PUBLIC HEARING:

Certification of Environmental Impact Report (EIR) Prepared for the Edelweiss Sustainable Farms Project. Interim City Manager Crecelius stated In April 2021, Edelweiss Sustainable Farms, LLC filed an application to develop a cannabis cultivation facility on 34 acres in western Blythe. In November of 2021 the city entered into a MOU with MSA Consulting for preparation and handling of an Environmental Report for the proposed project to satisfy requirements of the California Environmental Quality Act, known as CEQA. The City also retained its Environmental Consultant Dr. Jeff Harvey of Harvey Consulting Group to coordinate with MSA and represent the City's interests and requirements through the development of the Draft and Final EIR documents. The action this evening is Certification of the Environmental Impact Report for the Edelweiss Sustainable Farms Project. The City is required to evaluate potential environmental effects of the project under CEQA. In preparation of the EIR, the City's staff and consultant independently reviewed, evaluated and exercised judgment on the project and the project's environmental impacts. Potentially significant impacts were identified in the following resource areas: Aesthetics, Air Quality, Biological Resources, Cultural Resources, Energy, Geology and Soils, Green House Gas Emissions, Hazards and Hazardous Materials, Hydrology and Water Quality, Public Services, Transportation, Tribal Cultural Resources and Utilities. Mitigation measures have been designed and are included in the EIR to reduce all identified potential adverse impacts to a level of less than significant.

Representatives of the Edelweiss Sustainable Farms Project are here this evening to provide a brief overview of the project. After their presentation, it is recommended the City Council open the public hearing. Subsequent to the public hearing it is recommended Council adopt Resolution No. 2022-026 certifying an Environmental Impact Report, adopting and making certain findings relating to the Edelweiss Sustainable Farms Project located south of Hobsonway, north of Interstate 10, west of Lovekin Boulevard and east of Defrain Boulevard in the City of Blythe; direct staff to file the Notice of Determination for the project and adopt Resolution No. 2022-027 approving the Site Plan for the proposed project.

Mike Rowe of MSA Consulting has worked with Edelweiss on this project. He provided an overview of the project. The project will be built in three phases with all infrastructure built in Phase 1. We are trying to make the budgets work to build as we go. We hope to break ground later this year. He thanked Interim City Manager Mallory Crecelius and Dr. Jeff Harvey who helped his staff put this document together.

Patrick Kelly, Project Manager and Shaina Adamson, Compliance for Edelweiss stated they are excited about the project and working with Blythe.

Councilman Burton asked how many jobs this would create. Mr. Kelly stated each facility is mandated to have 75 full time employees. There will be a float crew that goes from building to building as well. The trim and processing crew is 150. We do non-volatile extract. That is a 35- person crew. So once its fully up and running we are looking at 400-500 people. We also do technology-based cultivation and look at automation. We certify and train all our employees.

No public comment. Vice Mayor DeConinck moved approval of Resolution No. 2022-026. The motion was seconded by Councilman Rodriguez with a unanimous aye vote. -45-

Proposed Ordinance No. 918-22 Amending Provisions of the Zoning Code Relating to Residential Care Facilities, Group Dwellings and the Definition of Family for Compliance with State and Federal Law. Interim City Manager Crecelius stated pursuant to State law, the City is required to treat various State-licensed residential care facilities serving six or fewer people no differently than other residential uses that are permitted by right. During the Housing Element update process, it came to staff's attention that the City's Zoning Code does not permit such facilities by right in residential zones. It also came to staff's attention that the definitions of "family" and "group dwelling" are not consistent with State and Federal law. The proposed Ordinance amends the table set forth in Section 17.08.010 of Title 17 of the Blythe Municipal Code to reflect that small residential care facilities are permitted in all Residential zone as well as in the Agriculture, Planned Development, and Specific Plan Resort zones. It also amends the table set forth in Section 17.08.010 to reflect that large residential care facilities are permitted with a conditional use permit in the Residential Estates, Low-Density Residential, Medium- to Low-Density Residential Medium Density Residential, High-Density Residential, Planned Development and Rural Residential zones, consistent with the programs outlined in the draft Housing Element update. The proposed ordinance also amends Chapter 17.08 to add a new Section 17.08.625 to provide a definition for "residential care facility, small" and a new Section

17.08.628 to provide a definition for "residential care facility, large". Finally, the proposed ordinance revises the definition of "family" set forth in Section 17.04.450 of Chapter 17.04 of Title 17 and the definition of "group dwelling" set forth in Section 17.08.370 of Title 17 for consistency with State and Federal law. This is the first of two public hearings regarding the proposed ordinance in accordance with the requirements of State law and the Blythe Municipal Code. The first hearing is being conducted by the City Council, acting as the City's Planning Agency.

