NEW BUSINESS:

FY 2022/23 Budget Amendment and Third Quarter Financial Report. Finance Director Elms stated the third quarter report is derived from a review of the City's financial activity during the first three quarters of the fiscal year. The review process provides the City with an opportunity to make any necessary amendments to its revenue and expenditure projections to better align budget to actuals. Today's review will focus mainly on the General Fund. At third quarter, the General Fund has recorded 61% of projected revenue and spent 75% of its adopted budget. Revenue estimates are developed prior to the start of the fiscal year and based on historical data, trends and actual receipts. Tax revenues make up the largest part of the General Fund's revenue. Sixty-one percent of the City's revenue is derived from taxes, including Measure K, VLF, Property Tax and Transient Occupancy Tax. Sales tax alone makes up thirty- three percent of the sixty-one percent. The third quarter review of actuals shows that these tax revenues are performing at or above budget projections. Based on timing of receipts, actuals in the third quarter are typically below 60% of projections, they are currently trending at 65%.

Fiscal Year 2022 was the first full year since passing Measure K. Original assumptions expected Measure K to bring in a fraction of what was received from Bradley and Burns Sales Tax revenue. The City closed the 2022 year at $3.7 million in Measure K revenue, almost double the Bradley Burns sales tax. With 42% of the distribution still outstanding, the forecast shows sales tax revenues should end the year on target. With two full years of data, Measure K's budget to actuals should begin to stabilize. Based on current trends, the City should experience another record year in TOT tax, making it the second largest tax source for the General Fund. As of March 2023, actual revenues received are at 104% of budget projections with 33% of the monthly reporting outstanding. This is the one tax charged to transient residents and not Blythe residents. Based on third quarter revenue, staff is recommending amendments to revenue estimates as identified in Exhibit A. The amendments will account for increases in the General Fund for TOT, franchise fees, grant funds and added revenue for service agreements. The amended General Fund Revenue Budget is proposed at $14.6 million with a net increase of $1.1 million. Operating expenditures should track close to 75% of the budget at third quarter. General Government expenditures trend above 75% due to timing of lump sum payments. Total year-end expenditures for all departments combined are anticipated to come under appropriations at a margin of 8%. As outlined in Exhibit A, staff is recommending amendments to appropriations in 14 the General Fund. The amended General Fund expenditure budget is proposed at $12.4 million, with a net increase of $533,000. Appropriations for operating transfers out are proposed to increase by $130,000 from $2.4 to $2.5 million. No amendments are proposed for the water and sewer budget. It is recommended the Council receive and file the Third Quarter Report and adopt Resolution 2023-004 amending the FY 2022/23 budget as referenced in Exhibit A.

No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

ESOLUTION NO. 2023-004. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNI MENDING THE OPERATING AND CAPITAL BUDGET FOR FISCAL YEAR 2022-202:

Partnership with Riverside County to Rehabilitate 6" Avenue. Interim Public Works Director Hamblen stated Riverside County gave us three options to repave 6* Avenue. As you see in the exhibit, Alternative 1 is Defrain to the end of 6" Avenue at $1.1 million. Alternative 2 is the center of Defrain with a cost of $600,000. Alternative 3 includes the east end of 6th avenue with a cost of $511,000. We own part of the road and they own part of the road so they are asking if we would like to partner in the re-pavement. We have partnered with them in the past.

Interim City Manager Crecelius stated they are going to re-pave their portion of the road. To complete that street, we would need to partner with them. Due to the size of the project, we wanted Council to weigh in on this to determine if this was the priority. If we move forward with all three alternatives, its $2 million, That will take most of next year's Measure A and SB 1 street funds. If there are other projects, they would be budgeted in the subsequent years.

Councilman Halby asked if we already had a plan for the streets we were going to re-pave next year. Interim City Manager Crecelius stated no, we must do this now due to the timing of our MOE report that is due to RCTC. Through the budget process I was going to get your direction on what streets you would like to do next as all the projects that were designed have been completed. We still have Wells Street that is designed and funded, but we are waiting on some projects to develop there before we re-pave the street. The other design that is on the shelf but probably needs to be updated is Defrain. We need to pick out another few streets the Council would like to see repaved. The council has previously brought up Broadway from Juniper to Chanslorway. There is also 7h street, the area around the hospital is one area I would like to see repaved. There is Defrain, 14t Avenue, there are a lot of needs and not a lot of money. We have about $2 million a year to spend on streets. What are your priorities? From here, during our budget study session we can outline the next priorities. The County is going to do their section rather we partner with them or not.

There was discussion amongst the Council related to which alternatives to move forward with.

Public comment. Rob Holt asked how deep are they going and what are they doing with the cracks? If you don't do it right, the cracks will come back.

Councilman DeConinck would like more information about the project. What are we getting for this kind of money?
15 Interim City Manager Crecelius stated if you don't like the County's plan the other option would be to do our section at a later date at a higher cost. A contract will come back to the Council. If we don't like something, we can negotiate with the County at that time.

Council discussed the costs of alternate 2 vs. alternate 3. It was determined there was an error in the math and would clarify costs with the County.

Interim City Manager Crecelius stated also included here is a small section of 10th avenue with the City's share just under $60,000. We have the funding to do this pavement section along with whatever you decide on 6* Avenue. It sounds like you would like to move forward with this project if we can flush out some of the details. Can we go ahead and plug it in the MOE to submit to RCTC by May 1st *, and at the May 9' meeting we will bring back the correct numbers and answer the questions about the type of project they are going to do? This assumes you want to do the whole project.

Councilman Reynolds stated we need to quit doing patchwork. If we are going to do it, let's do the whole thing and get it done.

Interim City Manager Crecelius stated if there is an error on the spreadsheet, that funding could be used to design a few other projects next year with them going out to bid the following year.

Our projects are costing about $1 million each. We can get projects ready and plug them into the budget the following year for construction.

Mayor DeConinck stated let's move forward as the Interim City Manger stated. We can make changes later if we need to.

Councilman Reynolds motioned that staff move forward with the project as presented. The motion was seconded by Councilman Burton with a unanimous aye vote.

