CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT

SILERISHE
MEETING DATE: January 24, 2023
SUBJECT: Golf Course Water Supply Line Project
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Council provide direction to staff.

FISCAL IMPACT: Unknown.

BACKGROUND: Water supply for the Golf Course is delivered from A Canal at the corner of 4th Avenue and Defrain Blvd. A 24" concrete pipe runs from the gate under a field currently owned by Red River Farms. Water from this pipe is pumped into a supply lake on Hole No. 6 and used to irrigate the Golf Course. It is believed the delivery pipe was installed in the late 60s.

It has been repaired over the years and has been leaking for some time. Red River Farms plans to build a new concrete ditch through their field for irrigation. They believe the City's leaking pipe will undermine the ditch and would like it repaired before they move forward. They also plan to level the field, lowering it by about 1 foot. This will not leave much cover over the water supply pipe, leaving it susceptible to breaks from equipment vibration or being hit or scraped by field equipment. This could make the pipe inoperable, starving the golf course of water necessary to operate.

After discussions with David Bayles of BNB Golf Management and Michael Mullion of Red River Farms, it was determined the best course of action would be the installation of a new 24" pipe. The project would consist of the installation of approximately 1000' of 24" pipe from the head gate located on the A18-CHK check station at 4* Avenue and Defrain to the cistern located at the holding pond on Hole No. 6. The new pipe would be installed 48" from the surface to insulate it from future damage. The existing pipe would be removed and disposed of.

On October 20, 2022 the City Council held a Special Meeting to discuss the issue. At the meeting, staff was directed to release a Notice Inviting Proposals for the project. On November 29, 2022, bids were received from RE Hoover in the amount of $143,500 and Radco, Inc. in the amount of $272,450. Due to irregularities in the bids received, Council rejected the bids on December 13, 2022 and directed staff to re-bid the project.

STAFF REPORT: On January 12, 2023, staff conducted the bid opening for the re-bid of the Golf Course Water Supply Line Project. The following bids were received:

Inland Builders Supply, Inc.: $195,000
Radco, Inc. $270,450
-3-
As the owner of Inland Builders Supply assisted staff with the bid documents for this project and has an interest in the Lease Agreement for operation and maintenance of the Blythe Golf Course, the City Attorney has advised there are potential conflicts of interest that would prohibit the City from awarding the contract for this project to Inland Builders Supply. The City Council's options include awarding the project to Radco, Inc. as the lowest responsible bidder, in amount not to exceed $270,450, or to once again reject the bids received and re-bid the project for a third time.

Staff was directed to apply for grant funding for this project through the Community Improvement Fund (CIF). Staff submitted the application after the bids were received. As such, the grant application requested a grant in the amount of $209,750, based on the bid submitted by Inland Builders Supply as the apparent low bidder for the project. CIF staff is working to set a grant committee meeting to discuss the City's grant request.

Pursuant to the Public Contract Code and the Blythe Municipal Code, it is within Council's discretion to reject any and all bids received and provide direction to staff on future action, which may include abandoning the project, re-advertising for bids, or, by passage of a resolution by four-fifths (4/5) vote of the Council, declaring the project can be performed more economically by City employees and having the work performed by force account.

The Holt Group also submitted a proposal for Surveying and Engineering services in the amount of $14,750.00. Should Council award the project to Radco, Inc., in the amount of $270,450, it is recommended Council authorize staff to enter into an agreement with The Holt Group in an amount not to exceed $14,750, authorize the City Manager to approve change orders during construction not exceeding $15,000 and establish a project budget of $285,200.

Any suspension of services made pursuant to the provisions of this paragraph shall continue until such time as this agreement has been fully and properly assumed in accordance with the applicable provisions of the United States Bankruptcy Code and in compliance with the final order or judgment issued by the Bankruptcy Court. If the suspension of performance of Consultant's obligation pursuant to this agreement continues for a period in excess of ninety (90) days, Consultant shall have the right to terminate all services pursuant to this agreement.

The Consultant shall not be required to execute any documents subsequent to the signing of this Agreement that in any way might, in the judgment of the Consultant, increase the Consultant's contractual or legal obligations or risk, or adversely affect the availability or cost of its professional or general liability insurance. Nor shall Consultant be required to sign any documents, requested by any party, including Client, that would result in the Consultant's having to certify, guarantee, warrant or state the existence of conditions whose existence the Consultant cannot ascertain. The Client also agrees not to make resolution of any dispute with the Consultant or payment of any money due to the Consultant, in any way contingent upon the Consultant's signing any such certification, guarantee, warranty or statement.

16. All fees and other charges due Consultant will be billed monthly and shall be due at the time of billing unless specified otherwise in this agreement. If Client fails to pay Consultant within thirty (30) days after invoices are rendered, Consultant shall have the right in its sole discretion to consider such default in payment a material breach of this entire agreement and, upon written notice, Consultant's duties, obligations and responsibilities under this agreement may be suspended or terminated. In such event, Client shall promptly pay Consultant for all outstanding fees and charges due Consultant at the time of suspension or termination. If Consultant elects to suspend or terminate Consultant's services pursuant to this provision, Consultant is entitled to reasonable suspension or termination costs or expenses.

17. Client agrees that all billings from Consultant to Client are correct and binding on Client unless Client, within ten (10) days from the date of receipt of such billing, notifies Consultant in writing of alleged inaccuracies, discrepancies, or errors in billing.

