NEW BUSINESS:
MOU between the City of Blythe and Indio for Law Enforcement Services. Interim City Manager Crecelius reported the City of Indio is responsible for providing law enforcement services for the annual Coachella and Stagecoach festivals, both of which are held in April. Over 100,000 people attend these events, and the Indio Police Department relies on the help of other local Law Enforcement Agencies to support their staff. The City of Indio reimburses those agencies for providing personnel at the established pay rate and a flat pay rate for other costs.
The City of Indio asked the City of Blythe to consider providing Blythe Police Officers to assist at this year's events. Officers will work this detail on their days off so it will not interfere with police operations in the City of Blythe. If there happened to be an emergency in Blythe, our staff could be recalled. It is therefore recommended Council authorize the Interim City Manager to enter into Agreement No. 2023-019 A once revied and approved by the City Attorney.
No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.
April's City Council Meeting Schedule. Interim City Manager Crecelius reported due to the Outlook Conference scheduled for April 6, 2023 and the other ancillary events that are held that week which is an Agenda week, staff asks to move the Council meeting from the second to the fourth Tuesday of the month. The regular meeting schedule will resume in May.
No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.
Ordinance No. 921-23 Amending Chapter 2.65 (Purchasing System) of the BMC to Outline Requirements to the Sale and Disposition of Surplus Property. Interim City Manager Crecelius reported once City property or equipment has met its useful life, the process for disposal has included a staff report to Council deeming the property surplus and authorizing aiction is feld to dispose of to as a otaly ne ten proces for disposing til tus bic assets, staff proposes the attached Ordinance which allows the City Manager to approve the disposition of any surplus assets with a value less than the City Manager's signing authority of $60,000. Staff will bring any City surplus asset with a value greater than $60,000 to Council for approval prior to disposition of the asset. Pursuant to the Ordinance, staff will also bring any surplus items proposed for donation to City Council for approval. The proposed Ordinance outlines procedures for disposing of surplus assets through public auction, electronic auction or sales including internet-based marketplaces, by consignment, competitive bid, negotiated sale or exchange or trade for new goods. This will allow staff more avenues to quickly dispose of assets once they are obsolete or have met their useful life. Under this Ordinance, the City Manager will have the authority to destroy or dispose of surplus property with no commercial value or items that require an expenditure of funds for continued care, handling, maintenance, or storage which exceeds the estimated proceeds of sale. This will eliminate the storage of items with no -39-
commercial value at Public Works as assets with no value will be disposed of in a timely manner. The Purchasing Agent/Finance Director will keep records of all surplus property sold, exchanged, traded in, disposed of, or donated pursuant to this Ordinance. To streamline the reces for disposing of party eri, it abashed Council ton orieN. 92123 and authorize the City Manager to approve the disposition of surplus items in a manner consistent with Ordinance No. 921-23 until the Ordinance takes effect.
No public comment. Councilman Reynolds moved approval of Staff's recommendation. The motion was seconded by Vice Mayor Rodriguez with a unanimous aye vote.
ORDINANCE NO. 921-23. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, AMENDING CHAPTER 2.65 PURCHASING SYSTEM) OF TITLE 2 (ADMINISTRATION AND PERSONNEL) OF THE BLYTHE MUNICIPAL CODE TO ADD A NEW SECTION 2.65.140 RELATING TO THE SALE AND DISPOSITION OF