CONTINUED BUSINESS:

Emergency Sewer Repairs at Hobsonway and Lovekin Blvd. Interim City Manager Crecelius stated the sewer repairs at Hobsonway and Lovekin have been deemed an emergency since February 23rd The City Council is required to review the emergency action at every regularly scheduled meeting until the action is terminated. Radco will finish the prescribed work -46-
next week. As such, we anticipate terminating the emergency at the September meeting. It is recommended Council, by a 4/5 vote determine there is a need to continue the emergency repairs.

No public comment. Councilman Rodriguez moved to continue the emergency repairs. The motion was seconded by Councilman Burton with a unanimous aye vote.

NEW BUSINESS:

September City Council Meeting Schedule. Interim City Manager Crecelius stated due to staff and Council's attendance at the League of California Cities Conference September 7-9th it is recommended Council hold the September City Council meeting on Tuesday, September 27* and go dark the second Tuesday of September. The Council will resume its regular meeting schedule in October.

No public comment. Vice Mayor DeConinck moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

Response to the 2021-22 Grand Jury Report. Interim City Manager Crecelius gave a presentation of the contents of the City's draft response to the 2021-22 Grand Jury Report. The repot highlights that Blythe is growing in projects, programs, development and in its financial health. The response also highlighted several inaccuracies and half-truths outlined in the Grand Jury's report related to the City' financial position as well as other statements made about the City, how the city operates, and statements made about its tax revenue. Blythe is not dying; Blythe is a market ripe for opportunity. We do not need to increase taxes; we need to grow our tax base with development. It is recommended that the City Council approve the response to the 2021-22 Grand Jury Report entitled "City Blythe is Dying" in substantially the form as attached.

We may make minor edits before it is submitted. If the Council would like to add anything, we will do that before it is submitted to the Grand Jury. It is recommended Council authorize the Mayor to execute the response and direct staff to submit the response as required.

Vice Mayor DeConinck stated we are the State line. We have two prisons, but there was supposed to be five built here. MWD gets a reduction in property tax, they file for it every year.

That takes away from our revenue. The Fish and Game received land through a conservatorship.

They do not pay a dime in property taxes, but the City is required to provide police and fire protection and maintain the roads. Those revenue sources were taken away from Blythe. Those are some of my concerns related to the Grand Jury report.

Councilman Halby stated there were so many misstatements in their report. The facts are not true because they are not facts. The one that made me laugh right in the beginning was when they stated in the 1970's the small family farms sold out to the corporate farms. What are they talking about? The corporate farms all left in the 70's and 80's like Dole and Del Monte. That had to do with California regulations. It was easier for them to go to Yuma. Now those companies are huge down there. Every time I read it; it makes me sick. People who have spoken to me about it know how I feel.

Public comment. Mike Farrage of 2714 Colorado River Road stated speaking about farming in -47-
the 70's, when Arizona was a right to work State and we had the labor strikes, that devastated Blythe. At the same time, I am not sure how that correlates with the freeway, but everyone traveling from Phoenix to LA came though Hobsonway. When the farming community left here, you can look at where Yuma was and where they are now. There has to be some liability. The County comes here, who are these people? They take everything away from us and come here once a year or when it's an election year to give the dog and pony show and after that they don't show up. I know they help with certain things, but I've even heard they say things like put them happening in Blythe from we can't, to how can we, because we are already doing it. It takes a long time for that to happen. To me, shouldn't be allowed to happen. We have investors that come here and then they see a report like this, that is devastating to Blythe.

Vice Mayor DeConinck moved approval of staff's recommendation. The motion was seconded by Councilman Rodriguez with a unanimous aye vote.

PUBLIC COMMENT:

Mr. Brookins made public comment related to the same officer I am dealing with; he continues to harass and profile me. If he damages my property, I can damage his. He put his clipboard on the hood of my car. They threatened to take my car. He issued unlawful and lawful orders. If you won't do anything about it, I guess its status quo. I have requested an IA. I am asking for preservation of documents and body worn camera footage.