18. Client agrees to pay a monthly late payment charge, which will be the lesser of one and one-half percent (1-1/2%) per month or a monthly charge not to exceed the maximum legal rate, which will be applied to any unpaid balance commencing thirty (30) days after the date of the billing.

19. In the event Consultant's fee schedule changes due to any increase of costs such as the granting of wage increases and/or other employee benefits to field or office employees due to the terms of any labor agreement, or increase in the cost of living, during the lifetime of this agreement, a percentage increase shall be applied to all remaining fees and charges to reflect the increased costs.

20. Client agrees that if Client requests services not specified in the scope of services described in this agreement, Client will pay for all such additional services as extra services, in accordance with Consultant's billing rates utilized for this agreement.

21. Client acknowledges that the design services performed pursuant to this agreement are based upon field and other conditions existing at the time these services were performed. Client further acknowledges that field and other conditions may change by the time project construction occurs and clarification, adjustments, modifications and other changes may be necessary to reflect changed field or other conditions. Such clarifications, adjustments, modifications and other changes shall be paid for by Client as extra services in accordance with paragraph 20.

22. Client acknowledges and agrees that if Consultant provides surveying services, which services require the filing of a Record of Survey, or a Corner Record, all of the costs of preparation, examination and filing of the Record of Survey or Corner Record will be paid by Client as extra services in accordance with paragraph 20.

23. Consultant is not responsible for delay caused by activities or factors beyond Consultant's reasonable control, including but not limited to, delays by reason of strikes, lockouts, work slowdowns or stoppages, accidents, acts of God, failure of Client to furnish timely information or approve or disapprove of Consultant's services or instruments of service promptly, faulty performance by Client or other contractors or governmental agencies. When such delays beyond Consultant's reasonable control occur, Client agrees Consultant shall not be responsible for damages nor shall Consultant be deemed to be in default of this agreement. Further, when such delays occur, Client agrees that, to the extent such delays cause Consultant to perform extra services, such services shall be paid for by Client as extra services in accordance with paragraph 20.

24. Consultant shall not be liable for damages resulting from the actions or inactions of governmental agencies including, but not limited to, permit processing, environmental impact reports, dedications, general plans and amendments thereto, zoning matters, annexations or consolidations, use or conditional use permits, project or plan approvals, and building permits. Client agrees that it is the responsibility of Client to maintain in good standing all governmental approvals or permits and to timely apply for any necessary extensions thereof.

25.If the scope of services requires Consultant to estimate quantities, such estimates are made on the basis of Consultant's experience and qualifications and represent Consultant's best judgment as a professional generally familiar with the industry. However, such estimates are only estimates and shall not constitute representations, warranties or guarantees of the quantities of the subject of the Page | 9

estimate. If the scope of services requires Consultant to provide its opinion of probable construction costs, such opinion is to be made on the basis of Consultant's experience and qualifications and represents Consultant's best judgment as to the probable construction costs. However, since Consultant has no control over costs or the price of labor, equipment or materials, or over the Contractor's method of pricing, such opinions of probable construction costs do not constitute representations, warranties or guarantees of the accuracy of such opinions, as compared to bid or actual costs.
26: Client acknowledges that Consultant is not responsible for the performance of work by third (Excluding Consultant's Subcontractors) parties including, but not limited to, the Construction Contractor and its subcontractors.

27. Consultant makes no warranty, either express or implied, as to its findings, recommendations, plans, specifications, or professional advice except that the services were performed pursuant to generally accepted standards of professional practice in effect at the time of performance.

28. In the event (1) Client agrees to, authorizes, or permits changes in the plans, specifications or documents prepared by Consultant, which changes are not consented to in writing by Consultant, or (2) Client agrees to, authorizes or permits construction of unauthorized changes in the plans, specifications or documents prepared by Consultant, which changes are not consented to in writing by Consultant, or (3) Client does not follow recommendations prepared by Consultant pursuant to this agreement, which changed recommendations are not consented to in writing by Consultant: Client acknowledges that the unauthorized changes and their effects are not the responsibility of Consultant and Client agrees to release Consultant from all liability arising from the use of such changes, and further agrees to defend, indemnify and hold harmless Consultant, its officers, directors, agents, employees and subconsultants from and against all claims, demands, damages or costs, including attorneys' fees, arising from the unauthorized changes.

29. In the event of any litigation arising from or related to the services provided under this agreement, the prevailing party will be entitled to recovery of all reasonable costs incurred, including staff time, court costs, attorneys' fees, experts' fees and other related expenses.

30. Client agrees that in the event Consultant institutes litigation to enforce or interpret the provisions of this agreement, such litigation is to be brought and adjudicated in the appropriate court in the county in which Consultant's place of business is located, and Client waives the right to bring, try or remove such litigation to any other county or judicial district.

31. CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT

SABLISHED
MEETING DATE: January 24, 2023
SUBJECT: Engagement of Communication, Marketing and State Legislative Advocacy Services.

PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
ECOMMENDATION: It is recommended Council authorize the Interim City Manager ti nter into Agreement No. 2023-008 A with Tripepi Smith & Associates, Inc. for Communicatio and Marketing Services in an amount not to exceed $125,000. It is further recommended Council Authorize the Interim City Manager to enter into Agreement No. 2023-009 A with Joe A.

