PUBLIC HEARING:

Categorical Exemption- Lester Fitness Center. Interim City Manager Crecelius requested to continue the Public Hearing to the November 8th City Council meeting. The applicant's agent submitted applications for the project with an address of 835 W. Hobsonway.

That address is incorrect, the address for the site is 475 W. Hobsonway. Due to this, the Public Hearing will be re-noticed with the correct address. If anyone is here this evening to speak on this matter, we will take public comment.

Vice Mayor DeConinck moved to continue the Public Hearing to November 8, 2022. The motion was seconded by Councilman Rodriguez with a unanimous aye vote.

NEW BUSINESS:

Engevik Park Playground Improvement Project. Interim City Manager Crecelius stated on August 19, 2022, the City released an Invitation for Proposals for the Engevik Park Playground Improvement Project. The bid was directly sent to eight playground installers and posted on the City's website. The specifications for the Playground Improvement Project included one play structure with capacity for 20 to 25 children combining elements to be used by children 5 to 12 years of age, one swing set with a minimum of 2 swings for children 5 to 12 years of age and a minimum of 1 toddler swing and a standalone spinner or climbing element.

The project also includes the installation of poured in place fall protection under the play systems. Sand will be left in the areas between the play structures like the playground at Miller Park. Project bids were received from Gotham Poured Rubber Corporation in the amount of $154,259.33 and Ortco, Inc. in the amount of $146,944.60. Ortco was the apparent low bidder.

Ortco's construction license is current and in good standing with the State of California. They have previously performed work for the City of Blythe, in 2019 installing the playground equipment, fall protection and shade structure at Miller Park. That project was successfully 24 completed and accepted by the City. Therefore, staff determined Ortco, Inc. to be the responsive and responsible bidder. Due to continued supply chain issues, there is a twelve-week lead time on the playground equipment. Ortco, Inc. has been in contact with the vendor and will place the order as soon as the Notice of Award is issued. Once equipment is received, the contractor will have 60 days to complete the project. It is recommended Council authorize the Interim City Manager to execute Agreement No. 2022-034 A with Ortco, Inc. contingent upon all bonds and proper contract documents being fully executed to the satisfaction of the City Attorney and Interim City Manager, issue a purchase order to Ortco, Inc. in an amount not to exceed $146,944.60, authorize an additional $15,000 for contingencies, project inspection and engineering services and authorize the Interim City Manager to approve change orders during construction not exceeding $15,000 and establish a project budget not to exceed $161,944.60.

Vice Mayor DeConinck asked how far out we were. Interim City Manager Crecelius stated it's the hope to have the project delivered in first quarter of 2023. There is a second component of this project which is the shade structure. It was budgeted with CDBG funding. We are working on those bid documents. We hope to coordinate both and have them installed together to deliver a complete project.

No public comment. Vice Mayor DeConinck moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

MEMBER COMMENT:

Vice Mayor DeConinck complemented everyone involved with Homecoming. There were a lot of people in the parade, and the next day CR&R must have been out with the street sweeper as the streets were clean.

Councilman Rodriguez stated Natalie Lough, a Candidate for Judge is here this evening.

Natalie Lough, Deputy DA with Riverside County is running for Superior Court Judge, seat number four. I will be on your ballot in November. My goal is to enforce laws as written, not as I wish it were written and to put public safety first. That is why I am running.

Councilman Burton stated Homecoming was awesome. Congratulations to the Jackets for that victory. They put on a show, and it was great to have a win on Homecoming.

Vit BrineD, Ra, there as ire at operation in you to control or he parole, Homecoming is a holiday.

NEW BUSINESS:

Water Supply Line for Golf Course Project. Interim City Manager Crecelius stated there is a lot of background information in the staff report as to how we got here. There is a lot of history. The original course was on W. Hobsonway. It became unstable when Interstate 10 was developed, and the City quickly looked for new land. The City requested proposals and at least two were received. The City ultimately went with the proposal submitted by the Mesa Ranch group to locate the golf course where it is today. The land was donated and from there the City hired a professional Architect to design a championship golf course. The golf course opened in 1968 and has been in operation since. The City operated the course until 2010. The City maintained the course. The Pro Shop and cart rentals were contracted out. The last Golf Pro was Willie Getchell. At that time, the Golf Course fund had operated in a deficit position for a number of years. Past city management workshopped ways to fix the issues, but the position did not change. When David Lane was hired as City Manager, he was tasked with making cuts to balance the budget as well as making steps to eradicate a $3.4 million General Fund Deficit. At that time, they formed a golf committee to look at options. The City Council released an RFP for management and lease options. Nine proposals were received, eight from management companies and one from BNB Golf management which was a lease. The Council granted BNB the lease. They believed it was the best option for the City as it stopped the bleeding. The City would have had to pay a management company to maintain the course and the City didn't believe that was the way to get out of the hole. In 2010 the City and BNB entered into the lease 27 we have today. It was amended in 2011 to extend the term, and the agreement is in place until 2025. The Lease requires BNB to operate the course and restaurant as well as pay for utility expense, property taxes and maintenance. A couple of weeks ago I was contacted by David Bayles one of the principles of BNB Golf Management. There is an issue with the water supply line that brings water to the course. The pro shop and restaurant are on City water but the golf course is irrigated with water from A Canal. Originally, the top half of the course was irrigated by a well which was later decommissioned. The bottom half has always been irrigated with water from A Canal from this water supply line. In 2011 BNB decommissioned the well and ran a new pipe from the lake on the top to the lake on the bottom. Now the entire course is irrigated by water from A Canal. In looking at this issue and that agreement we were treating it no different than a main line break for a customer on City water. If there was a break in the line running up to the course to the pro shop, that would be considered a main line break and the City's responsibly.