Save Chuck. Interim City Manager Crecelius reported the City has launched the Save Chuck Collection in response to the California Department of Correction and Rehabilitation's announced closure of CVSP by March 2025. The website, www.savechuck.org was launched in the last few weeks and we encourage everyone to visit and sign up to participate and receive updates on this movement. This topic will be discussed at the Outlook Conference on April 6th at Palo Verde College from 9-11am. The City continues to receive support for our legislators, and community partners and fellow cities. We have received support from CVAG, Supervisor Perez and the County of Riverside, Assemblyman Eduardo Garcia, Congressman Raul Ruiz, the Cites of Perris and Indian Wells, and several other cities are finalizing their support letters. Last night the Riverside County Division of the League of California Cities unanimously voted to support our efforts. The City is also working in close partnership with the City of Norco to propose a swap of CRC in Norco for CVSP in Blythe. If a prison must close, CRC is the better choice as it will save the taxpayers millions of dollars per year. CRC is $10,000 more per capita than CVSP.
To put that in perspective, it costs the state $20 million more per year to operate CRC than Chuckawalla. On top of that, CRC needs $1.1 billion in infrastructure improvements over CVSP's 640 million. As CRC has been slated to close since 2012, the State has made no infrastructure investments into CRC, however the State has continued to fund projects at CVSP, including a medical facility upgrade that was completed this year. The City of Blythe believes this is a win-win for Blythe and Norco as Blythe wants to keep CVSP and for Norco who has for years petitioned to have CRC shuttered. CRC was built in the 1920's as a hotel resort. It is one of the oldest prisons in the State's system and the only one that was never designed to be a prison.
This swap is also a win for the Governor who will still reduce bed capacity statewide by closed CRC instead of CVSP. The biggest winner in this proposal are the taxpayers, who could take the money spent on CRC and reinvest it in our communities. Staff wanted to take this opportunity to give a brief update of what has been done and allow time for any question may have about the Save Chuck movement. We would also like to encourage our citizens to sign up to support these efforts.
Public Comment. Mick Catron asked if the strategy to not have CVSP closed is to recruit others to propose a swap of CRC for Chuckawalla.

Blythe CITY COUNCIL MEETING
CHARTSHED STAFF REPORT
MEETING DATE: April 25, 2023
SUBJECT: Grant Partnership between the City and WattEV
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
It is further recommended Council authorize the Interim City Manager to execute any and all documents associated with the grant and grant application.
FISCAL IMPACT: Potential grant funding. The minimum grant award is $1 million.
BACKGROUND: WattEV proposes to develop a truck charging station to be located on three vacant parcels on East Donlon Street immediately west of the Casa Encinas Apartment complex.
The project will include an electric vehicle charging facility for 46 passenger vehicles and 72 medium and heavy-duty trucks. The project also consists of development of a convenience store, solar field, and battery storage area. The project has completed the City's PRC process and has started CEQA review.
STAFF REPORT: WattEV made the City aware of a grant opportunity through the U.S.
Department of Transportation which provides federal funding for entities to strategically deploy publicly accessible EV Charging Infrastructure, hydrogen fueling infrastructure, propane fueling infrastructure and natural gas fueling infrastructure in certain locations accessible to drivers. The grant requires the government entity to contract with a private entity to deliver the project.
WattEV asked to prepare a grant on the City's behalf to fund their EV Charging Station project.
Any and all costs incurred by the City through this grant process would be accounted for in the grant budget. From what I understand, there will be minimal work for City staff associated with the grant outside of the submission of the grant and quarterly reporting.
Both City staff and WattEV believe this would be a competitive grant due to the project's location on the I10 Corridor, providing travelers with a necessary charging point between Phoenix and Los Angeles. As the State moves towards electrification, the City of Blythe is well positioned for alternative fueling stations which will be required to get trucks to and from California ports.

CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: April 25, 2023
SUBJECT: Purchase of Blythe Police Department Animal Control Vehicle PRESENTED BY: Police Chief Garth Dale
PREPARED BY: Police Chief Garth Dale
RECOMMENDATIONS: Staff recommends Council authorize the Interim City Manager to enter into an agreement with Finn Motor Group for the purchase of a new 2022 Dodge Ram 3500 Tradesman in the amount of $72,578.67.
FISCAL IMPACT: $72,578.67 funded through grant funds awarded by the UC Davis Koret Shelter Medicine Program Grant.
BACKGROUND: On December 12, 2022, City council approved the purchase of a vehicle from the National Auto Fleet Group for use as an animal control vehicle. Unfortunately, the allotment was not available from the manufacturer. Therefore, staff had to find another source to purchase a vehicle within the timeframe allowed by the grant that was provided by UC Davis.
In March, the City released an Invitation for Proposals for the purchase of a 2022 or 2023 Dodge Ram 3500 Tradesman. The Invitation was posted in the Palo Verde Times, on the City's website and sent to vendors who routinely perform these services for the City.
STAFF REPORT: The City received one sealed proposal for the purchase of the vehicle from Finn Auto Group located in Blythe, CA. The proposal was determined to be responsible.
Therefore, it is recommended Council authorize staff to move forward with the purchase of the Animal Control Vehicle from Finn Auto Group in the amount of $72,578.67.