Abatement of 1203 E. Hobsonway. Interim City Manager Crecelius stated The City has worked to have the property located at 1203 E. Hobsonway abated by the property owner since it was severely damaged in a fire. As the owner continuously failed to act, the City completed all thirteen steps necessary to turn this case over to the City Attorney's office to obtain an abatement warrant from the court which would allow the City to abate the property. Last week, the abatement warrant was granted, giving the City only fourteen days to abate the property. As the last abatement warrant took over a year to obtain, staff was not prepared to have this awarded and abated so quickly. With the help of R&L Watkins, who has been working on this project tirelessly since late last week, the City should be able to complete the cleanup with one minor time extension. The abatement should be completed under the City Manager's signing authority of $60,000 but the City Manager will report back to Council with final costs once the project is completed. It is therefore recommended Council authorize the City Manager to take any and all actions necessary to abate 1203 E. Hobsonway including but not limited to entering into agreements and executing purchase orders for the project. All costs incurred by the City to abate this nuisance property will be placed as a lien against the property. Leslie, she jumped into this feet first, she worked through the weekend getting dumpsters lined up, waivers from the landfill, getting everything ready so they could start the project today and have it completed within the 16 timeframe provided. There is no way we could have had this done without her help. I want to say thank you Leslie for caring about our community and helping the City get this property cleaned up. She has been very instrumental in helping the City clean up blighted properties. She was awarded the bid for the last abatement warrant that was issued to the City and she has worked with other property owners with code enforcement issues. She has done a lot and I would like to recognize her for that. The last abatement warrant took well over a year. City staff had no idea we were going to court to ask for a warrant, and the court was going to give it to us that day, with 14 days to execute. It has been a learning experience. As we prepare our next one, the house on S. Main Street, we will put it out to bid ahead of time with notice that the job won't begin until the warrant is issued so we are not in the predicament next time. Its not a bad predicament to be in, because we can get this property cleared much sooner than we originally thought, but we were caught off guard when he came out of the court with the abatement warrant and we were left scrambling.

Councilman Halby asked what was different this time that got the warrant signed so quick? Interim City Manager Crecelius stated I think the key with this one was the property owner is alive. He's had a chance and failed to do anything. The last property owner was deceased, so the judge wanted death certificates, for us to track down next of kin and I also think judge. It's the luck of the draw so that probably had a lot to do with it as well.

Public comment. Leslie Watkins would like to commend Mallory and Jason, their efforts over the last few days have been tremendous. Between themselves and Michelle at the front counter they have towed the line to get us mobilized. In addition to that, Julie and John at CR&R and all of their drivers. I saw drivers running, they were hustling, and they were on it. They deserve recognition. Mallory mentioned getting the County to approve our landfill bins. It's always been a challenge with the County; but today I think we passed a hurtle. Our bins have been approved and we are thankful for that. Our utility partners and public works got everything marked. There is an active gas line on the property that is being taken care of. Blythe Police Department irradiated the homeless that were living in the debris pike yesterday. I would also like to thank the girls in my office. I don't think we are going to need an extension.

Interim City Manager Crecelius stated I don't think we understand how much work she has put into this. To get all of this done since last Thursday evening, I don't think anyone but Leslie could have accomplished that.

Councilman Halby stated I have been asking about this property for months, so it was a pleasant surprise when I saw this on the Agenda last Friday.

Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Vice Mayor Rodriguez with a unanimous aye vote.

Request to Waive Temporary Use Permit Fees for the Chamber of Commerce's Cinco De Mayo Spring Street Festival. Interim City Manager Crecelius stated the Chamber of Commerce will host their annual Cinco De Mayo Spring Street Festival on May 6, 2023. To accommodate the event, the City will close Spring Street from Hobsonway to Barnard. There is 17 no fee for the Street Closure. This year the Chamber would like to utilize the pads of the former Sears and Ashley Furniture Home Store located at 155 and 175 N. Spring Street respectively.

The use of private property for this event requires a Temporary Use Permit to be submitted to the City. The TUP has an adopted fee of $222.00. The Blythe Chamber of Commerce respectfully requests Council waive the Temporary Use Permit fee for their event on May 6, 2023.

No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

ORAL REPORTS:

Councilman Burton reported on the Prime Community Event and the dunk tank he participated in along with Councilman Halby, Interim City Manager Crecelius and Chief Building Official Brown. He also reported on the Crime Victims event being held at ISP tomorrow.

Councilman Halby stated the Dunk Tank was ran by the Blythe Baseball club, so all the proceeds went to them. Prime Leaf put on the event and I don't have a final tally, but they raised $50,000 or more. Most of the sponsors are not from Blythe but do business in Blythe. All the money raised is generously donated to youth groups, social clubs, sports, and various other causes.

Mayor DeConinck stated the funds collected at that event are held by the Chamber. I take my hat off to all involved.

PUBLIC COMMENT:

Mr. Brookins stated you know what I am here for. I shouldn't have to be up here again, but politics as usual. I feed into the process, so it's known that I did. I have been here three times this week and each time the police are called. I should be able to talk to you all on a consistent basis.

This is ridiculous. I have everything on film. You have a rogue police force. I am tired of it. I have done nothing, yet you treat me like a king pin. I come from great standing but am treated like trash.

ADJOURN: The City Council meeting was adjourned at 7:20pm.

CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: May 9, 2023
SUBJECT: Purchase of Blythe Police Department Animal Control Unit Body PRESENTED BY: Police Chief Garth Dale
PREPARED BY: Police Chief Garth Dale
RECOMMENDATIONS: Staff recommends Council authorize the Interim City Manager to issue a Purchase Order to California Truck Equipment Company (CTEC) for the purchase of a new Animal Control Body built for the 2022 Dodge Ram 3500 Tradesman in the amount of $63,904.50.

FISCAL IMPACT: $63,904.50 from Central Garage funds budgeted for the purchase of an Animal Control Vehicle in FY 2022/23.

BACKGROUND: On December 12, 2022, City council approved the purchase of a vehicle from the National Auto Fleet Group to use as an animal control vehicle. This approval included the Body for the unit from CTEC California Truck Equipment Company. Unfortunately, the allotment was not available from the manufacturer. In addition, this was a package purchase of the unit and body.

Therefore, staff had to find another source to purchase a vehicle within the timeframe allowed by the grant that was provided by UC Davis.

In April the City released an Invitation for Proposals for the purchase of an Animal Control Unit Body that will be mounted on the 2022 Dodge Ram 3500 that was approved for purchase April 25, 2023. The Invitation was posted in the Palo Verde Times, on the City's website and sent to vendors who routinely performs these services for the City.

STAFF REPORT: The City received one sealed proposal for the purchase of the Unit Body from California Truck Equipment Company (CTEC) located in Downey, CA. The proposal was determined to be responsible. Therefore, it is recommended Council authorize staff to move forward with the purchase of the Animal Control Vehicle Body from California Truck Equipment Company in the amount of $63,904.50.

Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: May 9, 2023
SUBJECT: Annual Military Equipment Report Pursuant to Assembly Bill 481 PRESENTED BY: Garth V. Dale, Chief of Police
PREPARED BY: Garth V. Dale, Chief of Police
Brittany E. Roberto, City Attorney
RECOMMENDATION: It is recommended that the City Council receive and file the Annual Military Equipment Report.

FISCAL IMPACT: None.

BACKGROUND: On September 30, 2021, Governor Gavin Newsom signed Assembly Bill 481 ("AB 481") into law, which became effective January 1, 2022. AB 481 seeks to provide transparency, oversight, and an opportunity for meaningful public input on decisions regarding whether and how military equipment is funded, acquired, and used by law enforcement agencies.

AB 481, codified at Sections 7070 through 7075 of the California Government Code, requires California law enforcement agencies to obtain approval from their governing bodies of military equipment use policies prior to taking certain actions relating to the funding, acquisition or use of military equipment, including military equipment acquired prior to January 1, 2022. The term "military equipment" is defined in California Government Code Section 7070 and includes, but is not limited to, unmanned aerial or ground vehicles, armored vehicles, command and control vehicles, pepper balls, less lethal shotguns, less lethal 40mm projectile launchers, long range acoustic devices, and flashbangs. The items considered to be "military equipment" by AB 481 are employed by many law enforcement agencies across the country to enhance citizen and officer safety.

Pursuant to AB 481, the military equipment use policy must be adopted by ordinance at a regular meeting of the City Council. AB 481 requires that the proposed policy be provided to the City Council and posted on the City's website for at least 30 days prior to the public meeting at which the policy is considered. Once adopted, AB 481 requires annual review and renewal of the ordinance, annual reporting on the military equipment identified in the policy, and an annual community engagement meeting regarding the annual report.

AB 481 requires that the annual military equipment report include the following information for the immediately preceding calendar year for each type of military equipment:
(1) A summary of how the military equipment was used and the purpose of its use. (2) A summary of any complaints or concerns received concerning the military equipment. (3) The results of any internal audits, any information about violations of the military 33 equipment use policy, and any actions taken in response. (4) The total annual cost for each type of military equipment, including acquisition, personnel, training, transportation, maintenance, storage, upgrade, and other ongoing costs, and from what source funds will be provided for the military equipment in the calendar year 5) The quantity possessed tor each type of military equipment 6) If the law enforcement agency intends to acquire additional military equipment in the nex year, the quantity sought for each type of military equipment.

STAFF REPORT: On May 10, 2022, the City Council adopted Ordinance No. 915-22, adopting a Military Equipment Use Policy ("Policy") governing the use of items that are deemed "military equipment" under AB 481. The Policy was effective as of June 10, 2022. The City's Policy includes four categories of "military equipment" listed in AB 481. The Policy also contemplates use of military equipment owned by other law enforcement agencies.

The Police Department has prepared an Annual Military Equipment Report ("Annual Report") in accordance with AB 481 and the Policy. The Annual Report is attached to this staff report as Attachment 1. Pursuant to AB 481 and the Policy, the Police Department has scheduled a community engagement meeting for May 18, 2023 at 10:00 AM in the City Council Chambers to discuss the report and respond to questions from the public regarding the funding, acquisition, or use of military equipment.

As outlined above, AB 481 also requires that the City Council annually review and renew the ordinance adopting the military equipment use policy. The Police Department has identified additional items that are considered "military equipment" under AB 481. To comply with AB 481, the Police Department will be proposing an amended military equipment use policy for the City Council's consideration at the June City Council meeting.

AB 481 Annual Military Equipment Report
Assembly Bill 481 ("AB 481"), codified at Sections 7070 through 7075 of the California Government Code, requires law enforcement agencies to obtain approval from their governing bodies of military equipment use policies before purchasing, raising funds for, or acquiring military equipment. AB 481 provides an expansive definition of "military equipment" that includes many items which law enforcement agencies use, deploy, and obtain on a regular basis.

PREPARED BY: Christa Elms, Director of Finance
RECOMMENDATION: Recommended Council take the following actions:

2. Approve for submission Blythe's Project Status Report for fiscal year 2022-2023 as presented in Attachment B.

3. Authorize the City Manager to execute Blythe's Maintenance of Efforts Certification Statement as presented in Attachment C.

4. Authorize Director of Finance to make minor amendments if necessary to the report as per Riverside County Transportation Commission's procedures for fiscal year 2023- 2024.

FISCAL IMPACT: Estimated allocation of $841,000 in Measure A funds and an additional $400,130 in STIP Trade funds for fiscal year 2023-2024.

BACKGROUND: On November 5, 2002, the Riverside County Transportation Commission (RCTC) proposed, and voters approved the extension of a one-half percent local transaction and use tax referred to as "Measure A" for the purpose of funding transportation needs within the County of Riverside. The tax was approved to extend for a period of thirty (30) years. RCT's Ordinance No. 02-001 provides for the imposition of the tax, the administration of the tax proceeds, and a county transportation expenditure plan that Blythe and other eligible entities within the County of Riverside must adhere to, to be eligible to receive their proportionate share of revenue.

STAFF REPORT: As per RCTC Ordinance No. 02-001 for the City of Blythe to receive its proportionate share of Measure A tax revenues it must annually meet the reporting requirements outlined within the ordinance which include:

1. Annual adoption and submission of the City's five (5) year Local Streets and Roads Capital Improvement Plan which identifies estimated funding available and use of those funds.

2. Annual submission of the City's Project Status Report which outlines the status of expenditures approved for the current fiscal year.

3. Certification of Maintenance of Effort (MOE) of which the City certifies it will maintain its required base year amount of no less than $170,000 of local funds towards transportation needs.

The proposed Local Streets and Roads Capital Improvement Plan begins with fiscal year 2023- 2024 and extends through fiscal year 2027-2028. The report is for a period of five (5) years and is amendable annually in the event Council makes project changes. The attached plan includes:
37 1. Preventative maintenance - Slurry Sealing of nine (9) streets recently paved throughout the City for fiscal year 2023-2024.

2. Count joint street resurfacing project - 6' Avenue end of road to Lovekin 2023-2024

3. Street resurfacing - Defrain from 10th Avenue to 4%h Avenue fiscal year 2025-2026 and 2026-2027.

Upon Council's approval staff will remit required documents to RCTC by the deadline with a tentative Committee and Commission approval of June 2023. If approved the City will begin to see its 2023-2024 Measure A funding allocations in September of 2023.