Gonsalves & Son for State Legislative Advocacy Services in an amount not to exceed $50,000 and to file the Lobbying Firm Activity Authorization, Form 602. Agreements will be executed once reviewed and approved by the City Attorney.

FISCAL IMPACT: Up to $175,000 from the General Fund Surplus. A Budget Amendment for these services will be brought to Council for approval a later date.

BACKGROUND: On December 6, 2022, the California Department of Corrections and Rehabilitation (CDCR) announced the planned closure of Chuckawalla Valley State Prison (CVSP) located in Blythe by March 2025. The City immediately opposed the closure, sending a letter to the Governor outlining the devastating impacts this closure will have on the City, its residents, and why CVSP is not the appropriate prison in the State's prison system to be selected for closure.

Mayor DeConinck and Vice Mayor Rodriguez were appointed to the City's CVSP Ad Hoc Committee to work with staff on all items related to the closure of CVSP. Staff and Council have contacted our elected officials, partner agencies and organizations for support in our efforts. As of the writing of this staff report, the City has engaged in discussions with Assemblyman Garcia, Senator Padilla, Congressman Ruiz, the County of Riverside, CVAG, the League of California Cities and the City of Norco.

STAFF REPORT: Staff wishes to engage Tripepi Smith to launch a Public Relations Campaign to bring awareness to the closure of CVSP, the impacts it will have on our rural and disadvantaged community, impacts which are disproportionate to what would be faced by other communities, environmental impacts associated with closing a prison located in a desert landscape and how there are other facilities that would provide more savings to the State and California's taxpayers by focusing on closing pre-segregation era prisons that need billions of dollars' worth of investment vs. closing newer prisons such as CVSP.

Staff also recommends that the City engage the services of Joe A. Gonsalves & Son, which will provide full-service State Legislative Advocacy Services. Joe A. Gonsalves and Son have 46 years of experience in Sacramento and have established relationships with lawmakers. Their expertise will be instrumental in navigating Sacramento, setting meetings with key lawmakers, -19-
and promoting the City's efforts in Sacramento.

Executive Summary
Thank you for the opportunity to present Tripepi Smith's offerings to assist the City of Blythe with outreach regarding the proposed Chuckwalla prison closure. This proposal offers the full array of Tripepi Smith services.

Tripepi Smith is a team of over 40 communication experts-robust enough to offer experienced and effective professionals for the job, yet small enough to be nimble and responsive. We offer a spectrum of skills that allow us to match the appropriate resource to the task at hand, letting us execute faster and reduce engagement costs. These resources vary by both years of experience and core hard skills (graphic design versus videography versus writing versus social media, for example. The result: we have an ability to tell a complete story across mediums, all within our one team. The City will only need one communication partner.

From Napa to La Mesa and out to Indian Wells, Tripepi Smith is actively working with dozens of city governments and public agencies. No other communication firm has the city client depth and diversity that Tripepi Smith offers. Our firm mixes technical prowess and policy competency, yielding key advantages:

1. No other public affairs firm in California (that we can find) has the certifications in social media and digital platforms that Tripepi Smith has. These certifications evidence our superior understanding of these platforms.

2. The breadth of Tripepi Smith's team-from policy to photography and videography—is rare. This experience benefits each of our clients as we can consolidate practical field experience to deliver insights and ideas for each new client.

3. Tripepi Smith's work with dozens of public agencies and municipal partners positions our team to communicate about the variety of issues known to local governments. Moreover, team members understand how to relate these issues to all stakeholders, including city staff, city council members, community leaders and residents.

4. Additionally, our team members are polished project managers equipped to coordinate across agencies and jurisdictions to ensure efficient meetings that leave no detail behind.

5. Finally, Tripepi Smith owns the largest local government publication in California - PublicCEO - providing an opportunity for our firm to advance ideas and thought leadership or generally raise awareness about issues affecting local governments.

We look forward to the opportunity to help the City of Blythe for the benefit of its residents, businesses, partners and visitors.

Respectfully,
Rape to frith

FIRM BACKGROUND & EXPERIENCE
Projects of Similar Scope
Tripepi Smith is currently engaged with dozens of local government agencies throughout California. The following are just four sample engagements that align with the services and scope the City has indicated it could need help with.

1. In the City of Duarte, Tripepi Smith works with the city manager's office in a broad and consistent arrangement to advance communications and augment the work of staff. The baseline engagement includes writing press releases and articles, updating the City website, managing social media, redesigning and creating the quarterly City News newsletter, developing a style guide, hosting quarterly strategy meetings with department heads, delivering monthly metric reports, advising staff on the City's upcoming website redesign and auditing City communications in an express assessment report. Duarte previously engaged Tripepi Smith for its first communications assessment as well as for videography, photography, drone, graphic design and email marketing services.

2. Tripepi Smith has been engaged with the City of La Cañada Flintridge (LCF) for more than six years as their contract PIO service. LCF is a small contract city with less than 30 full-time staff.