MEETING DATE: April 25, 2023
SUBJECT: Ordinance No. 921-23 Amending Chapter 2.65 (Purchasing System) of the Blythe Municipal Code to Outline Requirements Relating to the Sale and Disposition of Surplus Property
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
Brittany Roberto, City Attorney
RECOMMENDATION: It is recommended Council adopt Ordinance No. 921-23:
ORDINANCE NO. 921-23. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, AMENDING CHAPTER 2.65 (PURCHASING SYSTEM) OF TITLE 2 (ADMINISTRATION AND PERSONNEL) OF THE BLYTHE MUNICIPAL CODE TO ADD A NEW SECTION 2.65.140 RELATING
TO THE SALE AND DISPOSITION OF SURPLUS SUPPLIES AND EQUIPMENT AND FINDING THE
ORDINANCE IS EXEMPT FROM ENVIRONMENTAL REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTION 15061(B)(3).
FISCAL IMPACT: None
BACKGROUND: Once City property or equipment has met its useful life, the process for disposal has included a staff report to Council deeming the property surplus and authorizing disposal of the item. Surplus goods have routinely been stored at Public Works until a public auction is held to dispose of the asset. The City has not held a public auction in several years, which has resulted in the accumulation of surplus items at Public Works.
STAFF REPORT: To streamline the process for disposing of surplus City assets, staff proposes the attached Ordinance which allows the City Manager to approve the disposition of any surplus assets with a value less than the City Manager's signing authority of $60,000.
Under this Ordinance, the City Manager will have the authority to destroy or dispose of surplus property with no commercial value or items that require an expenditure of funds for continued care, handling, maintenance or storage which exceeds the estimated proceeds of sale. This will eliminate the storage of items with no commercial value at Public Works as assets with no value will be disposed of in a timely manner.
-78-
The Purchasing Agent/Finance Director will keep records of all surplus property sold, exchanged, traded in, disposed of, or donated pursuant to this Ordinance.
The City Council introduced Ordinance No. 921-23 at its regular meeting on March 14, 2023.
Staff recommends that the Council adopt Ordinance No. 921-23.

COAOLISHED STAFF REPORT
MEETING DATE: April 25, 2023
SUBJECT: Save Chuck
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file a report on Save Chuck.
FISCAL IMPACT: Impacts on the Blythe Community from the closure of the prison are unknown.
BACKGROUND: In December, the Secretary of the California Department of Corrections and Rehabilitation (CDCR) announced plans to close Chuckawalla Valley State Prison in Blythe by March 2025. The City quickly sprang into action to rally against this closure and sent a letter to the Governor related to the impacts this closure would have on the Blythe Community. The City began contacting State and Federal legislators and held meetings with elected officials, the CDCR Secretary, CVSP Close Down Manager and other CDCR staff members. The City submitted over 40 Public Records requests to the State seeking information related to how CVSP was selected for closure over other older and more costlier prisons in the State's system. Several of the City's requests for information were denied.
The City also went to work on solutions and proposed a swap of CVSP in Blythe for the California Rehabilitation Center (CRC) in Norco. Both City of Blythe and City of Norco officials are championing this proposal. This is a win-win for the Cities and State as a more cost- effective prison will be shuttered in a City that has far more resources to absorb job losses than Blythe. The City of Norco has petitioned for the closure of CRC for years. CRC has been on the State's chopping block since 2012. The State's own Legislative Analyst's report as well as other independent reports find that CRC should be the next CDCR institution to close due to a number of issues including cost to operate and safety.
In January, the City hired Tripeppi Smith for PR Services and the Gonsalves & Son Firm for lobbying efforts in the State Capitol. The City has garnered support from Assemblyman Garcia, Congressman Ruiz, State Senators Steve Padilla and Kelly Seyarto, Supervisor Perez and Supervisor Spiegel, the County of Riverside, CVAG, fellow Cities in Riverside County, Riverside and Orange County Sheriff's, PVID, Cal Cities Riverside County Division and others.
The Save Chuck (www.savechuck.org) website was launched. The City is working with Flash Vote to poll community members to gain input as we work through the efforts to Save Chuck.
We anticipate the first survey to be launched this week. Residents can visit flashvote.com/Blythe to register to participate in the surveys. Many presentations have been made around the Community to detail the Coalition's efforts to Save Chuck.