Re: Annual Consumer Price Index and Landfill Rate Adjustment Dear Mallory,
Pursuant to Section 22.7 of our current agreement to provide Solid Waste and Recycling Services to the City of Blythe, CR&R Incorporated respectfully submits the attached information which outlines our Annual Rate Adjustment request for fiscal year 2023-2024. As you may be aware, our current contract allows for annual adjustments to both the rates and the weightings which determine those rates. The attached rates are reflective of these changes for fiscal year 2023-2024.

This correspondence, as well as the attached exhibits, outlines both the current and proposed rates for residential and commercial customers located within the City of Blythe. In reviewing. the CP| data from the United States Department of Labor, Bureau of Labor Statistics, for December 2022 through December 2022, the CPI has increased by 7.45%. In addition; the County of Riverside will be increasing their Landfill Tipping Fee by 7.30% from $46.35 per ton to $49.73 per ton effective July 1, 2023. The new rate calculations for your city's rates are attached for your review.

As discussed in our rate adjustment letter last year, these proposed rates do not consider any potential rate adjustments that may be required as part of SB 1383 regulations. As you know, $B 1383 regulations went into effect January 1, 2022 and they carry a significant amount of additional regulatory requirements with regards to the collection, reporting and processing of organic materials. The enclosed rates do not consider any SB 1383 costs for 2023-2024. We hope to have a proposed contract amendment and new rates later this year for your review which will take SB 1383 into account.

As you know, we have been working hard to seek County approval for a Direct Transfer Station Permit that would allow us to more cost effectively move your organic materials for processing.

We have finally received approval from the Riverside County Planning Department which allows us to move forward with this project. There are still additional permits to attain, trucks to purchase, containers to purchase and lots of additional planning and reporting to set-up for the City. We will keep you posted on our progress in the coming months. erwasteservices com

1. OVERVIEW
A. INTRODUCTION
Pursuant to the order of the City Council of the City of Blythe, this report is prepared in compliance with the requirements of Article 4, Chapter 1, Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways Code of the State of This report presents the engineering analysis for Fiscal Year 2023/2024 for the Distic known as: City of Blythe Lighting District No. 1 (Hereinater referred to as The District, by special benefit assessments, provide funding for the maintenance of landscaped areas owned by the City of Blythe, for the operation of streetlights owned and maintained by Southern California Edison Company, for the operation and maintenance of traffic signals and for the operation and maintenance of appurtenant facilities; all of which are located in and along public roadways, streets and rights-of ways in the City of Blythe.

B. HISTORICAL BACKGROUND AND CURRENT LEGISLATION
Section 22573 of the Landscaping and Lighting Act of 1972 (the "1972 Act") requires assessments to be levied according to benefit rather than according to assessed value. The section states:
"The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements.

The determination of whether or not a lot or parcel will benefit from the improvements shall be made pursuant to the Improvement Act of 1911 (Division 7 (commencing with Section 5000)) [of the Streets and Highways Code, State of California]."
The 1972 Act also provides for the classification of various areas within an assessment district into different zones were,
"by reason of variations in the nature, location and extent of the improvements, the various areas will receive differing degrees of benefit from the improvements. A zone shall consist of all territory which will receive substantially the same degree of benefit from the improvements." Attachment E
An assessment district may consist of contiguous or non-contiguous areas. As the assessments are levied on the basis of benefit, they are considered a special benefit assessment, not a tax, and therefore, are not governed by Article XIlIA of the California Constitution. Properties owned by public agencies, such as a city, county, state or the tederal government must be assessed by law unless it can be demonstrated that they receive no special benefit.

IMPROVEMENTS AUTHORIZED BY THE 1972 ACT
As applicable or may be applicable to the District, the 1972 Act defines improvements to mean one or any combination of the following:

IV. METHOD OF APPORTIONMENT
The net amount to be assessed upon lands within the District in accordance with this report is apportioned by a formula and method which fairly distributes the amount among the assessable lots or parcels in proportion to the estimated benefits to be received by each lot or parcel from the improvements, namely the maintenance and servicing of public landscaping, ornamental structures, lighting and appurtenant facilities within the District. The maintenance and servicing of public landscaping, ornamental structures, lighting and appurtenant facilities installed and constructed in and along public roadways, streets and rights-of-way in the City of Blythe provides a special benefit which is received by each and every lot or parcel within the specified zones of benefit in the District, tending to enhance their value. Landscaping within the District enhances the aesthetic appeal of parcels within the landscaping zones. In addition, landscaping and ornamental structures improve erosion resistance and dust control.

The streets within the District provide access to the lots or parcels assessed.

Streetlights improve ingress and egress from such lots or parcels by illuminating access after sunset. Such streetlights, by so improving ingress and egress, improve the security parcels, facilitate the opening and operation of business uses after sunset.

The primary benefits of landscaping are as set forth below:

1. Improved aesthetic appeal of nearby parcels.

2. Improved erosion resistance.

3. Improved dust control.

4. Enhancement of the value of property which results from the foregoing benefits.

The primary benefits of street lighting, including traffic signals, are convenience, safety, security and protection of property, property improvements and goods as set forth below:

1. Improvement to traffic circulation and reduction in nighttime accidents and attendant human misery and decrease in personal property loss.

2. Less vulnerability to criminal assault at night.

3. Promotion of business during nighttime hours.

4. Improved ingress and egress to lots and parcels.

5. Reduction in vandalism and other criminal acts resulting in damage to improvements.

6. Enhancement of the value of property which results from the foregoing benefits. 75 Attachment E

77 Attachment E
B. ASSESSMENT FORMULA
The formula used to calculate the amount spread to the parcels within the District for street lighting starts with the basic assessment unit. The basic assessment unit (AU) is given a value of one (1) for a single-family residential parcel in Zone A. From this base, the remaining parcels are related according to their equivalent benefit within the District. Zone B parcels are not assessed for streetlights. Zones C through H, inclusive, utilize the same formula for landscape maintenance as does Zone A for street lighting. The assignment of assessment units is shown in the table below.