Anything past that point and on the golf course would be the responsibility of BNB. In our opinion, the agreement does not require them to make improvements to the supply itself. Issues with the irrigation system would be their responsibility. From what we can tell, the pipe was installed in the late 60's, probably by the City. As mentioned, the land was donated by Mesa Ranch. Once the design was under way, more land was needed to build a championship course.

They then acquired additional land from the DeMeyer family which came with the access to A Canal. In notes dated in the late 60's, there was a discussion about whether the City was going to put in a ditch or an irrigation line which is why I believe the City installed the pipe to supply irrigation water to the golf course. The pipe has been leaking for several years. It hasn't been an issue as it was leaking into a field. However, the field is now owned by Red River Farms and they would like to build a concrete ditch. They believe our leak will undermine that and have asked the City to fix the pipe. I met with Dave Bayles and Michael Mullion of Red River Farms and discussed running a new line from A Canal to the golf course. It's about 1,000 feet of 24" pipe. They estimate it to cost about $125,000. As the Mullions would like to install their ditch at the first of the year to have cotton planted in March, time is of the essence. Originally, I was going to going to bring this to the November meeting, but I felt it would be best to get direction now to have it under construction by the first of the year. I had originally told Mr. Bayles this would be discussed in November. In a subsequent email I told him I would call a special meeting. He didn't realize that meeting wad today until the agenda was posted and he was unable to be here. Mr. Bayles, as an A licensed contractor prepared the plans for the project along with the scope of work and contractor requirements for the RFP in an effort to move this along. We will install a new line next to the existing line. The existing line will be buried in the ground.

This was not an expected expense. There may be an avenue for funding through CIF. I can reach out and start that process if directed. If we are not successful with CIF funding the other option would be to allocate General Fund surplus to the project. Today I am looking for direction.

Would you like to release the RFP, approach CIF about funding and if funding is not available, what other options would you like me to explore? Once the bids are received, I would come back to Council, probably in December, for award of the contact. By then we should know if we are successful with CIF.

Councilman Rodriguez asked staff to reach out to County EDA for any economic development funding sources that may be available.
28 Mayor Reynolds asked if the line could run down the access road. Interim City Manager Crecelius stated the design is a straight shot from the canal to the lift station. Its gravity fed, there is no pressure. You open the line, and the water flows through to the supply lake. I think this is the most logical route. If you went around, there would be extra pipe and I am not sure if we would need additional engineering. I ran a Title Report as we are under the impression the City has an easement for the pipeline. If there isn't an easement, the Mullions are not opposed to putting one in place. They don't care that the pipe is there, they just don't want it leaking. The Mullions want to level the field 12 to 18 inches. This will expose the existing pipe so we will need to lower the new pipe. It will be buried 4 feet from top of pipe so there are no breaks from equipment vibration and another reason to put the easement in place.

Councilman Halby asked if lowering the pipe would affect the gravity fed line. Staff does not believe it will be an issue.

Public comment. Leslie Jessop-Watkins of 1250E. Hobsonway stated the proposed new supply line is a direct shot between A Canal and the lake on the lower half of the Golf Course. That is why they did not want to go around. If you look at the line due south, that is the separation of two fields. The concrete ditch is going to be in that same area to separate the two fields to irrigate both sides.

Councilman Rodriguez moved to direct staff to look at funding options for a new pipeline for the Golf Course and release an RFP. The motion was seconded by Councilman Halby with a unanimous aye vote.

ORAL REPORTS:

Chief Dale reported on the Law Enforcement National Night Out held at Todd Park on Tuesday night. The National Night Out is an annual event. It is typically in August, we but moved ours to October due to the heat and we seemed to get a better turnout. We had a lot of folks come out and enjoy the displays hosted by area law enforcement. We demonstrated our new unmanned aircraft system.

Chief Building Official Brown gave an update on the City's demolition projects. Cottonwood was completed. The recycling was very heavy, this means there was a landfill diversion which is great for the City. R&L Watkins did a fantastic job. The notice to proceed was issued for 241 S. 5th street to R&L Watkins. 241 S. 5" street is one of the Fernandez properties we have been working on for a long time. Its one of the properties that did not sell. There are four others that did sell, and we are working on that though the City Attorney's office and Code Enforcement.