They contract for an array of services, such as public safety, engineering and inspection services. LCF conducts weekly phone calls with Tripepi Smith to plan communications regarding upcoming community issues and for social media posts. Tripepi Smith monitors community Facebook groups to identify emerging issues early on. A core deliverable of our engagement is a quarterly newsletter that is mailed to every household in the city. The LCF Vista is a three-panel, 8.5" × 11" format newsletter that the City completely relies upon Tripepi Smith to produce. Tripepi Smith plans the editorial calendar with senior leadership, interviews subject matter experts to write the stories, designs all layout and custom graphics, and lastly, manages the printing and mail house process to ensure timely delivery to residents. This print newsletter is one of the primary drivers for community education and outreach. In late 2019, LCF selected Tripepi Smith as its website developer of choice through an RFP process. Our team executed and launched a new WordPress website for the City. LCF has also called on Tripepi Smith for additional graphic design, custom stock photography, video production and video livestreaming to social media.

3. The City of Indian Wells has engaged Tripepi Smith on a retainer basis to provide project management, social media management, monthly metrics reporting, graphic design support, content production, website content updates and strategic communications planning.

TRIPEPI SMITH

PROPOSED SCOPE OF WORK
Tripepi Smith begins all engagements with a kickoff meeting with the client to introduce personnel to one another, define Key Performance Indicators (metrics, goals and timelines); review project management processes and tools; and ensure each team member has a full understanding of their responsibilities.

Tripepi Smith primarily uses the following tools to manage projects:
• Google Suite for email, creating real-time collaborative documents and instant messaging; • Zoom for conference calls;
• Sprout Social for social media management;
• Meltwater for social media and media monitoring;
• Mavenlink for project/task management, interal project status updates and time entry.

These project management tools enable project manager(s) to quickly determine a project's budget status, review the schedule of tasks and send rapid notifications to the whole team if issues arise.

Outside of regular check-in calls, the City may contact Jennifer Vaughn, account manager, with any questions, requests or issues. Jennifer will then swiftly relay instructions to the rest of the team. Should a serious issue arise that could impact a deliverable, she will arrange a meeting with all team members to discuss potential solutions. For example: if more resources are needed to execute on a deliverable or speed up a process, Tripepi Smith can immediately tap into its internal talent pool.

Principal Ryder Todd Smith will also be available 24-7 to address the City's needs.

Fixed Fee Deliverable
Dedicated Website
Tripepi Smith can build and maintain a dedicated website to host all of the pertinent information regarding Chuckwalla's closure. Everything from press releases and FAQs to template letters of support and opportunities for interested parties to join the coalition of advocates. Tripepi Smith offers support options to make it easier for our clients to manage their websites. This can include items such as performing maintenance on the site, upgrading to the latest software for better security, adding content and much more.

Retainer Engagement
Weekly Check-In Calls & Content Planning
To coordinate our efforts with City Staff and sustain momentum on projects, Tripepi Smith will schedule a recurring, one-hour weekly phone call that will include a City-designated lead for our engagement. These weekly calls will help drive content planning for various communication channels, including website content, press releases and social media posts and stories. Call content will focus on story plans, new issues or concerns that need to be communicated, identification of major themes or ideas to address in the coming weeks, review of recent media mentions and social media comments and sharing of communication opportunities in coordination with lobbying efforts. This will be a working call during which Tripepi Smith will manage an agenda and provide notes for each call. After each call, the client will receive an action summary email about decisions made on the phone call and related action steps. We will produce work, such as press 17 TRIPEPI SMITH

releases and article drafts, in a shared workspace where the City can see our progress in real time and provide instant feedback as needed. These tools allow for enhanced collaboration and expedite the production process.

Social Media Management
Content Creation: Social media content creation involves: planning, fact-checking, sourcing graphics, grammar checking and scheduling the post. Tripepi Smith will create up to four (4) posts per month over the course of 6 months and distribute them on up to five (5) platforms (e.g. Facebook, Instagram, Twitter, Linkedln, Nextdoor).

Monitoring: Tripepi Smith will monitor inboxes for questions and comments. When appropriate, responses will be drafted, which will occasionally require fact-checking and seeking out guidance from the City.

Additional: Our work also includes optimizing social media accounts to boost performance and keeping up to date on the latest social media platform updates and options. Boosted posts and targeted ads are also helpful in disseminating information to community members, and Tripepi Smith is fully capable of running and tracking these paid campaigns (fees to be agreed upon and paid by the City).

Website Content Management
Tripepi Smith can ensure your dedicated website it kept updated with pertinent content such as press releases, FAOs and contact information. We can allocate 2 hours per month providing these updates.

Coalition Building Efforts
Our Tripepi Smith team is integrated throughout California communities and regional agencies. In concert with the City and its lobbyist, we can facilitate the growth of a strong and supportive coalition to amplify the City's message.

Optional Retainer Add On Work
Stakeholder Newsletter
Digital Newsletter:

Tripepi Smith has email marketing design experts with access to the complete Adobe Creative Suite to make any email template stand out. We will create one email template inside of your email platform for monthly newsletter use. Email is another avenue to distribute the news article content that is created every month; it's inexpensive, prevalent and a solid way to reach engaged residents. We can use existing email lists collected from the City's utilities and/or Parks & Recreation. The scope of the digital newsletter includes writing up to seven articles to build the content for what will actually go in the newsletter. If we deliver an electronic newsletter, we suggest the format be that we post the articles to the Blythe website, then link snippets of the articles from the email platform. Tripepi Smith's scope is to both design the electronic newsletter, provide editorial calendar planning services, write the articles in cooperation with City subject matter experts, and then deploy the content on the website and through the email platform (i.e. Constant Contact, etc).