Assessment Unit Chart

Railroad Property 50 3.00 Acre
Agricultural Uses (8) 60 0.25 Acre
Zone B (Not assessed for street lighting) 99 0.00 Parcel (1) DU = Dwelling Unit. The assessment formula for apartment complexes is additive. Apartment units are assessed on a decreasing scale as the number of units increase because such units generally have a greater density per parcel than SFR's, are often located on upper stories, may be located a great distance from public rights-of-way, and generally are smaller units (in terms of floor area than SFR's. (2) Commercial parcels are assessed at a rate of six (6) units per acre. This is based on the basic assessment unit compared to an average 65-foot by 100-foot residential parcel. Since there are 6.7 such parcels per acre, the number of assessment units was rounded down to six (6) per acre and applied to commercial property.
(3) Parcels receiving no special benefit from the district such as letter lots, open space, streets, etc. are exempt.
(4) Vacant parcels are assessed 0.5 AU per parcel for street lighting and landscaping (if the parcel is within a landscaping zone). Said vacant parcels receive a benefit from streetlights which tends to reduce vandalism and trash dumping in spite of the fact that they are not developed. Those vacant parcels that are assessed for landscaping receive a benefit that tends to enhance the value of the property. (5) Public utility parcels are assessed in the same manner as commercial properties. 78 Attachment E
(6) Churches and fraternal organizations are assessed at one (I) AU per parcel because they generally have less intensive usage of the land than other non-residential uses, such as commercial parcels, and therefore benefit less from the improvements.

The number of assessment units (AU) generated within the District for street lighting is 4,895.75. The dollars generated per AU in Zone A are:
$104,573.22/ 4,895.75 AU= $21.36/ AU
A. Commercial property on a 0.75-acre parcel.

Assessment Unit Chart shows commercial property is assessed at a rate of six (6) AU per acre.

Formula:

0.75 acres x 6 AU / acre = 4.5 AU
The Fiscal Year 2023/2024 assessment for this commercial parcel is:

4.5 AU × $21.36/ AU = $96.12
Landscaping
The number of assessment units (AU) generated in Zone C for landscape maintenance is 50.50. The dollars generated per AU in Zone C are:
$3,559.75 / 50.50 AU = $70.49 / AU
A. Single-family residence in Zone C.

Assessment Unit Chart shows single-family residence is assigned one (1) AU per parcel.

The FY 2023/2024 assessment for a single-family residence is:
1 AU × $70.49 / AU = $70.49
Assessments in Zones D through H are determined in the same manner as assessments in Zone C as shown in the above example.

VI. ASSESSMENT ROLLS
Parcel identification, for each lot or parcel within the District, shall be the parcel as I on the Riverside County Assessor's Parcel Maps for the year in which this Report is prepared. The land use classification and specific parcel data for each parcel is based on property information available from the Riverside County Assessor's Office or provided by the City, and by reference is made part of this Report. A listing of parcels to be assessed within the District for Fiscal Year 2023/2024, along with the proposed assessment amounts is provided on the following pages.

Approval of this Report (as submitted or as modified) confirms the method of apportionment and the proposed assessment rates to be levied against each eligible parcel within the District and thereby constitutes the approved levy and collection of assessments for Fiscal Year 2023/2024. The parcels and the amount of assessment to be levied shall be submitted to the Riverside County Auditor/Controller and included on the property tax roll for the fiscal year.

If any parcel submitted for collection is identified by the County Auditor/Controller to be an invalid parcel number for the current fiscal year, a corrected parcel number and/or new parcel numbers will be identified and resubmitted to the County Auditor/Controller.

The assessment amount to be levied and collected for the resubmitted parcel or parcels shall be based on the method of apportionment and assessment rate approved in this Report. Therefore, if a single parcel has changed to multiple parcels, the assessment amount applied to each of the new parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment.

1. OVERVIEW
A. INTRODUCTION
Pursuant to the order of the City Council of the City of Blythe, this report is prepared in compliance with the requirements of Article 4, Chapter 1, Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways Code of the State of California.

This report presents the engineering analysis for the 2023/2024 Fiscal Year for the District to be known as: City of Blythe Lighting District No. 2 (Hereinafter referred to as "District").

This District, by special benefit assessments provides funding for the maintenance and servicing of streetlights and appurtenant facilities owned and maintained by Southern California Edison Company, all of which are located in public rights-of- way in the District.

B. HISTORICAL BACKGROUND AND CURRENT LEGISLATION
Section 22573, Landscaping and Lighting Act of 1972 ("the 1972 Act") requires assessments to be levied according to benefit rather than according to assessed value. The section states:
"The net amount to be assessed upon lands within an assessment District may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements."
Furthermore, Section 4 of Article XIIID of the California Constitution requires that no assessment shall be imposed on any parcel which exceeds the reasonable cost of the proportional special benefit conferred on that parcel.

The 1972 Act also provides for the classification of various areas within an assessment District into different zones where,
"by reason of variations in the nature, location and extent of the improvements, the various areas will receive differing degrees of benefit from the improvements. A zone shall consist of all territory which will receive substantially the same degree of benefit from the improvements." 89 Attachment F
An assessment District may consist of contiguous or noncontiguous areas. As the assessments are levied on the basis of benefit, they are considered a special benefit assessment, not a tax, and therefore, are not governed by Article XIIIA or Article XIIIC of the California Constitution. Properties owned by public agencies, such as a city, county, state or the federal government must be assessed by law unless it can be demonstrated that they receive no special benefit.

C. IMPROVEMENTS AUTHORIZED BY THE 1972 ACT
As applicable or may be applicable to this District, the 1972 Act defines improvements to mean one or any combination of the following:
• The installation or planting of landscaping.
• The installation or construction of statuary, fountains, and other ornamental structures and facilities.
• The installation or construction of public lighting facilities. • The installation or construction of any facilities which are appurtenant to any of the foregoing or which are necessary or convenient for the maintenance or servicing thereof, including, but not limited to, grading, clearing, removal of debris, the installation or construction of curbs, gutters, walls, sidewalks, or paving, or water, irrigation, drainage, or electrical facilities. • The maintenance or servicing, or both, of any of the foregoing. • The acquisition of any existing improvement otherwise authorized pursuant to this section.

Incidental expenses associated with the improvements including, but not limited to:
• The cost of preparation of the report, including plans, specifications, estimates, diagram, and assessment;
• The costs of printing, advertising, and the publishing, posting and mailing of notices;
• Compensation payable to the County for collection of assessments; • Compensation of any engineer or attorney employed to render services; • Any other expenses incidental to the construction, installation, or maintenance and servicing of the improvements;
90 Attachment F
• Any expenses incidental to the issuance of bonds or notes pursuant to Section 22662.5.
• Costs associated with any elections held for the approval of a new or increased assessment.

The 1972 Act defines "maintain" or "maintenance" to mean furnishing of services and materials for the ordinary and usual maintenance, operation, and servicing of any improvement, including:
• Repair, removal, or replacement of all or any part of any improvement. • Providing for the life, growth, health, and beauty of landscaping, including cultivation, irrigation, trimming, spraying, fertilizing, or treating for disease or injury.
• The removal of trimmings, rubbish, debris, and other solid waste. • The cleaning, sandblasting, and painting of walls and other improvements to remove or cover graffiti.