Councilman Halby asked for an update on the burned restaurant in East Blythe. Interim City Manager Crecelius stated there are a number of steps to be taken. We have issued 6 citations and are now able to hold an office conference with the City Attorney and property owner. At the conference the City Attorney will try to light a fire under the property owner to either clean it up or the City will need an abatement warrant to clean it up. The costs of which would be a lien on the property.

Blythe CITY COUNCIL MEETING

STAFF REPORT

DELISHER
MEETING DATE: November 8, 2022
SUBJECT: Assistant City Manager Promotion
PRESENTED BY: Brittany Roberto, City Attorney
PREPARED BY: Brittany Roberto, City Attorney
RECOMMENDATION: It is recommended that the City Council:

I. Approve the promotion of Mallory Crecelius from the position of Deputy Administrative Services Director to the position of Assistant City Manager, and authorize the City Attorney and Finance Director to take any steps necessary to memorialize the promotion.

2. Authorize the Mayor to execute Amendment Number One to the Interim City Manager Employment Agreement between the City and Mallory Crecelius.

3. Adopt the following Resolution:

RESOLUTION NO. 2022-035 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

BLYTHE, CALIFORNIA, AMENDING THE SALARY SCHEDULE FOR MANAGEMENT

CLASSIFICATIONS
FISCAL IMPACT: No fiscal impact.

BACKGROUND: Mallory Crecelius has served in the position of Interim City Manager since July 2017. Due to the financial condition of the City when Ms. Crecelius was appointed as Interim City Manager, the City did not conduct a recruitment for the permanent City Manager position. In November 2021, the City and Ms. Crecelius entered into an employment agreement memorializing the terms of Ms. Crecelius' appointment as Interim City Manager.

Prior to her appointment as the Interim City Manager, Ms. Crecelius served as the Deputy Administrative Services Director. Duties of the Deputy Administrative Services Director include serving as the City's Risk Manager, serving as the City's Personnel Manager, including organizing the noticing, testing and hiring or new employees, maintaining personnel files, processing payroll status changes, and processing workers' compensation claims, and other duties as assigned by the City Manager. In addition to her duties as the Interim City Manager, Ms. Crecelius has continued fulfilling the duties of the Deputy Administrative Services Director.

Ms. Crecelius has also assumed the duties of vacant and frozen Department Head positions. In 2018, Ms. Crecelius assumed the duties of the City Planner and oversight of the Planning Department and continues to fulfill those duties. Ms. Crecelius has also fulfilled the duties of the Public Works Director and overseen the Public Works Department since December 2020.

She also implemented the commercial cannabis application process, oversees the City's commercial cannabis program and processes commercial cannabis business applications. Since the City's Economic Development Position has been vacant/unbudgeted for several years, Ms. 41 Crecelius also leads the City's economic development efforts on behalf of the Council, including, among other things, working directly with the City's consultant, Retail Strategies, to attract new retail development to the City.

STAFF REPORT: Ms. Crecelius works tirelessly to implement the goals and policies of the City Council, to serve the needs of the City and to improve the quality of life for Blythe residents.

As outlined above, Ms. Crecelius wears several hats, including her duties as the Interim City Manager, duties of the Deputy Administrative Services Director, duties of the City Planner, duties of the Public Services Director, and duties of the Economic Development Specialist, in addition to overseeing the commercial cannabis program and processing commercial cannabis business permit applications. When the City Council hires a permanent City Manager, Ms.

Crecelius would likely continue to fulfill the duties of the Deputy Administrative Services Director as well as several of the additional duties she has assumed during her tenure as the Interim City Manager, until such time as the City is able to fill positions.

In recognition of Ms. Crecelius' experience, skills, abilities, background and knowledge and of the additional duties and responsibilities Ms. Crecelius has assumed and will continue to fulfill in the future, the City Council has expressed a desire for Ms. Crecelius to be promoted to the Assistant City Manager position. Pursuant to Section 2.04.090 of the Blythe Municipal Code, it is generally the duty of the City Manager to appoint City employees. Since the City does not currently have a permanent City Manager, the City Council must approve the promotion.

Although the proposed action is to promote Ms. Crecelius to the Assistant City Manager position, Ms. Crecelius will continue to serve as the Interim City Manager until such time as the City Council hires a permanent City Manager. Because her Interim City Manager Employment Agreement references her Deputy Administrative Services Director position, an amendment is needed to reflect her Assistant City Manager position. Key terms of the proposed amendment to the Interim City Manager Employment Agreement include:
• Provides that, in the event the agreement is terminated for any reason, Ms. Crecelius will automatically return to the position of Assistant City Manager, and will solely be responsible for performing the duties of that position. • Provides that upon Ms. Crecelius' return to the position of Assistant City Manager, her compensation and benefits will be those to which she is entitled as the Assistant City Manager.
• Provides that upon Ms. Crecelius' reinstatement to the position of Assistant City Manager, she will be placed at the top step of the salary range for the Assistant City Manager.
• Provides that salary increases and certain benefits will be tied to the Management Unit, since the Assistant City Manager position is part of that unit.