NEW BUSINESS:

Law Enforcement Services Agreement between City and PVUSD. Police Chief Dale stated over the last several years critical incidences on school campuses across the nation have increased in frequency and severity. Most recently the tragedy at Robb Elementary School in Uvalde, Texas has prompted school districts and law enforcement to reevaluate how resources are spent on safety and security for students and staff. Putting officers on campus as School Resource Officers (SRO) has been the answer in the past. However, SRO programs often focus on mentorship and building positive relationships with students. This is only part of the solution.

A patrol officer properly trained in active shooter tactics, critical incident response planning and prevention, threat assessment and target hardening fills a void that a busy local law enforcement agency cannot do without additional personnel, training and equipment. Over the last six months Blythe Police Department administration has been in discussion with the PVUSD Superintendent's office to develop a new model of interagency collaboration between law enforcement and the school district. On August 16, 2022 the PVUSD Board approved the attached MOU and are committed to this program. The model will not replace; but will augment the Riverside County Sheriff's Department Deputy assigned as an SRO. A uniformed Blythe Police Officer will be assigned day shift during school hours and will patrol all PVUSD schools.

Duties of the officer include responding to all safety and security incidences requiring law enforcement action; and to provide backup assistance to the SRO. Officers will closely patrol campuses, conduct threat assessments, make recommendations for target hardening, prepare response plans, maintain keys, codes, and information needed to gain immediate entry into all schools. The assigned officer will develop contacts within every school administration and direct -49-
staff in the event of an emergency. The officer will have specialized tactical equipment available while on duty. In the event of a law enforcement emergency, the assigned officer will be responsible for establishing an incident command post, assessing the incident, and forming immediate response to active or potential threats to the safety of staff and students. PVUSD will fund up to $185,000 per year to cover the cost of this officer, equipment and training. The estimated cost of the program is $191,000 per year. This program will cost the City about $6,000 per year. It is recommended the City Council approve the addition of one full time police officer position and authorize the Interim City Manager to execute the MOU to provide law enforcement services to the Palo Verde Unified School District.

Councilman Halby asked about tactical equipment and what they would be wearing on a regular basis at the School. Chief Dale stated it's a standard uniform with an outer vest. Councilman Halby prefers they not wear the outer vest. I think they should look friendly and approachable.

Councilman Rodriguez stated this is not a PR position. It will be for command presence. I understand where you are coming from. Law enforcement is transitioning to the outer vest. The only one who still wear the inner vest is Highway Patrol. I have worn both and like the look of the inner vest better, but when I have to move and perform tactically, there is nothing better than an outer vest. You can carry more, its safer for the officer, you get less heated. It puts more command presence for this officer on the streets.

Chief Dale stated the full weight of the duty belt you wear on patrol causes lower back conditions for law enforcement. The outer vest puts the weight from your hips onto your shoulders. Its less of a medical problem for the hips and lower back.

Councilman Burton thinks this is proactive, not reactive. With everything going on, sometimes we get comfortable and think this would not happen in Blythe. When we have a prepared mentality, being former law enforcement, I am for being proactive. I think this is great.

Councilman Rodriguez commended the Chief and School District for jumping on this as fast as they can and pushing it as fast as they can to get it done.

Vice Mayor DeConinck asked if this officer would be available at all schools. Police Chief Dale stated the Officer will be dispatched through Dispatch. If someone called 911, they would be dispatched to respond, it would not be a call to their cell phone. This makes it recorded and makes the supervisor and other officers aware that there is an incident. This is part of the shift and supervised by the shift supervisor. Vice Mayor DeConinck thinks its great to have in place and hope that something never happens, but all we can do is try to be proactive.

Mayor Reynolds asked what type of equipment would be issued.

No public comment. Councilman Rodriguez moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT

TABLISHED
MEETING DATE: September 27, 2022
SUBJECT: Request to Waive Community Center Rental Fees for the Rec-N-Crew's Annual Homecoming Fundraiser
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council waive the Community Center Rental fees except for the $100 labor fee for the Rec-N-Crew's Homecoming Fundraiser.

FISCAL IMPACT: Loss of $500 in rental fees.