IV. METHOD OF APPORTIONMENT
The net amount to be assessed upon lands within the District in accordance with this report is apportioned by a formula and method which fairly distributes the amount among all assessable lots or parcels in proportion to the estimated special benefits to be receivec y each lot or parcel from the improvements, namely the maintenance and servicing of bublic street lighting and appurtenant facilities within the District. The maintenance anc servicing of public lighting and appurtenant facilities installed and constructed in public places in the District provides a special benefit which is received by each and every assessed lot or parcel within the specified zones of benefit in the District, tending to specifically enhance their value. The streets within the District provide access to all lots or parcels assessed. Streetlights improve ingress and egress from such lots or parcels by illuminating access after sunset. Such streetlights, by so improving ingress and egress, improve the security of such lots or parcels by improving the nighttime visibility of such lots or parcels and improve the access of emergency vehicles thereto and in the case of commercial lots or parcels, facilitate the opening and operation of business uses after The primary benefits of street lighting are convenience, safety, security and protection of property, property improvements and goods as set forth below:

1. Improvement to traffic circulation and reduction in night-time accidents and attendant human misery and decrease in personal property loss.

2. Less vulnerability to criminal assault at night.

3. Promotion of business during nighttime hours.

4. Improved ingress and egress to lots and parcels.

5. Reduction in vandalism and other criminal acts resulting in damage to improvements.

A. ZONES

B. ASSESSMENT FORMULA
The basic formula used to calculate the amount spread to each parcel within the District for street lighting starts with the basic assessment unit. The basic assessment unit (AU) is given a value of one (1) for a single-family residential parcel. From this base, the remaining parcels are related according to their equivalent benefit within the District. The assignment of assessment units is shown in Table Il below.
95 Attachment F

Public Utilities (7) 30 5 Acre
Churches, Fraternal Organizations (8) 40 1 Parcel
Railroad, PVID Property (9) 50 2.5 Acre
Agricultural Uses (0) 60 0.25 Acre
Notes:

1. DU = Dwelling Unit. Duplex, tripiex, fourplex and mobile home parcels, as well as each space in a mobile home park, are assessed at a rate of 0.8 AU per parcel/space because such units are generally smaller than single-family residences.

2. The assessment formula for standard apartment complexes is 0.6 AU per DU. Apartment units are assessed less than a single family dwelling because such units generally have a greater density per parcel than SFR's, are often located on upper stories, may be located a great distance from public rights- of-way, and generally are smaller units (in terms of floor area than SFR's. Studio apartment complexes are assessed at a rate of 0.4 AU per DU because these units are generally smaller than standard apartment units with a single room living area with a bathroom and a small closet.

3. Recreational vehicle (RV) park parcels are assessed at a rate of 0.3 AU per space because RV parks tend to have seasonal business and often have a high number of vacancies. Therefore, they are assessed at a substantially lower rate than mobile home parks.

4. Commercial parcels are assessed at a rate of five (5) units per acre. This is based on the basic assessment unit applied to an average 65-foot by 100-foot (6,500 square feet) residential parcel. If an additional area allowance of 20 percent (20%) is added to the average residential parcel to account for public streets, the total area per average residential parcel becomes 7,800 square feet. Since there are

5.6 such parcels per acre, the number of assessment units is rounded down to five (5) per acre, with a minimum of I AU per parcel, and applied to non-vacant commercial property.

5. Parcels owned by public agencies such as the federal government, states, counties, cities, water District, irrigation District, etc. are subject to assessment unless it can be shown that the parcel receives no special benefit from the facilities being maintained and serviced with the assessment proceeds.

6. Vacant parcels are assessed 0.5 units per parcel for street lighting. Said vacant parcels do receive a special benefit from streetlights which tends to reduce vandalism and trash dumping in spite of the fact that they are not developed.

7. Public utility parcels are assessed in the same manner as commercial properties. 96 Attachment F

8. Churches and fraternal organizations are assessed at 1 AU per parcel because they generally have les ntensive usage of the land than other non-residential uses, such as commercial parcels, and therefor benefit less from the improvements.

Railroad and Palo Verde Irrigation District (PVID) parcels are assessed at one-half the amount applied ommercial properties or public utilities because their parcels are railroad track or irrigation canal rights of way which receive a safety benefit due to grade crossing lighting (RR) or general lighting (PVID), but whose improvements are less susceptible to vandalism than commercial property improvements.

0. Agricultural parcels can have different types of use. Agricultural properties with no residence are assesse .25 AU per acre with a minimum of 0.5 AU per parcel (similar to other vacant property). Agricultur parcels with residences are assessed 0.25 AU per acre with a minimum of | AU per residence per parcel (similar to other residential parcels).

1. Special Benefit Analysis
Special benefit is defined as a particular and distinct benefit over and above the general benefit conferred on real property located in the District or to the public at large. General enhancement of property value does not constitute special benefit.

Only special benefits are assessable, and the District must separate the special benefits from the general benefits conferred on a parcel.

General benefit is gained by lots or parcels outside of the District and by the general public. That is, lots or parcels outside of the zone in question, or a member of the general public that occasionally uses the street improvements within that zone, are gaining a benefit that is general in nature and for which cannot be assessed.

The maintenance and servicing of public landscaping, ornamental structures, and appurtenant facilities installed and constructed in and along public roadways, streets and rights-of-way in the City of Blythe provides a special benefit which is received by each and every lot or parcel within the specified zones of benefit in the District, tending to enhance their value. Landscaping within the District enhances the aesthetic appeal of parcels within the landscaping zones. In addition, landscaping and ornamental structures improve erosion resistance and dust control. The streets within the District provide access to all lots or parcels assessed.

The primary benefits of landscaping are as set forth below:

1. Improved aesthetic appeal of nearby parcels.

2. Improved erosion resistance.

3. Improved dust control.

4. Enhancement of the value of property which results from the foregoing benefits.

In general, there is no component of general benefit for landscaping since each landscaping zone is set up on a tract-by-tract basis, thereby generating special benefit only.
97 Attachment F
Concerning this District, the general benefit component of the total benefit to each lot or parcel gained from street lighting is determined from the classification of each street which has public streetlights. It follows that when a street is used between sunset and sunrise, streetlighting is also used and is of benefit. The City of Blythe has five (5) separate street classifications, which are discussed below.