In addition to the proposed amendment, staff is proposing to amend to the Salary Schedule for Management classifications to add five additional ranges and move the Assistant City Manager position from Range 79 to Range 85. The proposed updated Salary Schedule for Management classifications is included as Exhibit A to the resolution.

As noted above, Ms. Crecelius will continue to serve as the Interim City Manager until the City Council elects to hire a permanent City Manager. She will continue to receive compensation and benefits in accordance with the Interim City Manager Employment 42 Agreement while she serves as the City Manager. She will only receive the compensation and benefits of the Assistant City Manager position at such time as she is reinstated to that position.

In the event of any inconsistency or conflict between the provisions of said Memorandum of Understanding and the provisions of this Agreement, the provisions of this Agreement shall govern.

City and Employee acknowledge and agree that Employee will continue to receive er Interim City Manager compensation as set forth in the Agreement, and not the capacity as Interim City Manager.

STAFF REPORT

SILISHED
MEETING DATE: November 8, 2022
SUBJECT: Class 32 Infill Development Categorical Exemption - Lester Fitness Center Project
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Subsequent to the public hearing, it is recommended Council direct staff to file a Notice of Exemption for a Class 32 infill development categorical exemption pursuant to CEQA Guidelines Section 15332 for the Lester Fitness Center Project located at 475 W. Hobsonway in Blythe with the County Clerk.

FISCAL IMPACT: None.

BACKGROUND: Dean Lester proposes development of a new 9,600 square-foot single-story gymnasium fitness center building on two vacant parcels totaling 0.37 acres located at 475 W.

Hobsonway. The site is legally described as APNs 845-112-026 and 845-112-027. The project includes 20 on-site parking spaces and 4,413 square feet of landscaping around the perimeter of the site. The on-site landscaping includes artificial turf on the north side of the building for outdoor fitness center use. Access to the site will be from one driveway on Hobsonway and one driveway in the alley on the northside of the project. A new sidewalk is proposed to be installed along Ash Street.

The current zoning and General Plan designation is General Commercial (C-G) which allows for the development of recreational/fitness facilities. The project is level with little vegetation. Surrounding land uses include a variety of commercial uses. Grading and construction are expected to take eight to twelve months.

STAFF REPORT: As the Lead Agency under the California Environmental Quality Act (CEQA), the City has undertaken preliminary review and determined that the proposed development qualifies for a Class 32 Infill Development Categorical Exemption from the provisions of CEQA pursuant to CEQA Guidelines Section 15332. The Categorical Exemption report describes the proposed project and assesses each of the criteria required to qualify for the Class 32 categorical exemption.

Class 32 Consists of projects characterized as infill development meeting the conditions described in this section:
(a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations.

The City's General Plan and land use and zoning classification on the project site is General Commercial (C-G), which allows for the operation of a wide variety of retail businesses, including a commercial fitness center.
(b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses.

The project site is located entirely within the City of Blythe on a 0.37-acre property north of Hobsonway and east of N. Ash Street. Surrounding land uses include Halby's Clothing Store, Goodyear Tire, the American Legion and Nails and Hair. (c) The site has no value as habitat for endangered, rare, or threatened species.

The site and surrounding lands have been in urban use for decades, including primarily commercial development and transportation corridors. The site is currently vacant, but is surrounded by urban buildings, roadways and is not located in proximity to any wetlands, wildlife refuge or protected lands. Plant and wildlife species expected to occur are those accustomed to an urbanized environment. The project site does not have habitat values to support any sensitive species.
(d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water supply.

The project is in an area of the City with multiple commercial services for residents. The project related trips will generate low volume traffic on roadway segments within the City that operate well below capacity. The fitness center does not require the use of any noise generating equipment. Air emissions for the project is very low, limited mainly to emissions associated with employee and customer vehicle trips to and from the site. Potable water will be supplied by the City with discharge to the City's Wastewater Treatment Plant. (e) The site can be adequately served by all required utilities and public services.

The City's water and sewer lines extend to the property, and connection to these lines will be made subject to review and approval of the City Engineer.

The proposed project is not subject to any of the exceptions for exemption under Section 15300.2 of the CEQA Guidelines. The location of the project is predominantly urban and not considered a sensitive environment; therefore, the project will not result in any significant impacts that may otherwise occur in a sensitive environmental area. The cumulative impact of this project, and the approval of other projects like it in the vicinity, is not expected to have any significant environmental impact.

The project is not located along any state designated scenic highway nor within any designated hazardous waste site. Staff does not expect any significant impacts or unusual circumstances related to the approval and construction of this project.

Blythe CITY COUNCIL MEETING

STAFF REPORT
ISHE
MEETING DATE: November 8, 2022
SUBJECT: Class 32 Infill Development Categorical Exemption - Edelweiss Farms, LLC K-Mart Building Conversion Commercial Cannabis Project
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Subsequent to the public hearing, it is recommended Council direct staff to file a Notice of Exemption for a Class 32 infill development categorical exemption pursuant to CEQA Guidelines Section 15332 for the Edelweiss Sustainable Farms, LLC K-Mart Building Conversion Commercial Cannabis Project located at 1255 W. Hobsonway in Blythe with the County Clerk.