BACKGROUND: For a number of years the Rec-N-Crew has hosted a fundraiser during Homecoming in front of the Community Center in Todd Park. The Community Center has been used by the Rec-N-Crew to store equipment overnight and for use of the public restrooms during the event. In previous years the Rec-N-Crew has coordinated its use of the Center with other applicants renting the center for Homecoming class parties. So far this year, nobody has requested to rent the center during Homecoming. As such, the Rec-N-Crew is required to submit the appropriate paperwork and fees for its use.

STAFF REPORT: The Rec-N-Crew was formed to support the Blythe Joe Wine Recreation Center. As the Homecoming event is one of their annual fundraisers, it is requested Council waive the rental fees for their use. As the labor fee to open and close the facility is a direct cost to the City, staff recommends Council waive all fees except for the $100 labor fee.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: September 27, 2022
SUBJECT: Surplus Property
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Staff recommends Council deem the items detailed in this report as surplus and excess property and authorize staff to dispose of the items which have met their useful life.

FISCAL IMPACT: None.

BACKGROUND: When City Equipment is no longer in use by a department, or has met its useful life, Council must deem it surplus for staff to dispose of the asset.

STAFF REPORT: The Joe Wine Blythe Recreation Center operates a fitness gym with various types of workout equipment available for use by the public. During an inspection the workout equipment earlier this year, it was determined there were substantial repairs that needed to be made to some of the City's equipment. Due to the age of the equipment and cost to repair, staff obtained quotes to purchase replacement equipment. The equipment purchase was approved in the FY 2022/23 budget. The new equipment was installed the week of September 12t and the old equipment was removed from the gym.

Staff recommends Council deem two stair steppers, two ellipticals, two stationary bikes and two treadmills as surplus equipment. These items need repair and have little value. Staff wishes to dispose of the assets as they are no longer needed for the operation of the fitness gym in the Joe Wine Recreation Center.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: September 27, 2022
SUBJECT: Consideration of Resolution Determining the Need to Continue the Local Emergency Due to May 23, 2022 Fire on Spring Street PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Brittany Roberto, City Attorney
RECOMMENDATION: It is recommended that the Council adopt the following Resolution:

RESOLUTION NO. 2022-032 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE,

CALIFORNIA, DETERMINING THE NEED TO CONTINUE THE LOCAL EMERGENCY PROCLAIMED ON MAY 24, 2022 AND PREVIOUSLY CONTINUED ON JULY 12, 2022 AND AUGUST 9, 2022 DUE TO THE FIRE THAT STARTED ON MAY 23, 2022
FISCAL IMPACT: Unknown at this time.

BACKGROUND: On May 23, 2022, at approximately 8:40 p.m., a fire started burning on North Spring Street between Hobsonway and Murphy Street. The Blythe Fire Department requested and received mutual aid from CAL FIRE, the Parker Fire Department, the Ehrenberg Fire Department and the Imperial County Fire Department. The Blythe Police Department requested and received mutual aid from the Riverside County Sheriff's Department, California Highway Patrol and United States Border Patrol, who assisted with securing the scene and traffic control due to the large amount of pedestrian and vehicle traffic that were impeding the Fire Department's ability to respond to the fire.

The fire was fully contained by approximately 12:00 a.m. on May 24, 2022. The Ashley Furniture HomeStore and Sears Hometown Store were completely destroyed and the Calvary Chapel sustained water damage as a result of the fire. Other damages included debris on City streets and rights-of-way, resonating smoke in the vicinity of the fire and a lingering smoke smell in the Blythe Police Department and City Hall. Since that time, damages to public property have been repaired. The owners of the Sears Hometown Store have commenced cleanup on their property.

On May 24, 2022, as authorized by California Government Code Section 8630(a) and Blythe Municipal Code (BMC) Section 2.52.120(A)(2), the Mayor, as the City's Disaster Director, proclaimed the existence of a local emergency due to the fire, through Proclamation No. 2022-

01. On May 26, 2022, the City Council adopted Resolution No. 2022-015, ratifying the Mayor's proclamation of the local emergency.

Pursuant to California Government Code Section 8630, once a local emergency is proclaimed, the City Council is required to review the need for continuing the local emergency at least once -66-
every 60 days until the local emergency is terminated, and must proclaim the termination of the local emergency at the earliest possible date that conditions warrant. The City Council previously determined there was a need to continue the local emergency on July 12, 2022 and August 9, 2022.