Starting with the lowest classification first, the benefit derived from street lighting by properties fronting on or in close proximity to Local (residential) Streets is readily determined to be 100% special benefit because all trips on Local Streets end on those streets with no "pass-through" trips.

The benefit derived by parcels or lots fronting on or in close proximity to streetlights on Collector Streets is determined to be 95% special benefit because approximately 95% of the trips on Collector Streets end on or near such streets. It is estimated that 5% of the trips on Collector Streets are "pass-through" trips, which represent general benefit.

The benefit derived from parcels or lots fronting on, or in close proximity to, streetlights on Major Collector Streets is determined to be 90% special benefit because approximately 90% of the trips on Major Collector Streets end on or near such streets. It is estimated that 10% of the trips on Major Collector Streets are "pass-through" trips which represent general benefit.

The benefit derived from parcels or lots fronting on, or in close proximity to, streetlights on Arterial Streets is determined to be 85% special benefit because approximately 85% of the trips on Arterial Streets end on or near such streets. It is estimated that 15% of the trips on Arterial Streets are "pass-through" trips, which represent general benefit.

The benefit derived from parcels or lots fronting on, or in close proximity to, streetlights on Major Arterial Streets is determined to be 80%special benefit because approximately 80% of the trips on Major Arterial Streets end on or near such streets. It is estimated that 20% of the trips on Major Arterial Streets are "pass-through" trips, which represent general benefit.

If a parcel is located at an intersection of two streets with different classifications, the higher classification shall govern for establishing an assessment. 98 Attachment F

2. Assessment of Public Property
Since the passage of Proposition 218 in November of 1996, it has been required that lots and parcels owned by public agencies be assessed in the same manner and by the same formula as all other property. However, in order to be assessed any lot or parcel must receive a distinct and special benefit from the facilities and improvements which are being maintained and serviced by the assessment District proceeds. An example of a public parcel which would be subject to assessment would be a City-owned vacant parcel which is near a streetlight. That vacant parcel would be assessed at a rate of 0.5 AU just as a privately-owned vacant parcel would be.

3. Assessment Examples
Lighting
The number of assessment units (AU) generated within Zone 1 is 445.67. The dollars required in Zone 1 are $8,030.97. The dollar value of each AU is:
$8,030.97/445.67 AU = $18.02/AU
A. Commercial property on a 0.75-acre parcel.

Assessment Unit Chart shows commercial property is assessed at a rate of five (5) AU per acre.

Formula:

0.75 Acres x 5 AU/Acre = 3.75 AU
The Fiscal Year 2023/2024 assessment for this commercial parcel is:

3.75 AU × $18.02/AU = $67.57
99 Attachment F
B. Standard apartment complex with 22-dwelling unit on one (1) parcel of land within Zone 1.

Assessment Unit Chart shows apartment complex is assessed at the rate of 0.6 AU per dwelling unit:

Formula:
22 DU × 0.6 AUIDU = 13.20 AU
The assessment for this apartment complex for Fiscal Year 2023/2024 is:

13.20 AU × $18.02/AU = $237.86
Landscaping:

The number of assessment units (AU) generated within Zone 85 is 42.00. The funding required in Zone 85 is $5,395.32. The dollar value of each AU is:
$5,395.32/42.00 AU = $128.46 AU
Each residence in Zone 85 is assessed for one AU, or $128.46.

Note: If any assessment amount is an odd penny, it will be rounded down to an even penny as the County does not accept odd cents and a parcel cannot be assessed over maximum.

LIMITATIONS ON INCREASE OF ANNUAL ASSESSMENT
The City Council will automatically increase assessments in accordance with the Consumer Price Index for all Urban Consumers for the Riverside-San Bernardino- Ontario, CA, published by the United States Department of Labor, Bureau of Labor Statistics; from March to March provided however, that any such annual increase shall not exceed five percent (5.00%). The maximum assessment rate will be increased by 4.57% for Fiscal Year 2023/2024.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: May 9, 2023
SUBJECT: Save Chuck
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file a report on Save Chuck.

FISCAL IMPACT: Impacts on the Blythe Community from the closure of the prison are unknown.

BACKGROUND: In December, the Secretary of the California Department of Corrections and Rehabilitation (CDCR) announced plans to close Chuckawalla Valley State Prison in Blythe by March 2025. The City quickly sprang into action to rally against this closure and sent a letter to the Governor related to the impacts this closure would have on the Blythe Community. The City began contacting State and Federal legislators and held meetings with elected officials, the CDCR Secretary, CVSP Close Down Manager and other CDCR staff members. The City submitted over 40 Public Records requests to the State seeking information related to how CVSP was selected for closure over other older and more costlier prisons in the State's system. Several of the City's requests for information were denied.

The City also went to work on solutions and proposed a swap of CVSP in Blythe for the California Rehabilitation Center (CRC) in Norco. Both City of Blythe and City of Norco officials are championing this proposal. This is a win-win for the Cities and State as a more cost- effective prison will be shuttered in a City that has far more resources to absorb job losses than Blythe. The City of Norco has petitioned for the closure of CRC for years. CRC has been on the State's chopping block since 2012. The State's own Legislative Analyst's report as well as other independent reports find that CRC should be the next CDCR institution to close due to a number of issues including cost to operate and safety.

In January, the City hired Tripeppi Smith for PR Services and the Gonsalves & Son Firm for lobbying efforts in the State Capitol. The City has garnered support from Assemblyman Garcia, Congressman Ruiz, State Senators Steve Padilla and Kelly Seyarto, Supervisor Perez and Supervisor Spiegel, the County of Riverside, CVAG, fellow Cities in Riverside County, Riverside and Orange County Sheriff's, PVID, Cal Cities Riverside County Division and others.

The Save Chuck (www.savechuck.org) website was launched. The City is working with Flash Vote to poll community members to gain input as we work through the efforts to Save Chuck..

Many presentations have been made around the Community to detail the Coalition's efforts to Save Chuck.

STAFF REPORT: Staff would like an opportunity to update the community on efforts being made to "Save Chuck".

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: April 25, 2023
SUBJECT: Abatement of 1203 E. Hobsonway
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Receive and file an after-action report on the abatement of 1203 E.

Hobsonway.

FISCAL IMPACT: $49,925.

BACKGROUND: The City has worked to abate 1203 E. Hobsonway since it was severely damaged in a fire. As the property owner failed to remediate the situation, the City took action.

At the end of March, the City had completed all thirteen steps necessary to turn this case over to the City Attorney's office to receive an abatement warrant from the Court.