FISCAL IMPACT: None.

BACKGROUND: Patrick Kelly, representing Edelweiss Sustainable Farms, LLC proposes to modify an existing building to a multiple use venue that supports cannabis cultivation, processing and distribution. The applicant intends to produce high-grade flower for wholesale distribution to manufactures and dispensaries serving medical and recreational marijuana markets in California.

The project site is located north of Hobsonway and east of the Palo Verde Irrigation District's C Canal in the western part of the City of Blythe. The site is more specifically described as APN 836- 180-022. The project includes the conversion of an existing building that previously operated as a K- Mart department store.

The Applicant plans to renovate 94,000 square feet within the existing building to support the growing of a total of 32,633 square feet of flowering plants concurrently. The project is proposed in two phases. Phase I will modify the southern portion of the existing building to create six grow rooms, four dry rooms and room for storage, packing, trimming, cloning, and shipping/receiving.

Phase II will develop the northern portion of the building to create three grow rooms and two dry rooms.

The current zoning and General Plan designation is General Commercial (C-G) which allows for the development of commercial cannabis facilities. The project is level with little vegetation.

Surrounding land uses include a variety of commercial uses.

STAFF REPORT: As the Lead Agency under the California Environmental Quality Act (CEQA), the City has undertaken preliminary review and determined that the proposed development qualifies for a Class 32 Infill Development Categorical Exemption from the provisions of CEQA pursuant to 59 CEQA Guidelines Section 15332.

The City's General Plan and land use and zoning classification on the project site is General Commercial (C-G), which allows for the operation of commercial cannabis businesses including indoor cultivation, manufacturing, distribution, and dispensaries. (b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses.

The project site is located entirely within the City of Blythe on a project site of 4.33 acres on the north side of Interstate 10, north of Hobsonway and west of Lovekin Boulevard.

Surrounding land uses include a variety of commercial uses to the north and southeast and vacant city lands to the west and southwest which are in agricultural use. The site was a former K-Mart store and has been an urban use since at least 1994. (c) The site has no value as habitat for endangered, rare, or threatened species.

The existing commercial building and adjacent parking lot area is currently developed and has been in urban/commercial use for decades. The project site is not located in proximity to any wetlands, wildlife refuge, or lands protected under a special habitat conservation or management plan.
(d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water supply.

The proposed reuse of the existing commercial building and parking lot will not have significant impacts related to traffic, noise, air quality or water quality. The project is expected to generate low volume traffic on Hobsonway and connector roadway segments within the City of Blythe that operate well below capacity and that do not experience any congestion under existing conditions. The project will generate less car and truck traffic than would be generated by the K-Mart or similar big box retail store. Indoor cultivation and manufacturing operations do not require the use of any high-level noise generating equipment and are inherently quite activities. Air emissions from the project are very low.

The Building is connected to the City's water and wastewater systems, and water use will include micro-sprinkler drip irrigation systems and potable water for staff. (e) The site can be adequately served by all required utilities and public services. 60 The City's water and sewer lines extend to the property at present and have surplus capacity to serve the project.

Shetion 1e, the, propose project is categorically exempt from CERA under CERA Guidelines The Notice of Exemption will be filed with the County Clerk following City Council approval.

STAFF REPORT
MEETING DATE: November 8, 2022
SUBJECT: Class 32 Infill Development Categorical Exemption - Cohen Commercial Cannabis Cultivation, Manufacturing and Distribution Project PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Subsequent to the public hearing, it is recommended Council direct staff to file a Notice of Exemption for a Class 32 infill development categorical exemption pursuant to CEQA Guidelines Section 15332 for the Cohen Commercial Cannabis Cultivation, Manufacturing and Distribution Project at 2161 W. Hobsonway in Blythe with the County Clerk.

FISCAL IMPACT: None.

BACKGROUND: Justin Cohen proposes to develop a commercial cannabis facility on a 1.42 acre parcel located at 2161 W. Hobsonway. The site is legally described as APNs 824-194-009 and 824- 194-010. The project site is level with an existing warehouse that will be expanded for the cannabis operation. A new parking lot with commercial entrance from Hobsonway will be installed along with new perimeter fencing and stormwater retention basin. Development would include the construction of an addition to the existing single-story warehouse to total 14,725 square-feet.

The current zoning and General Plan designation is General Commercial (C-G) which allows for the development of commercial cannabis facilities. The project site is level with little vegetation.

Surrounding land uses include a single-family residence to the north, Ace Towing and Recovery Group to the west, residential properties to the south and farmed lands to the southwest and east.

Interstate 10 lies to the south of Hobsonway, and various commercial, residential and agricultural uses extend up and down Hobsonway.

STAFF REPORT: As the Lead Agency under the California Environmental Quality Act (CEQA), the City has undertaken preliminary review and determined that the proposed development qualifies for a Class 32 Infill Development Categorical Exemption from the provisions of CEQA pursuant to CEOA Guidelines Section 15332.