Print Newsletter:

Alternatively, Tripepi Smith can perform the same process as above, but lay out the newsletter in a PDF format that is also intended to be printed, and we can collaborate with a local print shop to have the newsletter delivered via mail. Our proposed pricing does not include pricing for the printing and postage 18 TRIPEPI SMITH

fees. As a starting point for price consideration, Tripepi Smith has used our La Cañada Flintridge newsletter as the reference point for discussion. Tripepi Smith produces these quarterly tri-fold newsletters for clients like the City of La Cañada Flintridge, in which we develop up to seven articles highlighting key City events, accomplishments and features. These newsletters are carefully curated and designed with the support of our graphic design team.

Tripepi Smith can also provide in house Spanish translation and reformat the newsletter accordingly for a PDF format. For the digital format, we can write a native Spanish version, and then rely on the language translation on the City's website to handle the Spanish version.

The layout in PDF format and handling with a printer is more involved, complicated and demands more graphic design time, so the price for a print edition is more expensive than the email delivery format. The exception to this is if you want us to deliver a PDF version, but then we use an email for distribution.

PublicCEO Placement
PublicCEO reaches 16,000 California government executives daily with an email newsletter. With top billing on the PublicCEO website, the City of Blythe's efforts to educate the public regarding the Chuckwalla prison closure will reach a statewide audience of decision-makers.

Press Release
Tripepi Smith can draft news articles, press releases and/or official statements, which are typically up to five hundred (500) words in length. The City would direct the allocation of stories with Tripepi Smith's suggestions, making internal subject matter experts available to aid the development of the stories when needed. Additionally, this assumes the City would provide a media and external agencies notification list for use by Tripepi Smith where a press release scenario is desired. The City would also facilitate timely approval of quotes in the release when connected with City Staff or City Councilmembers.

Press Conference
In coordination with the City's lobbying efforts, Tripepi Smith's team will facilitate a press conference to educate the media on the impact of the prison closure to Blythe's economy and community. 20 TRIPEPI SMITH

Op Ed Writing
In addition to standard press releases, the City can benefit from additional support and coverage from the perspective of impacted stakeholders. Tripepi Smith can partner with the City to identify appropriate leaders and draft Op Eds on their behalf to distribute to media outlets reaching decision-makers in Sacramento.

Collateral Material
Tripepi Smith uses Canva extensively for basic social media graphics and therefore can use our Junior Business Analyst resources for that work. Where more extensive design is required, Tripepi Smith has an Art Director, Senior Graphic Artists and Graphic Artists that can provide meaningful collateral that will leave a lasting impression. The City would benefit from a slick flier/leave-behind piece to provide an overview of the issue and its impact on the community.

Video
Tripepi Smith can produce a general education video and/or a PSA to the community. We can provide scripting, use of teleprompter, full camera setup, a single day of production shooting, b-roll shooting on same day, pre-planning, post-production video editing, music licensing, voice over, transcription and upload to appropriate channels.

Town Hall Facilitation and Promotion
Tripepi Smith has extensive experience in hosting and facilitating community meetings. We can ensure that the event is promoted and well attended virtually and/or in person to maximize outreach. We can assist with logistical details and marketing each event to the appropriate audience. Tripepi Smith can use social media platforms, digital or printed flyers and custom graphics to advertise events based on the needs of the City.

Not only will this serve as a component of transparent communication to the region, it can attract additional supporters for the cause. Tripepi Smith can also dispatch junior level, bilingual resources to staff community events in-person to support community outreach, community booths at events Community Leader Training
Building a strong grass-roots network is essential for gathering support and spreading information. Tripepi Smith can create the talking points and training necessary so that community leaders serve as ambassadors to the City.

Human Interest Video Interviews
By conducting a series of interviews with people that have been positively impacted by Chuckwalla prison's efforts in the community, Tripepi Smith will help the City build a case for their contributions in Blythe and provide a better understanding for its positive impacts in the region.

Community Sentiment Analysis
To kick off community outreach efforts, Tripepi Smith recommends collecting community feedback using FlashVote, an automated scientific community survey technology that would provide actionable input on any pertinent community-oriented initiatives. FlashVote is inclusive for residents who want to participate, with communications by email, text and phone call, plus multiple language options. By collecting community

feedback, Tripepi Smith can help the City engage with residents more effectively on future City projects, events, and more.

Here is an example response format that uses survey results for outreach on community branding:

Other Costs
Because Tripepi Smith offers a broad set of services, including extensive content production, we have some other content production-related fees that may come up during our engagement that we want to tell you about.

Travel Costs
Travel costs must be pre-authorized and then will be reimbursed by the City for any requested travel. Travel costs to be covered are for airfare, lodging and car rental. If Tripepi Smith is requested to be onsite, we will invoice for travel time at half rate of the resource's applicable Hourly Rate.

Equipment Costs
Tripepi Smith offers some services that require equipment, such as drone operations and video production.

As such, in those cases, the following rates apply:

Half Day Full Day
Video Equipment $350 $550
Drone Equipment N/A $500
Five-hundred-fifty dollars ($550) for a full day of video equipment use (includes full set of video equipment). Full day is defined as a shoot lasting four (4) or more hours.

Three-hundred-fifty dollars ($350) for a half day of video equipment use. Half day is defined as anything under four (4) hours of video production. All such expenses will be authorized by the Town prior to fee being assessed.
• Five-hundred dollars ($500) per day drone fee applies and is not inclusive of the drone operator time (Drone Operator rate).