STAFF REPORT: Staff is seeking reimbursement through the Governor's Office of Emergency Services (Cal OES) of the City's costs incurred in responding to the fire and repairing damages to public property caused by the fire. Such process is still ongoing. As outlined above, California Government Code Section 8630 requires the City Council to review the need for continuing the local emergency at least once every 60 days until the local emergency is terminated. Staff is requesting that the City Council determine there a need to continue the local emergency in accordance with California Government Code Section 8630.

THIS IT SUITE CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: September 27, 2022
SUBJECT: Categorical Exemption- Gr&Be Commercial Cannabis Expansion Project.

PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Subsequent to the Public Hearing, it is recommended Council adopt a Notice of Exemption-In-fill Development for the Gr&Be Commercial Cannabis Expansion Project located at 2473 W. Hobsonway in Blythe and direct staff to file the Notice of Exemption with the County Clerk.

FISCAL IMPACT: Potential tax revenue from this Licensee after the development of more area at this facility for commercial cannabis activity.

BACKGROUND: In 2019 the City adopted a Notice of Exemption for the Gr&Be Commercial Cannabis facility. The project proposed to refurbish and repurpose a dilapidated hotel building on a 1.81t acre property located at 2473 W. Hobsonway, more specifically described as Assessors' Parcel No. 824-191-001. The project was completed in the fall of 2021. Gr&Be has maintained three active Commercial Cannabis Licenses at this property for Cultivation, Distribution and Manufacturing since September 16, 2021.

Gr&Be, Inc, represented by Berta Hovanesian now proposes to expand its commercial cannabis operation on the same parcel with the addition of a 15,000 square foot building to be located on the south side of the remodeled building. The site is zoned General Commercial (C-G) which allows for cannabis development.

The proposed site is level with little vegetation. Development consists of the construction of one single-story building totaling 15,00 square feet. Surrounding land uses include an adjacent hotel to the east, residential subdivision to the north and southeast, and various commercial operations to the north and south of Hobsonway to the east.

STAFF REPORT: Based upon information contained in the administrative record and review of CEQA Guidelines, the City has determined that the Gr&Be, Inc. Commerical Cannabis Expansion Project is eligible for a Class 32 Categorical Exemption. The project fits within the parameters included in CEQA Guidelines 15332 as an Urban Infill Exemption from CEQA as it meets each of the five criteria set forth in section 15332 In-Fill Development Projects of the CEQA Guidelines:

Blythe CITY COUNCIL MEETING
ДІДЕНІЗНЕВ STAFF REPORT
MEETING DATE: September 27, 2022
SUBJECT: Tentative Parcel Map 38413
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended the City Council, subsequent to the public hearing thereon, adopt Resolution No. 2022-029 approving the Notice of Exemption with De Minimis Impact Findings for Tentative Parcel Map 38413 and Resolution No. 2022-030 approving Tentative Parcel Map 38413 with conditions.

FISCAL IMPACT: None.

BACKGROUND: The current parcel is comprised of a residential structure and undeveloped land in agricultural production. The proposed subdivision of the subject property would allow the applicant to convey each use on autonomous parcels. The residence would be on a separate parcel from the land in agricultural production.

STAFF REPORT: Brad Robinson and his agent, The Holt Group are requesting approval to allow the division of one (1) 35.28t acre parcel into two (2) separate parcels and Lots A and B.

The project site is located at 3453 W. Riverside Avenue and is legally described as Assessor's Parcel Number 821-140-004. Proposed Parcel No. 1 is 5.00t acres in size, Proposed Parcel No. 2 is 28.59t acres in size, Lot A is 0.80t acres in size and Lot B is 0.89+ acres in size. Each parcel has access from an improved dedicated right-of-way. No variances or exceptions are required for this Parcel Merger.

The General Plan Land Use and Zoning Designation of the site is A (Agricultural). The existing zoning designation of A allows for a minimum lot area of 5 acres. As the smallest proposed parcel is 5.00t acres, the proposed project is consistent with existing zoning regulations.

Surrounding land uses include other undeveloped lands in agricultural production.

Environmental Review: The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Guidelines Section 15315-Minor Land Divisions, and a Notice of Exemption with De Minimis Impact Finding will be filed.