66 The City's General Plan and land use and zoning classification on the project site is General Commercial (C-G), which allows for the operation of commercial cannabis businesses. (b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses.

The pride it is locate e, cy within the big a and orest 0 Det pin Boy on thi Surrounding land uses include a variety of commercial and residential development. Vacant city lands lie to the northeast and southwest, some of which are in agricultural use. (c) The site has no value as habitat for endangered, rare, or threatened species.

The site has been previously developed and has been in urban/commercial use for decades.

The project site is not located in proximity to any wetlands, wildlife refuge, or lands protected under a special habitat conservation or management plan. (d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water supply.

The proposed expansion project is part of a small, indoor cultivation, processing and manufacturing and distribution operation. The project related trips will generate low volume traffic on roadway segments within the City that operate well below capacity and do not experience congestion under existing conditions. Commercial Cannabis operations do not require the use of any high-level noise generating equipment. Air emissions for the project is very low.
(e) The site can be adequately served by all required utilities and public services.

The City's water and sewer lines extend to the property at present and have surplus capacity to serve the project.

The proposed project is not subject to any of the exceptions for exemption under Section 15300.2 of the CEOA Guidelines.

Therefore, the proposed project is categorically exempt from CEQA under CEQA Guidelines Section 15332, Infill Exemption.

The Notice of Exemption will be filed with the County Clerk following City Council approval.

STAFF REPORT
ВЕЛІВНЕ
MEETING DATE: November 8, 2021
SUBJECT: 2023-2024 Community Development Block Grant (CDBG) Allocation PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Subsequent to the Public Hearing it is recommended Council:

1. Apply the $103,000 CDBG Allocation for 2023-2024 to the City's Home Enhancement Program in partnership with Riverside County HWS; and

2. Authorize the Mayor to execute the supplemental agreement with Riverside County Economic Development Agency for the allocation of the 2023-2024 CDBG Funds; and

3. Authorize the City Manager to reprogram funds as required.

FISCAL IMPACT: The City's CDBG funding allocation for 2023-24 is one hundred three thousand dollars (103,000).

BACKGROUND: The City of Blythe, as a member of the Riverside County Urban County designation, receives a Community Development Block Grant (CDBG) allocation each year. The U.S. Department of Housing and Urban Development (HUD) funds are received, distributed, and monitored by the Riverside County Economic Development Agency (EDA). The funds are distributed between the five supervisorial districts and those cooperating cities on the HUD "fair- share" formula which is based on population, extent of poverty and sub-standard housing Projects selected for funding must meet criteria established by HUD. From applications received the Council allocates the funds within the established guidelines.

Projects/activities eligible for funding include public facilities improvements; real property acquisition; public service (limited to 15% of total grant allocation); housing; capital equipment (fixed); and rehabilitation/preservation. For an activity or project to qualify it must meet one of the three national objectives: (1) principally benefit (at least 51%) low- and moderate-income persons; (2) aid in the prevention of slums or blight; or (3) meet community development needs having a particular urgency.

STAFF REPORT: The CDBG allocation for Fiscal Year (FY) 2023-2024 is estimated to be $103,000‡. Of the $103,000, $15,450 (15%) is available to fund non-profit projects. It should be noted that EDA has set time limits for the expenditure of City project funds. Funds allocated during any given year must be expended within two years of award.

Pursuant to CDBG program guidelines, staff has: 1) advertised in a newspaper of general circulation for interested applicants; 2) posted the notice and CDBG application on the City's website and, 3) noticed this public hearing for allocation of CDBG funds.

Although the City typically receives applications from Harmony Kitchen and the Blythe Emergency Food Pantry, no CDBG Funding Applications were submitted by either party. The 72 City received one application for public service project from Focus First Counseling and Education, Inc. The applicants request $12,600 to fund a community garden to be constructed on vacant City property located at 430 W. Rice Street.

Permission for use of the City property has not been granted or requested of the City prior to staff receiving the CDBG application. The property is zoned R-M-L which is a residential zone.

In this zone, light plant cultivation is allowed for personal use. As a Community Garden would not be considered a personal use, Council would need to adopt an Ordinance Amendment to allow Community Gardens in the R-M-L zones. If adopted, the regulations would apply to all properties with this zone(s), not specifically to the property they wish to use. The Ordinance Amendment would need to include a definition for Community Garden, determine the zone(s) within the City this use would be permitted, and amend Table 17.08.010 of the BMC to include the applicable zones. Staff also recommends adopting regulations for Community Gardens, as this use is not currently permitted. Regulations could include hours of use, type of equipment and structures permitted and whether the sale of produce would be allowed. As this would be an amendment to the zoning code, a public hearing would be required prior to adoption.

As stated above, for an activity or project to qualify, it must meet one of three national objectives. The Community Garden would need to benefit at least 51% low- and moderate- income persons. As the community garden would be open to the public, our CDBG representatives at County HWS are concerned that the project could not meet this national objective. The applicants would be required to obtain documentation from those using the site which would include paycheck stubs and/or income tax returns to verify that they are low or moderate income. Failure to collect this information from at least 51% of the people using the garden could cause funds to be withheld or the project being cancelled. City staff would be tasked with reviewing the income certifications to determine if the funds were eligible to be reimbursed.