Service Fees
Client Pays Directly Client Reimburses TS
Print costs, digital advertising, media
placement, voiceover/captions No Fees 10%
Typically, Tripepi Smith prefers to have service providers bill the client directly to avoid additional administrative costs and because we have no economic interest in the service provider selection. If Tripepi Smith is asked to pay the bill for the client, we will apply a ten percent (10%) agency fee to the reimbursement expense. Typical services include, but are not limited to:

Print Costs: Tripepi Smith is happy to use a printer of the client's choosing for print production work, or to recommend a printer with whom we have experience.

Digital Advertising: Tripepi Smith is a Google Partner and Constant Contact Solution Provider and has Facebook Certified staff. We consider digital platforms to be a cornerstone element of any outreach strategy; often this comes with digital advertising fees.

Media Placement: Tripepi Smith can help liaise on behalf of the Town for advertising space within various mediums, such as newspapers, magazines or websites.

Ms. Mallory Crecelius, Interim City Manager
City of Blythe
235 N. Broadway
Blythe, CA 92225
Dear Ms. Crecelius:

Thank you for the opportunity for Joe A. Gonsalves and Son to submit our proposal for full- service State Legislative Advocacy Services to the city of Blythe. We are honored to provide the attached proposal introducing you, and the city of Blythe, to our firm.

Our firm's strategic approach to advocacy is custom tailored to the unique needs of each of our clients by utilizing our 46 years of experience and relationships with Legislator's, the Administration and stakeholders. Our advocacy will embrace and help promote the City's agricultural community while ensuring the City continues to be an opportunity for businesses and residents alike through a tailored-made approach unique to the city of Blythe.

I have enclosed a list of our present clients. As you can see, we represent a large number of cities. We believe our base of client cities has provided us the unique opportunity to work with each member of the Legislature. Recognizing the number of Legislators coming out of local governments, we have established relationships prior to them being elected to the Legislature. In addition, I have enclosed an outline of both our legislative and grant funding accomplishments. Please note this is a partial list as it would be impossible for me to fully communicate the level of success we have enjoyed in representing our clients over the past 46 years.

We represent a very distinguished group of clients other than cities. FIRM QUALIFICATIONS
By way of background, our firm was founded by Joe A. Gonsalves in 1975. He served as a member of the California State Assembly from 1962 through 1974. Prior to that, he served as a Dairy Valley Council Member including two years as Mayor of the city of Dairy Valley, which is now the city of Cerritos.

In January 1977, Anthony Gonsalves joined the firm after having worked for the California State Senate. Shortly after he joined the firm, we incorporated; and we are now known as Joe A. Gonsalves & Son.

In December of 1998, Jason Gonsalves, joined our firm to assist with our lobbying efforts.

That gave our firm the proud distinction of being the first to have three generations of legislative advocates working on behalf of their clients.

In October of 2004, Paul Gonsalves, joined our firm after most recently serving as a legislative aide to former Assemblymember Rudy Bermudez. Paul received a B.A. in Political Science, a minor in Public Administration, and became Certified in Grant Writing from San Diego State University.

Our firm lists our scope of services in very general terms. We purposely do this to ensure that each client has the flexibility to request any assistance you may require in Sacramento, such as setting up meetings with the appropriate legislators, Governor's office or the various state departments. Should you have any changes you would like to make in the scope of services, please feel free to discuss those with us. Additionally, we do not assign clients to a specific lobbyist in the firm. Instead, you have access to all the firms' employees at any time.

Our firm charges a retainer on a monthly basis and contains a 30-day cancellation clause, as we are confident in our ability to continue to provide your City with an unparalleled level of service. The retainer is all inclusive of the services we would provide for the City. We do not charge for any additional costs.

Our firm will work cooperatively with your management staff and City Council to ensure a high level of legislative and administrative success in Sacramento. We utilize every asset available to us and we will personally meet with each Member of the Legislature, their staff and the Governor's office to ensure such success. Our strategies will vary depending upon the issues as well as Sacramento's ever changing political climate. Whenever you and/or your staff requests something from our firm, we get to work on it immediately and report the actions back to you.

Joe A. Gonsalves & Son is a full-service lobbying firm that has a reputation for hard work, honesty and a proven record of success. Our firm has the combined skills and expertise to get the results you want. As previously mentioned, our firm was founded in 1975 by Joe A Gonsalves. As a former California lawmaker, his long-standing reputation of honesty and integrity continues to serve as our firm's foundation.

In January 1977, Anthony joined the firm after having worked for the California State Senate.

Shortly after Anthony joined the firm, we incorporated; and we are now known as Joe A.

Gonsalves & Son. The political process in Sacramento is truly complex. In the four plus decades Anthony has been lobbying in Sacramento, he has had the opportunity to master such complexities, which enables our firm to be successful when representing our clients on particularly difficult and controversial issues.

In December of 1998, Jason joined our firm to assist with our lobbying efforts. That gave our firm the proud distinction of being the first to have three generations of legislative advocates working on behalf of their clients, which continued until Joe passed away in July 2000. Jason has successfully represented our clients before the Legislature and various State Agencies in the areas of local government finance, utilities and commerce, water, public employees' retirement, workers' compensation, environmental regulation, telecommunications, and conflict of interest issues.