Findings:

A. That the proposed Tentative Parcel Map is consistent with the City of Blythe General Plan.

B. That the proposed Tentative Parcel Map is consistent with the requirements of the Zoning Ordinance.

C. That the site is physically suitable for the land division as proposed.

D. That the designs of the project will have no impact on environmental resources including -75-
fish and wildlife.

E. That the project is exempt under State CEQA Guideline Section 15315 - Minor Land Division.

F. The environmental analysis/determination reflects the independent judgment of the City of Blythe.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: September 27, 2022
SUBJECT: Proposed Ordinance No. 918-22 Amending Provisions of the Zoning Code or Family for Compiace wit State a Fredera lines and the Detnition PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Brittany E. Roberto, City Attorney
RECOMMENDATION: It is recommended Council, subsequent to the Public Hearing, introduce for first reading, by title only, further reading waived, Ordinance No. 918-22:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, AMENDING TITLE 17 (ZONING) OF THE BLYTHE MUNICIPAL CODE RELATING TO RESIDENTIAL CARE FACILITIES

AND THE DEFINITIONS OF GROUP DWELLINGS AND FAMILY FOR COMPLIANCE WITH STATE AND

FEDERAL LAW
FISCAL IMPACT: None.

BACKGROUND: Pursuant to State law, the City is required to treat various State-licensed residential care facilities serving six or fewer people no differently than other residential uses that are permitted by right. During the Housing Element update process, it came to staff's attention that the City's Zoning Code does not permit such facilities by right in residential zones. It also came to staff's attention that the definitions of "family" and "group dwelling" are not consistent with State and Federal law.

STAFF REPORT: The proposed Ordinance amends the table set forth in Section 17.08.010 of Title 17 of the Blythe Municipal Code to reflect that small residential care facilities (those facilities serving six or fewer people) are permitted in the Residential Estates (R-E), Low-Density Residential (R-L), Medium- to Low-Density Residential (R-M-L), Medium Density Residential (R-M), High-Density Residential (R-H), Mobile Home Residential (R/MH), Rural Residential (RR), Agriculture (A), Planned Development (P-D), and Specific Plan Resort (SPR) zones. It also amends the table set forth in Section 17.08.010 to reflect that large residential care facilities (those facilities serving seven or more people) are permitted with a conditional use permit in the Residential Estates (R-E), Low-Density Residential (R-L), Medium- to Low-Density Residential (R-M-L), Medium Density Residential (R-M), High-Density Residential (R-H), Planned Development (P-D) and Rural Residential (R-R) zones, consistent with the programs outlined in the draft Housing Element update.

The proposed ordinance also amends Chapter 17.08 to add a new Section 17.08.625 to provide a definition for "residential care facility, small" and a new Section 17.08.628 to provide a definition for "residential care facility, large". Finally, the proposed ordinance revises the definition of -86-
"family" set forth in Section 17.04.450 of Chapter 17.04 of Title 17 and the definition of "group dwelling" set forth in Section 17.08.370 of Title 17 for consistency with State and Federal law.

In addition to these changes, the City will be required to make additional amendments to the Zoning Code in connection with the Housing Element update and in compliance with State law.

Such changes will be presented to the Council at a later date.

This is the second of two public hearings regarding the proposed ordinance in accordance with the requirements of State law and the Blythe Municipal Code. The first hearing was conducted on August 9, 2022 by the City Council, acting as the City's Planning Agency.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

SLABLISHED STAFF REPORT
MEETING DATE: September 27, 2022
SUBJECT: Emergency Sewer Repairs at Hobsonway and Lovekin Blvd.

PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
Brittany Roberto, City Attorney
RECOMMENDATION: It is recommended Council terminate the emergency action declared on by the Council on February 23, 2022 for the repairs to the collapsed sewer line at Hobsonway and Lovekin Blvd. It is further recommended Council accept the work performed by Radco Inc. and authorize the Mayor and City Clerk to execute and file the Notice of Completion for the project and authorize the Interim City Manager to release retention payments once the Notice of Completion is recorded and release project bonds once appropriate.

FISCAL IMPACT: Costs incurred to date include $593,319.91 for the sewer and manhole relocation, replacement of the 8-inch water line, insertion of three Insta-valves, demolition of old concrete encountered under the roadway, replacement of the storm drain repair of the Frontier fiber optic cable vault, street repairs and construction management services provided by The Holt Group.

BACKGROUND: In early February, Public Works was notified of a sewer back up at Sure Stay Motel located at the corner of Hobsonway and Lovekin. Crews believed there was a breach in the line and worked to determine its location. Due to the size of the line, no local operators had the equipment necessary to camera the line to determine the location. Crews set up temporary measures to keep the line flowing, and closed Hobsonway as a precaution until the repair could be made.