As there are a few administrative items that need to be addressed before the Community Garden may be established, staff recommends allocating the entire CDBG allocation to the City's project. The City is not required to fund a public service project. The only requirement is that if funded, the City cannot allocate more than 15% to a public service project. If Council is interested in moving forward with allowing community gardens in the City, it is recommended Council direct staff to move forward with the required Ordinance amendment to allow the use.

Staff would also need to prepare an agreement for the land use if the City Council authorizes use of City property for the Community Garden. Once the administrative items are complete, the applicants could apply other funding sources more in line with their project.

Over the past several years the City has expended CDBG funds in City parks. Past projects include restroom improvements in Miller, Appleby and Todd Parks, playground equipment in Miller Park and Appleby Parks, the Splash Pad in Todd Park, Community Center upgrades and improvements and installation of shade structures at Quechan Park. The City is currently working on project to place a shade structure over the new playground in Engevik Park and new shaded picnic areas at Miller Park with CDBG funding.

The 2023-2024 CDBG Funding Allocation is $103,000. As CDBG funding is typically used in City Parks, staff would like to implement a new program with this allocation to start a Home Enhancement Program with the help of Riverside County.

The program would provide exterior home improvements such as: roofs, doors, windows, and fencing. This program is in line with the goals of the City's Housing Element. The City has adequate housing stock; however, a number of the City's houses are considered blighted or sub- 73 standard. This program would help beautify neighbors and keep low-income persons in their homes. It may also decrease the number of vacant and abandoned homes due to them being in an unlivable condition and help the City meet the goals established in the Housing Element for hosing persons of low and moderate incomes.

The Home Enhancement funds are allocated one time per property. After the work is completed, the owner must remain in the home for 5 years, or the cost of the home enhancements would be repaid by the homeowner. A covenant is placed on the property to memorialize this agreement.

The improvements will be made to homes that are owned, not rented to low-income persons. The City would provide this program in cooperation with Riverside County. The County would work with city staff to identify potential properties. The County would conduct assessment and work with qualified homeowners. The County would hire local contractors to perform the work. There would be minimal City staff time involved in this program. With the current year's allocation and funding re-programmed from past projects, the City anticipates up to 5 homes could be rehabilitated through this project. All funds allocated to the City's Home Enhancement Program would be spent on property within the City of Blythe.

It is recommended Council direct staff to apply the $103,000 CDBG Allocation for 2023-2024 to he City's Home Enhancement Program in partnership with Riverside County HWS and submit he CDBG application for use of these funds on the Home Enhancement Progran ATTACHMENTS:

V. PROJECT BENEFIT
A. Indicate the number of people or households that will directly benefit from your proposal using CDBG funds: Note: This is based on the expected number of clients to be served if the County funds your project for the requested amount.

We project to involve at least 300 households within our community over the course of one year by providing seminars, on-going education, food sharing, recipes, gardening tips and tricks, and community involvement working towards common goals. This will all be provided to the residents of Blythe at the site of the community garden.

B. Indicate the number of unduplicated clients that will be served (An unduplicated client is counted only once, rio matter how many direct services the client receives during a funding year:

We estimate the number of unduplicated clients that will be served by this project to be around 350 based on the seminars offered and the food sharing we anticipate as we intend to focus several trainings to different local demographics which include various age ranges, potential for school field trips, service clubs, volunteer organizations, and all interested residents.

C. Length of proposed CDBG-funded activities or service (weeks, months, year):

The initial request for funding will allow us to start phase 1 of the project. The first phase will enable us to secure the site with the City, gain utility access via the City of Blythe for water resources and Southern California Edison for electricity. Once utilities are established, fencing the site, designing the phase 1 of the garden, and implementation of purchasing supplies and equipment will begin. We anticipate the project CDBG funded service to take approximately one year; however the project will not have an end date as the goal is to not only continue the project but to also have additional sites in the future.

D. Service will be provided to (check one or more):

Men • Seniors
Women ] Severely Disabled Adults
Children (Range of children's ages: 3-17 ] Migrant Farm Workers • Homeless (Number of beds at facility: ) | Families
4 79
E. What methods will be used for community involvement to assure that all who might benefit from the project are provided an opportunity to participate?
This organization intends to work with the City of Blythe, Riverside County, service clubs, other non- profit organizations, local law enforcement agencies, the local Chamber of Commerce, CARES Team, the school district arid Palo Verde College, churches, Future Farmers of America and 4H clubs to assure the community is involved in the programs and services this project has to offer. The specific methods that will be used will be via social media outlets, the local newspaper and the Chamber of Commerce which both maintain a events calendar, posting flyers and utilize community bulletin boards.

We plan to initiate a steering committee for this project which will consist of youth interested in the project as well as other community members within our school district, college, volunteer and non-profit organizations and other members of the community, interested residents / property owners near the site will all be engaged to become actively involved in the implementation of this project.