MEETING DATE: April 25, 2025
SUBJECT: Fiscal Year 2022-2023 Budget Amendment and Third Quarter Financial Report PRESENTED BY: Christa Elms, Director of Finance
PREPARED BY: Christa Elms, Director of Finance
RECOMMENDATION:
1. Receive and file third quarter Financial Report of fiscal year 2022-2023
2. Adopt Resolution 2023-004 amending fiscal year 2022-2023 budget as referenced in Exhibit A of said resolution.
FISCAL IMPACT: The City's Operating and Capital Budget provides the funding and expenditure plan for all funds. The fiscal impacts of the proposed budget amendments are identified in Exhibit A
BACKGROUND: It is considered best practice to review the annual budget on an ongoing basis. Since the fiscal year 2022-2023 budget was adopted on June 14, 2022, staff have continued to monitor the performance of revenues and expenditures throughout the year.
Through this regular review, staff has identified a need to amend some of the existing revenues and appropriations to allow for changes.
STAFF REPORT: Based on revenue and expenditure review through third quarter, March 31, 2023, the following budget amendments are being proposed.
General Fund.
Revenue: Revenue estimates are developed prior to the start of the fiscal year based on historical data, trends, and actual receipts. Tax revenues make up the largest part of the General fund's revenue, 61% of the City's tax revenue is derived from the City's sales tax, motor vehicle in-lieu tax ("VLF"), property tax, and transient occupancy tax ("TOT"). Sales tax alone makes up 33% of General fund revenues. Third quarter review of actuals shows these tax revenues are performing at or above budget projections. Based on receipt timing for the top four revenue sources, actual receipts at the end of the third quarter are generally slightly below 60% of projections, they are currently trending at 65%. In addition, other revenue sources are trending as expected with no noteworthy variances, actual receipts in the third quarter have reached 61% of budget. Based on the third quarter review staff is recommending amendments to revenue estimates as identified in Exhibit A attached. Although the amendment is not intended to correct all anticipated variances, it will better align the year end budget to actuals while providing additional resources. The amendments will account for increases in the General fund for TOT, franchise fees, grant funds, and added revenue for service agreements. The amended General fund revenue budget is proposed at $14,573,700 (excluding transfers), net increase of $1,113,300 as indicated in Exhibit A.
-87-
Expenditure: Although not all expenditures follow a straight-line spending pattern, operating expenditures should track close to 75% of budget at end of third quarter, general government typically trends above 75% at end of third quarter due to timing of lump-sum pension liability and debt payments. Most departmental operating expenditures are trending at or below target.
Total year-end expenditures for all departments combined are expected to come under appropriations at a margin of 8%. As indicated in Exhibit A, staff is proposing amendments to appropriations in the General fund. All amendments proposed correspond with prior actions taken by Council. The amended General fund expenditure budget is proposed at $12,367,160 (excluding transfers), net increase of $533,500. Appropriations for operating transfers out proposed to increase $130,000, amended from $2,386,000, to $2,516,000.
Enterprise Funds.
No major variances are expected in Water and Sewer Enterprise funds, therefore no amendments to the current budget are proposed. Consumer charges for Water fund is slightly under target at end of third quarter, while Sewer fund is trending slightly above target. Expenditures for Water and Sewer funds are expected to end the year within budget.
Other Funds.
The following provides a summary of proposed budget amendments to other funds. A complete list of these amendments is identified in Exhibit A to the Resolution:
Asset Forfeitures: Increase in revenue for asset forfeiture receipts.
Central Garage Fund: Increase transfers in and appropriation of capital expenditures for the purchase of police vehicles per funding agreements.
Hydrocarbon Cleanup Fund: Increase in revenue and appropriation for expenditures for Cleanup of Plume #6.

