, no local operators had the equipment necessary to camera the line to determine the location. Crews set up temporary measures to keep the line flowing, and closed Hobsonway as a precaution until the repair could be made.

On February 18, 2022, CV Pipeline was able to camera the line and determined the line was collapsed on the north and south sides of the sewer manhole.

Per Section 2.66.070 of the Blythe Municipal Code and the City's Purchasing Policy, in cases of emergency, the Council, after making a finding, based on substantial evidence clearly stated in the meeting minutes, that the emergency will not allow for a delay resulting from a competitive solicitation for bids, and that the action is necessary to respond to the emergency, may by a four- fifths vote of the Council, repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes without giving notice for bids to let contracts.

Due to the extent of the collapse and its repair, the location of the pipe in a main City corridor as well as its location to highly trafficked fiber optic lines, Council took action at the February 23, 2022 Special Meeting to deem the repairs an emergency and, by a four-fifths (4/5) vote of the Council, made the required finding that the emergency would not allow for a delay resulting from a competitive solicitation for bids, and that the action was necessary to respond to the emergency.

Per Public Contract Code section 22050(c)(1), the City Council is required to review the emergency action at its next regularly scheduled meeting and at every regularly scheduled meeting thereafter until the action is terminated, to determine, by a four-fifths (4/5) vote, that there is a need to continue the action. Council is required to terminate the action at the earliest possible date that conditions warrant, so the remainder of the work may be completed by giving notice for bids.
-72-
The Blythe City Council determined there was a need to continue the emergency at the March 8, 2022 Council meeting.

STAFF REPORT: The Holt Group provided a design for the relocation of the manhole and collapsed sewer line. Several contractors were identified, and proposals for the repair were received from:

Radco $179,795.00
Rove Engineering $308,450.00
Staff entered into an agreement with Radco the week of April4th. Due to supply chain issues, materials needed are estimated to be 3-4weeks from delivery. As soon as supplies are received, work will begin on the sewer repair. The contractor estimates the work could begin as soon as May 1, 2022. Once the new sewer line is in place, the road will be repaired. Rove Engineering will be in the Blythe April through June working on the San Luis Way and Lovekin and Barnard Street Improvement projects. The plan is to have Rove Engineering repave the street as soon as feasible once the sewer line is addressed.

As the repairs to the collapsed sewer line are still ongoing, staff recommends that the City Council determine, by four-fifths (4/5) vote, that there is a need to continue the emergency sewer repairs at Hobsonway and Lovekin Blvd.

STAFF REPORT
MEETING DATE: April 12, 2022
SUBJECT: Housing Element Update
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council entertain a presentation from The Holt Group on the process for completing the City's Housing Element.

FISCAL IMPACT: $63,000 in funds budgeted in FY 2021/22 for the required Housing Element Update.

BACKGROUND: Since 1969, California has required that all local governments adequately plan to meet the housing needs of everyone in the community. Local governments meet this requirement by adopting housing plans as part of their General Plan. General Plans serve as the blueprint for how the city will grow and develop and include seven elements: land use, transportation, conservation, noise, open space, safety, and housing.

The City's Housing Element was last updated in 2014, with a period of 2013 through 2021. The update was prepared by Pacific Municipal Consultants "PMC".

The Housing Element is the only element of the General Plan that involves certification by a State Agency. HUD will review and certify the City's Housing Element once prepared.

In February, the City Council awarded the preparation of the City's 6" Cycle Housing Element Update to the Holt Group.

STAFF REPORT: The Holt Group will present the process for completing the required Housing Element Update and how the public will be engaged throughout the process.

TRIES HAT BURE CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: April 12, 2022
SUBJECT: Ordinance Repealing and Replacing Chapter 3.08 of the Blythe Municipal Code Relating to Claims Administration Procedures and Settlement Authority
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Brittany Roberto, City Attorney
RECOMMENDATION: It is recommended that the City Council introduce for first reading, by title only, further reading waived, Ordinance No. 914-22:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, REPEALING AND REPLACING CHAPTER 3.08 (CLAIMS AND DEMANDS) OF TITLE 3 (REVENUE AND FINANCE) OF THE

BLYTHE MUNICIPAL CODE RELATING TO CLAIMS ADMINISTRATION PROCEDURES AND SETTLEMENT

AUTHORITY
FISCAL IMPACT: None.

BACKGROUND: Chapter 3.08 of the Blythe Municipal Code establishes requirements for presenting claims and demands to the City. Chapter 3.08 was adopted in 1916 and has not been amended since such time.

The Government Claims Act generally requires that a plaintiff first present a claim to a public entity before filing a lawsuit for damages against that entity. As a result of these requirements, the City receives a large number of claims each year, regarding a wide range of injuries, complaints and other demands.