F. What evidence is there of a long-term commitment to the proposal? Describe how you plan to continue the work (project) after the CDBG funds are expended?
Blythe is a long standing, multi-generational community with many residents involved in farming and agriculture; however, residents continuously express the need and desire for locally grown fresh produce which we cannot get from our local farms. The farm to table experience is increasingly being requested by local residents after the one local farmers market Blythe had shut down several years ago. We intend to continue working with the local residents in need to locally grown organic produce to grow and harvest relationships as well as food.

VI. National Objective

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: November 8, 2022
SUBJECT: 2022 Local Hazard Mitigation Plan
PRESENTED BY: Chief Garth Dale
PREPARED BY: Community Service Officer Kelly Thomas
RECOMMENDATION: Receive and file.

FISCAL IMPACT: None
BACKGROUND: The Federal Emergency Management Agency (FEMA) requires all jurisdictions to have an approved Local Hazard Mitigation Plan whereby jurisdictions recognize, evaluate, and provide possible mitigation measures for hazards unique to their jurisdiction. This plan is required in the event that a local jurisdiction experiences a disaster or recognized hazard and require FEMA financial support. In August 2006 California adopted Assembly Bill 2140 (AB 2140) into California law. AB 2140 prohibits the state share for any disaster assistance project eligible under the California Disaster Assistance Act from exceeding 75% of total state eligible costs unless the affected city, county, or city and county has adopted a local HIMP as part of the safety element of its general plan, in which case the Legislature may provide for a state share of local costs that exceeds 75% of total state eligible costs.

STAFF REPORT: The City of Blythe currently partners with other municipalities in Riverside County in submitting a Multi-Jurisdictional Local Hazard Mitigation Plan to FEMA for approval. Riverside County serves as the lead agency responsible for the gathering each participating jurisdiction's LHMP and submitting it to FEMA for approval. Staff is currently updating the City of Blythe LHMP. Community input is a vital asset in ensuring all hazards are assessed and a plan to mitigate is formulated. On 10/18/2022, local law enforcement participated in the National Nights Out program and an opportunity for community input was offered by staff. Staff is seeking additional community input by including the item in this agenda.

FINDINGS REGARDING THE NEED FOR AMENDMENTS TO PROVISIONS IN THE 2022

CALIFORNIA BUILDING STANDARDS CODE DUE TO DUE TO LOCAL CLIMATIC,

GEOLOGICAL OR TOPOGRAPHICAL CONDITIONS
Finding No. 1. The Palo Verde Valley experiences summer temperatures exceeding 110° Fahrenheit. Adverse climatic conditions increase the likelihood that children will attempt to gain entry into a pool area. The higher fence height, and gate-opening hardware height and requirement for permits for pools of a specific size haves been found to be necessary to safeguard the public from unnecessary drownings.

Finding No. 2. The Palo Verde Valley experiences severe Santa Ana winds and storms creating wind gusts of 80 miles per hour. These conditions are particularly conducive to the ignition and spread of grass, brush, and structure fires. Those conditions can also topple an unsafely constructed fence and injure the public.

The tables below set forth the City of Blythe's amendments to the 2022 California Buildings Standards Code and states which of the findings above make each amendment reasonably necessary.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: November 8, 2022
SUBJECT: Request to Waive Community Center Rental and Temporary Use Permit Fees for the Chamber of Commerce's Tree Lighting and Winterfest PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council waive the Temporary Use Permit Fee of $222.00 and Community Center Rental fee in the amount of $500. The Chamber will be required to pay the $100 Labor Fee and $150 Refundable Deposit for use of the Community Center.

FISCAL IMPACT: Loss of revenue in the amount of $722.

BACKGROUND: The Chamber of Commerce will install a Christmas tree on a vacant property located at the southeast Corner of Spring Street and Hobsonway. Once installed, there will be a tree lighting ceremony on Friday December 2, 2022. A Temporary Use Permit is required to place this Christmas Tree on vacant property.

The Blythe Chamber of Commerce plans to host its Winter Fest event in the City's Todd Park on Saturday December 3, 2022. They were provided with a City Park Use Permit for the event which is fee free. They also intend to use the Community Center for restrooms, lighting, and electricity. The City has an adopted fee schedule for use of the Community Center. Staff cannot waive fees for this use without Council approval.

Last year, Council approved waiving the TUP and Community Center rental fees for the Chamber's Christmas events. The Community Center labor fee and deposit were not waived but were paid by two Council members.

STAFF REPORT: The Blythe Chamber of Commerce respectfully requests Council waive the Temporary Use Permit and Community Center Rental Fees for the Tree Lighting Ceremony on December 2id and Winterfest on December 3, 2022, which are part of their "A Superhero Christmas" activities.

Staff recommends waiving the $222 TUP Fee and $500 Community Center Rental fee. As the $100 labor fee is a direct cost of the city, and the $150.00 deposit is refundable after the event, staff does not recommend waiving these fees as part of the Chambers use of the Community Center.