On February 18, 2022, CV Pipeline was able to camera the line and determined the line was collapsed on the north and south sides of the sewer manhole.

Per Section 2.66.070 of the Blythe Municipal Code and the City's Purchasing Policy, in cases of emergency, the Council, after making a finding, based on substantial evidence clearly stated in the meeting minutes, that the emergency will not allow for a delay resulting from a competitive solicitation for bids, and that the action is necessary to respond to the emergency, may by a four- fifths vote of the Council, repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes without giving notice for bids to let contracts.

Due to the extent of the collapse and its repair, the location of the pipe in a main City corridor as well as its location to highly trafficked fiber optic lines, Council took action at the February 23, 2022 Special Meeting to deem the repairs an emergency and, by a four-fifths (4/5) vote of the Council, made the required finding that the emergency would not allow for a delay resulting from a competitive solicitation for bids, and that the action was necessary to respond to the emergency. The Blythe City Council determined there was a need to continue the emergency at -93-
the March 8, 2022, April 12, 2022, May 10, 2022, June 14, 2022, July 12, 2022 and August 9, 2022 Council meetings as required by Public Contract Code section 22050(c)(1).

The Holt Group provided a design for the relocation of the manhole and collapsed sewer line.

Staff entered into an agreement with Radco, Inc. the week of April 4th to relocate the collapsed sewer line and manhole. Project materials were received and Radco, Inc. mobilized on May 3, 2022. During construction several unforeseen issues in the project area were encountered, causing additional work to complete the project.

STAFF REPORT: The project initially included the relocation of the sewer line and manhole and compaction and repair of the street damage caused from the initial sewer line break. At completion, the project consists of the sewer line and manhole relocation, installation of an 8- inch replacement water line, insertion of three water valves, repair of a collapsed storm water drain and repair of Frontier's fiber optic cable vault along with the necessary roadway repairs so that the street may safely re-open to traffic.

All work was complete as of September 2, 2022. The project was completed to the satisfaction of the Public Works Department on September 12, 2022.

Public Contract Code section 22050(c)(3) states that the governing body shall "terminate the action at the earliest possible date that conditions warrant so that the remainder of the emergency action may be completed by giving notice for bids to let contracts." As the repairs are now complete, it is recommended Council terminate the emergency action declared on February 23, 2022 for the collapsed sewer line at Hobsonway and Lovekin Blvd. in accordance with Public Contract Code section 22050(c)(3).

CITY COUNCIL MEETING
Blythe

STAFF REPORT
MEETING DATE: September 27, 2022
SUBJECT: Biennial Review of the Conflict of Interest Code PRESENTED BY: Mallory Crecelius, City Clerk
PREPARED BY: Mallory Crecelius, City Clerk
Brittany Roberto, City Attorney
RECOMMENDATION: It is recommended that the Council adopt the following Resolution to update the City's Conflict of Interest Code:

RESOLUTION NO. 2022-031 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE,

CALIFORNIA, ADOPTING A REVISED CONFLICT OF INTEREST CODE FOR THE CITY OF BLYTHE FISCAL IMPACT: None
BACKGROUND: The Political Reform Act (California Government Code Section 81000 et seq.) requires every local agency to adopt a Conflict of Interest Code. The Conflict of Interest Code identifies positions that involve the making or participation in making of decisions that may foreseeably have a material effect on any financial interest; assigns disclosure categories to these positions; and indicates the types of economic interest which must be reported, such as investments, interests in real estate or sources of income or gifts.

The Political Reform Act requires every local government agency to review its Conflict of Interest Code every two years (in even numbered years) to determine if the Code needs to be amended. For example, a Conflict of Interest Code may require amendments if any positions have been eliminated or re-named, or if new positions have been added, since the last Code was approved.

STAFF REPORT: On June 14, 2022, Council, as the code reviewing body for the City and City agencies, directed the review of the City's Conflict of Interest Code. Staff has completed its review of the City's Conflict of Interest Code and determined that amendments are required in order to update outdated provisions, incorporate the City Engineer position, which was not previously included in the list of designated positions, and update the disclosure categories.

The proposed resolution adopts the City's revised Conflict of Interest Code and repeals the prior version of the Code.