In October of 2004, Paul, joined our firm after most recently serving as a legislative aide to former Assemblymember Rudy Bermudez. Paul received a B.A. in Political Science, a minor in Public Administration, and became Certified in Grant Writing from San Diego State University. Paul has successfully represented our clients before the Legislature and various State Agencies in the area of transportation, environmental quality, water, affordable housing, local governance and telecommunications. In addition, Paul has helped secure millions in State grant funding for our clients.

In 2005 a newspaper reporter asked a high-ranking legislative staff member if he/she thought future generations would join the "Gonsalvi" at which the staff member responded "you sort of nope they do, it's hard to imagine this place without a Gonsalves." The Members of the Legislature and their staff know and respect us in Sacramento and, as importantly, they know we respect them. Without integrity, one cannot lobby, and our integrity never waivers. -59-

PROJECT TEAM INFORMATION
Our firm intentionally does not divide up workload. We have three full time lobbyists in our firm and each lobbyist is fully engaged in our representation of your City. As an example, when a sponsored bill is being heard in committee, we will have each of us in committee.

One of us will provide testimony, one may be meeting with Members and/or staff in their offices, and one will likely be pulling a member out of committee to request their support. It is very difficult for one lobbyist to actually lobby an entire committee alone.

Our entire firm intentionally uses the same [email protected] email address. We do this in order to make sure each member of our firm is aware of the issues of importance as we coordinate our efforts. Whenever we take on an issue, all three lobbyists actively advocate on your behalf.

We are a family firm with three lobbyists, Anthony Gonsalves (father), and his two sons, Jason and Paul Gonsalves: As with most family businesses you can safely assume the organizational structure, with one significant difference, we consider each and every one of our clients to be "the boss".

Personnel:
• Anthony D. Gonsalves - President: (44 years)
Jason A. Gonsalves - Vice President: (23 years)
• Paul A. Gonsalves - Lobbyist: (17 years)

STAKEHOLDERS
Joe A. Gonsalves & Son does not intend to subcontract for the proposed services, however, we do recognize the value of relationships and leveraging a diverse set of strengths and experiences to achieve a common interest and goal. Our firm has significant experience in building, leading, and working in coalitions with public, private and aligned advocacy groups to support our goals and objectives. Every legislative policy has numerous proponents and opponents, which varies depending on the issue. Our firm will assist in identifying and building coalitions with stakeholders that support the City's legislative and policy positions.

Additionally, we have personal and professional relationships with every member of the Legislature and their staff, including your Assemblymember and Senator. I would recommend you contact any Legislator and ask them about our firm. In addition, we encourage you to discuss our representation with our clients

GRANTS
Our firm proactively identifies and notifies the City of any/all funding opportunities. We assist you in developing your project proposals for each potential grant application. Once the application has been submitted for the grant, our Firm will work with the City management team to schedule meetings with the State Agency that is overseeing the grant. This allows for the opportunity to discuss the City's project in greater detail with the appropriate staff at the department. Often times, these meetings help put a "personal touch" on the project and provide for other funding opportunities to be revealed.

We recommend the city of Blythe request our firm set-up a series of "action days" in Sacramento to meet with the various State Agencies overseeing the desired funding in an effort to craft a competitive proposal. Additionally, we recommend meeting with Legislator's and Legislative Committees to seek their input and support on any funding the City is seeking. Likewise, this will provide an opportunity for the City to receive information and provide input on any funding opportunities that may be available or coming available.

PROJECT APPROACH
Our Firm works cooperatively with your management staff and City Council to ensure a high level of legislative and administrative success in Sacramento.

As previously mentioned, our firm intentionally does not divide up workload. All three of us will be available for the duration of the Contract.

Once we have received direction from your City and the facts regarding a specific matter, we will immediately work with your staff on the following steps:
• Identify potential Legislators whom can support our cause • Meet with the members of the Legislature

• Meet with the pertinent committee consultants
• Identify and meet with interest groups, lobbying firms and/or coalitions who can be supportive
• Identify and meet with interest groups, lobbying firms and/or coalitions who may be ir opposition. More than likely, we have a personal relationship with the opponents and or the firms that represent them and by reaching out early we find we are able to neutralize organizations that otherwise may have been opposed. • Assuming legislation is necessary, we will meet with each Member of the various committees the legislation will be referred to in an effort to secure their support for our position prior to each hearing.

We often times tell our clients: "our expertise is the legislative and regulatory process, we are not city of Blythe experts", "which means we will continue to work with your management and technical staff in order for each of us to have a clear understanding of the many issues we expect to provide assistance on. Our firm prides itself on being upfront and honest with the Legislature, which ensures we will never do anything to embarrass ourselves or your City.

Relationships and respect matter in Sacramento and we are extremely proud of the personal and professional relationships we have with the Executive Branch, State Agencies as well as the members of the Legislature. Our long-standing presence in Sacramento enables us to successfully represent your City.

We provide your city with a weekly report, which we send out every Thursday or Friday, depending upon the legislative calendar. We tailor our weekly report to ensure it provides a specific update on the legislative proposals identified/adopted by your City Council.

Additionally, we will provide the City with a monthly written and oral report of legislative activity, as requested.

Our firm lists our scope of services in very general terms. We purposely do this to ensure that each client has the flexibility to request any assistance you may require in Sacramento, such as setting up meetings with the appropriate legislators, Governor's office or the various state departments.