CITY OF BLYTHE
CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: April 25, 2023
SUBJECT: Partnership with Riverside County to Rehabilitate 6th Avenue PRESENTED BY: Phillip Hamblen, Interim Public Works Director PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Provide direction as to whether the City will partner with the Riverside County Transportation Department on the resurfacing and reconstruction of 6" Avenue. Should the Council participate, please indicate which alternative(s) for reconstruction the City would like completed.
FISCAL IMPACT: Up to $2,236,919 from the City's Measure A and SB 1 funds for Street and Road Maintenance.
BACKGROUND: The City has partnered with Riverside County Department of Transportation when road segments the County is replacing align with street segments within City limits. The County is the lead agency and the City pays an agreed upon percentage or amount of the project cost based on the size of the City's share of the project. The City most recently partnered with the County on the rehabilitation of W. Hobsonway and improvements at 3rd Place to improve road conditions near Appleby School.
STAFF REPORT: The County plans to resurface/reconstruct 6* Avenue near City limits. The County has estimated three alternatives along 6t avenue for the City's participation:
1. 6'h Avenue from end of road west to Defrain Blvd (0.25MI West) $1,115,410
2. 6" Avenue 0.25 MI west of Defrain to .25 East of Defrain $609,886 6* Avenue from Defrain Blvd (0.25 Miles East) to Lovekin Blvd. $511,624 If all three estimates are selected, the City's share of the project would be $2,236.919. Current Measure A and SB 1 funding can accommodate this project, but due to its size, will expend current funding on hand as well as next year's funding allocations. Although it makes a lot of sense to partner with the County on this project, the City has several streets in need of attention.
As those projects could be delayed, staff wanted to ensure this project is the priority.
The County will also reconstructing 10th avenue from W. Arrowhead Blvd. to Defrain Blvd. The County asked if the City would like to partner in a small pavement section near Defrain with an estimated cost of $57,928. Staff intends to move forward with this project. Current funding will support this project whether or not we move forward with the 6 Avenue alternative(s).

SARISHE STAFF REPORT
MEETING DATE: April 25, 2023
SUBJECT: Abatement of 1203 E. Hobsonway
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council authorize the City Manager to take any and all actions necessary to abate 1203 E. Hobsonway (the former Boone's Paradise) including but not limited to entering into agreements and executing purchase orders for the project.
FISCAL IMPACT: Unknow, but it could be above the City Manager's signing authority of $60,000.
$80,000 was allocated in the current budget for abatement services. There is $40,000 remaining for use on this project. Any overages can be covered by salary savings and contingency.
BACKGROUND: The City has been working to abate 1203 E. Hobsonway since it was severely damaged in a fire. As the property owner has failed to remediate the situation, the City took action. At the end of March, the City has completed all thirteen steps necessary to turn this case over to the City Attorney's office to receive an abatement warrant from the Court.
STAFF REPORT: Staff learned last week that an abatement warrant was granted, giving the city fourteen (14) days to abate the property. As the last abatement warrant took over a year to receive, the City was not expecting to be able to abate so quickly. The City immediately went to work with R&L Watkins to abate the property within the prescribed timeframe. If necessary, the City can return to court to ask for an extension but need to show that reasonable efforts have been made to abate the property for an extension to be granted. Once the project is completed, ATTACHMENTS: None

BACKGROUND: The Chamber of Commerce will host their annual Cinco De Mayo Spring Street Festival on May 6, 2023. To accommodate the event, the City will close Spring Street from Hobsonway to Barnard. There is no fee for the Street Closure. This year the Chamber would like to utilize the pads of the former Sears and Ashley Furniture Home Store located at 155 and 175 N. Spring Street respectively. The use of private property for this event requires a Temporary Use Permit, TUP to be submitted to the City. The TUP has an adopted fee of $222.00. The Council has previously waived or donated fees for Chamber events.
STAFF REPORT: The Blythe Chamber of Commerce respectfully requests Council waive the Temporary Use Permit for their event on May 6, 2023. Staff recommends waiving the $222 TUP Fee to help support the Chamber's community events.