In late April, the City Attorney was successful in obtaining an abatement warrant allowing the City to abate the nuisance conditions at 1203 E. Hobsonway. The warrant gave the City 14 days to abate this property. The City immediately went to work with R&L Watkins to abate the property within the prescribed timeframe.

STAFF REPORT: R&L Watkins completed all work to the satisfaction of the City on May 1, 2023. No extensions to the warrant were required. R&L Watkins was able to complete the project within the 14 days prescribed by the warrant. The contractor began work on April 25, 2023 and the final inspection was conducted on May 1, 2023. Final costs incurred for abatement totaled $49,925. Budgeted abatement funds and salary savings in the Development Service Department will cover the costs incurred for this project.

City staff would again like to commend the quick actions of Leslie Watkins and her team at R&L Watkins which allowed the City to abate this property within the parameters of the abatement warrant. Staff would also like to thank CR&R for quickly delivering the bins necessary to clear debris from the site, which contributed to the completion of the project within the necessary time frame and without an extension to the warrant.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: May 9, 2023
SUBJECT: City's 6t'h Cycle Housing Element Update
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council authorize the Interim City Manager to execute Agreement No. 2023-023 A between the City and Veronica Tam and Associates, Inc. to assist with the 6* Cycle Housing Element Update.

FISCAL IMPACT: $63,000 was budgeted in FY 2022/23 for the required Housing Element Update.

BACKGROUND: Since 1969, California has required that all local governments adequately plan to meet the housing needs of everyone in the community. Local governments meet this requirement by adopting housing plans as part of their General Plan. General Plans serve as the blueprint for how the city will grow and develop and include seven elements: land use, transportation, conservation, noise, open space, safety, and housing.

The City's Housing Element was last updated in 2014, with a period of 2013 through 2021. The update was prepared by Pacific Municipal Consultants "PMC". The Housing Element is the only element of the General Plan that involves certification by a State Agency. HUD will review and certify the City's Housing Element once prepared.

The City started preparation for the 6" Cycle Housing Element update in late 2021. The City entered into an agreement with the Holt group to prepare a Housing Element to be submitted to HCD for review and certification in February 2022. The agreement between the City and the Holt group expired at the end of February 2023. The City has submitted two drafts of the Housing Element Update to HCD for review.

STAFF REPORT: Staff anticipates further revisions will be required of the City's Draft Housing Element before it's certified by HCD. HCD has required up to 4 or5 revisions before certifying 6th Cycle Housing Element Updates.

VTA was established in 2005 and has since provided housing and community development consulting to local jurisdictions throughout California. VTA has recently assisted 25 jurisdictions in the SCAG, SANDBAG and ABAG regions in achieving Housing Element compliance. VTA was referred to the City by Jones and Mayer. Therefore, staff recommends the City enter into an agreement with Veronica Tam and Associates to assist with the required revisions.

March 20, 2023
Ms. Mallory Crecelius
Interim City Manager
City of Blythe
235 N. Broadway
Blythe, CA 92225
Dear Ms. Crecelius:

Veronica Tam and Associates, Inc. (VTA) is pleased to submit this proposal to assist the City of 3lvthe in the Housing Element update. Our scope of work focuses on addressing comments of th tate Department of Housing and Community Development (HCD) on the City's Draft Housing Element. Our scope does not include updating technical data that is not directly responding to HCD comments.

VTA has substantial experience in preparing Housing Elements and are familiar with new State laws and HCD review standards. For the current 6* cycle Housing Element, as of March 20, 2023, VTA has assisted more than 25 jurisdictions in the SCAG, SANDAG, and ABAG regions in achieving Housing Element compliance.

We look forward to discussing our proposal with you. Please let me know if you have questions or require additional information.

Sincerely,
Teronica Tam, AIC.

Project Understanding
The City of Blythe is in the midst of preparing the 6th Cycle Housing Element for compliance with State housing law. The City submitted a Draft Housing Element for HCD review on August 2, 2022 nd received HCD comments on Uctober 51,,
the revised Draft Housing Element out of compliance. We are unable to locate a copy of the State's latest review.

The scope of work below is based on our review of the City February 28, 2023 draft and our assessment of that draft responds to HCD's comment letter on October 31, 2022.

Scope of Work
Task 1: Housing Element Revisions
Based on out review, the February 2023 draft still requires substantive changes:
• Review of Existing Housing Element - Additional revisions are needed to summarize the City's cumulative efforts on housing for special needs population. This section should include quantified accomplishments to the extent feasible and to comment on the continued appropriateness of the programs.
• Affirmatively Furthering Fair Housing - This requirement is essentially not yet fulfilled.

A complete analysis will be developed for the City of Blythe. A robust analysis includes the following topics:
• Fair housing outreach and enforcement
• Integration and segregation patterns and trends
• Racially and ethnically concentrated areas of poverty • Disparities in access to opportunities
• Disproportionate housing needs
• Existing conditions and distribution of RHNA units
• Meaningful actions
• Constraints Analysis - This section also requires significant revisions. The February 28, 2023 draft does not fully respond to HCD's October 31, 2022 comment letter on 107 S. Fair Oaks Avenue, Suite 212 P (626) 304-0440
Pasadena, CA 91105 F (626) 304-0005

governmental constraints. While the revised draft Housing Element addresses some of the use control and pes, in perce fu procedures i ede, e cil on the top and, (emergency shelters) - now applies to the City of Blythe. • Housing Programs - The October 2022 letter identifies a number of revisions necessary. affirmatively further fair housing.

Task 2: Public and HCD Reviews
At this time, we are assuming that vacant and/or underutilized C-G commercial sites are available to accommodate the City's lower income RHNA. We are not anticipating the need to bring the revised draft Housing Element to the City Council prior to HCD review. The reviews required are:
• Public Review - The revised draft Housing Element must be made available for a seven- day public review before submitting to HCD. The Element must be posted on City website and stakeholders notified.
• HCD Review - After the seven-day public review, the revised draft Housing Element will be sent to HCD for its 60-day review. We anticipate working with HCD during the review to address any remaining comments on the Housing Element. VTA will serve as the City's liaison with HCD throughout the remaining Housing Element Update process. We will support communications and review, submit for a statutory 60-day State review, and assist in answering questions and resolving issues with HCD. We assume two rounds of revisions are necessary to achieve HCD certification.

Task 3: Public Hearings
If feasible, our preference is to attend public hearings virtually, given the distance. If in-person attendance is required, our budget will have to include time and expenses associated with an overnight meeting. We have budgeted two meetings either for virtual or in-person attendance.

Task 4: Project Management and Communications
We anticipate having routine meetings and email communications with staff (virtually) to discuss project progress and issues.