California Government Code section 935.4 allows the City Council, by ordinance or resolution, to authorize a City employee to allow, compromise or settle a claim against the City, provided that the amount to be paid by any allowance, compromise or settlement does not exceed $50,000. California Government Code section 949 permits the City Council to delegate authority to its attorney or to an employee to settle or compromise any pending action.

The City Council has not formally delegated authority to any City employee to settle certain claims or settle pending actions.

Further, the City is a member of the Public Entity Risk Management Authority (PERMA), and pools its self-insured liability claims and losses with other PERMA members under a Memorandum of Coverage. PERMA has indicated that delegating claim settlement authority to PERMA will allow early settlement opportunities and help contain costs which ultimately impact the City's annual contribution and the pool's funding rates.

STAFF REPORT: The proposed ordinance repeals and replaces Chapter 3.08 of the Blythe -76-
Municipal Code in order to formally delegate certain settlement authority to the Human Resources/Risk Manager and City Manager.

The proposed ordinance delegates authority to review and settle claims and pending actions as follows:
• Authorizes the Human Resources/Risk Manager or his/her designee to review al laims for sufficiency and to reject any and all claims. This formalizes PERMA' ability to review and reject claims on behalf of the City. • Authorizes the Human Resources/Risk Manager to allow, compromise or settle claims, including workers' compensation claims, where the amount to be paid pursuant to an allowance, compromise or settlement does not exceed $15,000, subject to the concurrence of the City's legal counsel.
• Delegates authority to the City Manager to allow, compromise or settle claims, including workers' compensation claims, and pending actions where the amount to be paid pursuant to an allowance, compromise or settlement does not exceed $50,000. • Authorizes the City Manager to delegate authority of up to $5,000 to the City's designated claims administrator to settle third party liability claims against the City.

Once a claim or pending action has been allowed, compromised or settled by the Human Resources/Risk Manager or City Manager or their designees, the ordinance requires the Finance Director to cause a warrant to be issued in the amount of such settlement or compromise.

Adoption of the ordinance establishing formal settlement authority for the Human Resources/Risk Manager and the City Manager will help to streamline claims processing and will reduce the need for the City Council to consider modest settlements in closed session. If approved, staff will provide reports to the City Council relating to claims and pending actions that have been settled or compromised within these settlement limits.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: April 12, 2022
SUBJECT: Blythe Police Department Security System Project PRESENTED BY: Garth V. Dale, Chief of Police
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Award the Blythe Police Department Security System Projectto ASSI 'ecurity in an amount not to exceed $78,350, Authorize the Interim City Manager to execute greement No. 2022-016 A for the project and authorize the Interim City Manager to enter int an annual maintenance agreement with ASSI Security in an amount not to exceed $3,500 per year.

FISCAL IMPACT: $100,000 was budgeted for security upgrades at the Police Department and City Hall in the FY 2021/22 Budget.

BACKGROUND: The current door lock system at the Blythe Police Department was installed in 1999. The company who installed and maintained the system has since gone out of business.

The Police Department continued to use the system; programming keys as needed until the sofiware finally failed. The Department now has a limited number of programed keys, with no way to obtain additional keys or restricts assess as needed to existing keys. This presents a security issue for the Department. Due to the age of the equipment, other options to continue with the current system are unavailable. The technology has changed so much, that the best way to proceed is to install a new, card reader system that can be programed in house by police administrators.

Replacing the access control system at the Police Department has been a priority for several years, but funding was not available. In the current budget, $100,000 was allocated to make these improvements at the Police Department and to upgrade the card reader at City Hall.

Although the access control system is the priority, the camera system is also in need of allocatenent. Both projects were included in the RFP in hopes of doing both with the funding STAFF REPORT: In January, staff released an Invitation for Proposal for the Blythe Police Department Security System Project. The RFP included converting the existing door lock system to an access control system and the installation of indoor and outdoor security cameras. A mandatory pre-bid meeting was held at the Blythe Police Department on February 8, 2022 with six contractors in attendance. Two responsive and responsible bids were received from:

ASSI Security $114,500.00
Johnson Controls $124,127.69
A third proposal received was deemed not responsive and was therefore not considered for the project.
-83-
Due to the bids for the access control and camera system being over the allocated budget for the project, staff decided to move forward with the access control system only at this time. The camera project will be re-bid as funding permits.

ASSI submitted a revised proposal for the access control system at a cost of $78,350 with an annual maintenance fee of $3,500. Johnson Control's proposal for the access control system was $92,112.04 with an annual maintenance fee of $3,720.60. It should be noted that maintenance is included in the first year.