Legislation:

Our firm actively monitors, reviews and participates in the daily activities of the Capitol and the State Agencies. We receive a copy of every bill introduced and each set of amendments.

We will read each bill and the amendments and send those that we feel may be of interest to your city. In addition, as the legislative proposals develop, we provide you with fact sheets and analysis of the bills that may affect you. We provide your City a "weekly report" with the status of all bills either watched, supported and/or opposed by your City. -64-

Additionally, we actively sponsor bills on behalf of our client's as well as maintain a constant line of communication with the Members of the Legislature and their staff to ensure we are apprised of upcoming proposals. Our firm will assist in preparing written correspondence on any/all issues of importance to the City. That said, we do not unilaterally adopt positions on behalf of the City. We work very closely with the City's management team under the direction of the City Council.

Whenever your City adopts a position on legislation and/or proposed regulations, we cover all bases. We meet with the Author's office, the Committee Consultants (both Democrat and Republican), Legislative Leadership, all pertinent stakeholders, and provide testimony in each Committee in order to ensure your City's position is known and ultimately supported.

Increased presence:

An invaluable part of achieving the City's goals and objectives is establishing a voice in Sacramento. Our firm will accomplish this by maintaining our relationships and communication with key policy makers on your behalf. We strongly recommend you request our firm to set up a series of "action days" in Sacramento to meet with legislator's, key committee members and staff, the Goveror's office, and State Agencies to discuss the Cities priorities.

Our firm will be present to represent the City of Blythe's positions on Legislation in every pertinent committee, on the floors of both houses, and in front of any state agency overseeing an issue of importance to the City.

Regulatory and Administrative:

The regulatory and administrative process are often the most time consuming and onerous part of advocacy. State Agencies within the State of California have continued to grow as the Legislature has provided many of them with new powers and responsibilities. Moreover, recent state budget investments and legislation have resulted in unprecedented amounts of funding for various projects.

Our firm will monitor, analyze, participate and influence agencies with administrative actions of interest to the City. The process for regulations and funding guidelines will be handled in the same manner as legislative matters. We will work closely with the City to establish policy direction and we will take the necessary steps to best represent the City before the State Agencies.

Dear Jason,
- our a lo avia, he distulatio redevelope beated Coming erylad and you family's firm.

I am convinced that if it was not for your involvement and advocacy for our community, we would not have our Finding of Completion, approval of our Long Kange Property Management Plan, and a repayment schedule on the $11.5 million settlement. It is very possible that West Covina could have been on the brink of bankruptcy, if you had not convince the Department of Finance that our new City Council and City Manager were committed to resolving the issues of the past.

As we move forward, it is rewarding to know that you will be at our side, as we seek repayment of our former Redevelopment Agency/City loans and to resolve the remaining ROPS issues that we need to complete. Unce this is all done, we can finally focus on the legislative priorities of interest to West Covina.

On behalf of the City of West Covina, I wish to thank you and the Gonsalves Family for over 10 years of friendship and dedicated service to our community. I look forward to many more! Sincerely,

Dear Jason,
I wanted to thank you for your excellent work concerning Roseville's meetings with the California Department of Finance (DOF) to discuss the City's 2016-17 Recognized Obligation Payment Schedule (ROPS) Determination. Because of your outstanding relationship with the DOF we had the opportunity to meet with the department on several occasions regarding their determination of our ROPS. Your guidance, insights and refined understanding of the most recent redevelopment dissolution "clean-up" legislation were critical to the positive outcome of the meetings, which resulted in the DOF approving the repayment of more than $7 million of redevelopment loans to the City, which they initially had disapproved.

As the City was developing its response to the DOF's initial determination, some individuals were recommending the City should bring a lawsuit against the DOF instead of attempting to resolve the concerns through the "Meet and Confer" process. However, staff chose to follow your recommendation to work with DOF and attempt to resolve the issue in a non- litigious manner. Our staff was confident in your recommendation because of the outstanding relationship staff has with you and the antire Gonsalves & Son organization.

We knew we could rely on the strong interactions you have with DOF and your tremendous understanding of the dissolution law to anticipate a successful outcome. I am very pleased that we once again followed your valuable advice, which resulted in such a noteworthy outcome for our City.

I realize the entire Redevelopment Dissolution process has been wrought with many difficulties over the years. However, we have found the process to be less problematic than many other municipalities, in part, due to your recommendations and help with understanding the implications and outcomes of legisiallon and assistance with DOF. We appreciate the outstanding work you continue to provide to Roseville in understanding and effectively working with the legislature, state departments, agencies and state wide organizations.

Sincerely,
Rob Senser

Allen,
Thank you for your responses to the email | forwarded you from Assm. Brown's office.

As we discussed last week, my understanding is the Mayor and/or his office Assm. Brown requesting her assistance with Secretary Laird and CalFire.

That said, 1 share your belief that politics could impede solutions and based upon the responses the Assm. Received from CalFire they do not seem interested in being part of a solution.

Assuming you are in agreement? I will thank the Assm.
for her support and let her know there is nothing more we need at this time as the City will continue working with the local stakeholders and the Court.

In addition, please know Supervisors Hagman, Gonzalez and Rutherford are all former clients and personal friends. in addition, Supervisor Rutherford's new COS, Andy Takata is a former CM, client and friend. If and when you feel we can assist you with the County please do not hesitate to contact me.

Happy New Year and here's to a successful and less stressful 2015! Sincerely,
Jason