Based on the bids received for the access control system, staff recommends awarding the project and an annual maintenance agreement to ASSI Security.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: April 12, 2022
SUBJECT: Ordinance Adopting Military Equipment Use Policy as Required by Assembly Bill 481
PRESENTED BY: Garth V. Dale, Chief of Police
PREPARED BY: Garth V. Dale, Chief of Police and Brittany E. Roberto, City Attorney RECOMMENDATION: It is recommended that the City Council introduce for first reading, by title only, further reading waived, Ordinance No. 915-22:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, ADOPTING A MILITARY

EQUIPMENT USE POLICY GOVERNING THE USE OF MILITARY EQUIPMENT PURSUANT TO ASSEMBLY BILL FISCAL IMPACT: No direct fiscal impact to adopt the proposed Ordinance approving the Military Equipment Use Policy. Indirect costs may include staff time for compiling reports and responding to complaints in connection with the Policy.

BACKGROUND: On September 30, 2021, Governor Gavin Newsom signed Assembly Bill 481 ("AB 481") into law, which became effective January 1, 2022. AB 481 seeks to provide transparency, oversight, and an opportunity for meaningful public input on decisions regarding whether and how military equipment is funded, acquired, and used by law enforcement agencies. "military equipment" is defined in California Government Code Section 7070 and includes, but is not limited to, unmanned aerial or ground vehicles, armored vehicles, command and control vehicles, pepper balls, less lethal shotguns, less lethal 40mm projectile launchers, long range acoustic devices, and flashbangs. The items considered to be "military equipment" by AB 481 are employed by many law enforcement agencies across the country to enhance citizen and officer safety.

Pursuant to AB 481, the military equipment use policy must be adopted by ordinance at a regular meeting of the City Council. For law enforcement agencies that seek to continue use of military equipment acquired prior to January 1, 2022, the approval process must commence by May 1, 2022. AB 481 requires that the proposed policy be provided to the City Council and posted on the Police Department's website for at least 30 days prior to the public meeting at which the policy is considered. Pursuant to AB 481, the City Council may only approve the military equipment use policy if it makes the following determinations:
-112-
(A) The military equipment is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety. (B) The proposed military equipment use policy will safeguard the public's welfare, safety, civil rights, and civil liberties.
(C) If purchasing the equipment, the equipment is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.
(D) Prior military equipment use complied with the military equipment use policy that was in effect at the time, or if prior uses did not comply with the accompanying military equipment use policy, corrective action has been taken to remedy nonconforming uses and ensure future compliance.

Once adopted, AB 481 requires annual review and renewal of the ordinance, annual reporting on the military equipment identified in the policy, and an annual community engagement meeting regarding the annual report.

STAFF REPORT: Of the fifteen categories of "military equipment" listed in AB 481, the Police Department has items in two categories and intends to seek approval for and acquire items in two other categories. The items the Police Department currently has include an armored vehicle and specialty firearms. The Department intends to seek approval for the purchase of unmanned aircraft systems and pepper ball carbines within approximately six months. The list of equipment is outlined in Attachment A of the proposed Military Equipment Use Policy ("Policy").

In addition to the City's equipment, the proposed Policy contemplates use of military equipment owned by other law enforcement agencies. The Policy provides that military equipment used by other jurisdictions that are providing mutual aid to Blythe must comply with their respective military equipment use policies in rendering mutual aid. The Policy also provides authorization for the Police Department to deploy or use military equipment owned by other law enforcement agencies. A non-exhaustive list of equipment owned by other agencies that may be used by the Police Department is included as Attachment B to the Policy.

The proposed Ordinance contains the findings required by AB 481 and approves the Policy. The Police Department will comply with the requirements of AB 481, including annual reporting and community engagement as well as presenting the Ordinance to City Council annually for renewal.

Increased accuracy and precision at long range distances • Currently used by most law enforcement agencies across the nation • Flashbang grenades
• Light Sound Diversionary Device (LSDD-"Flashbangs") are used to minimize risk to all parties through the temporary distraction or disorientation of armed and violent suspects that pose significant danger to the deputies and community. The effects of the LSDD reduce a suspect's reactionary capabilities and allow for momentary disorientation which creates a tactical advantage. LSDD is a hand delivered device and generally deployed on the exterior of structures Provides a humane fright to aggressive dogs that pose a threat to deputies Explosive breaching tools are used to breach fortified structures to establish a point of entry. Explosive charges are fashioned to produce little to no fragmentation at the time of detonation. Explosive breaching effectively reduces the time spent overcoming a fortified door or structure. The reduction in time mitigating a hardened structure increases officer safety and the element of surprise. Blast injuries are reduced by using low yield explosives that mechanically overcome door frames and locking mechanisms. Explosive breaching mandates extensive schooling and certification processes
• Tear gas
• Chemical agents are deployed through various means to include hand delivery and weapon launchable, such as pepper ball. Munitions are either 37mm or 40mm caliber, shotgun ferret rounds or cannister shotgun launched ordinance.
